My RFE was more of a harrassment as the attorney would say.

When I sent in my I-130 I sent copy of marriage license, pictures, emails, chat sessions, trip receipts and notorized statments from friends and family members. My wife has never been in the USA.

I received an RFE letter stating I lived in USA and wife lived in Ukraine (so they knew she was not in USA) and asked for proof of living together, property ownership, joint bank accounts etc...
Pretty much things impossible to give when person is not in USA.

I called an attorney. Attorney told me to send back the BLUE RFE paper and not to send back white paper with requirments being asked to be fullfilled. I was told to still write answers on paper but only send answers.
The attorney then told me to send every picture possible. Every email possible, and every chat session (5 years worth almost daily). I sent in every airline ticket from the two of us. Passport stamps, post office receipts for gifts I mailed. Moneygram receipts for money transfers. I sent in photocopy of my wifes engagment ring certificate and picture of her wearing. I bought wife car already and had it put in her name with receipt it was gift for me.
Long story short I sent a box of paperwork as attorney told me to do. He pretty much said send in so much they will regret they asked. Well after over $200 in printer ink and 3 packs of paper I sent everything in. Guess it worked. :thumbs:

It was crazy really. My wife has never been in the USA. we sent all evidence we could but I was asked to send in more information concerning owning property together, bank accounts etc... It was all information that can not be provided since she has never been here. I contacted an attorney and he told me to send them everything I had. Every email, every picture. Every chat session etc... He told me to send them a box if I could and that is what I did.
In the event they do not accept it the attorney told me to call him back.
But this is where I am right now.

I will. I received email alert letting me know. Once paper comes in I will post what they are asking for but it has me worried because I do not know what else I could send. We also had notorized witness statements with the I-130 (family and friends). I have feeling they will be asking for something impossible to give.

Cannot see possibly what they want since so much was sent with the I-130.

My wife has never been in USA so there is no property bank accounts etc that can be given. I did send tons of pictures, emails, yahoo chat sessions, evidence of trips etc....

Have no idea what else they could want and to wait this long to ask for more evidence.

I guess I fit this crowd. I received my NOA1 March 18th. No word yet so i am waiting patiently like the rest of you. I have seen many though who filed I-129 get fast approvals. While I am happy for them I do not see the logic in making married couples wait longer. I think it should be the other way around. Oh Well. Hopefully everyone will soon get their NOA2

This is a problem my wife and I have also run into.

Everything is in her maiden name. We both wanted it to be her married name.

Our problem tarted in Ukraine. Ukraine would not recognize a Jamacian Marriage license to change her name before filing on her passport.
We went through alot to get this done with no luck.

Now as far as her arriving in the US we thought we would try then to have her name changed. We were advised then this could create problems if she every went home to visit family etc.. and returning back to the USA. Now I am not sure for fact if it is true or not and we will be looking further into the matter, but it was explained to us by immigration attorney (we all know how that work out) that she could be denied rentry if names are not matching on passport and greencard. Like I said I waned to confirm this.
At the moment we have been left with belief she may have her maiden name until becoming a US citizen.

I am also curious as to what is true or not in this situation because we would like to have the last name changed but not at the expense of her not being able to leave the country.

The tables listed on I-864P, are they the actual poverty levels, and you must make 125% more than those poverty levels? or is the number listed on I-864P the magic number you must at least make anually corresponding to the number of "household size" as what you currently have plus what you will be sponsoring?


The number showing is what you must be able to prove you make.

OK quick question for anyone who may know the answer.

If I use my next tax return and avoid deductions to meet requirements. Since I want to do this fast as soon as new year hits meaning I will send in photocopies instead of transcripts to keep from the additional wait and send in my bank statements (3 years worth) as well as (I am ebay power seller for living) all my paypal statements (3 years worth) does anyone see this as a problem or a potential RFE?

I am trying to avoid any more hassels.

I am self employed too, satelite contractor. i too use turbotax to do my taxes each year, so i understand what your going through.

You will use your AGI ajusted gross income. it should be listed on the summary sheet on turbo tax (the first page that prints)

as for the credits i know how easy it is to keep digging and diggin till you owe nothing! but this does not help your situation. i planned 2 years in advance prior to my fiancee coming to usa,. i basically made my AGI what i needed it to be and what the goverment required it to be. sure i paid a few dollars in.

I dont know if maybe you can ammend your taxes, or maybe you should postpone till feb of next year. then plan accordingly!

I have a feeling that is what I am going to have to do. Wait it out until next tax return and pay some bucks by holding back on deductions.
Were you able to send in one return? Would the ask for more because I will only have the one.
I heard ammending a tax return can be more of a nightmare with IRS then it is worth and possible audit.

I can only speak for my tax return but I see the key line of the tax return looked at is line 22.

The first part of my tax returns are all 0

Nothing is filed out until schedule C for business and loss. There my gross is very high. But on line 31 nothing is left after deductions. Because of this Line 22 above is 0.

From what I have seen they are using NET income for Self Employed people. This is where the problem is coming in because of business deductions.
I have seen forums where people were declined because of the NET income when gross was more then sufficient.
I actually saw a forum where a person was going to send in fake returns in order to get approved because they were that desperate. This is reason I think proper information should be given so people are not going to extremes.

I am self employed and have a difficult time finding proper information concerning filing the I-864.
Even on this forum I have seen many different things concerning self employed people.

I am hoping those who were self employed and have gone through the process can help others.

Currently I am concerned about the I-864 and getting straight answers for a self employed person is not easy.

I more then make enough money to sponsor however tax returns say a different thing due to business deductions.

My gross income is more then sufficient. But net income is pretty much at zero.
I am honest on my taxes however over the past few years alot more credit has been given.
For example I received $0.78 a mile driving credit.
In 2008 I got $22,000 credit for driving and in 2009 $20,000.

However I spent no where near that much on driving. Those credits alone would have qualified me for the I-864 but are
now showing as a lose.

I know many other self employed people are in same situation as I am. I have seen it over and over while doing a google search on forums.

I wanted to know if anyone who is self employed can help out who has been through it.

I file my taxes with turbotax. I do have copies in my computer. Are these good enough to send in?
Also has anyone received a RFE if sending in returns not coming from the IRS?
How did you handle the business expenses bringing you under the 125% poverty limit etc...

I have not seen really any direct answers anywhere for those who are self employed and maybe a thread can finally put together to help the many like myself get around the self employed ordeal.

My situation was similar to yous in a way.
My wife and I were married for over 2 years before filing the I-130. We did receive and RFE asking why we took so long to file.
Just like your situation my wife wanted to finish what she started with her education. I was also self employed and operted completely under a corporation. My taxes and everything was under the corp so I had no income under myself for I-864.

Our delay was based on her finishing school and me disolving my corp to file taxes under my own name.
When we sent this information in we were approved a week later.

My wife had her interview today and was approved. Big relief to finally have this process over with. We are an IR1 case so she will have the 10 year green card. Big big weight lifted from us. It is now finally time we can live our lives.

I know some will say to update my timeline. I decided not to since we delayed the process ourselves (wife was finishing her education etc...) for this reason I do not want to give people a false sense of a timeline.

In short there is nothing you can do. Without your husband you are no different then any other Ukrainian trying to come to the US who has no relatives in the US.
However it is troubling that you still wish to come to the US even though your marriage seems to be over. This may also explain why the marriage is ending. You appear to be more concerned with coming to the US then your marriage and your spouse has sensed this and probably why he no longer wishes to bring you over.

I actually have a problem with this.

First I do not support anyone beating their wives. I do not want I am writting to make others think that.
What I am having a problem with is why would she want to stay?

I have seen many cases of fake abuse claimed in order to get a green card. My problem is she wants to stay. If she has an abusive husband then she should leave and go home.If he truly is abusive does she think moving to a new address here would make it stop? If he was this person she is claiming then he may even be more angry thinking she used him for a green card. I think that would put her in more danger.
When someone is so determined to stay and who has not been here long enough to build a life it seems fishy to me and I have seen several USC get screwed over by fake alligations of abuse because someone used them to get a green card.

If she is truly being abused it is obvious she needs to get away. But what is the desperation to stay? That part makes me think she married to get a green card to begin with.

This is an update to my wifes case for not receiving her green card.
First I will say yesturday her green card arrived in the mail. This was not the original green card. We also did not pay $450 for it.


Well to keep a long story short and not to recap what has already been written I refused to pay $450 for something that was not our fault.

We did visit local USCIS office and also got nowhere.

We had enough proof to show USCIS never mailed out my wifes green card.

Tracking information showed it was never mailed. We obtained a letter from our local post office that they never received it.
What was also interesting about our case was USCIS automated messages for my wifes case and how they changed.

For months after her arrival the automated message stated they mailed a 797 to us on September 28 (which we received)

In November after complaints of not receiving a green card that message was updated to green card mailed September 28.

After tracking number was give message was updated to Postal Service picked up green card from USCIS for delivery on September 28.

After complaining tracking number showed it was never shipped message was updated to USPS was reporting it was picked up for shipment on Sepetember 28.

The September 28 date was also interesting since tracking showed label was not even generated until September 29th.

So after all failed attempts to talk to USCIS we decided to go to our local Senator.

We mailed all information out to the Senator. 2 days later we received letter from Senator saying they already contacted USCIS and asked them to resolve this matter ASAP. Senator would also send us notice once they heard back from USCIS.

4 Days later we received another letter from Senator saying USCIS will be issuing another green card within the next 30 days.

Called USCIS number right away to hear if automated message was updated. It was. New message was green card will be issued within next 30 days.

3 days later after receiving letter from Senator with the good news a green card finally showed up in our mail box. Printed 3/26/2012

They DO have tracking number for mails with card enclosed and signature request for important documents like GC, passport. They just don't provide it until you inquire about it. I believe it was USPS mistake, they are well-known for their underachieved tracking system as well as service. USCIS doesn't have to lie to you about mailing a document, they did mail it but USPS failed to scan it and the mail lost somewhere (USPS picks up thousands of mails everyday from government offices. And it is bad luck happening to you.) It happened to me once so I know (when I mailed important payment to someone, and it never got scanned... And the package showed up month and a half later...)

I suggest you call mail inspector and provide the tracking number. The longer you argue with USCIS for a mistake no one at fault, the longer you wait for the card. You can pay a small money to get over with it, it is difficult but worth it.


This is not a situation with it being lost in the mail. From research this is a common problem with USCIS and green cards. A simple search on google for "green card never received in mail" shows many going through the same thing I am. While I know the USPS is not best I find it hard to believe they just lose greencards.
I am an ebay power seller for a living. I mail out 1000's of packages through USPS a year. I have been doing it for over 6 years now. To this day not one package has ever been lost. Some have taken longer then expected to arrive and yes they do not always scan the packages for tracking until delivery. However they all showed up. Taking that into consideration as well as the many many many others I have seen going through the same problem of receiving every other letter in the mail USCIS has sent BUT the actual green card. Well I at that point have to say USCIS is not being honest about mailing all of them out.

Some I read managed to get theirs. After alot of pushing USCIS finally told them it was an issue with production of cards. These were also people who were told once upon a time it was mailed then later it was not.

I apreciate your reply but this is not just a case of bad luck for me and my wife's card was lost in the mail. This is a case of it never being mailed and I would like to know what to do to get USCIS to finally see that.

My wife arrived to the US on September 14th 2011. After some time of her not receiving her green card we called USCIS who told us the green card was mailed September 28th 2011.
After more time and not receiving the greencard we were told it was probably lost in the mail. USCIS had not received it back that we would then have to file an I-90.
I filed the I-90. I saw a fee of $450 which I did not pay. There was a section of I-90 which stated if not received I would not have to pay.
I-90 was filed back in December. Today we received a response saying the I-90 was denied and we would have to pay the fees (That I already paid) to get a green card. In the letter they stated the reason for denial was that the tracking information showed the green card was never returned back to USCIS.
Needless to say this was frustrating to hear. However the tracking number was given in the letter. (something we were never made aware of before).

I looked up the tracking number and low and behold the green card was never mailed. USPS states they were electronically notified of mailing but have not yet received the item.

Looking around I have found this is a common problem with people getting green cards. Being lied to about green card being mailed and forcing people to pay outrageous amounts of money to get it.
I am refusing to pay again for something I already paid for. I have proof now as well I should not pay since GC was never mailed. No one else I have seen had a tracking number.
Does anyone else know how to handle this and get the green card? I know I have information that can get one without paying but I am sure there is a right way or wrong way to go about it.

Finally, today, 8th of June, our K1 visa got approved. It has been a joyous time since I heard the news especially since it coincided exactly with my birthday - what a lovely gift.

Then interview process took a few moments though the entire time spent was a little bit more but worth it.

Just received a letter from NVC dated March 29 stating that my approved I-129F petition has been received and that within a week, it shall be forwarded to the consulate in Australia.

I am so glad and was so excited that I had to wake my fiancee up in the late hour of night and tell her the news. This is great and I hope that all those following the same time frame as I am are getting their letters too.

Finally, 6 days after being approved, I receive the hard copy of the NOA2 in the mail today. Can't begin to tell you how happy we both are. Of course this is just the beginning but at least we know the ball is rolling.

A few questions and some guidance needed from those who are ahead of me in this. Now that I have received the NOA2, what do I do? Do I stay put and wait for correspondence from NVC? In the Step-by-Step guide here in VJ.com, there is a list of things I need to do upon receipt of the NOA2. Do I have to do them now or once the application has reached the consulate, which in my case is Australia.

Second question, #2 in the guide talks about sending originals of documentary proof - I had sent copies of my passport, naturalization certificate, etc. Do I need to send those originals? Or is this referring to something specific?

The letter mentioned in #3 of the guide, I presume it would be the same as the statement of intent that I had submitted or somewhat different. Do we have any examples of them here?

Lastly, at what stage do I send the I-134 and the necessary documentation?

Any and all help you can offer me will be greatly appreciated.

I am due to marry my fiancee in the Philippines in December and I am now going through and gathering the church requirements. I just got my new baptismal certificate and my fiancee says that it needs to read :ready for marriage". I asked the church where I was baptized at and they said they don't know about that and that this will fill the requirements. My fiancee stated that the "ready for marriage notation is required or the church will not marry us. Can anyone tell me if what my fiancee says is true? Or do I just need my new baptismal certificate among the other things?

Hello, I am currently in the Philippines and will be getting married in 2 weeks. I will be using the spouse visa to bring my wife over to the US. We both want to start a family right away and are trying right now. I have a couple of questions.

What would the citizenship status of my child be if he/she were born in the phils? American? Filipino or dual?

If my wife were to become pregnant right away can I still file the spouse visa or would I have to wait until after she gives birth?

Would she be allowed to emigrate to the US if she were pregnant?
