Hey there.

I have been here on pending I-485 through EB3 visa for almost four years. During this time I met a woman and fell in love, but have not gotten married. Around 180 days ago my I-485 was denied because of a fraudulent lawyer that screwed up my paperwork (used my approved labor certifiacet for someone else!). I'm already passed the 180 days since decision, can we get married and then file for a K-1 visa or do I need to leave the country and then file?

What is the best approach to get this right?

Seek the advice of a competent immigration attorney, whereby they will be able to advise you on the best course of action taking ALL your circumstances and evidence into consideration.

Just on the little you have disclosed here. If I was adjudicating the adjustment of status case, I would have to ask if you were only after the GC by marrying a USC as you have had an I-485 denied already. Not saying you are at all, but can you see my point at how important it is for you to seek legal advice.

Not meaning to be difficult here but a couple people already asked you, why wouldnt you? Indicating they thought it was strange you were considering not putting it on the BC ...

Im confused why you wouldnt to ... if you truely believe bubs is yours there is absolutely no reason why you wouldnt put your name on the BC ....

At a later date that BC will be translated to english, wouldnt it be nice for your child to see both parents name on the certificate? I would think so ...

trr333tx, dont stress to much mate, your times sound about right ... it took 3months from time of submitting the I-129 to getting the NOA2 ...

Start gathering documents and evidence, spend time with your sweety, talking, emailing or whatever you do to communicate to distract yourselves and try not to dwell on it to much .. Download forms and sample forms and have a read thru them theyre nowhere near as scary as you would think ...

Too few pictures may be a red flag so I suggest more than 4, but there is a point where you can overwhelm them also, so there has to be a happy medium somewhere in between. I think they are talking about the initial petition of the I-129F form .... We only stuck in 5 pics but we also had letters from my mum and some friends we spent time with over the course of Shays visit and they included a couple pics each with there letters ... they were just printed out on A4 paper

For my interview however I am taking several pics of just Shay and I alone and several of him with my family and friends (same people that sent in letters) ... I rather have to much then not enough ... Also taking in cards that were addressed to both of us, only required to bring correspondence between the two of us but I cant see how it could hurt to bring in things addressed to both...

I had my medical a few days ago ... I am a diabetic and was also concerned, I also have a weight problem ... The doc did the medical I passed all the bits, he gave me the required vaccinations and on the part of the form he fills out in comments he wrote ... Ongoing weight reduction plan to continue We had discussed the fact I was being monitored by my doctor on a monthly basis for both the weight and diabeties ...

Also in Section 4 Follow-up Needed after arrival ... he listed the medication and dose I am taking and put down about the continuing weight reduction...


Sooo dont worry!!! I made myself sick for several months and even put off having the medical for 2 weeks because I was sooo worried about failing ...

I know everything there is to know about his family, Ive developed a friendship with his mother and spoken to most of his immediate family on the phone at least once ...

Hopefully what the guys said is right and you wont get an RFE ... but you know what we did I had filled out the DS-156 and then realised when I looked at the Sydney consulated page I realised they dont accept hand written ones anymore so I had to redo it but I dont have a printer, it died and I didnt want to replace it at this late date ... Shay filled in the form electronically for me as requested in the directions and emailed me the PDF to proofread ... When I gave him the ok he printed and mailed me a copy with all the Affidavit of Support ... If your fiancee has a computer you can do the same for her just send her the pdf she can print it and sign it and send it off to you...

Nothing huge just family and close friends but hopefully he aunt and uncle and there family will be able to come from Wyomming and his brother from Eugene and a couple great uncles and aunts from interstate but they are getting old now and travelling is getting hard on them so we'll see.

His old boss said he is welcome back at anytime, they parted on good terms but he will have to wait till the summer hours to return ... We are just worried at this stage if her threats arent idol and she really does decide to hire someone else .. there will be a gap of a month or two were he is unemployed and that has us worried on what it will mean to us...

Hi guys, I hope you can help me out with this question ... Its probably not going to be an issue but it will give us a bit of peace of mind ...

My fiance lives in a small town in Grand County OR and when winter hits a lot of business shut down or go to minimum staff .. his a chef and his past employer was having a few probs and was going to go down to a minimum staff during the winter months ... Shay being the highest paid stuff member was going to have his hours reduced down to 20hours per week (distributed over the busy aftenoons /nights) which would have left him with barely enough to survive ...

In the meantime, one of his ex waitresses from a restaurant he had previously managed told him about a position that was becoming available at her current place of employment ... Shay met the owner and the woman would have promised the moon to get him ... He lay down the cards about our situation and she was completely supportive and said she would work around our plans ... that plus the fact he would have his steady 40hours+ and an increase of income he/we decided it would be a great opportunity ... He had left on good terms from his old employer so the opportunity for him to return at a later date is still there, maybe not right now but in the coming months..

Now 2-3months on the story has changed somewhat ... a few days back Shay and I sat down and started making more solid plans in regards to the wedding/reception/honeymoon etc ... We would like to get married in May and the 2 dates available are the 2nd and 16th ... I dont like the 16th because that was the date I was married to my ex, different month but I just dont want to see that date on our marriage certificate or engraved in our rings ... the other dates during the month are important work dates for him, his mothers birthday and the anniversary of his fathers death ... so they are also not suitable ... which leaves us with the 2nd ...

Now here is the problem ... She the boss, has gone all wierd on him and has started threatening him that if he doesnt do this or that she WILL hire another Chef and the new chef with have first dibs on hours ... first it was the our choice of wedding dates she didnt like, apparently she has a function on the 9th and the days he wanted off wouldnt suite ... soo we adjusted the dates so we can still get married on the 2nd but be back well and truely before the 9th for this function and make up the days we miss out on a couple weeks later in Bend or Boise on his days off ... But since the threats worked she now uses that card whenever she wants to have her way ... Shays very personable and has a good rep not only in his town but in neighbouring towns so its got nothing to do with his work quality, shes using this to manipulate him to get her own way ... Normally he wouldnt fall for this but she knows she has him over a barrel because he cant afford to loose his job atm .. We dont know what to do, she being completely unreasonable with her demands ... In the afternoon they have a split shift between 1 and 3 and during the two hours he is completely alone and has to bar tend, wait on tables and cook... the other day 7 tables came in at the same time during the two hour shift and he had to float between bar, restaurant and kitchen when he mentioned that it was getting increasingly hard to do this she again told him that maybe she would have to find someone who could ... The building is long and thin and takes almost a full street block the kitchen and bar are located at opposite ends it impossible to cook for 7 tables and serve the bar at the same time ...

We are terrified about what this can do for us at this late date in our process ... We're at the final stages now, Im just waiting for my interview date/time at the embassy ... If he lost his job at this stage how would it affect us at this stage?????

I think your going to have another trip to the phillipines, they tend to look at those a little closer from what Ive seen around VJ ... also by the time the Annulment is thru it will be several more months and that will well and truely take you past the 2year mark ... When/If you make the trip over make sure you get lots of pics etc as proof of ongoing relationshop also keep phone bills, letters, cards, emails, messenger chats as evidence ...

One of the paragraphs says the following

Filing for Adjustment of Status within the 90 days protects your legal status. Your legal status as a K1 expires after 90 days, married or not. The only way to protect your legal status is to apply for Adjustment of Status, and the only way to maintain continuous legal status is to file for AOS before the K1 visa expires. On the practical side, it is often difficult to arrange for the marriage, and get all the paperwork ready in time to file for AOS within 90 days. Many newsgroup couples have filed for AOS a few days or weeks after the 90 day limit with no problems. Thus far, newsgroup experience has shown this is not a major issue with local USCIS (INS) offices.

Were planning to file immediatley after we return from our honeymoon and do what we need to do to changed over things to both names ... My fiance has already spoken to landlord etc so its just a matter of us doing it when the time comes so I really havent looked into what could happen if you left it over the required time ...

You are lucky.

You need to get married and get a copy of the marriage certificate, and take some extra pictures and get a bank account in both of your names, put the electric bill and phone bill in both names, maybe get a joint credit card account

and get a social security # after 2 weeks

How long have you been waiting? It used to be 3 months, but the site says 6 months now.

Benificiary doesnt need to be employed .. there income is never taken into consideration thru the entire process even if they have proof they will be employed when they go to the states and have the appropriate paperwork... The petitioner is the one that needs to prove they can support the fiance/wife during the process ...

I dont know why your tourist visa was denied ..but from what you said you didnt have enough evidence that you had strong ties to your country so in their eyes there was a risk that you would enter and not leave ... the girl on the shopping spree prob had a lot of evidence that she was heading back home when she was done ...

So really at this point you need to concern yourself with getting enough evidence together to prove you and your fiance have a bona fide relationship and that will include phone bills, photoes, letters etc ...

Good luck, youll be just fine! smile.gif just because a tourist visa got rejected doesnt mean your k1 will be .. Just get all the evidence you need for the interview etc.

Do you think I should get hired and any job just for the document that shows I receive any kind of income? I just graduated my university and I haven't really looked for a job.The money are not really an issue but I have a denial of a tourist visa because of not being employed and now I am wondering if they will make it a problem again.

Any thoughts or suggestions are wellcome

Yeah darl, your going to have a few probs if you cant prove your making 125% above the poverty line so your going to need to get yourself a job ... Will your mum be willing to co-sponsor, if not your going to need to find a co-sponsor that will meet the requirements ... If money isnt a problem and you have a few $$ stashed away that can be added into the assets side and will help but under the circumstances you will need to get some sort of employment or have mum start paying you for the work you do for her so you can have pay stubs etc that are required ...

I really dont know a 'ell of a lot because my fiance did this side of things but youll get people coming in and giving you advice soon enough ...

I have a close friend who started getting what I would consider spam from some chicky in Russia and the silly boy who is rather lonely decided to reply ... From day dot it was evident this chicky was after a man to marry her and made no secret of the fact ... He sent me some of the emails and honestly I was a bit horrified that he was to blind to see what was so obvious to me ...

The first email he recieved was like the spam emails you get ... My name is Ingrid, I am blond, blue eyed with big blah blah's if you wanna chat email me on blah blah@yahoo.com .... then bam shes into the Im a good girl who works as a teacher Im raising my 15 year old sister etc .... Im reading this and Im like Woah not only is she looking for a hubby but shes looking to get her sister over too ...

You poor man, you really arent having an easy time of it are you ... *sigh* like the others said you should be ok ... submit a copy with a note saying they were included in the original package and hope to gawd that the person reviewing isnt having a crappy day ... but Im sure you be fine!

I had the prob with my police check, it gets sent direct to the embassy so i rang and confirmed it had been sent and I then included a copy of the receipt in with the file so they could see it had indeed been paid ... prob wasnt necessary but it made me feel better ...

To answer the question about the stamp ... the passports dont always get stamped theyre doing some electronically ... my fiances passport wasnt stamped either and he had a nigh stop over in fiji cause the plane was fluffed and then entry into Australia and he didnt get it stamp in either ... same for the return trip, no stamps ... they just viewed it did whatever they do in customs and let him thru ...

I dont know about everyone else but its taken its toll on Shay and I ... we both have similar personalities and after we met and became attached to each other we both found it very difficult to function in the real world .. we spent all our time waiting for each other to call or pop onto yahoo messenger, we were spending up to 6,7 maybe 8 hours a day talking on yahoo messenger and phone ... it got to the point of being emotionally and mentally unhealthy ... last 6 months or so we had to re-evaluate what was going on and we cut it back to 1.5 - 2 hour talk time on his days off and 3 - 4 hours on days off ... its been hard but least now we have a somewhat normal life ...


Me and Knight learned to time it, in our case...due to severe domestic issues on my end, we couldn't see one another in person for a year. He stood by me in that time, supported me, until I was able to move out and stand on my own feet. We use Skype, ensure we get enough sleep, heckle one another to get work done, because we know we'll be together. The time difference does help, weirdly enough -- it means we can both have our days to ourselves, and we keep our mornings and evenings for each other. Sometimes, he'll encourage me to go out with my friends, or I'll tell him to go and see his; other times, if we know we can, we'll stay up late or get up that little bit earlier so we can spend more time together.
But after I moved out, there was no way we couldn't see each other, so that's what we did. He booked a flight and then he was over here, even if the price was steep. If he's not willing to come and see you if he knows you can't fly over and see him, then you need to address that.

Thats were it became a prob for us ... I was getting up at 4am to spend time with him and in turn he was staying up to 2am or later ... I ended up with health problems because of it ... since we agreed to stop doing what we were doing we have both started being a little more social and Im back to normal ... occasionally we slip but ah well! biggrin.gif

I agree, just because you think you know someone it isnt always the case ... my fiance and I had obsticles to, it took us 2 years before we could meet because his grandmother who was 91 at the time was in a nursing home with Alziemas, he didnt want to leave just incase she passed away it meant a lot for him to be there especially since he moved for Arkansas to Oregon to be with her... 2 years later he took the risk and came for 5 weeks so we could meet ... Turned out he wasnt very different then the impression I had but different all the same, he was actually a lot nicer, more affectionate, helpful and giving ... but it could have gone the other way too, you just dont know!!

He returned home and we took a longer to file then we had expected because Grandma passed away and a few months later her sister passed away sad.gif things just kept coming up ... end of last year we thought it was time to start being a little selfish and think of us for once and we filed ...

All I can say is one of you go visit the other .. spend at least 3 weeks together and get to know each other ... we had 5 weeks and it went like a blink of an eye, being seperated was the single worse experience either of us ever had to go thru and we both cried like babes for 2 days prior to his leaving ... but then youll at least know if its meant to be ... dont hang on to what ifs ... time goes by fast and before you know it, it will be another 8 years!!

I have to agree ... Dhalia, for your own sakes meet first ... this is a really stressful process at the best of times, not to mention expensive ... your really opening yourself up to a lot of heartache ... If it is against your culture to be alone during the courtship, organise a chaperone to go with you to a few outings that way at least you can see if you at have compatible personalities ....

I had a workmate that lived in the US on a work based greencard .. he actually lived with his girl for a couple years and they broke up while going thru the visa process ...

Hi Guys ... How long does it usually take to get an interview time after you send in your Pack 3?


I mailed in mine on the 26th of February and a few days later contacted Australia post and they confirmed that the package had been received and signed for by someone at the embassy on the 2nd of March ... its the 12th for us now and I still havent received anything from them ...

A little while ago I emailed them and I got the following reply...




Thank you for your inquiry.

Our records indicate your documents were received on March 3. They are currently under review. Once the review is complete, you will be contacted with an appointment date.

You got your NOA2 right ... very shortly you will recieve the NVC telling you that paperwork has been sent off to your fiances embassy .... Shortly after that she will receive her pack 3 with directions of what forms need to be filled out ...Your fiancee will also need do a medical and police check .... the I-I34 is one of those forms, you will need to fill it out and send to her with the tax form, W2, pay stubs, a letter from your employer, a letter from you stating that you still wish to get married like the first one you did when you first put in the petition but with a more current date ... there may be a couple more things that Im forgetting but thats most of it ....

But yeah BREATH!

Hi Grace smile.gif I honestly dont think your going to get a RFE for forgetting his social security number ... the question is social security number if any ... since his the beneficiary it would be assumed he hasnt got one ... When he gets his pack 3 and fills in those forms the question is asked again, he can fill it in then ...

If it required and you need to fill in something, Im sure someone else with more knowledge will be able to tell you exactly what you need to do and what form needs to be filled out ...
