Before a ban of J-1s for AOS was instituted, they would come here and somehow fall in love or propose to people these J-1s barely knew.

That is why they were banned from AOS.

And when was that? There is no ban and there is documentation to show that from many that have done just that. Also read the link I posted. As long as one is not subject to the two year home rule then one can apply to adjust status. Even if one is subject to the home rule they can file for a waiver of that rule.

I think you will find that it did indeed go via the NVC as all petitions do. It is not uncommon for K visa petitions to show up nothing on enquires to NVC and then suprisinging show up at the consulate post. K visa petitions are often only at NVC for a quick pitstop of a couple of days, other times weeks or months. The operator you spoke to may also have made an error in keying in your receipt number etc when you made the enquiry. Wouldnt be the first time.

That particular question on the I-129F is not set out very well. If you look at the same question asked on the I-130 it lists 'birth in the US' and 'Naturalisation' beneath each other with the box for certificate number connected to the 'Naturalisation'. Not only is it from experiences that this is tried and tested to only put the certificate number in relation to Naturalisation, but lawyers also reference this on various websites. Other members though have put BC numbers with it causing no problem. I imagine the adjudicators see this quite a bit because of the way the question is laid out. There are other errors eg the instructions still mention 3/4 face for the passport photos, when it has been full frontal for a long time now. They just keep reprinting the same error.

I'm sorry that this has happened after all your waiting. Suggestion: It may be quicker to just refile and cut your losses, then to stuff around waiting longer for a response from the service center. If it was denied you could file a motion to reopen but I don't think this option is available for a cancelled petition. Someone hopefully has a definative answer on that.

You can read more about foreign residency requirement, eligibilites and applying for a waiver when you are on a J-1 exchange visa HERE, if it applies to you.

If the two year home residency requirement does not apply to you then you can adjust status through marriage to a USC. Read HERE

As other members have said in the past... you are building a picture here. Each piece of evidence on its own may not be terribly strong, but it is the complete package that creates the impression formed first by the Adjudicating Officer (in the US, for the petition) and later by the Consular Officer (in India, at the interview). Everyone's suggestions for evidence are good.

Boarding passes show that, not only did you have a plane tickets, but you actually boarded the plane. A credit card statement shows payment for the flight. I'm sure passport stamps are good, too.

I have heard on VJ of people getting their petitions approved without any photos. I imagine their other documentation would have been pretty good...

Since you don't have photos, the suggestion of affidavits from those who spent time with you (together) while your fiancee was in India, sounds particularly helpful to me. And emails discussing the trip before and after might also be useful.

You might also suggest to your fiancee that she provide a somewhat more detailed answer to question 18 on the I-129 form (fiance(e) visa petition). Many people just use the space provided (one line) on the form, and write only one sentence. But you can write more, and I would think a little story - no more than one page- might be helpful in constructing this picture for the Adjudicating Officer who will be reviewing her petition application.

Posted in many threads regarding evidence of having met.

Use Q18 to describe in some detail in an attachment, of how you met in the required 2 year period that established the relationship. Then the evidence submitted should support those details. Boarding passes, passport stamps, hotel/credit card receipts, rental receipts if ever lived together etc etc are primary evidence. Photos are secondary which support the primary evidence. What one should be aiming for is creating an image in the minds eye of the adjudicator......a complete picture. Look outside the box for evidence that shows you both in the same place at the same time. Each case is different and one should submit evidence accordingly, not just rely on the standard unofficial list.

I did and I am including it in my second K-1 to show that I was on top of things and earnest about getting my fiance here.

While Aussiewench is quite an authority on almost all things K1/K3/CR1 visa petitions, I think it's assumed--and rightly so--that 99.9% of the time petition validity extentions are granted automatically. A VO/CO can deny your visa too. They have final authority of course but it would be rare for them to deny an automatic extension, especially due to no fault of your own. They probably wanted to deny your visa but used the validity period instead. I'm really curious to see if you get approved this second time around.

I am just reluctant to just go along with the 'automatic' crowd after doing some research of my own and of hearing and reading of those that have had issues in the past with the revalidation of petitions. Hence why I pointed out that it can be dangerous to just assume that it is automatic. e.g. The reason why a second 'Letter of Intent' is required once a case is at the embassy/consulate is for this reason. To show that the intent still remains to marry once in the US and that the petitioner still wishes for the visa to be granted. Some consulates request a new 'Letter of Intent' as an automatic, some do not.

Also, a reply to a thread on the revalidation issue was posted some time back and perhaps the member with the entire story on it will see this and post, of cases where the date of revalidation was not recorded in the block on the petition and in the past it had caused problems at the POE with those entering on K visas.

From the FAM....
When a K visa petition is revalidated, the notation “Revalidated to (date)”
should be placed in the “Remarks” block of the petition over the signature
and title of the consular officer. The date of the revalidation should also be
shown.

There is no reason to stress over the issue, but being complacent and not knowing what can occur sometimes can cause a great deal of stress if it does happen, especially when it may of been avoided.

It should be kept in mind that whilst a petition can be extended and usually is, it is not a foregone conclusion as it is totally up to the consulate as to whether they grant the extension. To avoid any possible problems at POE the extension date should also appear on the paperwork as there has been those in the past that have had issues due to the petition being expired when the visa was granted and the date not being recorded to reflect the extension. Not trying to scare anyone, just trying to say that an extension should not just be accepted as automatic. That can be dangerous.

The question is applicable. A beneficiary eg may have at once stage had an A number. A USC may of had one unless a USC by birth. A beneficiary will also be assigned a case number during this process. An answer IMO is better as it lessens the chance of a RFE when an adjudicator may ask themself, why is it not applicable. This goes for any or most questions asked.

In your timeline it states Sep 1: Contacted Senator: "Your case is with an adjudicating officer", so doubtful it is lost. As you haven't heard anything and it has been with an adjudicating officer, there is a good chance you are now held up in background/security checks.....name hit etc.

Another call to your congressman would not go astray, even if at least to find out for sure if it is in background checks.

I live in the UK and my fiancee lives in the US and we have just had our K1 approved :D. I have received my forms, checklist etc from the US Embassy and am in the process of completing them.

However I am planning on visiting my fiancee for thanksgiving and I am concerned that I may not be allowed to enter the Us. Is there anything people could suggest that I bring with me to help prove that i plan on returning home and that it is just a holiday. I live with my parents which means no lease or utility bills. Any help would be greatly appreciated as my fiancee is extremely nervous that I wont be allowed to enter.

As Sarah mentioned it will be a risk and you'll have to keep your fingers crossed that they may allow you to enter the US. They generally deny the entry into the US while your K-1 visa is being processed.

Not true. Many have entered with no issues at all. Stating generally would IMO be an overstatement and much depends on circumstances and the CBP officer.

did a search and a user by the name of "Matt Stevens" did a k1 in vietnam about the exact same Time I will be doing it. his case finished in 5 months. If I get my case done in 9 months, then it's possible to go through. I hope they dont give me a hard time.

Keep in mind that matt to my knowledge filed pre IMBRA. Things have been moving at a slower pace generally since the implementation of the IMBRA. Much also depends on the service center you have to file through, amongst other things.

If she is returning home, I would leave it at that. If she changes her mind, there is an option to request the consulate to reissue the visa. It does however have to be within the initial 90 day period and there is no guarantees of them doing so even though it is open to them to do so. Actually what I am tying to do is both.... She went ahead and had all the documents translated based on the "embassy" standard (if I can call it that) which resulted in a process that may be superior but nonetheless different than the lesser USCIS standard.....

Which may or may not cause confusion to the one adjudicating the petition when it is not the standard. I really honestly don't know. If many others have submitted 2 translations, and had no issues, then I would go with their experiences.

I am sorry to have to contradict you, lucyrich, but in countries such as Romania, Ukraine or Moldova, the translations signed by any sworn translator are recognized as long as the latter's signature is certified by a notary public. Fwaguy says he had them translated at a specialized agency in Ukraine, meaning his papers followed all the steps considered legal in the above-mentioned countries. Also, if the final translations - the ones into English - bear the phrase "Translation from Ukrainian" (as any properly translated document should), he needs to provide USCIS with the intermediate phase documents: the Ukrainian translations. Let's not forget that the originals are in Romanian. Of course, fwaguy has another option, he can choose to find a person living in the US and speaking both Romanian and English and ask him/her to translate his documents as you indicated in your post.

There is a difference as to what is required by DOS (consulates) then what is required and accepted at USCIS when filing the petition. lucyrich was citing USCIS rules for when filing the petition.

It's just that the requirement is to only prove 1 visit, right? So I only, really, and completely have to prove 1 visit, right? No RFE if I prove 1 visit well enough.

But okay, I'll go back to showing proof of 3 visits. :blush: Do you think the passport stamp, translated flight itinerary e-mail, baggage sticker thingies (you know, the green and white ones, they show Air France, his name, and the date without the year just 28 OCT), and 3 pictures of us together is enough evidence for His October visit? I don't think it is - with boarding passes I'd be comfy that it'd be satisfactory, but I don't have his boarding passes. The green/white baggage sticker thingies I have are from his connecting flight between Detroit and LGA, I don't have his Paris to Detroit ones, but they do say Air France on them.

That picture of us together in the Bronx while he was a friar... what would I do, just guess a date in November or December of 2004 and write it on the back? I don't know the date or even the month when it was taken. I could get a letter from one of the friars stating I was a volunteer between this date and that date, would it have to be notarized? Then I'd have a copy of his R1 visa, a letter stating I volunteered from this date to that date, and 1 photograph. That doesn't sound like a lot to me. I don't know what else I could get.

No its not only one visit proves it. What you have to prove is having met. Sometimes that can be accomplished from the evidence of one meeting, sometimes not.

You are looking at each individually instead of looking at the complete picture.
