- you might want to try getting in touch with your congressman as well. The guy I talked to on Friday said he had a similar problem. USCIS wasn't responding to his phone calls and his application seemed to be lost with no news from USCIS and no action or "touches". Might be worth a shot??


Yeah I think it might be worth a shot. Your news is very encouraging. I didn't want to say anything before you had come to a decision on what route you were going to take on this but I am so glad that you didn't resubmit with the new fee.

I believe that we are all thorough and abide by strict instructions when we fill out these forms, usually to avoid the prospect of RFE's and the time delay that will ensue, but by the same token, we have to fight any inconsistency in their handling of our cases.

I feel the same way as you, that this is not about money...obviously, we both chose to submit close to the fee schedule increase deadline and I will admit that the fee increase was a factor for my fiance and I in terms of getting our act together and submitting the petition at the time we did. But knowing that both of our applications were submitted within the rules laid out by USCIS I really feel that we have much more to lose by resubmitting. Hopefully, if your case gets resolved as it should, your NOA1 should state the correct receipt date and your application will be queued with the rest of the July filers.

I am not dreading having to pay more, I want to be with my fiance whatever the cost, but I am dreading being put behind 3 months on an already lengthy process.

Good luck and thank you for being patient and disputing this decision. Your actions and the information you can provide as a result will be of benefit to many of us. biggrin.gif

This does help. A lot. It means that they are not dealing with applications consistently and gives hope for those wanting to appeal. It helps to know that people working on a similar timeframe are being processed correctly according to the USCIS notes on the fee schedule deadline.

As for your application being rejected; you met the conditions (postmarked application before 30th July) so there is nothing to worry about. Your application was dealt with properly.

It would be good if anyone who mailed their application close to the new fee schedule (late July) could respond with dates and details of the service center involved, whether they received NOA1's, had checks cashed, had applications returned due to the fee schedule increase already or are still awaiting any kind of response. This will help those of us who have either heard nothing or had the petition returned due to 'incorrect' fee deal with any prospective appeal to USCIS.

To answer your questions:

1) If you get a touch the 'last updated' date will change. It is worth noting that many people do not receive any touches before approval.
2) The stipulation for the visa is that you have met with your fiancee at least once in the last two years. Assuming you have met with her within the two years prior to the date you submitted the application then you should be ok. The communication part provides evidence that you and your fiancee have an ongoing relationship. Continue to keep a record of your ongoing communication as it is important at the consular stage.
3) If you have a co-sponsor who can demonstrate and assure that your fiancee will not become a public charge whilst in the US then your income is not an issue. There is info in the FAQs and Guides here on this.

I think everyone understands the frustration you are going through right now. The problem is amplified by the fact that historically VSC was the faster processing center for K1/K3 petitions. I recall feeling disappointment that we would be filing with CSC when I was doing research back in May. Things have certainly changed since then but I can empathise with what you are going through right now.

However, I am going to make a slightly contentious point having read through the last few pages of this thread. If the issue affecting K1/K3 approvals is that VSC are currently dealing with asylum applications as a priority then I believe that to be a justifiable decision. I understand, however, the point here is that USCIS are clearly understaffed and were unprepared for the obvious when the fee increase occurred and therefore the current slowdown is more extreme than it needed to be even with the refugee applicants. I am actually surprised that there are not separate systems in place for dealing with asylum seekers. Surely it would have been more prudent for USCIS to have one service center deal with these types of visa when they streamlined the service.

Having said all of this, I do agree that work-based visas should not be prioritised over US citizens applying for the right to be with the mother/father of their children/loved ones etc.

I genuinely hope we see some movement on approvals from VSC very soon. My best wishes to all waiting smile.gif

I read somewhere on here that the reason Cubans are priority processed is that it takes a long time for them to receive an interview in Switzerland. I'm not sure whether this is a fact, but if you do a timeline search (there are only 34 Cuban K1 applications within the VJ timeline data) the average no of days for the entire process is between 175 and 382 days - with CSC averaging 320 days.

By contrast, the average processing for a UK beneficiary is 143 to 215 days and they don't receive priority processing before receiving an NOA2.
Here's some more (chosen fairly randomly):

Canada 169-237 days
China 233-322 days
Mexico 146-206 days
Turkey 182-208 days
Vietnam 225-286 days

This is not a comprehensive analysis of the data, data skewing could be caused by the total number of applications or incomplete timelines but on balance it looks pretty fair to me. Cubans get processed faster in the early stages but typically end up waiting longer for the whole process to complete.

Plus, I am just guessing here, but I imagine it also causes some logistical and planning issues for the Cuban to get to Switzerland.

CanadaMarried Two Years Ago Then Moved Overseas
I was married in August 2006 to a Canadian in the US (I am a US citizen). We then moved overseas for the past two years. We thought our stay there was only temporary, so we filed an I-130 through DCF in Amsterdam. We decided we would stay longer after filing, and never went through with the DS-230 or anything else.

DH now has a job opportunity in the US. He has to go through an interview process. We are in the US now visiting my family, so he is going to have to leave and come through a POE to get a B-1 visa (Visitor on Business). I'm a bit worried that the previously filed I-130 will interfere somehow.

When I search on the immigration site and add my case, it says it does not exist. Does this mean all paperwork has lapsed? I'm just hoping filing the I-130 filed in the past won't hinder him coming in on a B-1 and then his employer getting his P-1 visa.

Anyone with any information would be greatly appreciated.

Another successful interview was done this morning.

I arrived at 6:00am. Waiting for 30mins for the 7:00am appointment for that is my time. After that, we are called to fall in line in the guard area to enter the embassy premises getting ready with us our APPOINTMENT LETTER AND DS156 FORMS.

As we get inside, instructed to sit on the blue chair waiting for our turn to get our number and so with the checking of DS156 (2copies), ds157 (2copies) and DS156K (1copy) for K1 only.

After having our number, waiting for our names to be called for fingerprint scanning. (The officer was impressed of me, saying "VERY GOOD PERFECT, YOU GET MY INSTRUCTIONS!!!" And I replied "Thank you Ma'am!" (But you know what guys I was worried because my name was called like 1hr after i got my number. I stand up and talk to an embassy lady and she told me "just wait ma'am you will be called later.") So i sat back.

Another half hour waiting for my prescreening. And thanks God I had a strict ugly Filipina prescreener. But anyway, I able to give to her all what she wants like my BC, NBI, Rodge ITR, our pictures together, and she asked me mails and emails and I told her I am sorry Ma'am we dont use to write coz we talk twice a day in YM and he called me 3x a day. So i handed to her our chatlogs and phonebills but she refused on phonebills. So I am done.

Waiting for my CO interview. I was assigned in window29. She is very nice.I greeted her first Good morning (with a big smile, hands on my chest and with a bow). She asked me to give her more seconds for she was searching a name and it was not in the list for the day, but she able to find it when there was a lady went to her side. So she's done.

MY TURN:
CO: Raise your right hand."Do you swear........................................."
Asnwer: YES I DO!

Asking the following questions
What is ur name?
What is ur petitioners name?
How old are you?
How old is ur fiance?
How you met him?

CONGRATULATIONS to you. You made it. Were same i was on window 29 that time. The lady consul was so nice to me but she did not say im approve. She only say dont feel nervous coz everything is ok, wait outside. She ask me if i did pay verification fee adn i said yes but of course i need to wait outside. When my turn, the lady in charge at window 37 she gave me back all the photos, cards,other evidence and gave me a pink slip and a sort kind of bondpaper that tells there peding document verification and wait until you hear from us. Till now im still waiting for my visa to come, i dont know if there still problem with it, i hope not ocz i gave everything they need. Im expecting this week or next week my visa.

Hello fellows,

I think it would be better to make a new thread for Visa Delivery Status of VJers who were interviewed April, May and upcoming interviewees of June 2008, for everyone to easily see and access the updates of our visa delivery success, especially those who are concerns in this topic. I think for next batch reference also to give them idea of estimation of the "waitings" in this "document verification" process when their time came.

Please kindly add yourself in the list, if you are being interviewed this April and May whether you receive your visa already or not yet and also to upcoming June interviewees. This might help to enlighten everyone about our worries with the situation going on now at USEM-Manila.

the routine questions were asked like:
how did you meet your petitioner?
what does he do?
what do you do?
when did you last see him?
how long did he stay in the PI?
how do you communicate?
how do you know that he is the one?

at the conclusion of the interview, the CO said: "well, i dont see any problem with your application it's just that we have to wait for the document verification. it's normal that your DV is not yet here but it really takes a while."

then at window 37 the clerk game me a pink and white slip. the white slip has "document verification" written there.

i asked the clerk at delbros, "how come my documents are not yet in when i paid for that 3 weeks ago?" she cant give me any answer.

what do i have to do now? im left hanging...sad.gif

i met ninfa..i hope she gets pink slip only.. she paid DV last may.

i really wanna cry...


Were same situation. They give me pink slip and white slip that tells pending document verfication. Dont worry you will have your visa soon. Me im still waiting for my visa too. Its been awhile already.I hope this week or next week.

Same us here were still waiting for our visa to come. My interview was june 18 till now i never got my visa yet. I texted Delbros they reply me that they already forwarded my verification request to NSO last june 4, 2008 2 days after i paid. I keep on texting them asking the status of my case, but still process. I hope this week or next week i will get my visa.
