I I also maid a front page copy of the RFE with all it's information and taped it to the front of the package inside the overnight package which had I-129F on it.


I'm confused. I sent in the new form but people that sent the new form have been getting the RFE. So far I have not gotten any thing but I just want to be ready when it arrives.I'm sorry I did not understand this part...... could you tell me what you mean?

It just means that I made a copy of the first page of the RFE. The first page has a lot of information on it, Petitioners name, Beneficiarys Name, Receipt #, A#, and couple other things. I taped this page to the front of the manila folder that contained the RFE response. I labeled the overnight package "I-129F"

So, there was no real waiting in the mail room. I guess anyway, it's all assumption and speculation, but I'm sure any tip that could help in any way is appreciated.

I didn't do that and I still jumped ahead of the line, I'm with CSC though :whistle:

I know this has been said before but it's good to repeat things as searching takes a lot of time. I sent back the RFE for IMBRA overnight on the 26th of this month, signed for on the 27th, VSC sent this e-mail 3 times :lol: on the 28th at 7:30pm:

I think it was a really fast response and I think it's because I followed these tips:

General Tips on Assembling Applications for Mailing
1. Mark both the envelope and the cover letter as to the nature of the submission. Example: ORIGINAL SUBMISSION - BRIEF FOR AN APPEAL - RESPONSE TO REQUEST FOR ADDITIONAL INFORMATION - etc.
2. Use the appropriate mailing address and mark both the envelope and the cover letter as to the form type. Example: I-129; I-130; I-690; I-698, etc.
3. Provide both the receipt notice number and the A-Number as an identifier, if they are available.
4. If the packet is being resubmitted in response to a REQUEST FOR ADDITIONAL EVIDENCE, please place the notice requesting the additional evidence/information on the top of the packet. Also, please use the special mailing envelope provided. (there is no special envelope)

Well, I typed "free consultation immigration lawyer" on google and found a couple of lawyers for my state. I don't think it matters what state you call from because it's a federal issue. I will PM his number for you.

If you want to learn more about DCF go to the forum on VJ, or the consulate website in you beneficiary's home country to find out what the resident requirements are. The DCF guide explains it all here on VJ

Well, as most of you know I've been struggling with the stresses of my petition :wacko: . I mean, I've been spreading my personal business all over this site like butter on toast :lol:

After talking to several VJ members I decided to seek the consultation of an immigration lawyer. I found a lawyer on the internet who does free consultations. I told him my story and concerns of IMBRA. He told me to relax!!! he said they are looking for domestic violence and the law is mostly geared towards people who met through a marriage broker. He asked how we met?, in states, no problem! he asked if this is my first petition? yes, no problem! He asked what the convictions were? DUI's, no problem! He said Police records do not come certified in the state of Maryland and the certified court records showing charges and disposition should be good enough. If they even feel the need to investigate further (knowing the nature of the crimes he doubts it) they can get all the information they want. He said it's a good thing I sent in the Police records I had anyway, it shows intent.

He said they may take longer to adjudicate my petition because of extra name checks and the possible investigation of other "hits", but since the other "hits" are not listed as "specified crimes" they will be ok. He said at the end of the day my petition should be approved. That was music to my ears!! :whistle:

If worse comes to worse (which I'm not worried about anymore) I talked to the Embassy in Poland and the lawyer about DCF. They said there would be no problems of convictions for the petitioner in that visa process. I also don't have to be a resident, just physically present to file.

so, I think I might actually get some work done today :thumbs:

No, it's not safe to say that. From what I understand the background check spans your entire life if your the petitioner. I'm not sure about the beneficiary.

I'm not sure how they treat students. I know in the mortgage business the 2 year work history includes college. You might have to be working in the field you studied, I'm not sure. You might want to do some research into the requirements for AOS. But, you should be ok for the I-129F, just get here, get married, and cross that bridge when you get there.

You might have another tax return by then anyway!! you can wait it out a little bit before you come to the states, I believe it's 6 months to enter the US after visa approval (I think), then you have 90 days, then you have the AOS process. Prepare for it now, but don't get in a big worry! you'll be fine for the I-129F as far as I know!

All the NVC does for K1 petitions is assign them a case number and make sure they get directed to the right embassy. There is no other processing, so it does go very quickly (most of the time).

I have a weekend in the way of my receipt... I'm hoping for Frankfurt to receive our by mid next week!

By the way... did NVC tell you that the embassy already received it, or did you phone the Embassy?



I thought they did some name checks as well.

I would think that the problem would be that VSC has handed out numerous approvals. The other service centers have not even touched! there USC petitions. There are lost petitions from the transfer from one service center to the next. Petitions are getting approved that have been mailed in months after the recalled petitions. The USCIS can offer no explination as to where these petitions are, when the backlog will get moving, or anything. That's just a small bit of the problem that I see. I didn't spend too much time trying to build a case for a problem, but I never do build a solid case for myself. I think people just need to vent a little. I said in a previous post that people aren't searching for answers, but for what they want to hear.

I feel that a Lawyers main use is assuring that you have all your paper work together and filled out correctly before mailing the petition. If you have a special case and need to obtain paperwork other than the norm, like Divorce, waivers, convictions, overstays, past visa fraud, and other things of this nature, a Lawyer can help guide you in the process. After the paperwork is filed there job is pretty much done. They have no hand on the internal processing of the petition. Actually a Lawyer can have name checks done on him if his name is on your petition, him and anyone else who's name is on it. Not that this would be a big deal for an immigration lawyer, I'm sure it's been done a bunch to them, but could cause delays. Who really knows!! You should feel safe with the paperwork you sent in having a lawyer review it, however, I need to be in control and rely on myself. I did not hire a lawyer but it might have been a good idea in my case, only time will tell.

No, I haven't been denied. I'm just worried about some things, that's all. I think everything will be ok, but I always prepare for the worst. I spoke to a Lawyer about some of my evidence concerns for convictions, he said I should be fine. Hearing that helps me sleep a little better, but I never take opinion for fact. I like to be one step ahead and prepared. I need to have my next step of action and plan laid out before hand if an denial were to happen. So, it would be nice to know I could just file again right away, if not, I have to look at other options.

I pray that everything will be fine with this petition. I have faith.

It seems the only real reason for denial that we've seen is not having met in person in the last 2 years. I think if you didn't give enough supporting evidence for something, they will just send you an RFE.

Don't worry - you are not going to be denied!!!!


If you forgot to sign your IMBRA RFE, answer all the questions, or send in all the evidence needed for convictions or waivers in the USCIS's opinion. They are instructed to deny the petition in the new memorandum of how to adjudicate after march 6th.
