I've been researching and keeping track of NOA2's, based on what I've seen and noticed. USCIS gives themselves 60 days to process an RFE after receipt of the RFE. If you don't hear anything within 60 days I would be surprised. If you don't hear anything within 60 days, USCIS says to call them. Good Luck!!

Convictions are not grounds for denial unless you are a multi petitioner. So if this is your first time than you are ok. I would suggest telling your fiancee that there could be an extended wait time for your case due to name checks. This way anything sooner is a blessing. Goodluck!

The UCSIS changed there processing goals to 6 months for K-1 fiancee visa. This is what they say about RFE per the website:

Case processing will be delayed if we must ask you for more evidence or information. If we ask for missing required initial evidence, count the processing time from when we receive that missing evidence.

That really sucks, I'm dealing with the same thing. However, it shouldn't and doesn't take that long. But it could.

If you have convictions you will need to provide certified copies of the charges and dispositions from the court having jurisdiction over your case. You will need to do this for every single case that applies to IMBRA. If no convictions than you do not need to provide anything.

it says , if you have ever been convicted, submit certified copies of all court and police records showing the charges and dispositions for every such conviction. well, i have been convicted of 3 alcohol related in 88(dwi), 90 (public intox), and 99 (boating dwi). now, i have to provide certified copies of my criminal record. is www.cir-ncrec.com an acceptable source? are these certified copies? if not, who do i contact for these certified copies? has anyone had to do this? and, yes i have been behaving myself since the turn of the century. thank you


The answer is NO. You need to go to the court house and get certified copies.

Sexual Exploitation is something that is listed in part B of the intructions for crimes included in IMBRA. Whether or not your crime is concidered exploitation is something you'll have to research. I did a qucik google search under "Sexual Exploitation Definition" and personaly found that it would be. The fact that it has been expunged does not matter, you still need to include it.

No sense in worrying about it now, you've already sent the application in. They run name checks and all of that good stuff so it may come up or not. The USCIS takes into concideration seriousness of a crime and whether or not to disclose the information to the beneficiary. That's what the law is all about, protecting the beneficiary from a harmful situation. They weigh the crime out and decide whether or not to disclose the information. They can disclose anything that you send or that is found through name checks, so I wouldn't worry about it now. What's done is done and you can't send extra information. Wait and see what happens. you may get a denial or an RFE.

I don't think you'll have a problem personally. but remember I'm not a lawyer!!

Well, I can't say how every consulate will be handling the job of informing the beneficiary about any convictions the USC petitioner may have. I can say however that the consulate officer in Poland did it verbally at the interview.

I don't know if it would be helpful to inform the Embassy about your unique case dealing with IMBRA before you go to the interview or not. This may help them to get prepared for what most likely will be the first time they handle a case like this. Maybe you could have a written statement from your fiancee saying that she is informed about the convictions and list what they are, have her sign it and bring it to the interview. Or Maybe you just want to wait and see how your consulate handles the case. It worked out for me in the end without a long delay.

Please post your experience here on this thread so others can see how things are being handled at the separate consulates.

Glad to see that non of you have been through the ringer as I have with Driving Under the Influence (DUI) and have never in your life gotten a Probation Before Judgement (PBJ).

I appreciate all your comments, as making a joke of the hell I've put myself through always makes me feel better. I am mostly happy to be making jokes at a time when I am desperately trying to put the I-129F petition together the correct way in order to see my beautiful fiancee Ania.

Thanks to those of you who decided to help and actually put the time in to find an answer for me. As for the rest of you, I'm glad I could fill your lunch break with a few laughs!!!

Are PBJ's considered convictions in the eyes of a federal court?

I an applying for a fiancee visa and need to know if they will consider PBJ's as convictions. The applicationa states that I must send complete criminal record to the government if I have been convicted 3 or more times for a drug or alcohol related crime.

I have 2 DUI convictions, 1 DUI PBJ, and some underage citations which resulted in PBJ's

I'm going to be using the Vermont Service Center, from what I've been reading I should consider myself lucky, they seem to be the fastest. I've looked at the time lines and I've taken the IMBRA hold up into account. My questions is this:

If IMBRA delay is over on the 9th and everything went smooth with the application process, approximately how long does the process take to get my fiancee to the states using the Vermont Service Center?

It looks like 2-4 months from the time-lines I read for Vermont! can somebody confirm this and make my day great!!!

I have a long way to go before I'm approved. However, I thought about how it's going to feel each and everyday I wait longer. I'm afraid that I'll end up in name checks for a long time and I won't be able to find out unless I eventually contact some congressman to help. For me, I don't like the feeling of not knowing what's going on. If they would just let you know what department or stage your in, it would do away with that horrible feeling of being lost. The only counter you have for this feeling is accepting the process for what it is and knowing that lost is what you will be.

I think what "Kaydee457" is trying to say is.... by the time you get started on your action you will get approved. I've seen many people suggest some type of action before, but as soon as there approved, you don't here about the action anymore. Why continue with the action when you finally have your approval??. I think if your going to start something it should be followed through to the end. That's why it's hard to collectively pull together and change something. Everyone is pissed in the beginning and demands action, as soon as there approved they move on and forget they were pissed, no follow through.

I commend the petitioners who get there visa and still come back to help others. Think about how many people use this site to get there visa and never come back after that. It's because there in it for themselves and demand action for themselves, to help there own cause. I truly commend those of you who come back to help after you have your visa in hand, that is a truly unselfish act!!

If you want my advice. Whenever I need a few good e-mails for myself... I create false hotmail accounts and send e-mails myself using different names.

I hope that the process does change to be more fair, somehow.

I can't really comment or relate to your case as I have filed the I-129F. I just wanted to let you know that proactive gets my vote! going to an infopass appointment can't hurt anything and at least gives you a chance to know something. It's better than doing nothing in my book. Have you called the service center to politely inquire? I wouldn't contact an elected official until something is for sure out of sorts. But sometimes depending on the case worker, you get someone who is nice enough to inquire for you. If you ask honestly and sincerely, they shouldn't have a problem with it.

I think everyone is really stretching on these "red flags". I can't blame anyone because I am guilty of the same thing. I have had some things happen in my life recently that had me looking for answers. What I found I was really looking for, was for someone to tell me everything was going to be ok. From what I understand, and it's not much, a "red flag" might draw a question at the interview. If you and your fiancee have been upfront about everything and open about past relationships (which I would rather not discuss) than you should be ok :) As long as your fiancee is aware of your divorce, when it happened, and possibly why, than you should be fine. Now keep in mind that I have no idea what I'm talking about and this is all personal opinion!! good luck!!

If you remember I lost all the e-mails that were in my outlook express that I was saving for the interview. I was worried because I wanted to show communication from the beginning of our relationship. Well, the e-mails are still lost, but I found something else.

I went to the chat history on Skype and was able to print out IM's from as far back as the beginning of the year. Not as far back as I would have liked, but better than nothing. I'm especially happy because it helps to show a relationship before the filing of the petition. I swear the print out is the size of 2 webster dictionary's!!! overwhelming evidence I think is good for a first impression. First impressions are important!!!

Now I have to go through and black out some things :blush:

I sent in the new I-129F with anwers to the IMBRA questions. I also sent in certified copies of court records and a typed explanation of each separate case made out to Dear Ania. The reason I did that is because the law is only to inform the beneficiary of your criminal past related to IMBRA. I however did not submit certified Police reports(records) because I am still waiting for that stuff in the mail. I sent it to get in cue. So, to answer your question. Yes, I sent in the new one. However I did not receive the RFE yet so I don't know what they are asking for. I should have that any day now. I have a thread in the IMBRA section for us to post our experience with this situation, it's not getting much use though!!

Well, I don't know what the F*#k!! happened but all the e-mails I was saving in seperate folders in outlook express are gone!! over 500 e-mails between me and my fiancee from the start of our relationship. I guess I won't be using that as evidence at the interview. I'll just have to start saving the ones from this day on. I guess I'm lucky for printing a couple of them out a while ago. I have other stuff to give her for the interview but it would have been nice to have those!! computers can be the devil sometimes!!!! :angry:

1. yes, unless you want to find out what will happen if you don't. I didn't take a chance
2. no, you can go to KRK office in Warsaw, where you can get it right away, and bring it to an interview with you. If you choose to send paperwork (request for police certificate) to KRK, Embassy will pick it up after it is ready or KRK will mail it to Embassy ( I am not sure which way is a correct one, I would assume Embassy picks it up)

I read this and got a little excited!! it has to do with opening a provisional file at the consulate after NOA2

o OF-169 - if you already had your fiance(e) sign this during your meeting, include it here and this will save you about 3 weeks. Be sure to state your receipt number or ARN number on the form and check the applicable boxes. The OF-169 isn't required to open the provisional file, and if you choose to include it here, you can basically ignore Packet 3. Also, Warsaw will accept a mailed or faxed OF-169 from either you or your fiance(e).

I'm trying to get a copy of this form from the net. Anyone know where I can find it?

Hey Mew!! I found something!!! I went to the website you gave me and found the Instruction Check List that has to be signed and sent back to the consulate for the interview to be scheduled. I bet printing out the PDF of the Instruction Check list, signing and dating it, and sending it with the request for provisional file will speed the process. I think I would also want to send:

-signed Instruction Check List
-Complete copy of passport
-Birth Certificate
-2 Photographs
-DS230 part 1

It's not called an OF-169, it's called WRW1. What do you think, am I onto something. You can get packet 3 right off of the consulate website, why wait for them to send it to you?

I believe it doesn't apply to any of us, Andy. K1s are non-immigrant visas. Also, should it be an option, I guess it would be up on the consulate website, right?

I checked the Tokyoo embassy site and there is an entirely different procedure for K1 applicants.


Maybe it doesn't apply to us. I thought I was going to skip out on 3 weeks :dance: but not happening :( Warsaw's instruction packet includes a WRW1 which is returned a signed. Oh! Well!!
