Still no update from TSC/CSC, no NOA2, no RFE, just... silence.

Maybe today they were in a big strategic office meeting getting prepped on how to wrap it all up before week's end.
I can just imagine the pep-talk,,,, "Okay guys,,, only 3 more days before it REALLY hits the fan!,,,Now get out there and wrap up those cases! I want to see those approvals flying like they're coming out of a wood-chipper!"
I'm thinking tomorrow (more so than today) will be a very active day!!

I just received the RFE in the mail today and they want me to submit evidence to establish the marriage is bona fide. I am furious!!!!! I sent 2 dozen pictures from several different cities with me and my wife. I send cell phone bills showing all the phone calls between us. I sent my marriage certificate. What else do they need??? I am not living with my wife helloooo!! How am I suppose to have the following?

*Documentation showing joint ownership or property
*A lease showing joint tenancy of a common residence
*Birth certificate of children born
*Affidavit sworn to by 3rd parties
*Any other relevant documentation to establish that there is an ongoing marital relationship

I am not living with my wife! Helllooooooo How am I suppose to have a lease or property??? We don't have children yet! So I am now freaked out!!! I will get 2 affidavits from 2 people (relative or friends) does it matter who I get it from? What else can I include??? I thought the telephone statements and the pictures from several different trips would have been enough. I can't even prove that my marriage is bona fide! Please help people I don't know what to send.

hello all,

when do i get my I 130 approved? I am also a late July Filer

I ask myself that same question nearly everyday!!
If you're last update indicated you were transferred from Cali to Texas, there's a good chance you may be sent back to CSC again because of the TSC issues (but maybe not...). I received notification today that I was sent back to CSC,,,but no update yet to my status on the uscis website. If I had not submitted a Service Request a few days back, I doubt I would have received the notification and would still be sitting in the dark like a shroom !

Hello, all. This is my first post in VJ.

We are July filer with priority date July 19. Our petition was transferred from CSC to TSC on Nov 3. The last touch was on Nov 24. After then, absolutely nothing happened. We tried many ways to get response on status and we just received generic message. We will get into 8th month within few days. Really really hope to get approval before teh end of this month (Feb).

Welcome aboard the crazy train!
Curious if you actually called uscis customer service & placed a Service Request???

I received e-mailed notification that my case(s) have been transfered to CSC:

Records show that your case has been relocated to the California Service Center on February 15, 2011 for processing. We understand the inconvenience associated with the previous relocation, and now that the petition is back with the California Service Center we are directing all available and appropriate resources to adjudicate the workload as quickly as possible. You should receive a notice of action by February 28, 2011 or sooner.
You may monitor the progress of your case by accessing My Case Status online at https://egov.uscis.g...s/Dashboard.do. If you do not see any action on your case by March 1, 2011 you may contact USCIS at: I-130Inquiries.Tsc@dhs.gov.
*A notice of action may be in a form of Approval Notice, Denial Notice, or Request for Evidence.

The response was a result of the Service Request I placed recently, however they are only referencing 1 out of 3 petition/cases I've submitted. I'm hopeful to see similar updates on the remaining 2 petitions tomorrow. I wonder if it's normal for them to reference only one petition number when sending out this type of notification when there's multiple cases... hmmm? Man! I hope they didn't lose anything!!

My file hasn't been touched and I haven't received any notifications, but when I do a search for my receipt number in the database it says, "The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office," while before it only said they'd received it, so I think it's good news. Maybe it means it's one of the ones that's been sent back to CSC.

My cases say the same. It's had the same message appearing since November. Like many are finding out, lack of status updates don't necessarily mean that a case is stalled... there may be all kinds of good stuff happening in the background! Kind of a guessing game at time unfortunately.

its been 8 months or roller coaster ride for me from csc to tsc .....and now that i got the approval for my wife...we are worried about the Medical exam at st lukes, my wife was diagnosed with uveitis last dec 2010 and now shes still on medications...steroids pills, steroid eyedrops to stop the inflammation on hey eye....we are worried that it might effect the medical exam or might cause her to fail the exam..we dont know....anyone here has any idea? another roller coaster i guess......

Yes! I found the new thread!!

Hmmm,,, I am not very well versed on the topic,,, but I have a similar concern with my wifes daughter who has severe CP. My concern was similar in that I was concerned that the disability may prevent an "approval" through the medical exam stage. My lawyer told me that she had never had a case denied due to a medical condition or disability as long as the petitioner showed capable means of supporting the beneficiary. She made it sound as if the governments primary concern is that the beneficiary doesn't become a hardship on the health-care system,,, but should be a non-issue if petitioner meets the financial requirements (and employeed with a company with decent medical insurance).

I can't say for certain that a medical case would never be scrutinized for some reason,,, but I felt comfortable with my particular situation based on what legal council shared with me. Hopefully there will be others out there with a similar situation as yours and can minimize any concerns.

IR-1 / CR-1 Spouse Visa Process & ProceduresFlight Arrangements Before Interview
Hi !

I don't see why you wouldn't book your trip ahead of time. You know, now most of the air companies have a policy allowing you to change your departure (or return) date up to 48 hours prior to departure, and for the ones I've checked so far it's just a matter of a $150 fee. I have done this before, not through my visa process though, but I plan on doing so.
The worst that can happen ? You're charged $150.
I personally think it's worth all the money you would save by booking your plane ticket in advance -- much more than $150.

You also have the option of purchasing a flexible plane ticket but according to me it's over expensive !

Good luck,
Aurore.

OOokk, so I found out at least a little of what the medical issue was.. during the course of the interview, they asked him about my job history, and he told them I worked as an interior designer.. they asked him more about it, well.. I worked as an interior designer while I was in prison about 10 years ago.. and then they asked him why I was in prison, and it got to my past drug problems.. they asked him if I still did drugs, which of course the answer is no, I've been clean for 7 years.. anyway, he went to the doc and they sent him to the lab and took urine (there's only ONE thing they need that for) and 3 vials of blood they say they're sending to France and the results should be back in a week. So basically, they're testing him for drugs and drug related illnesses, which is TOTALLY cool, because he's like a choir boy.. WHEW, I was worried it was his heart arrhythmia or something.. what a relief.. And since it takes a week, it gives us time to get the financial support documents in order.. waw I'm relieved..

Thank you so much for passing on the information. I find that really, really interesting. Your fiance's English is quite good, right? I've wondered before if part of what trips some guys up is that they can communicate with their SO just fine because they're relaxed and comfortable, but then when they are on the spot in the interview they have juuuuuuust enough of a language problem to not come off natural and like themselves. With the end result being that they look rehearsed or dispassionate or like they're hiding something.

On the flip side, I've been very curious about how the consulate takes humor. Not making a joke out of the interview - of course it's very serious business - but my fiance is incredibly outgoing and he jokes around a lot. Personally, I think it's disarming and it will show that he's enthusiastic about me and has fun around me, and I have no plans to tell him to dial it back because that's just who is he and how we are. I am glad to hear that this natural and light-hearted approach worked for someone else, though!

Yes, his english is very good. He's spent a LOT of time with me face to face and talks to my friends and family frequently on the phone, so he's very comfortable talking to Americans (and in an American kinda way). I think that helped him, because a year ago, I don't think I'd be able to say the same about him.

I just told him to be himself. People who know him like him for who he is, and that's the basic idea of the interview, for them to get a good idea of who they're letting into the US. I think they appreciate when people are really real. I still can't believe he told them about my b%tchin and complainin tho :jest: and he said "b%tching and complaining, like her Mom".. My stepfather is gonna get a serious KICK outta that one :P

Congratulations again!!! That must have been really intimidating with 2 of them questioning him. Did he happen to notice if they were doubling up for other interviews, or if they just both joined in on his because he was last? And when they'd send him back to the waiting room and call him back, did it seem like they actually had a "tougher" line of questioning or was it just more basic stuff?

That's annoying about the medical, I wonder if maybe the doc messed up and left out a form or forgot to sign something. But at least you know he's approved and your family can be reunited here! (And then you can work on that book...LOL)

He said when they'd ask him to sit in the waiting area, he could hear one tell the other "what should we ask him next".. Honestly, from the way he described it, it sounded like one of those nightmare interviews that you read about on the consulate reviews, where they're trying to trip up the beneficiary and it usually ends badly. I think what saved his #### is the fact that he stayed calm and conversational with them, like he was chatting over coffee. He said they sat there and listened to him with stone faces. He also said there were a few things he honestly couldn't remember, and he told them so. When they asked him questions about our relationship, like what we like and dislike about each other, and what our daily routine is, he answered them in a casual manner (not sounding robotic, using slang terminology, using irony), basically, he was himself in the interview, and I think that's how he got out of there in one piece. :content:

As the USC, Sarah, I would call and/or email the consulate and ask if there is something specific they need to complete the medical, so that you don't have to pay the full price for a new medical. Explain he just had it done last week and you'd like not have to pay again, so if there is something specific that is needed to complete it, can they tell you about it.

I did this, I called them, and it was the CO who interviewed him that took the call. She told me that the doctor "is aware" of what is needed, and that he needs to return to the same doctor. So he just left to do that. I bet that scandalous receptionist messed up some paperwork... <_<

Well, he got approved, but they need him to bring them a I 864a from my stepfather, because he co-mingles assets with my mom, who is the joint sponsor.. And here's something that totally baffles me- they want him to have a second physical exam. He just had the first one last week! So we have to pay for that ####### a second time! Anyone have a clue why they'd do that?!

They really grilled him. He was the very last person in the room, and waited 4 hours to be seen. They asked him about my work history, my education, his relationship with our daughter, my favorite food, about my mother's second marriage, my criminal record, why I didn't finish college, about my ex husband and our marriage.. and the kicker- what he doesn't like about me. He told them he doesn't like that "I b%tch and complain too much, like my mother" That made them laugh  He was interviewed by 2 women, one he said looked Moroccan but had an American accent, and he said a woman with light red hair stood behind her and commiserated with her during the interview. Several times, they asked him to sit in the waiting area while they discussed further lines of questioning for him. It was tough, but he made it.. I'll post more details later...

Sarah

Thinking of you and wishing you all good things!

We're doing really well! My fiance is the single most calm person I've ever met.. spent the evening watchin Three Kings and drinking sodas :D He FINALLY went out late this afternoon and got some clothes to go to the interview in, after I nagged him for a month about it. I don't know about sleep tonight tho, I don't sleep too much at night anyway, and there's a funeral going on outside our window.. They'll be reciting the Qu'ran all night.. It's kinda comforting and relaxing tho ^_^

Thanks to everyone for your prayers and well wishes. God willing, everything will be ok in a few hours.. :clock:

My fiance, our daughter and I sat in the cafe with Vanessa this morning while she waited for her husband. It was really wonderful to finally meet her, after we've kept in touch for so long and leaned on each other through this harrowing ordeal. When her husband walked in and I heard her cries of joy, tears came to my eyes. After all we've collectively been through, it was an amazing experience to see someone's dreams come true before my eyes. I wish the same for everyone on Visa Journey. And I pray that we get the same good news tomorrow. I want to feel the relief Vanessa feels.

Reading archived messages, it looks like the people who used to be successful years ago were the ones who came in with boatloads of evidence. 300 pictures, a thousand pages of IMs and emails, etc.

This was my opinion in the past, too.. I've been on here lurking for a while now.. but I noticed that the chunk of people who were denied in the past couple months on VJ went in with a truckload of evidence, and were still denied. And the ones who were approved (and this seems to be a global thing), weren't approved because they had 400 emails and 300 photos, because the CO never looks at them. So I reckon, better to have a small amount of very relevant evidence, than a copious amount of late night chat logs and over-posed photos in djamaa el fnaa. Besides which, I already sent them excerpts from 4 months of chat logs and over-posed photos from our engagement party :jest:

I don't know what else they could want from me. :P If they want a pound of my flesh, as I've said, I have plenty to spare!

Well, Vanessa1 has her interview for CR1 in the morning, I'm gonna go down there and sit with her while she waits for her husband in the consulate.. And then my fiance has his interview the next day.

I've decided, since I've been here for 4+ months, not to include a stack of old chat logs, since I sent some with the petition. I'm just sending him in with his forms, my passport and our daughter's passport along with boarding passes to show we've been here, a small book of good family photos, our daughter's birth certificate with his name on it, and I added an Evolution of Relationship letter, like what they suggest at the Manila consulate, to address the fact that I failed to provide much info about how we met online in the original petition.

I really hope it's enough evidence. I don't have much more to offer them. I've grown to feel that loading them down with too much stuff as evidence can give the appearance of over compensating, and that's just as bad as bringing nothing at all. I want him to stand on his own honesty and sincerity, and God willing, we'll be just fine.

I'm so ready to get all this overwith and go home to see my family again.. And have some Maryland crabs before the season's over. And some Ben and Jerry's. And a Whopper. With a Mountain Dew.

They're actually pretty good! They're spicy.. I still like them with garlic and butter better ;)

Sarah,
How are you doing? How are you feeling with the interview coming up? It's Monday, right? Did your fiance finally prepare everything he needed to prepare?

His interview is on Wednesday.. We've just been trying not to stress too much about it. He likes to do things last minute, the man hasn't even gone out and bought dress shoes yet. I feel like it's a really good thing I'm here to push him, or nothing would get done. As for me, I'm chillin here, eating some snails and drinking some tea, oh yes, and reciting my prayer- the serenity prayer.. It helps..

sorry I just stuck that info in there..but I felt that anyone that has a co-sponsor may need to make sure and get a copy of their passport..make sure you take the correct size of photo..double check everything that way you don't have to wait longer..

No, it's good to know.. After Linda posted in her profile about K1's needing a i864, now I'm having my mom express mail it to me, and she has to get a copy of her birth certificate to follow it, as proof of citizenship. I know we won't have the birth certificate here in time for the interview, but at least most of the papers will be here and it's a small delay. I'm glad I found out before the interview!

Monica, as for preparations- girl, you know what I'm dealing with over here.. The boy KNOWS he's gotta get some new shoes, he can't go in the consulate wearing some busted Nikes.. Does he go out and get them? No. He downloads rap music all day and then at 8pm says he'll do it tomorrow. :bonk: I think I have all the papers in order.. I chose not to send him with any more chat logs, since I've been with him here since I filed, and I sent some in with the petition itself. I'm sending him in with my passport, boarding passes, Moneygram receipts from my mom doling out my tax return to me, and a small book of pictures of us together and our daughter with his family. Oh yeah, and Zahra's birth certificate with his name on it.. I don't know what else they could possibly need from us, but if they need a pound of my flesh, I have plenty to spare.

I agree with much of Zaytoona's post.
I have also wondered if the CO's take the reverse into account - if they consider whether the USC would be with the Moroccan (in the same level of socioeconomic status, etc) if they were here in America.
Any thoughts?

 you made me think back to my more recent relationships in America- my ex husband, the out of status Nepali pizza delivery guy, the Moroccan Wal Mart employee, the Moroccan autoclave operator who has a daughter with a girl he met in a club when she was 17... LOL I think I'm moving up in the world with this one!!

Thanks, Sarah, for collecting so much information on what you've observed coming out of Casa. I'm still sifting through it and I'll probably comment more later.

Just wanted to ask at this point if anyone had ideas about whether the consulate takes into account things that happen AFTER the initial packet is filed? Monica's case makes me suspect perhaps they don't, or at least don't count it as much, but perhaps they really were just suspicious about something they saw in a chat. I admit I'm particularly interested in this topic because I've visited twice but I have another visit scheduled in a few months, and I've been considering holding off on the petition until after that's done so it will "count." But since either way that 3rd trip will be before the interview, if they consider all 3 equally then I'd rather get the ball rolling now.

FWIW, I respect everyone's right to make their own decisions, but I would also strongly urge someone whose SO has asked for (or not "asked" but hinted around and willingly accepted) money to think hard about the relationship. Just advice, take it or leave it.

No, they do count what happens after filing... That's why people recommend sending your SO to interview with a stack of chat logs- the chat logs should be from the time the petition is filed up to the interview, to prove an ongoing relationship.. I just guess in Monica's case, her visit wasn't enough to disuade them from other issues they found..

Hey ya'll, I wanted to throw an important bit of info everyone's way- after Linda's experience the other day, I thought I'd call the consulate to inquire about them needing an i 864 for a K1. I was told that the i 134 is no longer being accepted for K1's, and that the i 864 is now a REQUIRED document at interview for K1s, though it's not listed in the packet 3.. So for those with interviews coming up soon- send that i 864 to your SO and save the potential delay.. Thank God for express mail!
