I know your mind can just run with you, especially waiting in the hellish process. I hope you get your approval soon. Now I feel really stupid, but whats IBIS??

Q: What Is IBIS?
A: IBIS is the acronym for the Interagency Border Inspection System.


Q: Who Uses IBIS?
A: In addition to CBP, law enforcement and regulatory personnel from 20 other federal agencies or bureaus use IBIS. Some of these agencies are the FBI, Interpol, DEA, ATF, the IRS, the Coast Guard, the FAA, Secret Service and the Animal Plant Health Inspection Service, just to name a few. Also, information from IBIS is shared with the Department of State for use by Consular Officers at U.S. Embassies and Consulates.



Q: What Does IBIS Provide?
A: IBIS assists the majority of the traveling public with the expeditious clearance at ports of entry while allowing the border enforcement agencies to focus their limited resources on those potential non-compliant travelers. IBIS provides the law enforcement community with access to computer-based enforcement files of common interest. It also provides access to the FBI's National Crime Information Center (NCIC) and allows its users to interface with all fifty states via the National Law Enforcement Telecommunications Systems (NLETS).



Q: Where Is IBIS?
A: IBIS resides on the Treasury Enforcement Communications System (TECS) at the CBP Data Center. Field level access is provided by an IBIS network with more than 24,000 computer terminals. These terminals are located at air, land, and sea ports of entry.



Q: What Information Is in IBIS?
A: IBIS keeps track of information on suspect individuals, businesses, vehicles, aircraft, and vessels. IBIS terminals can also be used to access NCIC records on wanted persons, stolen vehicles, vessels or firearms, license information, criminal histories, and previous Federal inspections. The information is used to assist law enforcement and regulatory personnel.

Andy, we have been buds on here, so don't take this wrong.

Stop analyzing.

You are too worried about the lightning quick approvals coming out of VSC and yet, you are not approved.

You just hit 62 days for cripes sake. Relax man!!!! Try 150 days or more!! That is he!! on wheels. trust me.

I lived with my Fiance for 3 years and we just surpassed 1 year apart. Survival is communication, we talk for at least 1 hour, every single day.

Your issues are not issues for the K-1.

Be a little bit patient and you will get your approval.

Your right William33! and I know I need to be patient. Trust me, you know I've driven that one home on here time and time again.

But see, me and you are different. 150 days, there was a distinct reason for that and everyone was going through the same thing. Everyone knew why it was taking so long, you were waiting for IMBRA to run it's course. 150 days was common for your filing date and it wasn't an isolated case, it was the entire k-1 community that shut down. Doesn't make it any easier to deal with, just gives you reason.

I'm a little different. The wait I have is not common for VSC at the present time. I am one of few still waiting. I looked at the timelines on this site and discovered that almost everyone who filed before, during, and after me have been approved.

It just makes me paranoid and worried. I'm a natural worry wart!! and that doesn't help.

I will relax, I know I'm a bit of a hypocrite at the present time. I just know that I'm not a super clean petition and that worries me a little. I hope your right about the issues not being k-1 issues. I'm calmed down now. Everyone has helped so much. Thanks.

What more can you possibly do that has'nt already been done? Try to focus on your trip in October, think of your sweetheart falling into your arms and let your troubles melt away while you are in her company.
I'am sure your answer is on its way. Be positive ( I know it is easier said than done ), start by forming a mental picture of that day when you receive your answer from USCIS. Just know you are not alone in this maddening charade.

There is nothing wrong with your thinking . I think this is very normal for someone who has been waiting and seeing others get approved and you have absolutely no clue what is happening with your case. Talk about a dangerous process !

That's true, I could. The only problem with that is the fact that it's very rare you get a person on the phone who has the time of day for you. I think it might serve me better to wait until the 60 days are up for the RFE. (It still says to wait 60 days after RFE receipt to call VSC in the phone prompts) on September 28th. This way I'm not p!ss!ng anyone off, and they'll be more willing to answer my questions, I hope.

hhmmm....... I have an RFE received date of July 28th. That means I've been waiting for 47 days for a decision. I've noticed a lot of fast approvals from VSC. I noticed that almost no other petitioners have been waiting for as long as I have from VSC.

So... I figured I was in name checks, right? I mean, who really knows!! but it sounded good to me. I figured I would have some type of extensive look into my history having answered yes to convictions on the I-129f. Well as you may know I called VSC on Monday to see if I was in name checks. The lady said that I was not in name checks and that my case was with an adjudicating officer. She also said that they do not do certain types of extensive name checks unless something else is found. I never asked if I already went through name checks though, I wish I would have. I've read that the IBIS is pretty much an instant check. If they need more they can do an FBI name check which usually takes 2-4 weeks to complete, others under 6 months, and a few who take longer.

Ok, so here's the kicker. I'm with an adjudicating officer. GREAT!! right? but the officer is the one who runs the IBIS background check. I would think that this is when they would find something else, or find the convictions. Then they would probably request the FBI check for further investigation. I mean, is this the first time an officer has my petition? I wouldn't think so knowing VSC and the 47 days since they've had my RFE, or is this the 2nd or whatever.

So, I'm really hoping since I've been waiting for 47 days, and most petitioners from VSC have already been approved, that I've gone though and come back from name checks. Now my case is with an adjudication officer to make a decision. OR! I'm with an adjudicating officer for the first time who is getting ready to put me through IBIS and then put me in further name checks. Then the wait would have just begun. Arrgg!!

This is where my mind is right now! crazy isn't it??

and I know I need to have peace of mind, and trust me, I do.... a little!! I'm going to Poland in October and Ania is aware that we need to wait. It's just that they gave me hope that it could be soon, and this made it worse.

I called the USCIS and talked to a representative who gave me my receipt number over the phone. I had to be a little creative to do this.

When calling, there is a prompt that's for people who have been waiting for 30 day's or more for the NOA1. Follow the entire prompt until you get to a customer service representative.

I told them that I was out of town and asked a friend to mail my petition for me while I was gone 30 day's ago. I said I wasn't sure if they did it or not, I think they might have forgot and sent it later. I just needed to make sure you've got it.

The rep. was very nice, told me when they received it, then he said "well I can give you the receipt number now" he asked me a few questions.. Petitioner Name, Birth date, Beneficiary Name, Birth date, and then gave it to me. I was able to sign up online for status e-mails and checks, got the NOA1 e-mail in 1 week.

This might not work for everyone, it did for me.
It can take up to a month to get the NOA1

It's when the USCIS has a Request For more Evidence or Information after the filing of a petition. They will mail you the request and send you an e-mail notification if signed up to receive e-mails from the USCIS

One is assigned a case number. Name/security checks are also conducted at the NVC level. The time it takes is dependent on those name/security checks. It can be anything from a week or two, to months. Generally though it is only a short pit stop to be assigned the case number.


What is the name and security checks? I mean, she provides the police certificate at the interview, what is this check? I put a couple of her nicknames on the petition that she uses for "other names used" do you think this will effect the checks?

Hello there! I'm new here. I've now got pretty much all my documents gathered to submit my K-1 petition to the NSC, but wanted to verify something with people here who might have better information than me. I know that my fiancé will have to submit police reports from each city he's lived in since he was 16. Recently, though, I saw something that suggested that petitioners (or at least some petitioners) now have to submit a police report or criminal history, as well. Is this true? And if so, what exactly do they need. I have no criminal history--fine upstanding citizen Kirsten, at your service! :) But if they really do need this kind of documentation, what do I need to provide?

I'd be so relieved NOT to have to deal with this because it's more delay in getting this packet sent off and moving this process forward finally. But I also don't want to send my packet off without a required document and risk an RFE. Anyone know anything...?

You only need to provide that if you have any history of being charged with domestic abuse, assault, child molestation, or drug or alcohol offenses.

There's a bigger more comprehensive list, but if you have absolutely no criminal history, you don't need to worry about it.


assault is not included in the list of "specified crimes"

If you did have a conviction on the list you would have to gather certified court records and police records showing charges and dispositions for every such case.

you must simply provide certified court & police reports showing charges and disposition for every such conviction listed on the Petition. You might want to write a letter explaining the definitions of terms used in your disposition such as The nature of your conviction, why is this against the law, probation, etc.. I addressed two letters, one to whom it may concern and one to my fiancee. They want to make sure that your fiancee understands the nature of your crime and what happened. The purpose of IMBRA is to inform the beneficiary of such crimes. make sure your fiancee understands your convictions as questions could be asked in an interview.

You only have to worry about this if your crime is listed on the petition.

Did you meet through an International Marriage Broker? if so you may be required to disclose additional information not listed on the petition. Read the link on this thread to generate your own opinion http://www.visajourn...showtopic=24439

Remember that we are not lawyers, and no one really knows how IMBRA will effect petitions from this point on. A conviction for a first time petitoner is not grounds for denial. There is a buz on this site that seems to think that a conviction along with multiple petitions is grounds for a denial. I beleive there is some truth to that. I think it's a good idea to read the link on the above thread.

Unfortunately when applying for a waiver for multiple petitions I believe it is grounds for a denial depending on the crime. I believe you should seek an Immigration lawyer in preparing your waivers. I would get a lawyer for sure!!! please read the following:

Yes, they have new petitions. However, they have been sending IMBRA RFE's to people even if they used the new petition. It hasn't happened to everyone but some. I was one of the ones who got an IMBRA RFE even after using the new form.


I'd be willing to bet it's the notorious IMBRA RFE. You'll just have to wait and see. If this is the case you will just repeat the same thing you did in the application. I included a cover letter saying I already answered these questions in the original petition. Good Luck :thumbs:


That's a good idea. If I'm able to mail out our petition over the next few weeks like I'd like to, do you think I should do that in my cover letter as well? Or is it late enough for me to be "safe"?


I think you may have misunderstood me. I sent a cover letter for my RFE reply. But it might be a good idea to point out that you used the new petition in your cover letter for filing, why not?
