K-1 Fiance(e) Visa Process & ProceduresI am in IMBRA Hell....
It took 6 days for my RFE to come in the mail. USCIS asks for 30 days to get the form to you. I would wait for the RFE before sending anything back to them.

Well, down to 60% this sucks :( well the one good thing is I'm getting closer to being able to call USCIS about my case. Monday will be 60 days after the receipt of my RFE. I hope they will give me some kind of answers to my questions.

Maybe their preparing the information packet for my fiancee concerning my convictions, who knows.

All I know, is I'm waiting. Waiting to read those wonderful words.

Uling?? I'm starting to wonder about your under!! well, it's still going to be a long day. Plenty of time left.

Good luck today everyone!! I hope it brings an approval for someone. The week has been rather quiet around here. Let's make some noise USCIS, bring on the joy!! oooorrrrr......... keep us in the dark a little longer.

Andy,

Soon you will hear good news... ;)

I don't know! I don't seem to be on the winning side of Ulings odds. Or maybe he's not willing to bet against Michelle because he knows he would lose. yeah!! that's it!! GREAT!!

I'm in your corner... It's always funny when someone picks up on a joke or game that I start. I never know who is paying attention to my goofy behavior. You will definitely receive your NOA2 within the next 7 business days. I'm taking the under for $40 virtual dollars. LOL!!!

hhmmm......... sounds good to me. It's amazing how a little joke can go a long way. It really helps with the peace of mind. Glad to have you in my corner. If USCIS takes too long I'll have to get the gloves for you. Or maybe you prefer UFC style, any way would work for me.

Come on USCIS give this couple their approval! (F)

We'll see how I'm feeling as the week goes on. Monday's I have 100% serenity. 20% gets spent everyday. Then recharged on Monday!! I think I've heard someone call this a roller coaster before................ oh! yeah! that was everyone!!

I agree, come on USCIS give us our approval. Don't make us the only VSCers waiting for one. I like to think I'm special, but not in this case. I would like to be the norm, thank you!

Hang in there a little longer. You have only been going through this process a short time, really. You should remember that you are in the Vermont office while most people on this site are suffering with the California office. They aren't likely to be very sympathic with your short time period. You would be better served to be asking questions about how to make your fiancee most comfortable when she arrives. Remember, she is changing countries for you. So think ahead and treat her carefully.

Thanks for all those lovely tips ;) still trying to find out where I was asking for sympathy. My fiancee has already lived here for 6 months and is pretty comfortable with the idea. However, I'm not going to be snippy. I came into this day with a good attitude!! enjoy yours!!

She lived here for 6 months last year. Just wanted to clarify.

Well I went to my InfoPass appointment in Baltimore at 11:00am. I brought my NOA1 and a Cinnabunn for the immigration officer. She was very polite in telling me that they don't process these petitions so the information would be limited. She told me that they received my reply to there request for more information on July 28th. Great!!

I then proceeded to the lobby where I placed a phone call to VSC. I must have the best luck in the world when calling VSC, I always get the nicest people. She said that they received my reply for more information and request 60 days to give an answer or request further information. She said that would be on September 28th. After I explained that I'm counting July 28th as 1 day and there are 31 days in July & August, that it has been 60 days. She put me on hold and returned with a fax number to request expedited service. She said that I should state in my request that it has been 60 days since the receipt of my RFE and that I am outside normal processing times.

So, I will do as she suggested and see what happeneds. I'm not holding my breath as I know probably nothing will come from my efforts, we will see.

Should I send it today and explain how I came to 60 days? or should I send it on the 28th of September to limit the confusion?

It just sucks that they have no real reason for the delay. IMBRA is over, I'm not in name checks (yet), so whats the hold up??

Ok, I faxed it and mailed it. I'm going to contact my congressman as well. They shouldn't give themselves a 60 window if they can't comply. I know they cover there bases on this and don't have to give an answer. At least it gives me a reason to start prying for information.

Request for Expedited Service

Re: Request for Expedited Service
Receipt Number: EAC-**-***-*****

Dear Sir or Madam:
On July 28, 2006, you received my response to your request for evidence or information. You stated that preliminary processing was complete, and the remaining processing time will be less than the maximum stated in this message. On your website it stated that I’ll receive a written decision on this case within 60 days of USCIS receiving the requested information.
I called the USCIS phone line and the message confirms that I should have had a decision or another request for evidence or information within 60 days of USCIS receiving the information. The customer service line says to contact the USCIS by phone if you have not heard anything within the 60 days. I called and was instructed by a customer service representative to fax a request for expedited service as I am outside normal processing times.
As suggested by the USCIS customer service line. I would like to request that the processing of my petition, and request for evidence, or information receive expedited service for being outside the normal 60 day processing time given for a request for evidence or information.
I would also like to mention that I belong to a public forum, which is geared towards the I-129f process. I have noticed that 237 or more people, who filed their petition after mine, have received a decision on their petition. I have not even received an update on the USCIS case status web-page since July 29, 2006.
Please take my request into consideration as I feel completely lost and in the dark. This period of absence between my fiancée and I has been very heavy on our hearts. We miss each other entirely too much and are eagerly looking forward to spending our lives together. I ask you to please put yourself in my situation and see what can be done. Thank you!! J
Sincerely,

Andrew James Solomon Date:

Senator Mikulski's office called today. The lady working on my case is really cool. I told her the truth about having my congressman looking into it as well. She said that normally she would drop a case if she found out that someone was duplicating efforts due to the high volume of inquiries they perform. I'm lucky because she told me that she has already started working on this and wasn't going to drop me because I told her. She said that they both inquire to the same place and now the officer will have to respond to both of them. Man, I'm glad I took all of your advice and didn't do all 4!! I'd be screwed.

She said that sometimes it does slow there efforts when they have to respond to both people. She however said she would be hearing something soon. She did say that it's a much more in depth response than what I could ever get from the website or the customer service line. She said they act as a direct liason with VSC and can talk directly to them. So, I think I should at least hear something soon.

I just wanted to let others know not to duplicate efforts. It's not suggested. I acted on impulse, but she said I didn't do anything wrong and everything will be ok.

Good Luck to everyone!!!

Ok, you guys are correct. Maybe using 4 is overkill. Hence the reason for the thread. I have only put 2 of the 4 in motion. I will wait for there response.

Andy
I don't blame you at all for being one bit anxious as you have filed through VSC and people who filed after you (like me... sorry) got approved first.

Have you thought of sending a case of wine over? This may help loosen em up a little.

Mo

Mozplay,

you said it exactly. I am understanding of the IMBRA delay. I know lots of people had to wait a long time for there approvals. As I've posted before, I'm no longer a part of that delay, and neither is anyone else. We are back to normal processing times. My case is not normal!! I've seen tons of approvals for later filers from CSC and VSC. I'm still waiting. You can say what you want. But I know it's not normal for VSC to take this long, except for a few cases. Apparently that's me.

Sure, I could be reactive and wait another month or so, "ohh, this is normal, I'll just wait"

or I can be pro active and try to push the issue.

Well, as you all know, I'm outside the 60 day RFE processing times.

As suggested by USCIS, I sent an Expedite Request in today via fax and snail mail.

I have also begun to contact my elected officials:

Robert E. Ehrlich- Governor
Roscoe G. Bartlett- Congressman
Barbara A. Mikulski- US Senator
Paul S. Sarbanes- US Senator

Ehrlich's office told me to write a letter requesting an inquire be done on my behalf. They then will ask VSC to send me some type of update.

Bartletts office is already on the ball. They took my information and already sent an e-mail to VSC. The very nice lady handling my case at his office said they have there own response team in VSC, whatever that means. I just need to send over the Privacy Release form now, with a quick letter of explanation.

Mikulski's office needs me to fax a letter with all my information and explanation and they will do an inquire.

Sarbabes's office is already in motion, taking my information and sending an inquire to the VSC. She said they usually respond the same day.

Everyone seems really nice and willing to help.

My question is...

Since I already have 2 out of 4 on the move, should I wait to use the other 2? I could really flood the USCIS with inquires and get a good push for my case. The problem is, these elected officials wouldn't want to hear from me again for another 30 days or so. Maybe I should use 2 this week, wait two weeks and use the other 2. This way I have someone to look into things in the begging and end of each month. But really, how many more months can I be there for????

Maybe I should just open the flood gates and see what happends. What do you think?
