Just in case other ppl see this, there are some high fraud consulates where taking too much evidence can be looked upon as overcompensating. This has caused some problems with individuals on VJ that I am personally aware of. I doubt this would be the case with the OP's consulate, however.. :)

If you already know the date he's flying, he can go to the French Consulate and apply for one- considering the circumstances, and if he showed them his itinerary, they might grant it, but he should find out how long it would take.. We thought about this too, but didn't have enough time for the French to process an application..

I also didn't include this in our packet. Our lawyer didn't tell us to. When I asked my lawyer later, she said that she never includes these (and she has done many cases like this). If later, they ask for this letter, it won't slow down your process. I'd suggest listening to your lawyer, especially if they have experience with K-1 cases.

Your lawyer must have plans to get some more money out of you. I'd suggest listening to the government, who put specific instructions on the forms themselves. You really should read all the forms yourself and think twice about placing the future of your relationship in someone else's hands that may not have your best interests at heart. Especially if you don't really have to.

I hate to say it my friend, but you are out of luck. In order to get a fiance visa, you must have met the US Citizen petitioner within 2 years of her sending in the petition. This can be waived, but only if the US Citizen can prove that 1.) air travel is not possible due to extreme illness, or 2.) that the intended spouse's culture prohibits meeting before marriage. No other way to get it waived. Visitor visas are very rarely issued from Morocco for young, single males. The only people who easily get a visitor visa are the parents of Moroccans who are already living in the US. I have a good friend who has a steady, good paying job, $10,000 in his bank account, a car, and a house, and he has been denied a visitor visa twice. He's 24 years old, and they simply told him he is too young. Even if you were in a country that had a lower rate of fraud, getting a visitor visa when you have a significant other in the States is difficult, because you'd have to prove that you do not intent to immigrate.

Your girlfriend has to come to Morocco. There is no other way for you to join her in the States.

While your suggestion is good, you make it sound like it is that easy to get another job in this present economy. Of course the ultimate is to look for another job while this process is going on ...we just suggested an alternative way out in the worst case scenario. Some people chose to be with their spouses and "manage" together (if at all) than to be apart and live well. You don't want your petition to expire while holding it off looking for a job since there is no guarantee on how soon you would land one.


I just spent 6 months in Morocco, and within 2 weeks of my returning, I was working at 3 jobs, because that's what I have to do to make ends meet. It was no trouble at all for me to find work, because I'm not picky. They're not fancy jobs, but I make enough to feed my family and pay the bills. There is no excuse not to work.

There are entries on the I-129F and G-325A that require the alien fiancee's country.

Some fields are not big enough for Republic of Korea. Some fields are not big enough for South Korea! And some fields only ROK will fit.

Also, for nationality or citizen...should I write "South Korean"?

I'm concerned that having ROK/Republic of Korea and South Korea/South Korean on the same form will cause trouble, delays, or confusion. (This is the government we're talking about)

Should I write South Korea everywhere since that is what people think ???? is? :)

On the forms where typed words and phrases will not fit, the best bet is to leave the field blank, fill in the rest, print it out, and then write the info in the blank fields by hand. We had this issue with the long winded names of my husband and his parents. We just wrote it in neatly by hand, and had no difficulties during the process. Good luck!

As Ryan said, he can come in on the Visa Waiver Program, and you can marry here, then he can return to Switzerland and you can file for a CR-1. When he enters the US on the CR-1, he will be sent his greencard in the mail and can travel freely. However, he must maintain a residence in the US and pay taxes on his taxable income to maintain the greencard. Meaning, he'd have to spend more time in the US than out to keep it. Bear that in mind.

They really want to see your last year's tax return as proof of your yearly income. You may be able to swing it if you get a letter from your employer after a few months stating your monthly rate of pay, and that you are a permanent employee- however, this kind of issue tends to be very consulate specific, so you may want to ask in a thread specific to your SO's country :) Good luck!

Probably an odd question but I'll try anyway. I'm starting pharmacy school next year, and even though I'll work as an intern, I'll only make about 10-14 an hour and part-time so I will be way below the poverty line, lol. I don't want to ask my parents for help, so is there anything else I can do to get a sponsor with an adequate amount of income or will I just have to wait until I graduate from pharmacy school? Like is there an organization where you can "buy" sponsors or anything like that?


Oh dear. If you can afford to "buy" a sponsor, you'd be above the poverty line, trust me. Sponsoring an immigrant is a big obligation, basically saying you will be that person's back up source of support for the next 10 years or 40 quarters of work. If you're unwilling to ask your family to do it for you, you really should wait until you're in a financial situation where you can support yourself and your SO comfortably. Believe me, I support a family of 3 on my own working 2 jobs, it's not easy, and I'm just above the poverty guidelines. The kind of financial situation you'd be putting yourself in if you don't wait places a lot of stress on a relationship where there will already be considerable stress from your SO adjusting. Go easy on yourself and wait.

Hello All,

Filing the K1 visa petition- Employment ???

Back ground info,
52 yrs old, Moved to France 1992 until 2008. Moved back to USA 2008 to present -unemployed.
Have never asked for government assistance.
Have not filed taxes in USA since 1992.

Question: Concerning "employment" How best to fill in the forms? What to do for smooth processing?

Note, we are not destitute, have money in the bank, a sponsor if needed and employment lined up for next year.

You will need a co sponsor for sure. As far as the forms, just put that you are unemployed.. The issue of future employment can be addressed during the interview by your fiancee if they ask (provide her with proof of your future employment).. List any previous jobs that you held while in France on the forms where it asks about past employment, just like you would if they were jobs in America.. You can provide them with bank statements, but I doubt they will make up for lack of any tax returns. Get your co sponsor ready ;)

Even at the consular level, having a notarized, signed affidavit of parentage along with the birth certificate is not proof enough of a relationship for them. Trust me, I went through it. I lived with my fiance and our daughter since she was 3 months old, had all the legal documentation that she was his, and they still grilled him at interview. Because the bottom line is, fraudsters will do anything to get into America, including knocking a woman up. The burden of proof is still on you to provide proof of a real relationship- just as if your child didn't exist. Good luck..

How do you know when you get a touch??? :S

You can create an account on the USCIS web site. You enter in your case numbers,,, and there will be a column that reflects a "last activity" date. That date = last touched, and can be touched for a variety of reasons....most desirable of course is for approvals!

For those of you getting email alerts whenever a post in this thread, I can hear you know, "Damn that SqdnGuns, not again!!"

Well, my persistence paid off, I just got an email from the Director of the Texas Service Center, this is a reply to one that I sent to her 20 minutes before getting this reply.

Mr. Grant,

Thank you for your email. I had received one over the weekend from you and your case was approved this morning. You should be able to see it on the case status online tomorrow or Wednesday. I would have to agree with you that the process was temporarily broken, but we have taken steps to correct this and we will have all cases processed within the next weeks. Hopefully your future experiences with USCIS and with TSC will be more positive. My apologies for your wait, and I hope that your son recovers soon and fully.

I got this message from TSC today saying all applications will have a response within 2 weeks:

"Unfortunately, our office is closed today because of the ice/snow storm that has hit Texas, but I did not want you to wait to hear from me. The I-130s are the priority for the Texas Service Center and we will have an action taken on every petition within the next 2 weeks. On a separate note, we are working with our call centers to ensure a more accurate and consistent delivery of information so hopefully your experience will not be repeated."

Wow! That's a rather encouraging message compared to many I've seen here! I hope it has merit! :luv:
