I am planning to do class action lawsuit against USCIS. Please leave your opinion

Personally. I would be concerned to go after a government agency with a lawsuit in a situation like this. For most, I believe the cases are maybe 1-2 months past the desired 5-month processing time. Is that enough elapsed time to file a suit...? ...I'm not sure but doesn't seem like it would be,,,especially since there's no uscis guarantee for any case to be completed within the 5-month target.
I would be afraid that if my name were on such a class action suit, they would just get peeved and somehow misplace my file! It could also potentially result in even further delays if suddenly they (uscis) had to engage in legal proceedings for all the cases listed on the suit. The link you have referenced also mentioned that even if you win your case,,,the anticipated time for them to complete processing & obtain approvals is 180 days! Man! What if legally the uscis could then re-start the clock over again with the dreaded 180 day time frame! Augh!
I don't know,,,, maybe it would have merit,,, but I'm a big chicken! bak bak! :D

I remember when I was a kid, I would see some cool item or toy in the comic books that you could order (rare stamps,,,scuba-steve,,,etc...)and they always say "please allow 6-8 weeks for shipping". And,,, CONGRATS to all who have been approved!! That is wonderful news!

I haven't really been pushing the inquiries out there too much... just 1 call to the uscis customer service dept about a month ago, and just this past week, legal council sent a letter of inquiry on my behalf. I'm anxiously waiting to see what kind of response I get from that (assuming maybe just a standard form letter...but ya never know!!). Well... good luck to all who still await the blessed news! I'm going to go outside and shovel snow out of my driveway for a while,,, maybe when I come back in & check the website I'll be approved along with a multitude of other patient folks! :whistle:

I really feel for you guys out there that's been trudging along longer than me! Man!
However, it has been encouraging over the past couple of days to see some approvals of those in the same general processing time frames.... God willing it won't be much longer!

Hi everyone,

I was reading the step by step checklist guide to making the I-129F packet and it said to send the completed packet to Texas in the U.S.A. On the actual form it says for certain areas to send it to certain states. So my question is do I follow what the form states and send it to where my state is located in or do I just follow the guide here and send it to Texas? Thanks.


Hi!

The new thing is to send your file to the Texas Lockbox facilities, in Lewisville (or Lewisburg, I can't remember, I'm new too and I'm the beneficiary). They made it this way to be more efficient and (possibly) faster. Once they receive it, they will sent it to the appropriate Service Center, according to where you live. They'll let you know when it leaves their offices through email or textmessage.

We got our textmessage yesterday !

Hello, I was wondering if anyone had experience or advice on the following:

My Australian (of Greek parents) boyfriend finally obtained his legal Greek residency after 4 years of living in Greece. During that time until now, I believe he would have been classified as an illegal alien, though he does have proof that he attempted to get started on his paperwork 2 months after arriving here. The police didn't seem concerned in the slightest with his status..

During the past 4 years he has also been working for family members' businesses "under the radar" and not paid taxes, though the wages have been low anyway.

What's the best way to go about filling out the location and employment history forms for his past 5 years? Should he honestly list having been in Greece for 4 years even if it wasn't legal until recently? Should he list employers if he didn't pay tax?--I mean, will they contact previous employers and can they get in trouble for employing people off the books? Also, will it come back to bite us in the butt when they look at his employment history but he says he has no tax forms for the past 4 years?

I'm so confused!

Finally, when I met Kosta I was traveling, and then opted to stay in Greece with him. Just these past few months I have overstayed my visa here, but it shouldn't be a problem for me leaving as I can go through Italy or another Schengen country. They have no proof I entered Greece because we flew in from Germany in December, and that's the last stamp on my passport. But, should I list that I've been living in Greece for the past year? Or list that I've been living in Maryland, and describe it as a "trip"?
We just recently set up a joint bank account here in Greece with both our names on it.. will the processors question that if I consider this to have just been a "trip" yet I have an established bank account here?

Any advice??

Spoke to USCIS and got a few different responses... basically one lady told me I needed to file I 824 (? I think) which is an adjustment of the petition after approval. But we have just filed.. so it seemed silly to have to wait until it's approved to change a minor thing like the address / consulate to interview at.

My Dad gave them a call and was told that all I have to do is send a "certified letter" to the Vermont filing center referencing my receipt number, and question 20, notifying them of the new mailing address and filing consulate.

Wonder which is real..
But no one said it would jeapordize his visa status at all, so that's good news. Just thought I'd update.

My Fiance and I are currently living in Greece, and had hoped to have the visa process completed by this fall, however due to the fee increases and the enormous influx of applications, I think it will take more like 6 or 8 months to receive the visa (if it's approved!). We don't want to live in Greece any longer , though we had listed Athens as his interview location on the I-129F petition.

We wanted to look into moving to Canada some time around October to work and wait out the rest of the visa process. How plausible is this? We wouldn't know for sure that we were moving for another month or so, and wouldn't really have a mailing address there until we/he actually moved.
Is it possible to change the consulate and country where the fiance is awaiting his interview? Does this slow the process or raise red flags in any way?

My fiance is Australian (greek australian) and has lived in greece for several years now, and doesn't want to stay and be conscripted into the army.
Has anyone got experience with this?

It's going to take about a year for them to review it. They might ask your wife to send in more information at that time. If they reaffirm it, you will get another interview. If you don't pass that interview, you're pretty much done.

Don't start a new petition- it's a waste of money, will take just as long as a review, and if you haven't fixed the issue that got you denied in the first place, you will be denied again.

This is going to take some time. It will take at least 45 days for USCIS to even get the petition back from Casablanca. There is no way to make it faster. Best idea now is to calm down, have your wife come visit you, and work on a defense for when your petition is reviewed.

By the way, you've been told this several times by various people. I know it sucks, but you have to think clearly through this and be patient. Good luck.

I was in a similar situation back in 2008 when I filed for K-1. Consulate in HCMC didn't believe we had a bona-fide relationship. Said they will return petition to USCIS after interview. HCMC consulate is one of the most difficult consulate for visa interview.

I immediately sent them a letter informing them my fiancee is pregnant with my child. Two weeks later, I received an email saying they will hold my petition and that I might want to conduct DNA test.

If you can give them more convincing evidence of relationship, there's a chance they might reconsider. It's worth a shot. Waiting for them to send it back to USCIS then rebut is going to cost you another year.

You can try to get you senator or congressman to intervene, but all you'll probably get is a letter telling you to co-operate with consulate.


Your situation involved a pregnant woman, and a different consulate. Casablanca has a record of not giving a #######, that's why I say- there's no keeping that petition at Casablanca. Even if it sits on a desk for weeks before being sent out, they won't touch it.

OP- The file will take several weeks to reach USCIS, then several months after that to be reviewed. If they need further information at that time, they will send you a letter asking you for it, and then you can send them a rebuttal.

Getting your congressman or senator's office involved prior to that might not be a bad idea. The consulate is much more likely to share information with their offices than with you.

Don't send anything certified express mail to the embassy. Huge waste of money, time and effort-it will likely be sent back to you. That's besides the fact the embassy doesn't handle visa cases in Morocco.

I did send 3 afidavits of my son, daughter, and my self. Also letters of my husband, his brother and best friend. I put this with the packet i sent with the I 130 as I said i front loaded this I 130.



It's great that you frontloaded the petition. It rather forces the CO to look at your evidence. Next best step is to prepare hubby thoroughly for the interview. He's already had one go round with them, which works to his advantage because he has a feel for what he's getting into and knows the gravity of the situation. Make sure he goes in there with the right attitude and a little bit more evidence for good measure, and God willing, you'll make out fine. Good luck.

Casablanca is going to want to know how you're gonna eat when you get to America. Her payments are for one person. The co sponsor might actually have to take care of you until you get a job, and it's not always easy to get a job. When you interview, make sure you have the right answers for any questions they will ask about it.

He was interviewed by 5 people total. 4 of them spoke English and French. Only 1 of them spoke some Arabic and Moroccon Arabic is different from Arabic and he could not translate very well for Cherkaoui. I will get the list from Cherkaoui. I think I will make 2 trips to Morocco and start the paperwork for marriage the first trip. And then go back again the second trip for marriage. That gives him time to learn English and more time for us to spend together to solidify our relationship. Cherkaoui is under the impression the paperwork is coming back to the US and they are going to reinterview me. He told me this information was given to him from someone that works in the consulate.


I don't believe starting the paperwork in one trip and finishing in another will work. The process to get married in Morocco takes 3-4 weeks on average. There are official documents you will need to get, and all official documents receive a stamp that expires in 90 days. The process involves a lot of travel, and waiting- the time frame can be unpredictable.

Your paperwork is coming back to the US, but will likely expire before being reviewed.

Here's the thing- Casablanca does not like K1's and on very few occasions do they get approved. They have a habit of denying these applications, I believe it is there way of "testing" the relationship. I've read that 75% of cases returned to USCIS from Casablanca do not refile. They don't expect to hear from you again- prove them wrong.

Is there any way your fiance could return to Italy, so that he might interview there? You may be able to circumvent getting married in Morocco if that is possible.

My finance's interview was Monday and the K1 Visa was denied. I was unable to attend the interview was obviously a huge mistake. The paperwork is still at the office in Casablanca. All paperwork was complete the reason was they don't believe legitimacey of the relationship even though we have 100's of pictures of us together. Does anybody know if they consular office would see me or talk to me or let me Fed ex all of the paperwork back to the USCIS if were to fly to Morocco next week? Has anybody ever tried to plead a case by showing up unexpectedly? I was told it could be 8 weeks till the paperwork returns to the USCIS.


I highly doubt the consulate would let you in. If you go, go during citizen service hours and ask to speak to Nahal Kazemi. They won't let you have your own paperwork, that's a certainty. They will tell you the papers are gone already, though you know they're probably sitting in an office in there. I believe they wait until they have a stack of denials to send off before they DHL them. Usually takes 6 weeks to 2 months for USCIS to receive them. And they will most likely let the case expire before it is reviewed.

A better plan for your trip to Morocco is to get married. Get fingerprinted for your police record now, and when it arrives, gather your stuff and head over there for a while. It takes a couple weeks to get married in Morocco.

Then file a CR-1. That's your best option right now.

Inky is right. An individual can adjust status from a visitor visa if they can prove that they didn't have immigrant intent when they entered on that visa. Your wife has already made her immigrant intent clear by having an I-130 filed on her behalf. There's really no way to erase that immigrant intent at this point, and to try to adjust her status now may result in deportation and a ban. Keep the ball rolling with the spousal visa. :thumbs:
