Hi Grace smile.gif I honestly dont think your going to get a RFE for forgetting his social security number ... the question is social security number if any ... since his the beneficiary it would be assumed he hasnt got one ... When he gets his pack 3 and fills in those forms the question is asked again, he can fill it in then ...

If it required and you need to fill in something, Im sure someone else with more knowledge will be able to tell you exactly what you need to do and what form needs to be filled out ...

No the $455 is the only fee you need to pay ... apart from that youll have t he fees for the medical and police check fees .... there will also be a visa processing fee its $130 american dollars that gets paid before the interview and receipt produced before the visa is issued ... apart from that there is no other fees until you do the AOS and that ones $1010...

If your not the US citizen they dont care if you work or not .... The US citizen has to prove they can support you, if they do not earn over the 125% poverty line then they will need to find a co-sponsor ...

Im not working at the moment (Im the Beneficiary) and in that section I filled in that I was a volunteer receptionist (Salvation Army Relief Centre) and filled in the details as if I was employed ... Ive been part of the organisation for 4 yrs so I felt that it was acceptable even thou I am not getting paid ...

I am not sure if this person is a troll or not but theyre story definately has me curious ... My mother has had a stalker for several years and the irrational take on the situation is very similar ... This woman also lives in his small town and enjoys sabitotaging his life if she gets an opportunity, she is now married to a relative and my fiance has to be careful there mail doesnt get mixed up in their POBox's or she will destroy it ... she has caused endless rifts within the family etc ... At the moment things are settled but its only a matter of time before the timebomb goes off as it has several times over the years and usually its over something trivial and then we start on the gay sites, slandering etc allllll over again...

Tickles, your story may be unique on VJ but its not unique on other types of forums ...

You need to delete your facebook, myspace and livejournal accounts and start new ones using a unique username and not your name ... changing your password will do nothing since this person would have the page bookmarked ... once you change these pages set them on private and only allow people you know are real friends join by invite only ....

Also change all your email accounts ... again, do not use your name or variations of your name and instead use a unique username eg TicklesRox1975@*******.com something along those lines .... make sure those are set on private also....

FBI may not be able to help you because your reside outside the US but your country will have an equivilant eg Federal Police, CIA ....

Lastly change your mobil/cell number and landline and get a silent number... and only give it to personal friends ... I suspect your brother is not the only person you need to watch, I suspect you may have another informant getting back to your stalker...

Far as your petition goes, how will this chick know what your doing unless your telling everyone ... get yourself a PO box so you know your mail is safe and keep it zipped, no one needs to know your business but yourself ...

As far as evidence goes you will need photos, phone records, emails, messenger chats, letters, cards (birthday, valentines) ... proof of gifts can be used to (eg my fiance sent me flowers and fruit basket) ... we prob went a bit overboard but he submitted things like bus tickets that were purchased in my local area and entry tickets to theme parks were we took photos together ... Pics of you with your fiances friends and family are great to, shows they approve .... We also had several letters from people that spent time with us both and a couple cards given to us both by a third party ... Obviously you dont need every single thing but that is they are the sort of things that are used as evidence ...

I met my fiance on a writers fan site .. we are currently waiting for me to get an interview date and have my interview and we've had no probs ... As long as you meet all the requirements and have all the evidence you will be just fine ...

I hope your fiancee stops worrying, this is a stressful process and the last thing you both need it to worry about stuff that is not going to be an issue on top of everything else.

I think it depends on the Embassy .... with the US Embassy in Sydney we have to send all original documents in before the interview ... they wont schedule an appointment without the required documents ... Which has got me very nervous because I if I dont get them back Ill have to go get them reissued @ $50+ a pop ... They also wanted an original birth certificate and marriage certificate ...

By original they mean ones that is issued by the government department with the official stamp and not a photocopy.... it doesnt have to be the original you received on your wedding day...

You usually get NOA2 around 3 months after your NOA1 some have gone over thou ... Soon after NVC will send you a notice saying that things have been forwarded to your fiancees countries US Embassy .. but yeah have a read thru the guides also look at the downloadable forms in downloads and the example forms .... that way you can start gathering what you need for Pack3 and you can submit everything after you do the medical and police check...

Evidence = phonebills, photos, letters, cards, chats from messengers ... you can also keep things like receipts for gifts like flowers because it would show that you purchased and it was delivered at your fiancees adress... If you have an engagement ring the receipt is also evidence but you DO NOT need to have an engagement ring ... and lastly boarding passes, trip itinerary etc ....

But yeah, plz fill in your timeline and possibly a basic profile, its so much easier to help if you know at what stage people are at.. What country your from helps to since things are little different between countries ...

AnnexoxShay - any child you have in the US will be American and will not depend on your immigration status, AOS, green gard possession.

Regarding dual citizenship, I don't know about Australia. You'll need to check that independently. Most likely your child will be a dual citizen from birth.
That was my case - I was born in the US to Canadian parents, making me a dual US/Can citizen at birth.
Later in life I acquired Israeli citizenship as an adult, and now hold 3 passports.
My kids have 4 (Canada, Israel, Brazil, US). - tthe first three at birth, and the US status obtained via legal immigration to the US in 1999 followed by passage of the Child Citizenship act in 2000.

I assumed thats how the duelly worked see my parents are both greek citizens that immigrated to Oz before I was born and I was able to enter Greece (as a child with my grandmother) and remain in greece for 11 or so months without any special visa ... I had a look a few days back and couldnt see anything about Greece or Australia needing anything specific apart from a least one parent being a citizen .... Now Im not sure about any children I have having automatic duellies in greece, Id have to check on that but I know I have.... But I will check into whether the births have to be registered with the Australian Embassy in the US...

I have nothing to add regarding the OP's question about his own visa options - that's been answered correctly many times here already.

I just wanted to jump in on this one point about the baby.
The baby *most probably* will be born a US citizen due to the mother being a USC.
However that's not necessarily so.

- If the baby will be born in the US - he/she will be a USC from birth.
- If the baby is born outside the US - he/she will be a USC from birth assuming the mother met the residency requirements throughout her life.
- If the baby is born outside the US and the mother did NOT meet the residency requirements, the baby may not be born a USC. It would then be determined by whether the grandparents - the mother's parents - met the residency requirements.

I point all this out because we know nothing of the mother's US status or intentions, from the OP's post.
This may make a difference in their plans, too. For example, if they decide that due to how long it wil take to complete K1/K3 filing that the OP's fiancee should travel to his country and stay with him there for the baby's birth, this could have an impact on the baby's US status.

Hi smile.gif I have a couple questions regarding this statement .... I already knew that if you were a non US citizen and had a child in the US it didnt automatically give the child US citizen status ...

My question is at what stage will a child born to a non US citizen be considered a citizen... eg will it happen once the non US citizen marries a citizen and they have a child after they are married? when they get the 1st 2yr greencard after they do AOS? or when they get the 10 greencard?

Im very proud of my country as my fiance is proud of being a US citizen and ideally we would love our children to have duel citizenship ... I just assumed that once we were legally married any children we had would automatically be US citizens actually duellies since they would have a Australian citizen parent...

When your dealing with immigration there are no miracles ... they want cold hard facts and evidence that you are a couple and that you meet all the minimum requirement for filing .... At this stage if you want to continue your fiance will need to get letters from his doctors stating that he is incapable of travelling due to his illness and chemo that he needs for treating his illness .... and you will need to find out what you need to provide as evidence of hardship which is holding you back from visiting your fiance ...

You just answered your own question ... they want evidence that you have met within the last 2 years, and not a day over .... There are only extreme cases were they will accept a petition when the 2 people have not met ... religion being the biggy, health reasons were one of the couple is unable to travel and the other has been denied a tourist visa ... even then its difficult ... why did your fiance file when you hadnt met previously, thats a lot of money to blow when you obviously didnt meet the requirements ...

Most of them I copied verbatim (well, changed names and such) and had not a single question in the entire process, (I had questions, sorry, I meant questions asked of myself or wife in the interviews) but I studied these forums and guides every night for weeks and weeks. I still do because I am not done yet and now I hope to help someone that was nervous and worried like I was.

Yup, totally agree ... I think I would have freaked if it wasnt for VJ and the Example forms, they made everything soo much easier ... I've had to ask a couple little questions but mainly because of reassurance rather then not knowing ...

laughing.gif mind you the first run of the forms (for pack3) I actually sat there for over 2 hours and tried to remember every single place I lived and wrote each address and then when i reread thru the forms I realised what I had done, smacked myself in the head and started over and put down only the area instead of the full address ...

I have been reading and reading and reading. Yes Sir, I read them and then I just re-read them and answered part of my question. I NOW know for sure which one to use. You see, I am on this forum to learn and to get my visa petition file quickly as I am leaving to visit my fiance in a few days. If a person finds all he needs on the government forms, then there is no real need for this website other than a place for people like you to talk down to others. As is so often on the internet, forums that are intended to share information are hijacked by people who claim it as their own personal homepage.




Seriously not Kewl no0pb.gif We are here to help you all we can, most of us are busy trying to get our apps together ... being told to go read isnt being talked down on ... the reason your being told to read is because you will find a million answers to a million questions and armed with the answers you can submit the apps sooner ...

But anyway your doing the I-129F????? Click on Downloads up the top of this page ... then click on the link for K1 forms ... and you will see you are required to DownLoad G235A ... it needs to be filled out 4 times, signed etc ... NO PHOTOCOPY each must be original....

See the link right next to downloads called Example forms ... look there too, it will save you a million other questions as each form has been filled out so you can see what is required ...

Filling a timeline is good ... so is letting us know what country your fiance is from ... it will actually help answer some of your questions faster as different embassy's have slightly different requirements and people that went thru that embassy for their appointments can give you better answers...

Initially, Shay and I met at a writers fan forum where Shay had just become a member ... I had been a member for about a year and was posting stories I was writing and Shay and I started chatting when I volunteered to read some of his work ...

Within a very short period we became friends and started chatting everyday on yahoo and after a bit we started talking on the phone ....

Its been 4 years and 4 months since we first met and we have several hours daily contact ... we soon got bored chatting on yahoo and now just talk on the phone but I agree with the others you develope a much deeper relationship when all you have is a phone or messenger to communicate with .... Your able to disguss or open up to topics/past experiences etc that you never would have if you had met in a more conventional way ...

In person, unfortunately we only got to spend 5.5 weeks together ... There were many reasons why we were unable to meet earlier or for longer .. main reason being Shays was caring for his elderly (94year old) grandmother who had Alziemas .... When we did meet it was like we always had known each other, there were little things to discover like habits but overall I think we had both got a good picture of what to expect thru the verrrrrry many hours of yapping ... The other bonus for us was the fact that we are very similar personalities .. this can be a bad thing as people can clash but in our case it worked in our favour because not only do we have similar personalities we have similiar values so tend to have very similar opinions on various scenarios/subjects ...

I feel soo bad for guys like you ... being apart is soo horrible but to be seperated is even worse ... I know what Shay and I went thru when he had to go home after 5.5 weeks I cant even begin to imagine how hard it would have been if we had been together for months or a year and then had to be seperated to do this ... Our saving grace was the daily calls and only because he works nights .. if he had worked days it would have been almost impossible because of the time differences...

I think a lot of people start getting nasty because they get sick of hearing the same thing over and over ... Its so unfair I had to wait 5minutes blah blah blah ... its hard for everyone, I know its worse for some because the usual 7 months becomes a year or more but its rarely them that complain but rather the people whose timelines show a month or two ... and its like OMG get over it! and you just know tomorrow its going to be something else and the day after something else again ....

The other thing that kind of bugs me is people who want to keep ringing and ringing ... everytime someone rings about some frivolous thing it holds things up, ya know ... and its like OMG look on the timeline and youll see that your waiting period is within the realms of normal ... Sheesh I was constantly stressed about how long it was between stages I wanted everything yesterday but I/we would look on the timeline and realise we were either on time or sometimes a little earlier then the suggested time .... The only time I became vocal about the delay was when I thought I had waited way longer then normal to get an interview time and when I looked at the consulate section I realised I had misread/misinterpreted what it acutally said and I did email at that point and got an interview date shortly after... but I dont think it had anything to do with the email, I think if I had let it go another few days I would have got that interview date regardless...

They dont care if you work or not and they definately dont care how much $ or savings you have, they only care how much the petitioner earns and if he is employed .... Im not working atm either and when I filled in the papers for pack 3 when I got to those sections I put down Volunteer Receptionist as I was volunteering at a Salvation Army Relief centre at the time (actually yesterday was my final day) ... I proceeded to fill in the address phone number etc as if I was employed .... I wasnt sure what to put but I figured that a voluntery position was not any less important just because money wasnt exchanged and it didnt seem to make any difference infact it was never mentioned ... at my interview I was asked what I intended to do when I went to the states, I said start a family but at that stage you could say you would like to return to your previous line of work as a (whatever) when you have your proper work authority ... but keep in mind that can take a little while to come thru...

The steps are as follows:

*Initial petition - I-129F
*NOA1
*NOA2
*NVC notification that papers been forwarded to the foreign fiance/fiancee's embassy
*foreign fiance Receives pack 3 instructions
*(They go get medical/police check)
*They send in pack 3
*They receive interview date/time and further instructions of what they need to bring to the interview

Process takes about 7months in total ... sometimes a little less and unfortunately sometimes longer but about 7 months is normal time to expect from start to finish ...

But what exactly the sponsor has to show?past year return filed with IRS or past 3 years?

Also how they consider total income ?

for example a girl has income more than 125% of poverty guideline but she is also studying so most of her income is spent for fees to school and if you deduct these fees from total income it would come less than 125% of poverty guideline...

so please guide us about this sponsorship eligibility ( or the income proof and requirement)

Consulates vary in what they use to determine if the applicant will or won't become a public charge. If they ask for an I-134 , deductions for schooling etc don't even figure into it. They look at the tax return amount. As for 125%, there is no set amount that is used for the I-134. That figure of 125% comes from the I-864. Many consulates will use 100%, some from memory the 125%. Some don't even use the I-134 at all. Some will ask for 3 years tax returns, some 1 year. Your best source of what is required at the consulate you will be dealing with, is from others going through the same consulate.

The top address block, the first place the forms ask for an address. This is the address they will use to put in their system as a mailing address.

1. Beneficiary Birth Certificate is not a requirement. The USC is required to send either BC or copy of passport etc to prove citizenship.

2. If you downloaded the form from USCIS or from the link on VJ which is linked to the USCIS then this is the latest revised edition and will be usable for quite some time past that date.

3. Yes.

4. The FC-029 is an obsolete form and no longer required.

5. The embassy address is used for the letter of intent submitted by both of you again at interview stage.

6. The letter of intent on VJ is an example which has been used by many members. You insert/change the words to suit.

I guess the answer is it is different for everyone and each person who reviews our packages has a personal standard that is different then the next review. My package was not to long very orginized and well done. I went with Auzziewenchs thoughts so I did not include my Fiencee' birth certificate this was the third thing requisted in my RFE 1. Expand on my already 3/4 typed page on how we meet

As for the beneficiary birth certificate.......whilst it is not a requirement with the initial petition, it can be requested by an adjudicator if it is felt it is warranted. It doesnt seem to happen very often, but it does happen. Just as an adjudicator can request the original certified copy of a birth certificate or any other documentation if deemed necessary.

Each case is different and each adjudicator can and will perceive evidence submitted differently. Unfortunately country of origin of a beneficiary can also figure into this as well and an adjudicator may require more clarification of the evidence that has been submitted. Is that fair....no....does it happen.....it appears so. Its all up to the adjudicator. Many submit photos to support primary evidence with dates either only written on the back or on a sheet beneath a photo copy of a photo etc without receiving an RFE. Evidence is about the whole picture. eg. without a year on the airline stubs that evidence is useless as it could of been at any time. Photos submitted without clear indication (a recognisable landmark eg) can also be deemed not acceptable depending on other evidence that is submitted. What will be accepted for one may not be accepted for another depending on the whole picture in the minds eye of the adjudicator. It does seem on the evidence that you have submitted that perhaps not even the passport stamp was accepted as proof because the supporting evidence failed to show that you actually met in person within the required 2 year period. I realise you did submit Motel receipt in English itemized with both your names on it, but perhaps that was misplaced....either that or they just didnt accept it as sufficient supporting evidence because of the other evidence submitted. Evidence must be looked at as a whole, not individually.....How it all fits together to support each other.

Digital prints with date stamps to my knowledge is not a requirement as shown time and time again by other members who do dot receive RFE's. You could call the service center and speak to another operator and get an entirely different answer. That is why it is often referred to as the misinformation line.

I would resubmit what you have already submitted, but I would also gather further evidence. This could also include affidavits from family, friends etc. When you mentioned airline stubs, was this boarding or ticket stubs? How detailed was your declaration in answer to question 18 of the I-129F?

I am sorry that you received an RFE and I wish you all the best on resolving this.

I'm a little concerned with the evidence we've produced.
All my photos were digital photos which, when printed at the shops did not have dates printed at the back.
Nevertheless, I'm more concerned with the fact that airline stubs do not have dates on them. We have submitted the itineraries which obviously will have dates of departure/arrival, I wonder how how effective this secondery evidence will be? :unsure:
Along with that my fiance also photocopied his entire passport, this will identify his last visit to the UK.

What's most stressful for everyone is the difficulty in being able to make ocntact and/or ask for advice directly from USCIS.

There is no real difinitive answer as to what proof as a whole one should submit....hence why USCIS cannot offer those answers. When you look at it all logically it is not up to USCIS to have a defined list of requirements that one must submit to prove having met, just as it is not up to USCIS or the consulate to have a defined list of what one must show to prove a bonafide marriage/relationship. We know we are genuine cases, but there are many who do try and circumvent the system to gain a green card and they are not about to assist in that. One must submit the evidence one has to prove a case. As I said.....each case is different. What I have always advocated is sending only what is required. Many have argued on the sending of more with initial filing of a petition, to show evidence of the relationship and that it has its benefits especially for those petitioning for a partner in high fraud countries. Whilst I agree partially with that argument, IMO it can also have its downside at USCIS level. Give an adjudicator more then is required to adjudicate the petition, and one is opening the door for an adjudicator to find fault with a petition, to question.....culminating in an RFE.....even when what has been submitted to show the meeting requirements perhaps on its own would of sufficed and an approval otherwise granted.

There is little you can do but wait and see how the evidence you have submitted is viewed. An RFE is not necessarily a bad thing as at best it strengthens a petition and approvals in general come very quick after submitting the extra evidence requested. I have noted the very very few outright denials of a petition since joining VJ so dont stress it. Relax, breath and wait :)
