Until an adjudicator looks at your evidence when your petition is processed there is no way to say if what you have supplied will be accepted or not as proof of having met within the past 2 years. I have seen some that have submitted similar to what you have and beeb approved.....and some that have submitted similiar and have been sent an RFE for more evidence.

Photos are a tricky thing as some have received RFE's clearly stating that photos do not prove that one has met. They are looked on as secondary evidence in support of primary evidence such as passport stamps, boarding passes, rental receipts (if have lived together) etc. Evidence should create an entire picture in the minds eye of an adjudicator and each adjudicator is going to see evidence differently...hence why some will get an RFE and others dont.

Its normal to second guess but try to relax about it and see what happens. If you get an RFE you will just need to supply the further evidence. I know thats not what you want, no one does, but little one can do about it.

Yes you would put SSN in Q8 if you had one.
'A' number is Alien registration number given to immigrants, those in the US on most working visa's, and to J-2's. If the petitioner does not have one put 'None' If the beneficiary does not have one they will be assigned one by USCIS during this process so would also put 'None'. If you were assigned one with your working visa you would put that. The alien registration number is one way of keeping tabs on those in the US.

2. On the biographic form where it asks about employment for the past five years, should I put down that I am a student? I have worked in part time jobs here and there, but full time I am a student for the past five years. How do I address this?

It states on the biographic form 'If none, so state'.
Putting student, as many have done, would also be acceptable.
The important thing on the G-325A is not leaving any gaps in the time frame as there has been RFE's for this.

Also, I currently live at college, but as of September I am finished with college and will locate to where I find a job. Therefore, my address will change. Do I put down my college address on the form as permenent address? I do not have another address to put and do not know where I will be living as of September.

Put down your current address. Your address can be changed with the relevant party at a later date.

If you wish to include them, also include a translation. This does not have to be done by a certified translator, only certified by someone that is conversant in the foreign as well as english language to be able to certify that the translation is complete and accurate.

As per the I-129F instructions the submission of an egagement ring receipt is something that you 'MAY' submit. If you have one, why would you not wish to include it? Use all that you have to create the image in the minds eye of the adjudicator that you have met within the required two year period that established the relationship.

The letter of intent is a good idea to include. I am under the impression you only need it from the USC but if you want to send one from both of you it wouldn't hurt.

damn... i thought i sent all the documents the USCIS was asking for but after reading several posts in here i realized that i made some stupid mistakes.... 1st i made black and white copies of the pictures i sent and 2nd i forget to sent the letter of intent to marry within 90 days :huh:
do i really have to wait until i get a letter from the USCIS asking me for exactly those things or can i just go ahead and send them? anyone knows how much of a delay it will be???

Wait for the RFE which you will get as the letter of intent is one of the requirements for the I-129F for fiance. Sending anything to the service center is not advised by USCIS if not a part of the original filing or when requested via an RFE.

This is quite common and they will do this without you filing for an extension. Many call the consulate to comfirm just for peace of mind so perhaps you could do that.

Not only will you start all over again, but it is my understanding that the K3 process takes longer than the K1.

Not necessarily so eg CSC is processing I-129F petitions for fiancee dated Feb 3.....NBC is processing I-129F petitions for spouse dated Feb 21. It depends on a few things including the service centers and embassy/consulate one will interview (how long the wait is). The I-129F for spouse is processed the same as for I-129F spouse.....the only difference is one is processed at a service center...the other is at NBC (national benefits center, formally missouri service center).

So you sent a written request plus fingerprints to the Criminal Investigations Department in Nairobi? On the reciprocity site it states only 2-4 weeks so your wait of even 3 months seems an awfully long time. I am thinking maybe it is lost and never reached there. Perhaps sending it again might be the best. Do you have an interview date yet? If you have the interview before you get the police certificate, your visa wont be issued until you submit it, but you will get it if otherwise approved.

The naturalization certificate is what you would use to show US citizenship. You are not required to send your birth certificate as this shows your birth in another country and does not prove your US citizenship which is what the requirement is of the I-129F

Hi guys!

It has been over four months (NOA1: Jan 4th, 2006) since I submitted the I-129F application. I have called and e-mailed the CSC and they have told me that my case is undergoing security checks.

It is already May, my case is still at the CSC and I am supposed to get married in December. How is this going to work out? I am very stressed out, because I don't seem to know what they are doing. I e-mailed my senators, congressmen etc. last week, but I haven't heard anything from them.

What else can I do? Should I hire a lawyer? My case has been touched four times, but I don't know whether it is due to me sending them e-mails or what!

Please help, I am very scared that the wedding won't take place in time. Anyone else in my situation; why is it taking ages for my NOA2?

Why are you so desperate to obtain immigration benefits, when you're still 7 mos. away from the wedding? I'm pretty sure that if you told the 'CIS you'd be marrying in Dec., they already know your paperwork needs to be processed before then. But you continuously making phone calls and sending e-mails to senators, the USCIS and congressmen in order to get your case approved asap makes it look like you're only interested in obtaining immigration benefits and nothing more.

What exactly do you mean by "immigration benefits"? I want to be with my fiance and that's it. YOu realize right that I am already a US citizen and have received all the "immigration benefits" I had to receive six years ago when I came to this country.

Anything I need to do when I submit the I-129F to request the interview in Canada? If she can interview in Canada, which embassy in Canada she should attend? She lives in Alberta. As far as I'm concerned, the interview ALWAYS takes place in the country where the beneficiary is native from! So, she would have to come back to China to have her interview...

As per the I-129F......it uses the word 'resident'.........not native of. Ones country of residence is not necessarily ones native country.

The example G-325A that you refer to is all four pages of it.......if you look at the bottom of the first page it has 'Other' checked. The G-325A which is used in the example is from the USCIS website, which unfortunately has a bug in it, so as when it auto fills it incorrectly checks 'Naturalization' box on pages 2, 3, 4. This has been happening for quite some time now. So when you do complete this form using autofill...it is best to check this box by hand to avoid this bug.

When the I-129F is approved at the Service Center, it tells you right on the NOA-2 notice that the approval is valid for four months. I would have imagined that you would have known right up front that you were required to submit evidence of being able to support your fiancee if the visa was to be issued. It appears that you didnt take timely action and let the approval expire. They are not obligated to renew it just because you failed to make timely submissions on required documents.

Your only recourse is to file again, but this time have the required documentation to submit when it is required in the process.

Actually Jenn it is relevent. The OP stated that the interview was in August.......this was when a request for co-sponsor was made. The submissions were not made until March.....that is 7 months and because of that the petition expired.

There is a timeframe though to submit the requested documents .....I thought it was something like 45-90 days (anyone know the exact timeframe?) or the petition would still expire and still up to the conof as to whether it is revalidated.

N6.1 Action When Petition Received

Upon the receipt of an approved K-1 visa petition the post should send a letter to the beneficiary outlining the steps to be taken to apply for a visa. If the initial 4-month validity of a petition has expired without a response to the post''s letter, the consular officer should send a follow-up letter to the beneficiary, with a copy to the petitioner, and request a reply within 60 days. If the 60-day period passes without a response from either party or if the response indicates that the couple no longer plans marriage, the case is to be considered abandoned, the petition is to be retained at the post for a period of one year and then destroyed.


N6.2 Validity of a K-1 Petition

An approved K-1 visa petition is valid for a period of 4 months from the date of BCIS action and may be revalidated by the consular officer any number of times for additional periods of 4 months from the date of revalidation provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary''s admission into the United States. However, the longer the period of time since the filing of the petition, the more the consular officer must be concerned about the intentions of the couple, particularly the intentions of the petitioner in the United States. If the officer is not convinced that the U.S. citizen petitioner continues to intend to marry the beneficiary, the petition should be returned to the approving office of BCIS with an explanatory memorandum. [See Sec. 41.81 PN7 for revalidation procedure.]

You can do DCF in Thailand .....read this thread http://www.visajourney.com/forums/index.ph...topic=11821&hl;= but dont know that it is a suitable option for living in the US short term....for that matter none of the fiance or spousal visa are if the OP's boyfriend will not stay around long enough to complete the AOS process. Someone else may have some ideas on viable options.

You have an NOA1 date of Nov 11? Has USCIS told you anything at all yet as you are way beyond the 30 days past processing date. I would be calling your representitive and speaking to them directly. They may not be able to do much if the petition is undergoing security checks but at least they should be able to find out what is happening with the petition. Most security checks are completed within a relatively short time, some however can take some time. Until a name hit is resolved the petition will not be approved. In very few cases, some will stall, with no one knowing what to do with them.....sounds ridiculous I know. Don't expect your congressman to be able to work miracles as they dont have the authority to expediate a petition if it is undergoing security checks. The best you can really hope for is knowledge....and that in itself can at least ease your mind some.

The date they stamp on your actual petition is the reciept date and this is what is on your NOA1 as the receipt date. This is the date that will affect whether you fall under the new IMBRA.

Applications are stamped with the time and date of physical receipt, not the time and date they are actually opened.

Actually I'm in California and my fiance is in Davao City, Philippines. Thanks for all ur advice and opinions. I'll take them all to heart but nobody attempted to answer my main question about the letter of intent. Also she does not have a passport yet. Will this be a problem? I am not planning to carry alot of hard cash coming and going there. I was told by Bank of America that I could use my ATM card there to withdraw pesos directly. Just pay a $5 fee for each transaction. If anybody has anymore advice or opinions, PLEASE feel free to give it. THANKS AGAIN.

Your fiance will need to obtain a passport but at the initial filing of the I-129F at CSC this wont be a problem. When she eventually receives the packet 3 from embassy she will need to put her passport number on forms within that packet as without a valid passport she cannot be issued a visa.....but you know that already ;)

I have no idea on ATM withdrawals in the philipines but Im sure someone will.

For the initial filing of the I-129F you would use the USCIS heading and address (your service center) For the interview you would use the the Embassy heading and address. For the initial filing your fiance only needs to complete a G-325A (4 pages) and do a letter of intent.
