Hello all, i am new to this site and trying to find out as much information as possible before my fiance and i start the K1 visa process in June. Now, did you all go with a lawyer or have you done this process on your own? Looking over it i think i could do it alone but just wanted to get views on what to do, id really rather save the money and spend it on the visa than pay a lawyer.


We have a lawyer, our case is not complicated but I suppose we have peace of mind knowing we can call him and he can deal with any problems that could arise.
We actually found this site because of him, he has a link on his web page for VJ.
He may slow things down a little by eveything having to go through him, but so far we have been lucky. apart from the intitial questionairre that we filled in for him at the start of our case we havent had to fill anything in, he completes all the forms and sends by email, if they require a signature we print them off and send them straight back to him, so far we have only done this once for the intial filings. I am just waiting for one more document to arrive so that I can send all docs required by NVC directly to him. It works for us, but I agree there is so much information on this site that you could do it yourself.

We have an attorney, and while if I had to do it again, I wouldn't hire one, we have had no problems. Our attorney responds immediately to our queries and actually helped put the initial I129F packet together quicker than we could ourselves. Her flat fee is semi-reasonable and she hasn't caused any delays.

All that being said, if I knew of this website and had more time to research before we wanted to file the K-1, I would not have used an attorney.


I agree, with what I know now from this site I prob wouldn't have hired an attorney, but as I found this site from a link on his web page, well... He also responds immediately and after waiting 17 days for case number to be assigned by NVC, I called him, he said he would call NVC and the next day we had a case number, coincidence? maybe. Although our case is not complicated I think having someone with experience dealing with our case gives us peace of mind.

Some of you are way out of line. A scammer wouldn't have given as much personal information as I have on her including bank account information especially for only $5,000. This is definitly a case of mis-understanding by the consulate and my fiancee. It is possible that she went to the consulate without an appointment and ended up talking to someone who's whole purpose was to deter people from filing a visa. This would be a simple way to do it.

Well think about it for a second, really what personal information do you have on her that really matters..hmm lets see do you have her ssn? I think not being she is in Turkey, hmm lets see whats next...address,birthday,telephone number email address... god real personal information that is really damaging to have out there...NOT. Bank account...like you can do anything about that being in the US...My point is if she was to scam you there isn't anything you could possibly do about it short of traveling there and smack her around. News flash for you, US laws have no bearing in other coutries so it's not like you could sue her or anything. Scams are a dime a dozen and its not uncommon for someone to 'fall in love' just to make a buck. As for getting in and out quike....who knows she could being doing you and 5 others at the same time. Think about it man, she is in another country and 5000 USD there might be enough to live on for 5 years. I could go on and on, do your self a favor and reallyquestion her over this.


Relationships need trust, I would contact the consulate and clear things up, find out exactly what happened before even considering that there is a scam involved.

US Ankara Consulate is what she said, and probably was whatever was listed on the paperwork which is the Embassy. I won't talk with her again until later this afternoon. She is working and probably crying at the same time.

There is nothing I can do about it now. I gave her everything I had and she is supposed to take care of the stuff she needs per the documentation on the Embassy website. She just needs to submit it and get an interview date.

When I received my 1st letter from Emassy for K3 it says on the DS-2000 (Evidence which may be presented to meet the public charge provisions of the law.

In the section about Affidavit of support -

If you get married and then file to bring your wife here on CR-1 visa she will enter as a conditional permanent resident which she will receive a 2 year green card and she is free to travel immediately. If you wish to bring her here before you marry you will need a K1 fiance visa which means you will need to marry within 90 days of her arrival then apply for Adjustment of Status (AOS) but you can aplly for (AP) Advanced Parole which will allow her to travel but this can take a few months to get.

If you left before you received advance parole (permission to travel) you would have to start the process again through CR-1 and/or K3

You could marry now and file for the CR-1 and return to Europe before your 90 days is up. They have been processing much faster so maybe you wouldn't be apart for very long.
If you apply for adjustment of status you could suceed but can also risk being denied with no appeal allowed and be banned from entering US.

I'm not looking for legal advise but I'm a bit worried about the wording of the decree since we've been planning to begin our filing as soon as I had it in hand. Thoughts?


Also, it's been a bit of a struggle to find the exact process one uses to facilitate the K-2 visa for my fiance's child. I think I have most of it nailed down, however there remains some gray areas. I've found conflicting reports about whether or not a G-325A is required for her child who is under 10 years of age. Most sources say no. I've also read that children under age 14 are not required to attend the visa interview in London and was curious about how the visa is approved and issued without the child being present.

This is the 2nd time you posted this. I asked you if you were married already in my last reply.

If you are not married then you will need the I-134 filled out and signed by your fiance for your interview, you will take it with you along with other documents they need. If you are already married you will need to start whole process again for a spouse visa.

August wedding? You may need to do some reading and look at timelines on this site. Although this seem to be moving much quicker now with USCIS than before, if the petition has just been filed it is unlikely you will be done in 4-6 weeks unless you are already approved and have your interview date.
Please fill in your timeline!!!!
If you havent submitted your I-129 and are set on getting married in August then it may be better to wait till after you are married and go for the K3/CR-1 because if you marry before the K1 is issued it will be void and you will have to start again.

If he's submitting an I130, he's applying for a CR1/IR1.

Here's a link to the VJ guide, which details the process for a CR1/IR1 visa, including the following details of Bona Fide Marriage evidence:

1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financialresources; or
4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or
6. Any other relevant documentation to establish that thereis an ongoing marital union.

Well I havent even sent my first package yet, Im filling for a CR-1. but I will do.

Google the DS 169 form. it tells you in detail about Obtaining records. You need one from each county you lived in for longer than 6 months going back to the age of 16. There is a list of countrys that are not required because the Embassy will do the check. i.e. the usa.

It would look better if she goes with you to the interview, however if she really can't attend for whatever reason, it's optional for the petitioner to attend :) so don't worry about it if she can't make it to the interview :) Goodluck with your journey :thumbs:
