yea! your right! I'm inside processing times. I know, I know! trust me, I've preached that on here. As a matter of fact, knowing that I'm within processing time is the only thing that keeps me sane. I just wish they could tell you something. Just something to let you know where you stand. It's tough for sure.

I'm still going to look into it. I've been dragging my feet a little because I know it will take just as long if not longer that the process I'm in now. I have to go to court in Poland to get a "free to Marry" requirement waived before we can have our wedding. So I will go to Poland and file for that hearing. I wish I could stay there for the entire time it would take to file but I can't. That means I would need to fly back and forth $$$$$$$$$$. There is no reason for my petition to be dinied. I guess there is some reason why it should take awhile though.

I guess I will do all the normal stuff. I will build a case for my Congressman/Senator and request there help. I will contact VSC and get nowhere. But I don't think I can sit on my hands anymore and say it's going to be ok. I'm not a reactive type of person, I'm a go getter!! and that's what I'm going to do "Go and Get Her!!"



heheh.. sucks, huh? Their version of 'telling you something' is "6 months"---that's all there IS to tell.

As for the DCF--ideas: You can get a statement of non-marriage from your County, or better yet, your State's Secretary of State office. You can also usually get this for a fee from the US Consulate in the country of interest. I was charged something like $60 for it, but it came already translated English/Greek.

The USC only need appear for the first 'interivew' aka filing the I-130. The foreign spouse may attend the visa interview alone. One trip = get married and file I-130.
Do you know how long the wait is from I-130 to visa interview?

$$$$$ = now we find out HOW much of a problem the wait is for you or if you can dredge up some more patience after a healthy griping session. ;)

Electeds can't do anything for you until you are out of processing range; congresscritters are generally more responsive than Senators.


I do have to get the letter from the American Citizen services dept. of the consulate in Warsaw or Krakow. That letter is to state that the USA does not have "free to marry" proof, as we do not keep such records. That letter is then taken to court to be presented to the judge as to why the requirement should be lifted. After you file for the court date it takes about 6-8 weeks for your court date. In the mean time you need to register to get married and you need to wait 1 month after registering to get married.

this would equal

1 trip for registering and requesting court case
2 trip for court date and possible marriage (that may have to be a third trip)
-I will file I-130 after the wedding on one of those trips
3-4 trip to go to the interview with her (she wants me there)

All this could total up to 3-4 trips at $800 a clip + missing work. If I start this process of DCF I probably will bet my approval before it ends. Then I would have wasted all that money. I think if I would have done the DCF first it would make more sense. Now, I think I need to wait it out.



Without getting into the illegal aspect of immigrating Andy. I live in Chicago (2nd largest polish population in the world next to Warsaw Poland) and there are many polish here that dont speak English. How did they get here and your still over there :huh:


My fiancee is an honest person. She didn't want to screw heself by trying something that could ruin her life. She also didn't want to have that hanging over her head. What a horrible feeling to know that any day could be your last in the states if figured out. Doing it illegal is stupid.

yes! that's what happened. I got the RFE despite using the new form. I'm not going crazy, I know I'm within processing time. But I am going to start the war, even if it gets me nowhere.

Well the beast has been awakened!! I have no other alternative but to raise Cain!!

I’ve been patiently waiting, I’ve been supportive, I’ve been understanding to USCIS, I’ve tried to make sense of things, and now it’s over. I know a lot of you are still waiting for your approval from months precious to my NOA1, I understand that. The problem here is…. My wait time is not the norm for VSC. I’ve checked the VJ database and discovered that I am one of the only July NOA1’s to be waiting for NOA2. I would be fine with waiting longer if it wasn’t for the fact that everyone else has been approved. There is no IMBRA excuse anymore. VSC has proven time and time again they are back to speed.

This leaves me to believe my worst fears. There must be something wrong with my petition. I have convictions and reasons for other name hits, which are not a part of IMBRA so they shouldn’t be a problem. I’ve sent everything they asked for. I can no longer wait and see what happens, I must take action. I don’t know how I’m going to get around the canned 6-month wait response, but I WILL!!!

You can say wait and be patient but it’s not normal for a petition to take this long at VSC for VJ’s, just take a look at the K-1 processing times. Everyone has been approved, but me. What should I do? Do you think I’m right? How am I going to handle this one?

I've been reading that it's helped in cases of finding out more about name checks and information the USCIS finds within the name checks. I think this will be my next step before building my case for my congressman. You see, I believe I have good reason to be delayed in security checks due to my petition. I'm going to first introduce myself to my congress person as someone who might need there help in the near future, as I am currently within processing times.

I want to get the FOIA sent in to the USCIS and the FBI first. I also want to get the privacy thing sent into my congressman ahead of time.

But anyway, does anyone have information on FOIA? am I barking up the right tree?

At Vermont, the application assembled into a file by people who do that, then sent to adjudication and entered into their records (NOA1) then enters the adjudication queue. The adjudicators look at files when they make it to the front of the queue and either approve or RFE.

At California, the application is assembled into a file by people who do that, then sent to adjudication and entered into their records then put in a storage box at the back of the third stall on the second floor ladies' bathroom. Sometimes they move the boxes to clean the toilets, this is known as a "touch." Once every four months, the CSC adjudicator hauls out a box to go through the files and either approves or issues RFE or, if he feels like it, tosses aside unopened. Then he glues the applications to his office ceiling. It takes three to six months for the glue to weaken sufficiently for an application to drop back to the floor. Every morning when he first arrives he picks up the applications that have fallen from the ceiling, and because they have shown the most effort, forwards them to mailroom so the applicants can be notified.

P.S. I made that up.

Well, this worked for the Vermont Service Center. I'm not sure how you contact California.

How to contact VSC

Despite what some will say about Vermont having a direct phone number I used theses steps
1-800-375-5283
press 1 pause 2 pause 6 pause 1
Enter Receipt #
press 3 pause 2 pause 1
And they pick up saying it is Vermont Service Center, If those steps are not used you get the normal Customer Service at USCIS.....And was told by them I was in Security Checks.

I called VSC using the calling instructions (given on VJ) to get a live person, it worked!! They said "Hello, Vermont Service Center"

A very nice young lady answered the phone and asked how she could help me. I politely explained to her (in the most charming way) that I know it's probably too early for me to be calling. That I told myself I would wait the 60 days requested to process an RFE (by the way it still says within 60 days in the prompts for processing an RFE) but I couldn't wait. I'm trying to follow all the rules and regulations but can't wait. I said that I've been reading horror stories of security checks and since I have answered "yes" to convictions, I was afraid I would be stuck in security checks.

She responded by saying that they received my request for more information on July 28th and my petition was with an officer and currently being looked over.

I asked her "what does that exactly mean?"

She said it means they are looking over my file to decide if it's going to be approved, denied, or request for more information. She said that's all she can disclose.

I asked her if that meant security checks were already done.

She said that this type of petition does not go through prolonged security checks unless something else is found. Then they would need to request a different type of security check.

I asked her "if I were in security checks, would you have told me that?" she said "yes".

So, I don't know what all that means, it could mean nothing. It could all be canned responses to my questions, I don't know. All I know is it felt good to talk to someone about my file and at least have a conversation concerning it.

Has anyone else got the "it's with an officer" response? Does that mean a decision soon? or does that mean I'm in a pile, nothing really changed, here's what I'm supposed to say, have a nice day.

Oh yeah! I forgot the most important part of what I posted. In my case, we truly did not intend or have the pre-determined idea to get married. So we would not have been lying. You would be in your case. It would be a solid case for visa fraud. So, you should take that into consideration. It's best to do things the right way. But with all that being said, marriage can be done. I just wouldn't want to risk it, not for the one I loved. Because you risk losing it all!! so get lawyer!! and even they are not guaranteed to work!

It is that easy, but it's not that easy. Meaning, it's been done and is being done all the time. You just need to prove that you did not intend on getting married or immigrating to the States when on your J-1. You should for sure get a lawyer for this one. I talked to one a long time ago while Ania was here on her tourist visa, he said marriage would work. We were not ready then and she went home though. But he and other lawyers (never take the advice of just one) said it would be fine. Consult a lawyer as the interview will be key for this.
