If your petition is denied at the service center level, is there a waiting period to file again? meaning, if I was denied for wrong or lack of supporting evidence, would I have to wait any period of time to file again? I think I would use a lawyer this time if worse came to worse.

I don't know why they send the "preliminary processing has been completed" e-mail!! from my understanding of the memorandum on how to process petitions after March 6th, they don't do any processing until the IMBRA RFE is received. After they have the IMBRA RFE the file is looked over for completeness, then 2nd RFE's will be sent out for the regular stuff. Ahh!! the water is nice in the waiting pool :wacko:

I have no middle name (strange as it seems). I was thinking putting "None" for the middle name in the forms, but would they mistake you as (for ex.) "John None Doe?" as "None" in actually your middle name? Hmm....


Just leave it blank. They will also notice from your documents that you don't have a middle name. USCIS knows that some don't have any middle names. It is like when you write a foreign address, some foreign addresses don't have any state and you can just leave the state as blank.


There are no documents for the beneficiary in the petition. I would play it safe and cover your bases!! peace of mind goes a long way in this process.

The form say's to answer all questions. Telling you to put "none" or N/A in place of blank answers. I wrote "none" and sent in a supplement to the questions stating that my fiancee had no middle name, just incase we're dealing with a low IQ adjudicator. But, if you leave a question blank, they could view it as a mistake or you forgot to answer the question, then they would need clarification with an RFE. I'm not saying you would get an RFE for sure, but it's possible. I would answer the question with N/A or "none" and add a supplement regarding the question. I did a supplement for the I-129F and the G-325A. ohh yeah! I'm #######!!

Actually some people on this site like to use there "so called" knowledge to make other people feel stupid. Some people are more into controversy than lending a helping hand. Some people decide to take people a little too serious, and jump on every small comment they make. I come here for advice, and knowledge. I think the whole visa process is set up for relationship failure. I mean, whats a better way of controlling immigration than making it almost impossible. They want us to quit! to give up! and to end our relationship. Ultimately this helps control immigration. That's just my two cents.

At some point during one of my internet information hunts, I found this. I don't remember where I got this information from but whatever! I cut and pasted it to a word document. I think it may be old and might not offer much, they still refer to USCIS as INS, but it's interesting. It kind of helped me to understand why the process takes so long. I don't know how accurate it is, so don't hang me for presenting it. I don't even think I have all of it copied, whatever! read it if you want. Here ya go:

THE PROCESS AT INS
· Mail Room: Your Petition will arrive at the INS Service Center's mail room with hundreds of other Petitions.
· Intake: Your Petition will be taken to an Intake Clerk from the Mail Room. This Clerk will look it over for all of the proper forms. They will not examine any paperwork, but simply take the form checklist (that they have memorized by now). For example, the checklist will say "(1) Form I-129F, yes here; (2) G-325A's, yes here, (1) Birth Certificate, yes here, etc." Your Petition could sit on the Intake Clerk's desk for days, especially if the INS Service Center is busy.
· Processing: Your Petition will be sent on to the Processor from the Intake Clerk. This person assigns your case to a specific Examiner.
· Examination: Your Petition will be sent on to the Examiner from the Processor. This is the actual person that inspects your Petition to verify that your relationship is valid, that you are an American Citizen and so on.
· Central Processing: Once approved, your Petition moves to Central Processing, where a Divisional Director separates your Petition by region, Asian, Central America, Eastern Europe, Southeast Asia, etc. This task is only for categorizing your Petition.
· Outtake: After being classified by region, your Petition is sent to an Outtake Clerk. The Outtake Clerk assigns your Petition an "A number" depending on your region.
· Distribution: After being assigned a reference number, the "A number", a Distribution Clerk will carry out any special acts, such as cabling the Embassy. The acts are a result of notes made by the Examiner, not you by you.
· Information: If you call INS, you will speak to an Information Officer. This is a glorified term for "INS Secretary." The only access they have is the INS Service Center's computer network, which will not tell you anything more about your Petition's status than you hear on the INS telephone voice message. They do not interface with Examiners, who are much too busy examining than to cater to specific requests.
EXPLANATIONS
· Non-sequential examinations: Approval is happening to other K-1 applicants who submitted their Petition after I did (according to the I-797 notice date). At the INS Service Center, various Petitions are randomly pulled from the files to train new Examiners. Most likely, an experienced Examiner grabbed a Petition out of the stack to train a new recruit right there at his/her desk. They then subsequently approved the Petition (lucky Petitioner!). The Petition the Examiner grabbed may have been anywhere and hence explaining why it was "out of order" or why the approval date is earlier than other Petitions with earlier I-797 notice dates. This is happening everyday, Examiners are training new recruits everyday. If your Petition was approved in a very quick timeframe, say within 10 days, it was most likely pulled for training purposes.
· Request for more information: There are no rules here, just based off of the Examiner's judgement. If the Examiner requests additional information, it will delay your Petition from about 1 week to as long as 1 month, typically. Your Petition will most likely be sent to the "back of the line." Possible reasons for a request for more information include:
o Your fiance(e)'s last name matches another last name of a Beneficiary from a previously fraudulent marriage. Supposedly, INS holds a list containing the names of previously fraudulent K-1 marriages.
o You or your fiance(e) did not sign the I-129F or G-325A form
· Examination is 15 minutes: The actual examination process typically takes 15 minutes, that's it. On to another Petition.
· Priority given to most paperwork: If an influx of non-I-129F paperwork arrives at the INS Service Center, your K-1 Petition could be sitting for a very long time, until the backlog of other paperwork is examined.
· K-1 decision legally set at 30 days: No, nothing legally binds the INS Service Center to process your K-1 case within 30-days. Unfortunately, the goal of within 30 day processing is stated in most of the INS Service Center guides, but may not necessarily be followed.
· G-325A carbon copies: The duplicate G-325A carbon copies are not used anymore, the INS Service Center actually will throw these away. Your whole Petition will eventually be filed electronically, once the Outtake Clerk assigns it an "A number." Still, you should definitely submit your Petition with the carbon copies, but no need to worry if not every carbon copy is legible.
· NSC: The Nebraska Service Center typically processes as much paperwork than all three other INS Service Centers combined. This may help to explain longer waiting times.
· File cabinets: Petition paperwork is held in file cabinets before the Intake Clerk pulls it for examination.

I keep going back to the thread I started "keeping track of NOA2's" and I don't see much action on anyone's timelines at all. Seems like it's moving at snail pace for the moment. I would hope to see an explosion of approvals like we did a week or so ago. We will see.! I hope so for most of you! as for me, I still have some waiting to do.

It's crazy!!! I'm going to contact a lawyer in Poland to see what my options are, how much it will cost for there services, how long it might take, etc...... I can't stay in Poland during the whole process. I'm hoping that physically present means present at filing and at the interview. I'll go to Poland and have the court case, then come home. Go back to Poland after the 1 month register period, get married, file, and then come back to the states. Finally go back to Poland for the interview and bring her back.

It's such a hard decision because as you can see this will be very expensive!! however, if I don't at least start the process, I limit our options and lengthen the wait. With convictions on my record being the USC, I feel I could get caught up in lengthy name checks at every level USCIS, NVC, and Consulate. I've read stories of people getting caught up in name checks for 1 year!! and that's just at one level. It's tough!! but I really think I have to start the DCF process with a lawyers help from Poland.

I've called several lawyers and I've heard everything from you'll be fine don't worry to your screwed!!! as far as my I-129F petition is concerned with name checks.

What to do????

Well, I guess starting the court hearing process for the "free to marry" waiver is a right step. I think that will take a month or so. I should hear something from USCIS by then. Even if it's a "your in name checks" customer service response.

Have you emailed the U.S. Embassy to ask them whether a "Certificate of Free Status" can be obtained through them by making a sworn statement?

In Germany, a similar document is required. It's officially called a "Certificate of Free Status," or an "Ehefähigkeitszeugnis." I went to the U.S. Embassy in Berlin and received one. I simply had to swear under oath in front of a Consular Officer that I was indeed free to marry.

Maybe you can ask the U.S. Embassy in Poland if it is possible to get a "Certificate of Free Status" instead of going throught the Court procedure.

Alright. I think that you should contact the lawyer. I'm pretty sure that the PoA should be written under Polish laws and there's no way to find out how to do that if we don't know anything about laws in Poland.


I'll contact the lawyer. She said she wouldn't charge that much to be an advisor and help through the process. Keepin it in the familly :lol:

Good plan. The web site of the US embassy in Poland does say that the embassy can give USCs a list of Polish attornies who can represent the USC in the court activities that are required to ge married in Poland.

DCF is great in Poland because I don't have to be a resident, just present. So, I give her power of attorney to take care of a couple of things, come and get married, file the I-130 in the same trip, come home, and go back for the interview. Sounds good to me!!

yea! thanks! I'll call the Embassy tomorrow to find out how I can do it. I'm going to start the motions for the DCF and I need to give her Power of Attorney to request a court date for us. We have to get a "free to marry" requirement removed that can only be approved by the courts there in Poland.

In Poland you have to provide a legal document stating that your free to marry before you can get married in Poland. Well, we don't have such a document in the states so we need the waiver approved through the courts. I swear!! it's crazy the stuff you learn going through these processes.

I posted the same thread in the DCF forum. Maybe someone there can help. Just thought I would try here, it's the most read forum.

I'm going to comment here against my better judgement of this being a huge joke.

If you are serious about this than I pray for you first of all. I would like to say welcome to america!! 3 years must be a good experience!! maybe you haven't had enough experience to know that saying "I'm an American citizen" doesn't go to far around here.

Now, the person your trying to pull at emotionally (the adjudicator) will never have the "honor" of reading your well written letter. Your petition will be scanned for completeness and an RFE will be sent for divorce papers. That's the best case scenario!!

But if it's advice your looking for!!

FORGET THE WEDDING!!!! NOT HAPPENING ANYTIME SOON!!!!!!!!
