I put pretty much everything in the package that was relevent, as I was dreading getting a RFE. I only went on ane trip to the US, so I put in:
all my boarding passes, itinery etc in there
3 photos of us together
copies of letters and the mail bags they were sent in
copies of bankcard statements and phone bills

IMO it is better to put too much in than not enough. Good luck on your journey!

Personally, I'd be happy to help her find another guy and start over (not me of course, I'm already taken). It sounds to me like she's not trying to break any laws, she just wants another chance and wants to know what the problems will be.

I think that when the facts are looked at there are none that I have seen that were really approved from NOA 1 to NOA 2 in 15 days.

Some people get a little confused about the facts. It is certainly possible to happen but not very likely. Dont be disscouraged if you are like most of us that have at least a couple of months or more to wait for the approvals.

My I-130 was approved in 63 days and that is amazing in itself, but 15 days is very, very rare, if it eve happens.

That OP also said the petition that was sent in March didnt go through for whatever reason. Not uncommon either for a petition to get lost in mail etc. We have to take that approval on face value as she states, mainly as it is not uncommon for 12-15 day approvals from VSC. I have seen many out of VSC that where approved within days of NOA1.

OK, I know its VSC but is 12 - 15 days from NOA1 to NOA2 for real ???? Congrats if it is!!! I just sent our I-129f last month with the new form and am also wondering how much an affect the new form may have on the time frame. That, and great information from VJ on what the IMBRA form was already asking for.

I think I'll start a new thread to find the time line on NEW I-129f's filed and NOA2 approvals.

I still pray for the Pre-IMBRA folks :thumbs:

VSC is historically known for these types of fast approvals. I also asked the question earlier though as to the actual speed of the approval as I feel that the NOA1 notice date was used instead of the NOA1 receipt/received date. Could be wrong but it is a common mistake.

Firstly Congratulations :thumbs: Not historically unusual for quick approvals such as this from VSC

I would like some clarification though as to just how quick it was, for statistic purposes in the timelines.

From your timeline....
I-129F Sent : 2006-07-06
I-129F NOA1 : 2006-07-31
Was this the NOA1 date or the received/receipt date on the NOA1 as it does make a huge difference and it would seem by the timeframe in between that you may possibly have used the NOA1 date which is not the correct date to go by as this is only the date of NOA1 generation not the date it was received and that they go by.

It is normal to not receive an RFE....if you (1) submitted the new I-129F containing the IMBRA related questions (2) If everything was complete and didnt require further documentation or evidence.

We've been approved in 15 days! We just feel wonderful but we wonder how could this be possible? Guess what no RFE yet..... Is it normal? Our NOA1 took longer then NOA2. I've learned according to VJ website that people's case approval takes longer then 15 days I've seen that some of them waited more then 60 days. It is really amazing that we've got approved within such a short frame time. I wish everybody would have good luck. :dance:

Is it just me or does Vermont seem to process more quickly than other centers?

Prior to IMBRA VSC was in general streaks ahead of other service centers in processing both I-129F's and I-130's. VSC was so fast that they approved the many many cases you can read of that were recalled from consulates etc because they didnt comply with IMBRA. They were way ahead of the eventual implementations put in place at service centers to address IMBRA. Now it seems they may be back on track somewhat to doing same again. They have good leadership, and its just a shame that the other service centers dont have the same.

I read this as skip the application for a fiance or spousal visa, enter on a visitor visa, get married and then adjust. How does he NOT have intent to immigrate if his fiance has a baby on the way. I didn't see anything about returning to Australia after getting married . . .

You dont apply for a visa without having to return.

I had intent to marry when I entered, whats the difference. It is up to them to decide at POE if you have intent to immigrate. It is not illegal to enter and marry on a visitors visa nor VWP. Just as it is not illegal to enter the US once you have a petition in process.

1) DUMP the lawyer. What he has suggested to you is immigration fraud and could result in your visa being denied and your deportation. In fact, you should ask him to explain to you how you could legally enter on a tourist visa, where you are required to swear that you do not have intent to immigrate, when you obviously have intent to immigrate with a baby on the way. What an ###. Plus, you do not need a lawyer to file for a fiance visa.

DCF in australia is a cake walk and as easy as 1 2 3. The USC does not have to be a resident of Australia in order to file direct with the consulate. You do however need to be married. Read the DCF guide available in the Guides tab at the top of the page as well as visit the DCF forum.

You should check out the DCF forum for the aussie threads. You can marry your girl, and file here in australia direct with the consulate, saving you a hell of a lot of time. Australia is one of only a couple of consulates that will allow this with the USC not being an australian resident. You wont be disappointed with what you read and many australians opt for this because of its ease.

That would be so cool to show up at the interview with her. I don't think there is any better proof than that.

Once your petition is approved it is sent off to the consulate via the NVC. The wait time for interviews in Manila are 4-6 months on average currently in themselves, so an Oct/Nov interview is out of the question Im afraid.

The NOA1 date is the received/receipt date on the NOA1. The date that they also stamp on the petition when they receive it.

Hang in there, yours will come. They are running up to 3-4 weeks in many cases at present in sending out the NOA1's.

Well three things using the common logic:
(1)>>They had RFE for the first application so instead sending the RFE they filed the new I-129F which brough up the data of first I-129f and that speeded upi the process
(2) If the case is approved within this impossible miraclous time then i am wondering embassy would be little reluctant to issue the visa because they can put the application on AR any time.
(3) I would be pissed off at the damn USCIS if any application is approved before other application which were filed at the same date and having a crystal clean background.

The timeframes are neither miraculous nor uncommon from VSC. This is how so many petitions were approved erroneously, forwarded to consulates and then were recalled due to IMBRA.

If your fiancee walked across the border and their is no document of him being here, then he should simply walk back (if at all possible). No document of him entering or leaving is better than him being documented and leaving. Waivers are difficult and slow

Once he is in Brazil, get married, apply for K3 and come to US and adjust status. By getting a marriage license, it shows ur intent is to marry. So why not just get married and apply K3. I dont knwo why people are waiting for K1s. K1s take longer than K3 and just more hassle.

Getting good legal advise is good but remember attorneys often have the habit of complicating cases.

Regarding the bolded text above... When did a K-1 start taking longer than a K-3? I was under the impression and been told by others that the K-1 route was quicker.

That has usually depended on the service center one had to file the I-129F with, as the NBC where I-129F's for spouse are filed were faster in a lot of cases then I-129F for fiance from eg CSC, TSC or NSC. This of course was happening pre-IMBRA. Now they are about on par with each other in a lot of instances.

You dont need the affadvit of support which is required for the spouse visa. In k-1 you just submit I-134. In that case you may not need to have poverty line restriction. This poverty line requirment is for I-864 when you apply for AOS or K-3/souse visa.

Check with the consulate site or with others going through same consulate to see what they require. Some will require that the sponsor is 100% of the poverty guidelines, others 125%.

The I-134 is only one thing that a conof may use to determine if the applicant will or wont become a public charge. Hence why in many cases documentation and requirements outside of what is instructed with the I-134 is often needed eg tax returns. Consulates vary.

My foreign fiancee' is currently filling out his side of the G-325a question. There is a section asking for all residences in the past five years, and then another question underneath it asking for the last residence outside the U.S. Does he have to fill out the second question? If so, I assume that would be his last residence that he stayed at for over 1 year?

Also, he lived in another place prior to the five years asked for on the form, but it asks for starting and ending month of residence. What should we do if he cannot find out exactly when they moved to the current residence?

Once you have listed residences for the past 5 years, you then need to answer the question of the last residence lived at for more than a year outside the US. This address can be one of the ones already listed or other, no matter how long ago that was. If you cant remember exact dates give an approx. Just make sure that when you complete forms later on down the track that they contain same info.


You can put 'student' in employment section.






I did not see a side for the fiancee to fill out. I filled out all the information based on me and they accepted it right a way. Hope you get some other opinions.

We have a question. We've reading some posts where people say their case is on hold at USCIS level because they are in security checks?

Question: How do you know that you are in security checks? Who gives you that information?

If a petition is way past processing dates there is a more then pretty good chance it is due to the background/security checks.........that one has had a name hit or there is a security issue. To confirm such, one can request that their congressperson make an enquiry on their behalf.
