CanadaBringing a leased car from Canada to the US for a year?
QUOTE (zyggy @ Mar 24 2008, 11:37 AM) <{POST_SNAPBACK}>
Nope...

Importing a leased car from Canada into the US would break the terms of the lease. Sorry... they will not give you permission to do it. You're either going to have to get rid of the car by having someone take over the lease or basically smuggle it over, drive it with Canadian plates until your lease expires and then drive it back to Canada to turn it back in. But somehow, I think CBP is going to catch onto that plan and won't let you import the car. Try leasebusters.com to see what you can do...

You're going to have to take some kind of a hit on this... and there is no easy way out. My wife had a leased car and we had to pay someone a significant amount of cash to take over the lease.

Yeah, I didn't think it would be allowed but he wanted to make sure. He only has like 18 months left or something on the lease so he is going to see what kind of plan he can work out with the dealership to get out of the lease.

Thank you for your help smile.gif

CanadaBringing a leased car from Canada to the US for a year?
Hi everyone, my husband had posted this in another forum but I think fellow Canadians may be able to help answer this better than anyone else. I apologize now if this question has already been answered on a previous thread.

Hello all!!! I'm Laurent spouse of Amber-Lynn and I need your help. Many Thanks in advance.

Lease is due Sept. 09 I don't wanna buy it, I cant return it (too expensive) or cant sell it for that matter because buy back+(18 month @ 350) is to much!!!

So GMAC Canada tells me I can take the car to the USA only for 180 days but the car has to be back here for 1 month and so and so...

This is the answer from US CUSTOMS :

You may temporarily import the car; however, it cannot be reimported after the 1 year temporary import expires. Please se the following:

Question:
Temporarily importing a vehicle, car or engine into the U.S.

Answer:

Vehicles and engines imported into the U.S. temporarily may be eligible for an exemption from complying with Federal emission requirements. Generally vehicles are imported temporarily for the following purposes: for repair or alteration, display, testing, imported by a diplomat or foreign military member or nonresidents.

Generally, a Customs bond is posted for vehicles temporarily imported for repair or alterations, display, and testing purposes. The importer must file a temporary importation under bond (TIB)entry with CBP. A bond is usually required for vehicles that are shipped.

When a vehicle accompanies a traveler crossing the border a bond generally is not required. However, a CBP officer can require the importer to post a bond. You can obtain a Customs bond from a surety company. A list of sureties is available on the Treasury web site under publications, circular 570.

Generally, diplomats, foreign military, and nonresidents temporarily importing a vehicle through a land border do not have to file a Customs bond. However, a CBP officer has the authority to request a bond be filed.

Approval to temporarily import a vehicle is not required from EPA or DOT, however the forms 3520-1 and HS-7 should be filed and submitted to CBP. Ensure you check the appropriate box when filling out the 3520-1, and indicate the appropriate code for temporary imports in block 9 on the form HS-7. Vehicles or engines temporarily imported for the above purposes, must be exported or destroyed within 1 year. They can only remain in the U.S. if an entry is filed with U.S. Customs and Border Protection and duty is paid. These vehicles must conform to U.S. emission and safety standards to be cleared through CBP and to be registered in your state by the Department of Motor Vehicles.

The problem is, I will be a Permanent Resident. Anyone had to go through with this? any suggestions?

I'm waiting for a reply from CBP CUSTOMS web help and will let you guys know about it.

Thanks alot for reading.

Hi Parnita,

Not sure if this will help, but I am the sponsor and I will be bringing an updated I-864 as well as a copy of my W2 and tax return for 2007 to my husbands interview. Since the interview is occuring after April 15th tax deadline, I don't want to take the chance of them requesting this info and my husband not having it.

US Citizenship General DiscussionQuestion on INA329 (Naturalization for active members of the Armed Forces)
Link to INA329
Link to USCIS's explanation of "Naturalization through Qualifying Service during Periods of Hostilities"

Hello fellow VJers.
For as long as I remember I've always wanted to be a US Citizen and serve in the Air Force (preferably a pilot).
I married a US Citizen last year and this coming 11/25 I will be having my AOS interview and (hopefully) become a legal permanent resident. Or is it conditional LPR? I've been married less than 2 years so I think I will be assigned visa category CR-1... or is it IR-1? I don't know for sure. That is the one part I'm confused. But anyhow...

Godwilling, by the end of the year I will be in basic training and pursuing my dream.
My understanding of naturalization while being an active member is that you had to have serve AT LEAST 1 (one) year honorably before you send in your N-400 paperwork.

However, reading again this morning under USCIS's page (link provided above) it seems if you served just one day then you can apply. I was curious so I looked into the scope of INA329:

Sec. 329. [8 U.S.C. 1440]
(a) Any person who, while an alien or a noncitizen national of the United States, has served honorably as a member of the Selected Reserve of the Ready Reserve or in an active-duty status in the military, air, or naval forces of the United States [...] may be naturalized as provided in this section if (1) at the time of enlistment, reenlistment, extension of enlistment, or induction such person shall have been in the United States, the Canal Zone, America Samoa, or Swains Island, or on board a public vessel owned or operated by the United States for noncommercial service, whether or not he has been lawfully admitted to the United States for permanent residence, or (2) at any time subsequent to enlistment or induction such person shall have been lawfully admitted to the United States for permanent residence.

There are footnotes on that section of law but nothing regarding the 1 day/1 year or whether IR-1 or CR-1 makes any difference.
Two things that catch my attention:
"whether or not he has been lawfully admitted to the US for permanent residence, or at any time subsequent to enlistment [...] such person shall have been lawfully admitted to the US for permanent residence"

Has anybody looked into this?
Can I send in my naturalization papers the day after I enlist?
Will my "conditional" status make any difference?

US Embassy and Consulate Discussionplease how do i print out yahoo messanger chart log?

What you can do is print the page(s) that show all the chat dates you have and then print selected example conversations.

I have done all of this-it took me awhile, but I know how to do it to show the archives-of every chat, without printing out every chat-as that is what prints when you push print from the archives.

This is what I did-went to the archives, pushed print screen. For me it did not print the whole screen for some reason-if it does great-move the tab down to the next section to show the next part of the archive history and do each one-print screen (for my computer that is function insert).
What I had to do is print screen, then copy (control C) and then I went to Word and I pasted it there-it shows the whole screen-with your date and time, so it's rather hard to make that up-nor alter anything. Then I'd scroll down so it showed the new part of the archive history and do the same thing, over and over until I had every archived date of our chat logs.
Good luck.

US Embassy and Consulate DiscussionAn Encounter with Lagos Consulate and the Asian Lady
I am happy to hear you guys got an approval with the Asian lady!!! I feared so much of my fiance getting her, but the questions she asked were the standard-but you are lucky she didn't deny you due to the traditional marriage as that has been a trend lately not just for her. My fiance said after waiting in there for five hours (then getting approved with the white woman) that he heard her deny deny deny. I am starting to wonder about the theory behind it -sorry I am an academic. I wonder if she's really okay with denying-so they give most of the packets that have already been flagged as possible issues to her, then some that are "normal" like yours???
Glad to hear a success story though-for future people, it's not a death sentence if you get her. But I have found so much of the success really depends upon us in AMERICA doing a really really good job with our portion, then providing tons of info for communication to our fiances in Nigeria.
Best of luck for your future together!

US Embassy and Consulate DiscussionNOA2 Received... now what?
Finally, 6 days after being approved, I receive the hard copy of the NOA2 in the mail today. Can't begin to tell you how happy we both are. Of course this is just the beginning but at least we know the ball is rolling.

A few questions and some guidance needed from those who are ahead of me in this. Now that I have received the NOA2, what do I do? Do I stay put and wait for correspondence from NVC? In the Step-by-Step guide here in VJ.com, there is a list of things I need to do upon receipt of the NOA2. Do I have to do them now or once the application has reached the consulate, which in my case is Australia.

Second question, #2 in the guide talks about sending originals of documentary proof - I had sent copies of my passport, naturalization certificate, etc. Do I need to send those originals? Or is this referring to something specific?

The letter mentioned in #3 of the guide, I presume it would be the same as the statement of intent that I had submitted or somewhat different. Do we have any examples of them here?

Lastly, at what stage do I send the I-134 and the necessary documentation?

Any and all help you can offer me will be greatly appreciated.

Thanks to all in advance.

US Embassy and Consulate DiscussionDuring the Interview
Thanks! I appreciate you all giving me your input and advice. I dont foresee any such issues, but it is better to be prepared, I suppose. I guess my main concern is flat out denial based on something small, but I gather from what everyone has said, that may only be due to the presumption of a fraud, which is the least of my worries.

Thanks again everyone.

US Embassy and Consulate DiscussionDuring the Interview
My fiancee and I are pretty much up to date as far as the paperwork needed for the interview goes. We have yet to submit the checklist, pending arrival of police and medical reports.

The question I have, especially if anyone has experienced something like this is that when you go for the interview, what if there is something missing or out of order or maybe they need additional information/documentation. What do they do in that case? Do they give you time to sort out the issue and come back for an interview another day?

I guess what I am asking is that in the case of filing the petition, they would issue an RFE - what is the equivalent during an interview? Or does no such thing exist?

Has anyone gone through this experience or have any knowledge about this?

Thanks in advance.

Asia: SouthIndia birth certificate questions
If you can't obtain another birth certificate from the registrar's office of the place your fiancee birth was recorded at, then you need to get a 'non-availability of birth certificate' from that office, and also need to get affidavits from parents, and other family members.

QUOTE (ms_jinga_lala @ Mar 4 2009, 07:55 AM) <{POST_SNAPBACK}>
Okay, here's the problem. My fiance was born on August 6th but when his grandfather filled out his 10th certificated he put the 16th so now since that is what has been used for everything all my fiancee's records say he was born August 16th. My fiancee doesn't have a birth certificate and I've searched on here and couldn't find anything about alternatives. What qualifies as a legitimate birth record when applying for a K-1 in regards to India? Can he use his 10th certificate? Do we need to try to obtain a birth certificate (which from what I am finding are still hand written so I'm not sure how much weight that is going to carry)? Or is there something else we need to do to prepare for when these documents are needed?

Thank you for your help!

K-3 Spouse Visa Process & ProceduresPassport vs Citizenship Certificate
Hello All
I thought this would be an appropriate place to post rather than in the AOS section since more people deal with the I-130 app here (I think). So Erin (the USC) was born in Canada and never had a consular report of birth or a citizenship certificate. Rather, she applied for a US passport and was issued one based on birth to her USC mother abroad. So I am curious has anyone else dealt with this when filing an I-130? I am asking since on the I-130 application it specifically asks if she has been issued a citizenship certificate based on birth to a USC parent. I was wondering fi this might be an issue since citizenship certificates are issued by USCIS but Passports are issued by the state department, and perhaps there is little/no communication between the two when it comes to things like immigration benefits??? The instructions for I-130 say that a copy of the passport is evidence of citizenship for the petitioner, but I am worried that USCIS may still insist she get a citizenship certificate first (which can take ages to process apparently)

Anyway maybe I am woryying about nothing, but any help will be greatly appreciated
Thanks
Muraari

Africa: Sub-SaharanBlood Diamonds
I chose not to have diamonds. When I was in college, a classmate of mine maxed out her credit cards to get her family out of Sierra Leone to London. Her grandmother's throat was cut and she could not find alot of her male family members. I kept wondering why this wasn't on the news. (another commentary for another day on poor American news) Ever since then, I said I would not have a diamond. Even if a jeweler says that they are non conflict diamonds, the borders in Africa are easily crossed. So can it truly be a non-conflict diamond. I understand that the conflict is over, but I realized I can't do it. I have a citrine stone engagement ring. (yellow color)

K-3 Spouse Visa Process & ProceduresMoving to US n applying for K-3 ??
Salut Groomit,
Bienvenue a VJ! I am new in this forum too. My fiance lives in France and we are applying for a K-1 Visa. I am sure how you should proceed, but I am sure that some of the veteran VJers can answer your questions better. I do know that if you do the K-3, you would have to go back to France to get it. We didn't have any luck with the B-2 tourist visa for my fiance. It took him 3 months to just get an interview at the Paris embassy, only to be denied the tourist visa. I would spend 3 months in France and return to the US and go back. Not the ideal.

Anyway, Bon Chance!
