I know when completing the I129F forms it specifically said that all children claiming K2 visas must be listed on the form. You could not add them afterwards. It must be different if the father is the USC and petitioner - I would follow Aussiewench's links - she knows everything!!! I would also suggest calling USCIS for confirmation.

Michelle.....their child would not be applying for a K-2 visa as once the birth is registered the child is a USC and as with all US citizens they dont need a visa to their own country. There is no immigration process for the child.

Just thought I'd share the news to everyone that I found out my fiance is pregnant!!! :dance: . We did try to be careful because I wanted us to enjoy our time just together for the first 2 years before any additions, but hey - i'm still really happy. I also didn't want any complications in the process, specially with her family. Anyway, i've spoken to her family and everyone's okay with the situation and is willing to wait for the K-1 process. Still, I wish I could be with my love and our miracle. :(

Now I know this doesn't grant me any special case to expedite my petition so let's get off that subject. I do have questions though:
- Should I inform CSC of this situation? Should I write a notice/amendment to my petition and mail it? I just want to be sure just in case she has the baby before NOA2 or the interview that they're aware there's 2 people involved now in the petition.
- Should I just wait until she gets her medical exam and they find out she's pregnant? Or send the notification of her pregnancy with her packet 3 documents to Embassy in Manila?
- Is it true they will grant our baby a visa right away when my fiance gets hers? (read it somewhere here) or do I have to apply for that separately?

Thanks for any help and advice.

Firstly congratulations :thumbs: Read the below link for registering birth abroad. There is also seperate procedures for a baby born out of wedlock so make sure to read those. There is no visa for the baby as once registered as a USC all you need to do is apply for a passport for the child.

What you were reading was information in regards to DCF (direct consular filing)....a totally different process for those that are married whereby the filing & approval is done in the beneficiary's country as opposed to filing in the US at a service center.

I have convictions and reasons for other name hits, which are not a part of IMBRA so they shouldn’t be a problem. I’ve sent everything they asked for.

Regardless, if there is a name hit with the background/security checks it can indeed hold things up. This would happen even without IMBRA as background checks have always included those of the petitioner as well as the beneficiay. As suggested already, the only way you will know with any certainty is to have your congressman enquire on your behalf. Be prepared for the same answer though, as until your case is 30 days past processing they are not obliged to say anything but 'wait'.

Waiting is tough, especially when you see that you are outside of the current norm for VSC. I hope you hear something soon Andy (F)

There has been (the old site) cases of RFE's being sent for overlaps in timeframes which is why when the pinned RFE list began, I made mention of such. As you have indicated, a seperate attachment seems to be the best solution and indicating the attatchent on the G-325A just as with any other attachement.

What do you mean over lapping jobs, specifically? That you held two jobs (old and new) simultaneously, prior to transitioning to one job?

If that is the case, use a separate sheet of paper to capture these details. Be sure to list form and line number on the separate sheet.

For example, if you worked for company X from June/2003 - June/2005, Meanwhile picked up a second position at Company Y in May/2005 until present, then list them on the form this way, in chronological order.

If you feel compelled to provide more detail, do so on a separate sheet of paper.

RFE's are generally for missing evidence. No need to over analyze every little detail. Rather, make sure you provide everything that is asked for, with respect to evidence.



I've been hearing different things about how to report employment history on the G-325 and I just wanted some clarification so I don't get RFE'd when I send the petition.

How do I list jobs that overlap eachother? I've heard some people have gotten RFE'd for that.

Also, my fiance doesn't have much of an employment history, but has had a number of internships. Should those be listed?

I'm pretty sure I sent copies of EVERYTHING (with a note on my coversheet that originals could be provided IF NEEDED).

How am I certain?

My copies intended for USCIS were blown out of my hands on that windy day, so I swapped the copy of the payment with the ACTUAL payment from 1 of the other 2 copies I had made. I also had to move the passport style photographs.

The originals were stored safely in a folder after I had copied them.

Of course Olga has the originals now for her interview.

This includes I-129F and both sets of G325A, UNLESS this has changed since April.

If you only sent copies of the forms with the initial filing that didnt have an original signeture and they were accepted, then you were extremely lucky to get away with it.

Hi Bruce and welcome to VJ!

I just looked at my own G-325A (I am the beneficiary) and I put the month that we filed, so for your finacee, if you are filing this month, I would put 09/2006.

As for your question about the second part of the employment area. I put "same as above" as my answer because, of course, all my employment was 'abroad' if you will.

Not sure if you have seen the sample forms, but they are really helpful. That being said, a wonderful VJ member double checked my forms for me as I was paranoid as hell. :blush:

Thanks! I have looked at the examples, and I still question it. :) For my question 2 the example is blank. And while 09/2006 could be put where you say, what happens when the petition is worked on and/or the interview occurs and it says 09/2006 in that field? "Present" seems more appropriate I think.

I agree on 'Present'. Just write it in by hand. There is no points deducted for using a pen :P

Original birth certificate, passport photos, criminal record & proof of being single are all things that would be asked of the applicant (your fiance who is applying for the visa). Sometimes certain consulates ask for certain documents from the USC but not generally.

Photos and other evidence of an ongoing relationship are also required as is the visa fee of $100. Im not sure on the cost of medicals in your fiances country but its not cheap no matter which country.

Regardless of what resulted with your friend I would still seriously look into WHY the petition was transferred to NBC where the spousal I-129F's are processed (K-3). Fiance petitions are not processed at NBC. Either contact the NCSC on the 1800 number and try to get someone to put in an enquiry for you to NBC, and contact your congressperson if you have no luck in finding out through NCSC as to WHY your petition is at NBC.

yes [b]aussiewench[/c] were still married here in the Philippines but when i went to my K3 interview, the consul told us that they're not considering/recognizing our marriage hence it is null and void due to technicalities.. and yes also, we did some legal research and opinions and they told us to go throught fiance route and just remarry in the US when i get there.

my husband called USCIS and they said we should hear something in the next 3 weeks as they are just now getting to those papers and that it is still within time scedule for 3 to 4 weeks more

actually i met a filipina who has the same case as mine, her husband is a USC servicemen and the woman got 2 kids from previous husband (also marriage was declared null and void) and 1 kid from american husband.. they did not filed for annulment of their marriage and instead went through fiance also... and they were approved last month.... and so with their kids..

im hoping for that nice turn of events too..

You do seem to have a problem however. They transferred what was filed as a fiance petition across to NBC which means they are processing it as a spousal petition (K-3). Were your marriage details etc included with the I-129F petition?

The problem seems to be from my understanding of what the OP has written, that they are still married and as such would not be able to file for a fiance visa, even if it was advised for them to do so........hence the transfer to the NBC as a spousal petition.

Did you seek legal advice prior to filing? If not, it may of been wise to have. Perhaps its time you asked for your congressperson to look into things. All the best.

Your case was transferred to MSC (which is now the NBC)? That is odd indeed. Are you sure about that?

The only processing centers that handle K-1 petitions are VSC (Vermont) and CSC (California). Please clarify.

here i am again... venting.

Our case is quite complicated. we were married here back in 2004 but i was denied to K3 because my annulment decision (declared fraud, illegal and null and void, august 2005) and my marriage to my husband (2004). we were advised by the Consul and consulate officers here in Manila that if we do not want to annul our marriage is that we can go thru the fiance route.. and so we did.

we filed it to CSC Service Center and they transferred our papers to MSC (see my timeline) and until now, we haven't heard anything.

im starting to loose hope :(

Just to clear this up after recovering my composure from heishe's post :P

The consulate approves/grants a visa.......the service centers approve the petition. One needs an approved petition in order to apply for the visa. Two seperate processes by two seperate departments.

The process is the same regardless of service center. See HERE and HERE

At Vermont, the application assembled into a file by people who do that, then sent to adjudication and entered into their records (NOA1) then enters the adjudication queue. The adjudicators look at files when they make it to the front of the queue and either approve or RFE.

At California, the application is assembled into a file by people who do that, then sent to adjudication and entered into their records then put in a storage box at the back of the third stall on the second floor ladies' bathroom. Sometimes they move the boxes to clean the toilets, this is known as a "touch." Once every four months, the CSC adjudicator hauls out a box to go through the files and either approves or issues RFE or, if he feels like it, tosses aside unopened. Then he glues the applications to his office ceiling. It takes three to six months for the glue to weaken sufficiently for an application to drop back to the floor. Every morning when he first arrives he picks up the applications that have fallen from the ceiling, and because they have shown the most effort, forwards them to mailroom so the applicants can be notified.

P.S. I made that up.

Not even a copy is required as you have completed your phase as the petitioner. If an original of your naturalization certificate was required it would of been requested at the petition stage at the service center. I have rarely seen posts whereby any original documents are requested from the petitioner at interview stage other then what is required of a sponsor for the affidavit of support and also a new letter on intent. An entire copy of the petition sent to service center is also not a requirement even though it remains in the guides here on VJ.

The person posted in this forum, but is referring to an I-130 which is a K-3, yet they still have K-1 listed on their forum profile, and their timeline says K-3. I think the person who posted that topic was confused.

Point of clarification cause I cant help myself :P I-130 is a petition for alien spouse which is used to gain immigrant status either from entry to the US on a K-3 (which needs an approved I-129F) or for the CR-1 immigrant visa. In order to file the I-129F for a spouse which leads to the K-3 visa, one needs to have already filed an I-130.

No you are not able to file both for a fiance and a spouse at the same time. Some members just get a little confused like the member from the linked thread Arazia referenced. They have filed for K-3 but in doing so they have also filed for CR-1 as an I-130 is required for both.

Will there be someone who can receive your mail and inform you if you should get an RFE that you need to respond to?

And will you be able to provide financial sponsorship for your fiancee should she need it? (Most Phillipinas do need a sponsor, and the anecdotal evidence is that the consulate in Manila takes a dim view of any sponsor other than the petitioner.)

I was wondering if anyone had sent their I-129F petition in to CSC and then went over to the Philippines to wait for it's approval. I am planning to go to the Philippines on November 5th and stay until April 22nd, 2007, (maybe longer). Hopefully I can be there to help my fiancee with her preparation for her interview. If my I-129F gets approved while I am over there, do I have to come back to the states for anything concerning my fiancee's interview? I submitted my I-129F and CSC received it July 18th. I am taking copies of everything I submitted with my application over to the Philippines with me. Thanks for any help anyone can provide.

How one answers Q18 is going to differ as it is dependant on individual circumstances. The format it takes can be in letter or perhaps timeline format. Use Q18 to describe in some detail of how you met in the required 2 year period that established the relationship. Then the evidence you submit should support those details. Boarding passes, passport stamps, hotel/credit card receipts, rental receipts if ever lived together etc etc are primary evidence. Photos are secondary which support the primary evidence. What you should be aiming for is creating an image in the minds eye of the adjudicator......a complete picture that takes in both Q18 & the evidence. Look outside the box for evidence that shows you both in the same place at the same time. Each case is different and you should submit evidence accordingly, not just rely on the standard unofficial list.

Actually I was not approved....yet. But the biggest thing that prevented it is now not in our way. I got a good feeling that thing will get approved in the coming days or weeks. After 302 days I can be patient. I don't know how many of us are still left from 2005. Maybe a hand full. I was also told through the liason for the congressman that they will not move my case to California. Will see if this is true. One more thing when I get the approval you will hear me yell all the way to New York ( I'm in Chicago) Thanks for the pre-approval

oops....That will teach me to read with my eyes half closed. Thats twice I've done something similar in past couple of days. What a huge weight off though Scott, knowing you are clear of the checks. You're right, the approval shouldn't be too long in coming now. I don't think there is too many at all left from 2005.
