I think I kinda have to agree with Joey on this. Vermont was processing those approvals sooooooo fast so the NOA1 date on all those approvals was after March 6. Now...they have to go back and re-process those cases since most of them will be re-called for the futher security checks. The reason CSC/Texas is still moving is because they are just now processing cases that have a NOA1 receipt BEFORE March 6.

I hope this makes sense......I am sure they will begin processing these cases soon but if you put things into perspective, Vermont folks are now in the same waiting timeline as CSC folks........which I think is only fair............(I am sorry...don't shoot me!!!!!!!) :blush:

Really though....one processing center should not be any faster than the next because there is not any equitibility in that..........

You are certainly entitled to your opinion. I do not think that you would have said that if your SC was Vermont. I sympathize with everyone on this journey. We need the support from everyone on this forum and not their animosity. We are not crabs in the barrell. Do not hope that someone else will not get their visa before you do. It is counterproductive. No matter when someone gets their visa; it is still entirely too long to be away from their loved one. I wouldnt wish that pain on anyone.

Call your service center and they will change your address and send you a confirmation that the address was changed. I did this for my fiance, but the information was not transferred to the NVC and the embassy abroad. You may want to confirm with them to during the whole process.

Oh no. I am not giving up. We have been together for 2 1/2 years. I just meant that I can't be the strong one in the relationship now. This all happened this morning. I spoke to my fiance last night and will wait until he gets off of work to tell him the bad news. I don't know if I can be the optimistic one now. Last year, he applied for a tourist visa and was denied. He has never met any of my family and only a few of my friends who came to Europe. Yet, I know his family and friends and have spent time with them in France and Belgium. He has no faith in our immigration process and hates going to the Paris embassy. He does not understand why it is so difficult to go to the US for legitimate reasons.


Ohhhh okay, good good! I misunderstood what you meant -- I'm glad you're not thinking of quitting. I can sympathize with how you're feeling -- my fiance' feels almost exactly the same way and is all but convinced that he may get turned away at the Naples consulate for being from Albania (even though he's in Italy legally). He applied for a tourist visa too and also got denied about a year and a half ago and it was a BAD experience (he applied in Florence -- everyone except the security guard acted like a complete a**hole -- his denial wasn't just "I'm sorry, we cannot grant you the visa" it was more like "Visa denied -- now get out of my sight and out of my consulate you filthy, un-American scum!" -- I went to the interview, so I heard it all and I wanted to punch someone for how they were acting towards him lol).

Question: is your fiance' a French citizen or is he a foreign citizen living in France legally the way mine is in Italy?

*sigh* good luck breaking the news to your fiance'! :( I know what you mean about having to be the optimistic, strong one regarding the visa and how difficult that can be sometimes when you feel like crappola.


We are in the same situation. My fiance has a European residency card, which gives him permission to live and work in France. He is originally from Togo. He never really thought seriously about becoming French until he met me and realized he couldn't visit me in the US. His tourist visa denial went similar to yours and they were not very customer service friendly to those seeking visas. I wasn't there, but he said no one talked and everyone looked petrified.

Anyway, I spoke to him last night and because I was calm, it calmed him down. So maybe I am still strong. :no: Well, I am off to my local CIS office to try to find out more. Thanks Karen_L

I spoke with USCIS Customer Service and they told me to go to my local office. I know that this is useless, but I made an INFOPASS appointment at my local CIS office for tomorrow to find out about my case. Since USCIS, NVC, and the embassy claim to not know anything about the return of my case, there is really nothing else I can do except wait. I will let you know what happens tomorrow. I can't do nothing, so I will do everything even if it is in vain.

After reading many posts about cases being sent back, I began to worry. I called NVC and they said my case had been sent to Paris on 4/21/06. I called the Paris embassy and was told that my case had been returned to NVC and that Packet 3 had not been sent out yet. She also told me that I am not unique, that all the cases sent to Paris at this time were being returned to NVC.

Now I am thinking what is going on at NVC. They didn't tell me any of this. I called the NVC again. She told me that she didn't know anything about my case being returned and that my case was not at NVC. She told me to send an email to nvcinquiry@state.gov. I received this response:

This is an automated reply. Please do not respond to this inquiry. We are currently processing inquiries in the order of receipt. Please allow 3-5 business days for a response.

No no no -- please don't let your resolve wear away because of this! You love your fiance' and he loves you and despite this EXTREMELY aggravating and terrible hang-up, you guys will be together (hopefully asap!) I've often felt the same way though and I think so have many others in here -- but just think: if you give up now, it's like saying "You're right, we don't deserve to be together." Just hang in there *hug* and things will work out (F)

Give it until maybe Monday and then try calling again -- maybe the embassy sent it back to the NVC but it hasn't arrived there yet.

I faxed the US Consulate in Paris to ask about my fiance's packet 3 and interview date. The embassy called my fiance. (Wow, didn't see that one coming). Told him to tell me not to worry that it had been sent. She asked him why didn't we file as a married couple directly with the embassy. She said that the process is quicker than a K1 and that we would have already been together. She said that only one person of the couple had to live in France.

I thought that both of us had to be living in France in order to use direct consular filing. When this whole IMBRA stuff happened, it didn't even occur to me to go get married in Paris and file DCF there. :yes:

Well, just spreading some knowledge. I will post this in the K-1 forum as well. I know that every consulate is different and even different people at the same consulate contradict each other. :thumbs:

We were denied a tourist visa in Feb 2005 (so he could meet my family too) and approved for a K-1 this year. If I remember correctly, they ask if you were denied entry. My fiance was never denied entry into the US at POE. We did however, put that he was denied a tourist visa.

I don't have too much to add beyond what has been stated above. You should get checked out and not worry about it. The US does allow refugees on class B1 and B2 visa waivers into the US. We screen them at the clinic that I work in for active disease.

If you have latent infection (positive ppd, negative chest x-ray), you are not infectious. You will neet preventative therapy of INH or Rifampin to prevent getting TB in the future. This is not a reason to deny your entry into the US.

If you have signs and symptoms of active TB disease, they may require you to complete therapy which is at least 6 months or more depending on where in the body TB is located and how sick you are.

I got an unusual RFE in the mail today. I filed the I-129F using the new form. Yet I got an RFE asking for the same information that persons using the old form were asked to submit. The questions were the new questions placed on the revised form relating to the IMBRA issue. I was under the impression that the new I-129F addressed the questions contained in the RFE sent to persons who had had used the old form. It seems like everyone now has to submit this form whether they use the new form or not.

I guess I should ask whether anyone else who submitted the new form received an RFE requesting the same info that persons using the old i-129F had to submit. If so, then what was the use of producing a revised form with the additional questions and then asking for them to be answered again?

You know you are right. We try to figure out what is going on at those service centers and look for any pattern, but there is none. I wonder if these people have any idea that thier actions, or lack thereof are affecting lives. People are waiting every day, chicking the web site like me, every day and someone is sitting with an application and taking no action on it. What is it going to take for them to realize that we want them to take action, to do what needs to be done. We are not asking for favors, we follow the rules, submit the application and all we ask is for someone to look at it and make a decision.

Got that infamous e mail today that said my the I-129F was approved on 08/21/2006. I can still hear my fiance screaming in my ear after calling her with the good news.I was willing to wait for a couple months (she was not) given all that was happening. But less than 2 months is a miracle. I sure do wish there was something I could say to the people who have been waiting for some time. My prayers are with you and I know that we will all feel that joy someday.Love is a beautiful thing and in the end USCIS will never take that joy away from you. I could tell you it seems so unfair for the people who file recently to get approvals before those who file a long time ago. Hang in there....this too shall pass!

Everything I've seen, take both. SHOW them the originals (they'll definitely want to see them), but if they ask to keep them give them copies.


That sounds like a good idea.

I would make several copies of all supporting evidence in case you misplace an original.

In addition to sending the original documents or certified copies of the documents to the NVC, the applicant and each accompanying family member must submit a photocopy of the original documents or certified copies of the documents.

But under Getting the applicant’s documents back, it says:

the I-130 and it was accepted March 18th

I have a concern with the I-485 petition of support.
I have read that they require three years of tax returns. At the present I only have two from the previous two years. My concern is missing the third.

I make a living from being an ebay powerseller. I have tons of paypal records (5 years worth), bank statements (5 years worth) etc... and earn more then enough money to qualify.

I wanted to know if anyone had advice or knew if this was enough or how tough they are.

As far as assets I do not own a home. The home idea was put off until my wife arrived and we made the decision together. We had planned to wait a couple of years before buying a home so that she had time to get use to being in the US and we can make a decision together as to where we would both be happy living.

I do have three cars. One is my wifes (in my name)that I had already bought for her. All cars are owned and two are high dollar cars and one is my work car (what I use to get my product to sell) that is only worth a few thousand.

I do not know if these assets will help or not but figured I would mention everything in hopes to find a way to make sure my I-485 is approved.

Any help is apreciated. I have been worrying about this for a while now

I received the RFE in the mail today. It is not good. They are asking for proof of legit marriage and it is the information I cannot provide since my wife has never been in the USA. They are asking for joint bank accounts, assets, or living together since marriage. It is impossible to get with someone who has never been in the USA and the thing is they stated in the letter I live in USA and she lives in Ukraine. Now I have no idea what to do.

I filed the i-130 and received my NOA1 on March 18th. While waiting for an approval like everyone else and thinking it would come any day I received a REQUEST FOR MORE EVIDENCE.

I originally sent marriage license, pictures, and many many chat sessions via Yahoo, along with notorized statements from friends and family.
My wife has never been to the USA and therefor I there is no way to have a joint living place, bank accounts and assets together. I sent all I could other then resending even more pictures.

I have no idea what else to give them and want to know if anyone has ideas.
My wife has a thing for everything being red or pink. When we were to get married I bought her a 3.5 ct engagement ring that had a 2 ct pink diamond center. I also bought her dream car (Audi TT)that is waiting here for her.
Also recently I bought a 2005 Jaguar (car) that was bought to be resold (I do resell cars on the side). The car was red and made my wife excited to see it (pictures). So I choose to keep it and give to her as a surprise also. I did the paperwork as a gift with the DMV and the car is titled in her name.

The reason I am mentioning all this is would this qualitfy as evidence? Would anyone buy such gifts for a fake marriage?
This is all I can think of sending them now.
Please do not take what I am writting in a wrong way. I am stuck right now not knowing what else to send and this is all I can think of at this point since I have sent everything else to them I could. I wanted to know if anyone thinks this will help or if anyone has advice who is in same position as me with their spouse never being in USA to aquire assets, bank accounts or living together.

Will this be an issue? Only difference is PO Box#.

USCIS website says "Important: Any Form I-130 filed at an incorrect location will be rejected."

wrong service center. I think your problem will come down to postal office worker as to weather or not
they see the USCIS on package and put into the right box. If put into right box I do not see any problems
for you.

I just wanted to update you-regarding our interview-where my fiance was accepted. They asked about communication with calls, etc. My fiance just explained that we do majority of our communication online. I know the person who was denied without phone records, but my guess is that they had another red flag and did not sound confident that they communicated often. When my fiance was asked, he started to show our Yahoo Messenger archives, he had printed out emails -I think 8 for every month for the last two years, all in order categorized by month/date. He explained that we do not talk by phone due to it being expensive but we communicate on a near-daily basis, and that is through emails, skype and yahoo messenger-I have archives and records of all of this-what month and year would you like to see first and through which communication system? He just showed that he was fully prepared-and the truth, and switched the phone calls to other forms of communication in two seconds-but had the evidence to back it up. She said-show me an email from May of this past year-he asked how many and she said just one, and from that she was satisfied.
I think being confident, and going in there ORGANIZED with evidence says a lot.
Hopefully you guys can do the same-just get ready to print a lot. Put it in a binder-with sticky tabs or some way of knowing each month etc.
When you have evidence and it is organized-I think it shows a lot-that the person is really taking all of this serious. I have often heard of people taking plastic bags of evidence in-that's great they have the evidence-but it doesn't show how important each piece is if you are putting it in a plastic shopping bag. Make it look good and like they care and and are taking this very serious.
With this and a quick detour from phone-to however you guys communicate, you should be fine.

You should be fine-as you are new to the VJ-start going through consulate reviews-there you will find what questions were asked. Often phone records are not even asked for. As long as you have evidence of other forms of communication-you should be fine-ie. emails, Instant messaging, skype, and the plain calling cards themselves. Our interview is on the 19th-in four days, and I am a PhD student, poor, and I just sent in some of my calling cards, I am not worried about that part because we have so much other evidence. I think you should be fine-just have explain the situation, and give as much evidence of communication in other forms that you can. I am sure you will be fine.

I would answer question 18 within the space allowed on the form. However, since this is Nigeria, your evolution of relationship letter is a good thing to include. You might have a less interested party give you some editing suggestions though. Three pages is a bit much. Keep it to a page if you can. That way, they'll actually read it.



Okay yes I am just freaking out, as I know they treat Africans worse than most other continents where people are from. Can I do a 1 pager, and then put a supplement to the supplement "Our Story"? I just want them to know how long we have been together and how our relationship is real. Or just cut it down to 1 page-it's okay be honest with me.

How long is too long for the explanation of meeting #18, I wrote mine and went from how we were introduced, to me moving to Nigeria for my PhD research, to our friendship becoming more, to meeting his parents, to the proposal. Is that too much-it is 3 pages too long??? Please help! Any input would be appreciated greatly!
