Are you the petitioner or beneficiary?

USCIS needs to be informed of the withdrawal. You will possibly draw a red flag with the filing of another petition so close to the other considering one has only recently been approved at service center.

Also read up on the IMBRA regarding multiple filings of petitions for future reference. Here is an extract...

11. Mandatory Tracking of Multiple Petitions and Dissemination of Information Pamphlet
The International Marriage Broker Regulation Act requires USCIS to maintain a database to track repeated petitionsfor K visas. Upon approval of a second petition for a K-1or K-3 visa filed by the same U.S. citizen petitioner, USCISwill notify the petitioner that information concerning thepetitioner has been entered into a multiple visa petition tracking database. USCIS will enter all subsequent K-1 orK-3 petitions filed by that petitioner into the database.When a second petition for a K-1 or K-3 visa petition has been filed less than ten years after the date the first petitionwas filed, USCIS will notify both the petitioner and thebeneficiary of the number of previously approved petitions listed in the database. USCIS will also send the beneficiarya pamphlet containing information on legal rights and resources for immigrant victims of domestice violence.

awwwwwwww sweetie *hugs* I can only imagine what you are going through. I think contacting the congressman is a good idea. At least he may be able to find out something.

I was browsing sites the other day and found the same thing time and time again. That if one wants a congressman to be able to get any real information that they needed to be supplied with a signed privacy release form. Does anyone know anything of this? Because if that is the case then maybe that is something you should look at.

Hey guys, almost ready to file, just waiting on my fiance's info. One thing is, is the Proof of Intent to Marry letter enough for proof?

I know that lots of people submit plans or ring receipts for their future nuptuals, but we don't have those. Is that letter going to be enough? We don't have a ring yet because we are planning on getting a setting for a diamond I have while I am visiting in August. He hasn't officially proposed so I can't tell the circumstances of that. I know that we prob won't get the Visa till next year so I don't want to get a dress now or make any set plans, having no clue of when all this will take place... We will prob be getting married and having a reception at my parents house (so no receipt or info there). We may hire a caterer but we may just do our own food, so no communication there....

Anyone submitted paperwork and the letter of intent sufficed? Any other creative ideas to prove of intent to marry?

The letter of intent is exactly that...a letter of intent to marry within the 90 days on entry to the US. Nothing more. The instructions for the form say that engagement ring receipts may be submitted but it is not a requirement.

What other posts refer to is the evidence of having met within the required 2 year period prior to submitting the petition which is a requirement of the I-129F (fiance) petition to be eligible. What evidence you submit in this regard is dependant on your circumstances. Photos are secondary evidence so make sure you also supply primary evidence such as boarding passes, credit card receipts, etc. What you aim for is to submit evidence to assist the adjudicator in forming an image in the minds eye that you do satisfy this requirement. Use question 18 along with an extra sheet to detail the circumstances of meeting which established the relationship.....the evidence you supply should support the written statement.

(1) First of all, where to clarify (if at all) that I'll be with my fiancee at her home country during the whole process? Only in Section B question 18?

I would just use Q 18 to establish this. As you are residing together presently, anything that can show this, is evidence of having met within the required two year period as well as evidence of ongoing bonafide relationship.

(2) Section A, question 2: My address. Do I put my current address (fiancee's / non US) or my US address?

Personally I would us a US address (family member or friend) where all correspondence can be sent. Q2 is what is entered into the system as the mailing address....it does not have to be the present address of residence.

(4) Section A, quest. 8b: "A# (if any)". A# is a greencard number? Since I was naturalized, do I have to find that number and put it there? I have no copies of greencard left, is that information somewhere in my US passport?


Unknown would also a suitable answer.

(6) Sect A, quest 10: US citizenship acquired through... under "Parent" checkbox there's "Have you obtained a certificate of citizenship in your name?" question - it applies to "Parent" checkbox only? I.e. I should not put anything there?


There is only 3 answers to that question using the check boxes.....Birth in US, Naturalization, Parents. If Birth in the US, that question has been answered and all other boxes can be left blank. If Naturalization, one also puts the certificate number etc....then the question has been answered. If Parents, then the other boxes below it need to be completed.

(7) Sect B, questions 8-9: SS# and A# for fiancee - put "none" or "n/a"?

SS# could be answered either way. We put N/A for out I-130. A# can either be answered 'none' or 'unknown' as your fiance will be assigned many an A# during this process.

(12) Sect B, quest 17: Related to you? "No" and leave explanation field empty, right?

Correct as there is nothing to explain :thumbs:

(15) Sect D: Day Phone Number: Should I put US address phone number (I won't be there) or Ukrainian cell phone number with all the dial codes?

I would use a US phone number.....same as the for US address used for mailing.

(16) Documentary Proof of Ongoing relationship. Should I translate and certify documents such as internet provider bills (in my name in fiancee's country), car insurance (same story), tech passport (in her name, but me listed as a driver), etc, etc?

Reads like good evidence of having met within the required two year period which is a requirement of the I-129F, so yes have anything you want to submit translated that is going to assist in showing this.

To my knowledge yahoo personals and the like are not classified under Marriage Brokers. A Marriage Broker is a business where paypent/fee is received from the USC to have access to the foreigners listed with them for the sole purpose of finding a spouse.

Also note...Q18 of the I-129F where it asks, where did you meet. It is referring to when you met in person, as this is one of the requirements of this form, that you had to of met in person within the required 2 year period. For that question, having met online is of no relevence.

As to Q19, it is not specifically asking for a street address. I imagine that country, web address and perhaps even contact details would suffice.

Hello everyone.... First off, I'm new here..... Met my fiancee online by chance (we say by fate (L) ) in March 2005.. first made contact via phone in May 2005....Pete's first visit to the USA was in September of 2005 for two weeks.......everything was perfect...and we knew then there was something there...we talked everynight via telephone at that time... He flew here again in December 2005 for two and a half weeks....and proposed Dec. 27...since then , I've purchased a computer, we talk every night on web cam and with a headset...so at least we can see each other....Pete visited again for my 30the birthday In April 2006....we are filing the petition now....

Question is.... WHATS AN AFFADAVIT OF SUPPORT????? :help: Has anyone filed for it.....????

The I-134 is the affidavit of support that you will need to use. Whilst an I-134 is not a requirement for K nonimmigrant visas, it is one thing that a conof can use in determining if the applicant will or wont become a public charge. The I-864 will be used when you adjust status in the US once you have entered on the K-1 and married. Whilst the guides state either/or depending on the consulate, this really should be changed as the only times an I-864 has been mentioned from consulates in relation to a K visa has been India (I think) and they were given an option of using either. It is however stated in the FAMM that an I-864 is not to be used by consulates for K visas.

As others have said....read the guides. There is also a pinned I-134 thread in the Foreign Embassy forum.

It sounds like you may of been erroneously included with the IMBRA recalls. If your received or receipt date on the NOA1 is prior to March 6 this should not have occured. It seems to of happened with other members as well. Get in touch via email and phone with NVC and inform them of such, as well as the embassy. Also contact the NCSC and explain the situation as according to the FACT SHEET they can make enquiries to the service center and someone will get back to you. This should be done by the USC petitioner.

Let us know what happens. All the best to you and I hope you get this resolved soon.

Another uncorrected error left over from an old form :blink: you'd think they'd get it right one day soon after all this time.

B.Give USCIS a passport-style color photograph of yourself and a passport-style color photograph of your fiancé(e), with both photos taken within 30 days of the date of filing this petition. The photos must have a white background, be glossy, un-retouched and not mounted. The dimension of the full frontal facial image of you and your fiancé(e) in separate photos should be about one inch from your chin to the top of your hair in 3/4 frontal view. Using a pencil or feltpen, lightly print the name (and Alien RegistrationNumber, if known) on the back of each photograph.

Whilst a denial of another visa (tourist etc) has no real bearing on the issuance of a K visa it may perhaps be prudent to make some mention of it in the initial petition to USCIS/DHS as if it raises any kind of red flag at the time of interview, having made USCIS/DHS aware of it and hence the petition approved, a conof has no basis in this regard to deny a visa/return a petition to USCIS for revocation. A conof can only do this if USCIS was unaware of any information at the time of petition approval.

It sure isn't going to hurt any to have it mentioned with your initial petition.

Yes but there is never any guarantees that your fiance will be granted entry. Many here on VJ have successfully visited their fiance/spouse during the process. Always a good idea to have on hand anything that can show ties to your fiances home country for if and when asked. This applies though for anyone visiting the US as all entering are looked on as intending immigrants.

O Gosh I just read the new I 129F form.......
OK here's the story,
my boyfriend has been accused of raping some girl years ago,from what I know she pressed charges against him but she never showed up in court and the case was dismissed.He was not convicted or anything.The woman was nothing but a liar and did this to him oput of God knows what reasons.
Now my question is what would he have to put in? Does all this effect him since there has never been a conviction?????????

The form is asking if any convictions. If there was no conviction then one would not have to include it.

If there had been a conviction he would have to check the appropriate box listed and obtain the police and court records.

Photocopies are fine for evidence, even of the birth certificate which proves US citizenship. USCIS no longer routinely requires original certified copies of documents. Your fiance should have any originals of anything submitted as a photocopy, on hand for the interview. Any translations though should be in the original.

Was the personals a Marriage Broker that requested a fee for its services eg? If not and it was just something like yahoo personals etc then that is not included, as per the IMBRA. I met my husband through the internet, but not through a marriage broker and if I was doing a K visa, would answer that question in the negative.

New to this - and sorry if this seems like a basic question but i am keen to get it right first time ..so i would rather look like a plank and ask than get it wrong just for the want of taking advice. Me and my fiance have know each other and been visiting each other since 2003 - however when question 18 comes along should he simply stick to the last two years or actually state we met in 2003 - and should we be furnishing them with actual mm/yyyy for the past two years only?

Grateful for any advice regarding this aspect of the I-129F as the rest is straight forward but i am concerned about what they actually want to see in this question

There is nothing that says you cant include details from before the 2 year period, as long as you can show that you have met in person in the 2 years directly before the filing of the petition with is the requirement of the I-129F. Use Q18 to describe in some detail of how you met in person, especially within that two year period and how it established the relationship. This should then be supported with the evidence that you will submit. What you are envisaging to do is to create an image in the minds eye of the adjudicator that you have satisfied the requirement of having met within the 2 year period.

Many of the USCIS forms have expired according to the dates, however they are still the current one being used.
