You can check the status of your application online at the USCIS website. All you need is the case number from your NOA1. You probably won't hear much for a couple of months or so as currently the service centers are working on April/May petitions. When they get around to looking at your petition, they will either approve it and send you an NOA2 or they may need further information and send you an RFE (request for further evidence).

It would be a good idea to look at the K1 flowchart in the 'guides' section, this describes the whole process for you.

Sorry, I misunderstood. You are saying the online system says 'we received your petition on October 2nd'? That's normal, your case number and the webpage for your online account was created October 2nd. The guys are right it is the 'received date' on the paper NOA1 that is important.

Your received date should be when the packet was signed for at CSC, i.e. August 20th. I'm not sure what you can do about this error. USCIS did say on their press release about receipting delays that the received date would be honoured. Now you have a case number you will be able to query this more effectively though. I would try calling the service center direct and requesting a new NOA1 which reflects when your packet was actually received.
If anyone has any other ideas please chip in.

No touches for me. I'm not worrying about touches for a while yet. Some petitions get approved without any touches at all, some with many. I doubt it's an indication of anything significant since they are not expected to get around to ours for a good while yet.

Congrats to the latest NOA1 recipients. It sure puts your mind at ease knowing the application IS in the system smile.gif

Yes, everything is going well. CSC have accepted your petition into the process by cashing your check and issuing an NOA1. You need to use the 'received date' on the notice as an indication to how your application might be prioritised for processing. You can use the receipt number to check the status of your application online. You will hear from USCIS if they require any further information from you. The NOA2 should hopefully be the next thing you receive, but this will take a while yet. Good luck!

Yes, the thread certainly served a purpose and I will make no apologies for starting it. I think I explained clearly and fully in the introductory post what the purpose of the thread was and it brought together a number of people in a similar situation, which I felt was important under the circumstances. It also attracted comments from more experienced VJers about how to handle this specific issue and as a result we were able to keep our spirits up, keep informed and understand the process more clearly. I believe this information would have been lost amongst a more general 'August filers' thread.

A few of us have only learned in the past two or three days that our petitions have actually received a case number, we are still to hear from others whether they have been as fortunate. Prior to that there was a possibility that we may have to contact congress and take up some form of dispute with USCIS about the loss of our petitions OR resubmit all our petitions next month. This thread would therefore have moved into different territory, but the point is that we had made contact and could have helped one another.

It appears that this issue has just about been resolved and the thread will slow down as people move onto the general filer threads and share, hopefully, a more joyous experience. I too can't understand why the thread would bother anyone but I expect it will disappear in time into the vault of resolved threads and as such will not be a threat to anyone's sensibilities. rolleyes.gif

Also, I don't think that mid August applicants hearing nothing and the fact that many late August/September petitioners have already received NOA1's is easily explainable by the current backlog and streamlining issues. Except, perhaps, that they are processing boxes off the semi-trailer as they come to them and not by date received. Thank goodness USCIS have stated they will honour the received date on the NOA1, when it comes! wink.gif

Thanks for your advice and information. I don't mind being told to be patient, I have come to that conclusion for myself. I will not resubmit, I agree it will probably just cause further problems.

Just to explain things a little. Initially it felt like *my* application had been lost, I was on the July filer thread (as I did file in July) and everyone, without exception, were getting NOA1's or had petitions returned for incorrect fee submission. And of course, I wondered what the hell was happening with mine. Clearly, I'm technically an August filer because the packet was delivered late and so I searched the August timelines to get some bearing on what was happening with those. I posted the topic when I noticed the gap in the timelines and realised that I was not alone...and that others may be just as worried as me and it might help to stay in touch with each other.

Since then, I have done a lot of research and realised that this issue doesn't just apply to me and the 10 other K1 applications I saw on the VJ timelines, it also applies to people submitting all manner of petitions to CSC. Not to mention the majority of applicants who don't even use these boards.

It is normal, I think, to expect your check to be cashed within five weeks even if you hear nothing else. Especially when most people hear something within a couple of weeks of delivery. So it's not a lack of patience so much as a concern that the applications have been lost. There is also a side of me that is comforted by the volume of applications in mid august that have not been looked at yet. It means there is a reason for this...and that I'm not alone.

I've found the best way to keep the lack of patience and increasing worry at bay is to keep yourself informed. Ask questions, talk to people, listen and find people who are in the same situation as you. Then we can all help each other.

There is still a slim possibility that ALL of us may have to resubmit at some point in the future. We know our petitions were received and that later petitions are being processed. So, if that day comes, a couple of months down the line, then we can help each other deal with that scenario.

You know it does help to know you are not alone. That's why I am here.

I'm not looking to resubmit. At the start this really concerned me because it just seemed odd that the packet had been received at CSC but the check had not been cashed at all. After all, many people do not receive NOA1 hard copies but they do have their checks cashed!

Having done some research on this, there seem to significant amount of people who have submitted varying petitions at the same time as us who have not had checks cashed either and others who submitted later who ARE receiving NOA1's. I guess there are a whole lot of petitions, that were received mid-August, which they just haven't got to yet. The good news for us is that we are not alone in this. CSC will either get to us sometime and backdate our NOA1 receipt dates or have to cope with a huge number of us sending in delivery receipts if they have accidentally trashed them all (please no!). I'm assuming it won't be too difficult to prove that the fault lies at CSC's end. However, I'm hoping it doesn't come to that and I doubt doing anything before 90 days since we sent our petitions will be productive. sad.gif

So yes, I am being patient for the time being. I hope we do all stay in touch. It will help during the wait to hear from each other when we do get updates and from anyone else who has an alternate experience because knowing there is a lack of consistency will assist us in the future if we do have to resubmit.

The receipt is merely proof that US Mail delivered it. I actually didn't even receive the return receipt, but I do have a tracking number and proof online that it was delivered. I doubt CSC will be able to inform us if they lost our applications, but, let's hope it doesn't come to this, we all have proof that our packets were delivered.

I really don't want us to be in a position where we have to prove we actually sent in applications and have to face difficulties in getting our applications backdated. That would really suck at this stage.

I will keep my fingers crossed that we all get processed soon. Please let me know if any of you receive an update. Best of luck!

USCIS' weekly update on where they're at in issuing NOA1s. According to the 9/14 update, they are processing I-130s received 8/8/07, but for "all other forms" they've completed data entry and issued receipt notices for applications and petitions received on or before 9/6/07. If they are lumping 129Fs in with the 130s, then we don't have anything to worry about yet. But if we read this update literally, something's gone amiss.

Hi, thanks for your post. I'm sorry that there are others who are having this worry over their petitions but also glad that I am not alone here.
I think, like buckeyes that perhaps the I-129F applications are lumped in with the I-130 data. I have posted a couple of questions about how whether the I-129F is classed as 'all other forms' or the I-130 on two other VJ threads but have no clarification as to whether this is the case. It does seem likely though. I will update here if anyone responds to that question with a firm answer.

If we are looking at 8/8/07 as being a starting point it still doesn't explain why I-129F applications received at CSC after the 25th August have already received NOA1's. Still, those of us who haven't heard anything appear to belong to a specific time frame for receipt at CSC and therefore I can only assume that we're all sitting in a box together at CSC.

If that is the case, and our received date is honoured then we'll be back to where we thought we'd be soon enough. *fingers crossed*

The purpose in creating this thread is two-fold; it would be good to keep a track on each other's progress but also because there is seemingly an issue with some applications received by California Service Center in mid-August, it seems necessary to maintain contact with people who are concerned about the filing of their petitions. I noticed a few people have posted concerns on another thread but it might be useful to keep things all in one place.

Here's my story: I mailed my K1 Visa application to CSC on 27th July but it was not received until 15th August, therefore I am technically an August Filer (although I would love to say I am a July filer, ho-hum whistling.gif )

Anyway, I have yet to receive an NOA1 or have my check cashed and under some good advice from a member on the July Filer thread I did a timeline search to see what the status is for NOA1 issuing for August.

What I noticed was very interesting; There is a range of 11 applications sent between the 8th August and the 24th August and not one of us have received NOA1's as yet. There are NOA1's for all other applications sent in August before the 8th and for most after the 25th.

My fiance and I have been wondering whether to resubmit our petition (in our case, this would mean resubmitting with the new fee, which I'm less worried about than the actual time lost) but, it looks to me like CSC have a wad of petitions they are unaware of. This is not one or two applications we are talking about - this is a whole set of applications received between two specific dates (and these are just 11 we know about).

Those of you planning on resubmitting might want to hold off for a while - not least because USCIS have said they will honour the received date as the start date for queuing purposes.

I hope this information is of use to some of you. Those of you who have received NOA1s: congratulations and good luck! Let's keep in touch with one another on our progress.

I know that contacting them before 90 days is up will just reward you with a 'wait for 90 days' response. Meh! That doesn't bother me. I think it's good to get your interview out of the way rather than having to be in a total flap like I am tongue.gif

What does bother me is I have NEVER heard of two interviews being allocated. And it happens now....and it's a chance...but it's such a long shot.

Did you see the thread about two interview dates? I'm totally freaked out about it now. I am desperate for an interview date before the 20th March. I know it's a long shot too. But WHY oh WHY oh WHY did someone have to have two perfect interview dates for my needs? These things are sent to try us tongue.gif

It's funny. Really early on in the process I was explaining things to my Mum and brother and I got really stressed out when they didn't get that there's a possibility of denial. I got so flustered and upset because it didn't seem so clear cut and, after all, this was my future happiness in the balance. I think pre-NOA2 was just so much more nerve-wracking even though people always warn of the possibility of denial at interview.

I do think the emotions go up and down though. Shortly after NOA2 I was panicking about the medical, but now I'm not sweating it so much. Last week I was worried the finance stuff might not get here in time, but it's on it's way and I've relaxed about it. I am really beginning to see the light at the end of the tunnel and it's made me feel much more positive.

Now, I'm collating evidence and I'm thinking how can they possibly argue that this isn't a real relationship. I have so much ####### printed out it's ridiculous. And I know the chances of them looking at it all are very slim. So, I don't think it's foolish to have that feeling because now it is all down to you. Show up with everything they require and they really can't say no.

I am hoping I get short notice on the interview too. I too can't understand why people have been getting early March dates and suddenly Geordielover gets stuck in April.

Anyway, I'm not holding my breath either. So many things have been delayed in my process so far that I'm convinced that's just the way of it and it hasn't made us feel any different about each other despite the stress of it at times. As things stand, the timing has worked well for me as my job finishes just before Easter. I am hoping to be able to make it out there for the 25th so I can make the annual Las Vegas trip with him and some of our friends. We're thinking of doing a drive thru wedding or something similar, just for the fun of it, since we're planning the ceremony we want for later in the Summer when my family can make it.

If I don't make it in time, well I'll be upset but it's not going to spoil our future. )

I'm having a better day so far today & thought I'd check in here. Most days lately it's too hard to come on this thread but today I'm feeling hopeful. I got a letter from congress yesterday stating they are checking into our case again. I know it doesn't really do much, but at least it reminds uscis that they have to check on things and not just let it sit there. I wonder if I'll ever get to know what took so long for our name checks.
