Hey OP. it's going to take an average 6 months for your wife to receive a NOIR in the mail. NOIR= Notice of Intent to Revoke. It's SO SO SOOOO important that she answer it in the time that USCIS gives her. In the NOIR, they will list the reason for the denial, and it's your job to prove them wrong in order to get reaffirmed.

I know several people who've been reaffirmed that interview almost exactly one year after their original denied interview. This seems to be the norm with Casa. Let us know what the NOIR says when your wife receives it, perhaps we can help with the rebuttal. Good luck, khouya.

You also need to read over the NOIR and specifically address the consulate's reason for denying you. If it was stated in the letter that they believed the relationship to be strictly for immigration purposes, pointing out that your wife is now living with you in Morocco would be a good idea. Pictures can only prove so much. Your wife needs to write a letter addressing the NOIR, point by point, in addition to the evidence mentioned above.

I hope you know how serious this is. If they don't reaffirm your case, your chances of ever immigrating to America are very slim. Good luck.

What he's got is not an RFE. It's a NOIR. And that's serious stuff. If they want further proof of your relationship, and your wife is living there in Morocco with you, send copies of the stamped pages of her passport from entry, and a copy of her Moroccan carte de sejour. Send photos of you both together in Morocco. And do it quickly. They always give a deadline for the NOIR to be answered, and if they deny you this time, your wife had better settle in Morocco for good.

Is it possible that the time frame got a little longer because there were a larger number of March filers? I'm just speculating but from looking at the Igor data it seems that there might be a larger group of March filers. Maybe because of Valentines Day weddings? April filers count seems much lower. But of course there is no way to know for sure because everyone is not registered with VJ and not everyone has entered their timelines. It's just a thought.


I've always thought filing went up this time of year because of tax returns and people having funny money to spend..

"touch" is a Visa Journey term. On the USCIS site, under the "Last Updated" column, when that date changes, that's what we call a touch.

Dude, the government has divorce waivers for this express purpose- so that the LPR can remove conditions on their own in the case of an honest to goodness divorce. As long as the marriage was entered into in good faith. Sometimes things just don't work out. They understand this, hence the waiver. Look it up, it's not a matter of your opinion on what's right. The FACT is, it's possible and it happens all the time.

Yes, if he goes and applies for a tourist visa and is refused, it may negatively effect a later interview for a CR-1 visa. I would suggest filing for a CR-1 directly. I don't see how it's a case for legal advice. Unless there's some red flags in her case that she hasn't mentioned, she can use the guides here and file a CR-1 for him fairly easily. They've been married for 2 years already. Casablanca is a difficult consulate, this is true, but they will and have issued CR-1 visas for valid relationships without much hardship. If anything, OP might need to find someone with better English skills to help her fill out the forms and better understand the process. It's nothing she should have to pay a lawyer for..

He won't get a tourist visa. No. Forget about even bothering to try. A CR-1 visa will take 6-9 months on average. It is in immigrant visa and your husband would receive a greencard upon entering the US. Or as someone else said, you could go to Morocco to visit him, it's cheap to fly there this time of year. But it doesn't matter what you tell the consulate, or how long you've been married, he won't be issued a visitor visa. They're not easy to get. Sorry.

I also have heard of a case being expedited where the beneficiary lived in a war zone. But yeah, those are the only cases I have heard being approved. Military deployment and the SO living in a war torn country. Even pregnancy can't expedite a petition.

I have to say, part of why I don't read or post in the K-1 and CR/IR-1 forums anymore is because there are far less questions relevant to filing, and far more posts that sound like "I mailed off my petition 4 days ago and haven't heard anything, is that normal?" And that irritates me. Americans are so damn impatient. I didn't even realize this until I spent time overseas. My husband was never concerned about waiting, because his country's government takes forever to do anything. They can't even get a government ID the same day it's applied for, and we complain about waiting an hour at the DMV.
I was of the attitude that I wasn't going to whine about waiting. You can do one of three things: 1. ###### and complain, 2. Wait patiently or 3. Get up off your butt and move to your SO's country while you wait. Complaining and calling every day aren't going to get you an approval any faster.

This process is a choice. Our government doesn't owe you a husband/wife. Immigration is not a right. Suck it up and wait your turn. We all had to do it. God forbid some of you get a NOID/NOIR and have to wait possibly years for a chance for rebuttal..

You don't have to be considered part of their household if you don't want to be but you must have domicile in the USA. If your only domicile in the USA is your parents' home, then you are part of the same household. If you can use a different address, then you file the I-864 and one parent also does the same. If the parents need to combine income or assets to qualify, the second parent files an I-864a. First you must be clear on whether you and your parents are part of the same household. Without that, no advice be be counted on. Circumstances control what is needed.


I'm confused about this.. I had the same situation as Tracy, and they required my mother to fill out an I 864, only my stepdad filed the I 864a, because I had no income for the previous year- Casablanca told my husband that my mother would be his primary sponsor (I guess for purposes of collecting, if need be). And they took the paperwork that way.. My mother and I had the same address.

Yes, she is living in Morocco with her husband. But she is petitioning for a visa DCF, which means that she and her husband intend upon going to the US to live, and if she lists her mother's home as her domicile in the US with her mother co sponsoring, then her mother would have to include them as part of the household. Therefore, she needs to file an I 864 along with Tracy, and her stepfather an I 864a. I went through the same thing- the consulate knew I was living in Morocco, but I shared an address with my mother in the States. I used the forms as I said above, and had no problems.

You and your mother would both file an I 864, if she is the main co sponsor, since you have no income. Your stepfather would file an I 864a, as he is the cosponsor's household member. And Tracy, be sure they BOTH send certified copies of their birth certificates, Casablanca requires one for the I 864a as well. :D

had my interview yesterday in casablanca consulat in morocco for a cr1 visa.after the CO asked me about 20 questions most of it it was about my wife. im sure 100%i replyed at all of it and all the answers its write
but at last she give me back my passport and a paper that the section 221 g its marked. the CO told me that my application it will send back to USCIS
SECTION 221 (g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the immigration and national act or regulation issued pursuant there to.
i think they refuse to give me the visa because my wife it dont work and her ex hasbend is the co-sponsor

Your wife will get a chance to appeal the decision. She will receive what's called a "notice of intent to revoke" in the mail. It could take months for her to receive it. If you are sure you were denied due to the co sponsor issue, then that situation needs to change when she presents her appeal. She must find a different co sponsor. It is possible and very likely that the appeal process for your CR1 could take a year, maybe longer. Be prepared for it to take a long time, and use the time wisely to make a stronger case for when your wife presents her evidence for the appeal. So sorry this happened to you. :( Best wishes,

Thank you that is good to know as I am looking to start everything as soon as possible....Is one week ample time to file with USCIS in the states or would I be looking at having to stay longer. I have bank accounts back in the states, drivers license, start a job again in May, but have never had a rent lease....Is it a good idea to have a Co-Sponsor and if so does that slow down the process..


Don't forget that you're going to want to have any documents that are in Spanish translated to English, including your marriage license and your baby's birth certificate.. Maybe call a certified translator in the States and find out how much it would cost and how long it takes. Give one or 2 days for the bank, get a letter from your job, etc.. You can certainly do it in a week's time.

No one has mentioned, in order to file DCF, most consulates require more than just proving you've been living overseas for 6+ months, they require that you actually establish legal residency in the foreign country and hold it for 6+ months. So unless you have a residency card for Uruguay, I don't think you can file DCF.

If you've been married over 3 years, IR-1 is the option you'll need.. I believe the processing takes just a bit longer.. but it's worth it :D

I believe it's been taking anywhere between 1 & 2 weeks for the approved cases to make their way to the NVC,,, then maybe another couple of days for them to send out the notice containing the NVC#. I would imagine you could be seeing a case number at any time now!! :yes:

Wahoo...! Called NVC today & operator verified my cases were there! :dance:
I didn't get a case# (didn't ask for one either...)but I presume maybe they haven't gotten that far yet. I believe the next step is for NVC to send my lawyer all necessary paperwork /request for payment(?) I feel good knowing I'm officially out of TSC/CSC and on to the next phase! Woot!!
