Thank you... So, yeah. I-130 is a petition for a relative, including spouses; they have the number for I-130 and I-129f added. So... still, it's amazing that they have to work on over 6 million I-130/I-129f petitions.

Only time will tell as far as an RFE is concerned. Try not to get wrapped up or worried with things that are now out of your control. What's done is done. Your petition will be corrected and approved in it's time. They may send an RFE, they may do a name check on the wrong name. Who really knows at this point. Just sit back, relax, and wait to see what happens!! you won't be able to change it by calling. good luck!!

I don't know if this is possible but is there a way to get some type of visa for your fiance to visit the US while the I-129f is processing?....If so..would anyone know how? Thank you!


I'm not saying it's impossible, but I believe it's close to being that way. It's tough because the Fiancee Visa is intended for immigration purposes even if it's not an immigrant visa. The consulate will have a hard time giving a temp visa to someone who is intending on immigrating to the States. Temp. visa's are given on the bases that the applicate has strong ties or reason to return to there home country. It would be hard to prove this given there intentions with the K-1. Also, it's been tried on VJ many times before and failed.

Yodrak had mentioned in another topic similar to this about "engaged" not really being in the vocabulary of the USCIS/Consultate.

If you decide to get married, you're getting married, regardless of if there was proposal or not.
I'm sure a lot of people discuss marriage and decide to get married before there ever is a ring or a proposal (which is what happened with us). It's enough for the USCIS that you intent is to marry when you both write those handy-dandy "intent to marry" letters for the petition.

I would think telling the Embassy that you were engaged prior to the filing of the I-129f would be a good idea. I'm not sure how they would view that. "When did you get engaged?" is a common question in the interview process. I really don't know how much this would effect things but............ who know's? oh! yeah! I'm not a lawyer!! just someone who thinks deep into things and situations.

or explain that you agreed to get married on a certain date (the date you did) and then explain you officially got engaged when you could present her a ring. I dunno!! maybe I'm too much!!

It was just hard to flip through 978 petitions from VSC to see that I am 1 of about 8 who don't have an approval. Makes you think a little. It would be different if I was part of a bigger picture like the IMBRA thing, where everyone knew why it was taking forever. I feel this is different. But I hope all will be well.

Andy, try and find irishgirl.. she had a long run in VSC too and felt unfaired on as you do. It happens sometimes & there IS nothing you can do about it.
The promise is that they will get petitions/applications processes in 6 months. If you're not there yet, you're not out of date range, no matter how many other peitions you find to support your theory.

yea! your right! I'm inside processing times. I know, I know! trust me, I've preached that on here. As a matter of fact, knowing that I'm within processing time is the only thing that keeps me sane. I just wish they could tell you something. Just something to let you know where you stand. It's tough for sure.

I'm still going to look into it. I've been dragging my feet a little because I know it will take just as long if not longer that the process I'm in now. I have to go to court in Poland to get a "free to Marry" requirement waived before we can have our wedding. So I will go to Poland and file for that hearing. I wish I could stay there for the entire time it would take to file but I can't. That means I would need to fly back and forth $$$$$$$$$$. There is no reason for my petition to be dinied. I guess there is some reason why it should take awhile though.

I guess I will do all the normal stuff. I will build a case for my Congressman/Senator and request there help. I will contact VSC and get nowhere. But I don't think I can sit on my hands anymore and say it's going to be ok. I'm not a reactive type of person, I'm a go getter!! and that's what I'm going to do "Go and Get Her!!"



heheh.. sucks, huh? Their version of 'telling you something' is "6 months"---that's all there IS to tell.

As for the DCF--ideas: You can get a statement of non-marriage from your County, or better yet, your State's Secretary of State office. You can also usually get this for a fee from the US Consulate in the country of interest. I was charged something like $60 for it, but it came already translated English/Greek.

The USC only need appear for the first 'interivew' aka filing the I-130. The foreign spouse may attend the visa interview alone. One trip = get married and file I-130.
Do you know how long the wait is from I-130 to visa interview?

$$$$$ = now we find out HOW much of a problem the wait is for you or if you can dredge up some more patience after a healthy griping session. ;)

Electeds can't do anything for you until you are out of processing range; congresscritters are generally more responsive than Senators.


I do have to get the letter from the American Citizen services dept. of the consulate in Warsaw or Krakow. That letter is to state that the USA does not have "free to marry" proof, as we do not keep such records. That letter is then taken to court to be presented to the judge as to why the requirement should be lifted. After you file for the court date it takes about 6-8 weeks for your court date. In the mean time you need to register to get married and you need to wait 1 month after registering to get married.

this would equal

1 trip for registering and requesting court case
2 trip for court date and possible marriage (that may have to be a third trip)
-I will file I-130 after the wedding on one of those trips
3-4 trip to go to the interview with her (she wants me there)

All this could total up to 3-4 trips at $800 a clip + missing work. If I start this process of DCF I probably will bet my approval before it ends. Then I would have wasted all that money. I think if I would have done the DCF first it would make more sense. Now, I think I need to wait it out.



Without getting into the illegal aspect of immigrating Andy. I live in Chicago (2nd largest polish population in the world next to Warsaw Poland) and there are many polish here that dont speak English. How did they get here and your still over there :huh:


My fiancee is an honest person. She didn't want to screw heself by trying something that could ruin her life. She also didn't want to have that hanging over her head. What a horrible feeling to know that any day could be your last in the states if figured out. Doing it illegal is stupid.
