Well, i think most July filers are starting to move on to the interview and wedding phase. Are there many still waiting for an NOA2?

There are some unfortunately sad.gif

I did a lot of complaining when our petition got to the six month stage but I am so glad that we are passed the NOA2 hurdle. I can't imagine what it must be like to still be waiting.

Yeah I'm banking on 30 days all in from returning Packet 3 to getting an interview. I will twiddle with my spreadsheet further and see if I can come up with a 12 month average. 30 days seems so delightful by comparison with 180 though.

Mox, it's really hard waiting on NOA2, especially in the final 60-90 days when approvals start happening all around your approval date. July was a stacked month admittedly, but when the first July approvals started in November it was pretty tough seeing December and January go by. I hope and think you are in a more favourable position since there were far fewer petitions filed on average post-July. It will happen and when it does, the wait doesn't even matter anymore. Time seems to fly post-NOA2.

StP, I understand some of what you're saying. I'm not displaced from my own country but having lived away from my home county for so many years I do feel a bit out on a limb now I've moved back. Everyone seems to have moved on and really (I never thought I would say this) if it wasn't for my mum's company I sometimes feel I would really despair. I'm glad I don't have to wait on a visa then go and tie up loose ends at the other side of the world before I move to the US though.

My job finishes on Maundy Thursday. So, I was rather hoping that I too could get a late March interview and fly out as soon as possible afterwards. I won't get work during the two week Easter break and I can't bear the thought of doing any more day to day supply teaching. So, fingers crossed we both get our visas by the end of next month.

I need to expand my data wink.gif

Christmas cocked it up. Plus, that figure is Packet 3 to Interview date so let's say 2 weeks to hear and 2 weeks to interview. Doesn't seem quite so bad when you split it down.

When are you hoping to leave the UK?

I totally agree with the limbo thing. Though recently I've started to feel less stalled by it all because things are actually happening. But, give it a week or two and I'll be pressing to have it over with.

I'm starting to fret about medical and interview now.

I've also been unable to find out how long it generally takes to get a date out of London, so I don't even know when to get worried laughing.gif
I'll give it a few more days, and then maybe call them... I'd be hopeless calling them now anyway; I can barely speak laughing.gif

I'm trying to work out 'how long' too. My case is only just at NVC but I started tracking London petitions on a little spreadsheet I made last night. I've only included petitions from the end of November to present and the average number of days between returning Packet 3 and interview is 37 days. However do bear in mind that the inclusion of December has meant that some of the paperwork will have been delayed. I reckon 4 weeks should be around about right.

I wonder whether I should have just done an average over a 12 month period.

Thanks!

I was surprised we got the interview so quickly. What happened was... we had faxed in the DS-230 Part 1... but for some reason the fax messed up and they only received the first page. So I got a call directly from the Vancouver Consulate asking me to re-fax the papers, and the guy said "while you're on the phone I can go ahead and schedule you for an interview". He asked what day I wanted and I said ASAP, so he gave me a date which was less than two weeks from the phone call. Crazy! I think we may have lucked out by accident because of the fax issues.

Just thought I'd share.

London has been pretty good about giving out interview dates within a month or two of pkt 3. I did my employer letter and I 134 soon after I got noa2.
I got mine notarized at the local ups store. But banks do them too. U can look up local notaries on the internet.

Thanks for the info. I was wondering about whether I might get a faster interview than usual just as a result of the slowdown at CSC and reduction in K1 applications following the fee increase. Since most of the July filers have already been allocated interviews or visas (!) maybe I will make it over in March after all! I know she ordered her employers letter already and was worried it might not be new enough when it comes around to the interview.

K-3 Spouse Visa Process & ProceduresCalifornia Service Center closed on weekend? Need hel urgently
They work Monday to Fridays generally. I doubt they could help you with this anyway since it has technically not arrived at their facility. Keep tracking the delivery on USPS website. It could well show up 'delivered' during the course of next week. Worst case scenario is it will be returned to you and you will have to resend it.

CSC will not be able to help you until the package has been entered into their system and an NOA1 has been issued, or your payment has been cashed. They cannot or will not help without a case number. Sorry.

K-3 Spouse Visa Process & ProceduresFile I-130 but mistakenly didn't attach G325 A for both me and spouse.
Now you have a case number you can try sending them the additional documents with a cover letter explaining your omission and quoting the case number. I would take copies of any documents you send so that if they fail to match up your original application with the additional documents at least you have them ready if they send an RFE to you.

Yes, use the form on the Metropolitan Police Website. I've read that many people were able to take the form into the police station with payment and 2 forms of id and obtain a receipt. I had problems with this, but I am in the West Yorkshire Constabulary area and it may be their policy not to accept applications in person. I posted mine off.

My fiance is only just filing the I-129F, but once it's sent and NOA1 received I would like to get my police certificate done - one less thing to do later!

Do you know where I go to get one, or who I contact? I'm in the UK. Also, do you know how much it costs?

Thanks

You need a 'subject access' form. Some police constabularies allow you to make the application at your local police station whilst others require you to send it by post (West Yorkshire Police). So, to save yourself a trip to your local police station check out their website first. The certificate costs £10 and takes up to 40 days to arrive.

Yep, it is 12 months.

US Embassy and Consulate DiscussionHelp please! (Affidavit of Support)
QUOTE (YuAndDan @ Feb 3 2008, 03:33 AM) <{POST_SNAPBACK}>
Not an absolute requirement but the consulates tend to treat I-134, like I-864 and recomend same financial evidence.

Example:

http://guangzhou.use...w/3._OF-167.pdf (Read affidavit of support section)

http://london.usemba...faffidavit.html (Read Affidavit of support section, (notarized copies of his or her latest federal income tax return, a statement from his or her employer showing salary and the length and permanency of employment)

http://manila.usemba...ov/wwwfivk1.pdf (k. EVIDENCE OF SUPPORT)

http://tokyo.usembas...kaffidavit.html (Copies of his or her latest federal income tax return, Statement from his/her employer showing salary and the length and permanency of employment)

The list can go on and on.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html
  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Thanks Yu and Dan. This is a VERY useful post. Just seeking info on this myself. The process can be very confusing. good.gif

My fiance and I are just preparing our evidence for the embassy interview and have a couple of questions regarding the I-134.

He is currently a student and so his mom is co-sponsoring. A look through the guides/forums has generated the following areas of confusion:

Q11. I intend/do not intend to make specific contributions to the support of the person(s) named in item 3.
I see on the sample form that it recommends 'N/A ( K1 visa process for permanent residence )' but I don't actually understand what this means. His mom will be providing room and board for us until we get settled so i'm not sure whether we should put that down or the 'N/A' comment. Why is it not applicable?
The I-134 can also be filled out for other visas where stating specifically the type of support you're providing is necessary. So for K-1, N/A (K-1 visa) is the correct answer.
Q7. I am employed as or engaged in the business of....
My fiance is a student. Should he state here that he is engaged as a full-time student and enter the address of the university?
He would write full-time student and name of the university.

Q3. Relationship to sponsor
For his mom's form should we write 'future daughter-in-law' here?
Sounds good to me...but I didn't have a co-sponsor, so maybe someone who did it w/ co-sponsor can chime in.

and finally as a student what evidence does my fiance need to submit in support of his I-134? He has details of his financial aid, bank statements but has not filed taxes for some years.
Has he made less than the minimum income for filing taxes? Is he being claimed on his parents taxes? it is my understanding that even though your income is minimal, you should file taxes. I have filed taxes since I was 16 years old...and I was a student for a good few years afterwards. smile.gif
Many thanks for your help!

Good luck,
-P

Thanks for the quick response and the advice. I don't think he has filed taxes in a few years. He has made less than the minimum for filing. Is this going to cause us a problem even if the co-sponsor comes up with sufficient evidence to support her I-134?

US Embassy and Consulate DiscussionAffidavit of Support and Interview
You also need to provide a notarized I-134 with supporting documents as you are the primary sponsor regardless of your financial situation. You still have time to get this information together and fed-ex it to him.

It is also advised to provide an updated notarized letter of intent to marry. The same as you provided with your I-129F but of a recent date.

Another thing you might want to consider is proof of ongoing relationship, since you filed. They want proof you met and I assume these were provided in the I-129F packet but they may also ask for evidence of communication between visits. Phone bills, chat archives, emails, letters. That type of stuff.

I'm sure someone will chime in if I've forgotten anything. I am preparing for my interview also so still learning myself. Good luck!

Paula,

You are wonderful. I will phone his mom and see if she thinks this might be an option. I had no idea that HR could be this difficult about it - she explained the whole situation to them as well. I wanted to avoid them sending the letter direct to the embassy in case they took their time over sending it. It also troubles me that I will have the whole I-134 package except for that one piece of evidence. Relying on others to tie the two things together seems like too much of a risk at this stage in the process.

Thanks again for your help.

US Embassy and Consulate DiscussionI-134 Statement from Employer
Hope someone can help me here.

My fiance's mother is acting as co-sponsor and has been gathering together supporting evidence for the I-134. However, her employers (a national healthcare company) are being awkward about issuing a statement showing salary and the length and permanency of employment.

What they want is to issue the letter to the person requesting the information and will not issue it direct to her or myself. They would, however, issue the statement to a lawyer but we are not using one. They have also asked her to sign a release of liability before they will issue the statement at all, which she will provide. Is this normal practice?

Can I send this information direct to the embassy and present the rest of the I-134 documents in person at interview? I am worried the embassy will not receive it or 'lose' it and it will delay my application. Anyone else had similar experience?

Thanks.
