The LPR needs to file AR-11 Change of Address. If your spouse is your sponsor, then the spouse needs to also file I-865 and mail it in (no online option).
This is all you need to do until you have to submit your I-751 for removal of conditions.

I believe sending tax-transcripts are better, and here is why I think they are better than sending a copy of your tax-return: tax-transcripts comes directly from the IRS and hence it is a proof that you actually filed your tax-return....tax-returns are filled out by you(or your accountant) and USCIS assumes that you actually filed your return. But in reality I think they accept both.

Hi Everyone,

My GC will expire on April 02, 2011 and I'm starting to gather evidences for my ROC but I have some few questions that I wanted to know before sending it.

1. I'll be filing on Jan 02, 2011 but the Form I-751 available on the website expires on Dec. 2010.
Can I still use this form as I'll be sending my application at the 30th of Dec.?

2. Should my husband and I sign on the Form I-751 dated on Jan. 02 or is it okay to sign it the date we sent it?

3. Do I need to send a copy of my passport?

4. When I send a copy of our debit cards, do we need to send the back copy as well?

1. Keep checking USCIS website and see if they have new forms before you send it in. I wouldn't take any chances by sending in expired documents, and risk having them sent back to re-do

2. Put the date that you will be filing it on

3. Copy of your passport is not listed as a requirement, but if you feel you need to show immigration stamps from any overseas vacation you have taken together, then go ahead.

4. I think sending in copy that shows the account numbers should suffice.

Hello All
I am worrying about this very far ahead of time but I think its only wise as it could affect our plans in a big way. So I am on an H1-B visa, my fiancee (the USC) and I are getting married in June and then moving to Baltimore where we plan to apply for AOS for my green card. So now based on what I can tell assuming things go well, we can hope to have the green card sometime by June of next year (at the earliest at least).

Now my question is the following. MY fiancee (then wife) will continue to work in Baltimore, and it may turn out that I have to move to either New York or Boston to go to school. If this is the case then the removing of conditions two years after the green card will happen right as we are about to end our period of living apart. How problematic will this be? Some thing that will be true in our situation: plenty of Amtrak tickets for visits, there will probably be a student loan account for me on which she is the co-signor, and we might be able to get affidavits from friends relatives etc.

How bad is our case going to look when it comes time ot removing conditions i..e that we had been livingapart for the entire two years after getting my green card?

I'm asking this right now, as if this is going to be a huge issue I'd be tempted to try to get my green card through employment instead even though it is more expensive. I think I might qualify for the EB1 category, and I dont know if there is much to lose besides the effort and cost.

The form AR-11 does not change address on a pending application. The AR-11 must be mailed to the address, which is written on that form and that changes the Alien address on DHS/USCIS's database. Form AR-11 can not be submitted online.

For your pending application, you can either change your address online with USCIS or call USCIS 800 number and they will change it.

Hi All
I am putting my I-751 together to be mailed out soon (on the 22nd which is 90 days before my GC expires) and I had a couple of questions.

-I am planning a trip out of the country starting December 27th. I know there is always a chance something might go wrong, but is it reasonably safe to expect that I will have my NOA before then extending the GC validity so I can travel?

-I am mailing my letter to VSC (I live in Boston). Now, I will be moving out of Boston to New York in May. I have heard many stories where applications have been derailed due to a change of address midway. Should I be safe and just use a friends's address as a mailing address in Boston? Or am I overcomplicating issues?

Hi All
I just filed my I-751 with VSC. I have a ton of travel coming up in the next 2 months or so, including a month long trip overseas starting end of December. If it turns out that my biometrics date happens to fall on one of my travel dates, is that a valid reason to go to the center early and try and get them to see me for biometrics even though my scheduled appointment is for a later date?

And on that note, has anyone tried to do early biometrics in Boston? If so any suggestions/advance?

That's kind of eerily familiar becasue I did my AOS in Baltimore, MD but had moved from Seattle, WA so for a while the Baltimore office thought I was supposed to have done my biometrics in Seattle and couldn't find my biometrics and medical exam results when I went in for my interview. So anyway odd.

Any chance you can schedule an infopass appopintment in Baltimore and see if they can sort out the situation for you?

There is really nothing complicated about my case. However, my husband is in the military and received orders to Germany in 2006. In 2007 I filed my I-751. My timeline explains some of the stages I have been dealing with.

In August 2009 we returned to the USA. My husband was assigned to Walter Reed Army Medical Center where we are currently stationed. I successfully reopened my case but here is the dilemma that USCIS put me in as of today:

My mother-in-law (who resides in Washington State) received a letter from USCIS for an interview appointment regarding my case. For some reason, her address is still on file with them even though I put in a change of address in August 2009 and even confirmed my new address with a USCIS representative when I called them in October 2009.

My Interview was scheduled for Nov 24, 2009 at 10:00 am in SEATTLE, WA.

I live in Maryland and my Field Office is Baltimore.

I just sent an email explaining my case to the following email address: scopsscata@dhs.gov

Question No.1: Was anyone ever scheduled for an interview in a Field Office that was not his/her home field office (AOS/I-751 anyone?)?
Question No.2: Has anyone ever used the previously mentioned email address to contact USCIS?

Thank you very much for posting this. My fiancee and I are going to apply fgor AOS for me as soon as we get married in a month. However, we know we will have to live apart for a year to possible two years, and were worried about how this will look when it comes time to lifting conditions. So this is fantastic info. Thank you. hi everyone,

my message is for everyone who are in the same situation as mine where husband and wife live apart due to work/school etc. i applied I-751 in august 2006, got interviewed in april 2007 and just received my 10 year permanant residency card in may 2007. on a different note, the NSC is a bit slower in processing than other centers. anyway, the bottom line is "DONT WORRY" that u are living apart. if ur case is genuine it will get approved. me and my wife are living apart for the past 3.5 years. in fact, i got my initial AOS approved for conditional residency in 2004 while we are still staying apart.

what we dont have
we DON'T have joint house leases/mortgages, no joint bank accounts, no joint vehicle related stuff, no joint health insurances, no joint credit cards etc..

what we submitted
travel/vacation itineraries, phone records, some photos, joint retirement plan, employer/school official letters stating our current employment positions, joint TAX returns (very important). thats it.

interview
both husband and wife must attend. took 15 minutes. took some notarized affidavits from family and friends. the officer was very nice. explained our situation. she took a note of it. no hard questions. be honest and be urself. u dont have to pretend. the officers understand that life doesn't always follow as per the USCIS guidelines. at the end of the interview, she did not tell us whether it is approved or not. however, i did a walk-in biometrics the same day. she said that i will receive the decision by mail and eventually my case was approved and got my GC.

I might be getting a bit worried too early, but I have received my NOA1 but not my biometrics notice. I am worried that the longer it takes, the later my appaointment will be. This is a problem since I am effectively going to be out of the country from December 26th onward for more than a month. If it still does not show up in the next day or two, is there anything I can do (perhaps an Infopass etc?) Thanks!

I never knew when they cashed it because I did not track the check to see if it was cashed. But it should take a week or no more than 10 days. I've sent it on 20 and I got the NOA1 on 30. Did you track the package or did you get a receipt that the package was received by USCIS? I've used the online tracking just to make sure it made it safe.

I just want to seriously thank VisaJourney. My immigration journey has finally ended. Our I-751 was approved on 8/4/2009. We applied in April and we did not have an interview. I followed all the guides in VisaJourney from the K-1, to AOS, to Lifting Conditions and we have our 10 year green card. This website has been so helpful and it saved me the cost of hiring a lawyer. What if they file on December 15 and it is lost in transit? Can good cause be proven or do you have to refile? Will a postmark be acceptable and of course the cancelled checks? Apparently there is no kindhearted soul from DHS who is going to call and say you can file now your 90 days starts today.

I am dreading the process of filing to remove conditions simply because there seems to be a strict requirement it be initiated exactly 90 days before the expiration of the temporary green card.

Does USCIS adhere strictly to the rule or is there some leeway?

Maybe if I start now I will have everything ready by March of 2008. :wacko:

Some people are good with forms but I tend to get stressed and try to make the documents letter perfect which takes more time. When I filed AOS I completed all the forms by hand (no typing or carbon copies).

It sounds like the lifting of conditions requires less in legal documents but more in actual proof of a legitimate marriage. Except for the USCIS form and biometrics, I do not see that evidence is required such as proof of birth, passport, divorce decree etc. The real work now is gathering the evidence to establish a lasting marriage. I have plenty of time to get it together.
