PhilippinesChanging name after marriage

Not necessarily true.

We applied for AOS using the Filipino way but our IO would not allow it. My wife's green card was issued with her single middle name and her new last name. We supplied documents showing her name the Filipino way but it did not matter. We decided not to go through the additinal hassle of getting it chnaged legally and will just get bank accounts, etc. chnaged to reflect the name on the green card.

Didn't work for us, sadly.

Howdy! Did she use her Philippine way married name when renewing her passport and on reporting for marriage?

I'll be having my AOS biometrics this February. My passport will expire next year so Im very critical on what to do next.

Kindly check this out. she has something interesting for us to know...

It appears like when applying for Philippine passport renewal,we have to abide following Philippine name change way. Will it follow doing same thing on submitting the Report of marriage, using father's name as middle name?? One one hand, we follow the US name change way to all our documents such as SSN,driver's lic, bank accnts. city serv. billing ,basically transactions done here in the US, like I do. ^_^

 international Immig.Inconsistencies,just like I-94 :P

Oh my, theres got to be a final way to settle this out  . We need more responses,if not defined ways on how to deal with this.

I need to renew my passport, thats for sure

PhilippinesUpdates from marriedtomrg

Hey peeps. :-)

ChuckandRhean, am happy you made it to your beau's arms, finally! :D Lots has happened since we moved here, sorry if I have been unable to keep in touch here.

We haven't applied for AOS yet (I'm on K3 and Pippo is on K4, so these visas are good for 2 years); we will file for AOS later in the year when we are close to our 2nd year wedding anniversary.

I did apply for EAD first, and just got the approval notice today. :D Hope the rest of our journey to GC (and ultimately to citizenship) is a good one.

luvtechwifey, we'll be cheering for the SAINTS in the Superbowl! :D Got a lead for you also on a Filipino store down there in Baton Rouge, if you haven't been to it already.

Godspeed to everyone!

Howdy y'all ^_^ ( im trying to perfect the Texan accent :P )

Great to know you all are doing good.I just got my AOS AED,and AP NOA1 last week, and am waiting for my biometrics appointment to arrive soon. I'll add u up if ur here, let me know ^_6

Saints won ! .. I guess Dallas Cowboys will do better next time :luv:

Take care always Kaye,Rick, Pippo

Id suggest LOtus garden Hotel. Their rate is really affordable. It has safe, and good ambiance.People are friendly and accommodating. Its located just along intersection ,hence, access for taxi is easy. A single bedroom will cost P1600 per night.Theres no particular hotel thats really near CFO .

Oh btw, guidance and counseling seminar is done at PRISM , located just beside Banco de Oro,and right infront De La Salle University. After the seminar, they'll give you a certificate of attendance. That certificate is needed to present at CFO( in Quirino Ave) to process your guidance and counseling certificate .Your visa is a prerequisite so as to issue u a sticker placed on your passport. thats it!! CFO done!

QUOTE (Loterly_Richard @ Apr 27 2008, 12:58 PM) <{POST_SNAPBACK}>
pushbrk,

for the nth times, why do u really wanna insist on "the relationship" when in fact the uscis clearly wrote there "marriage"?
PLEASE READ POST #82 AGAIN SEE FOR YOURSELF WHAT USCIS WAS LOOKING FOR... IT CONTRADICTS ON WHAT YOU INSIST

THIS ONE IS A CONTEXT FROM USCIS >>>information and details explaining how the person acquired his or her knowledge of your marriage)

THIS ONE IS A CONTEXT FROM PUSHBRK >>> The affidavits should contain information about the relationship, not the wedding.

I'll answer the why question gladly and thoroughly. First, the USCIS wrote a lot of things including but not limited to using the word "marriage". Sometimes we can get away with following only the context of one phrase. More often we need at least a full sentance. Sometimes we need a paragraph, other times a section and still other times we must follow the complete context of a form's instructions including all paragraphs and sections. Further, we sometimes need to use more than the most simplified definition of a word. Many people hire attorneys to sort through all this kind of thing for them because they know they aren't able to do it themselves. Others ask those who do have the capabilities or seek help here.

The I-130 is filed in behalf of a relative of a US Citizen. So, the beginning of all context in the instructions is establishing the category of family relationship.

For a spouse, from the instructions....

You have to prove that there is a family relationship between you and your relative. If you are filing for:
1. A husband or wife, submit the following documentation:

A. A copy of your marriage certificate.

B. If either you or your spouse were previously married, submit copies of documents showing that all prior marriages were legally terminated.

A. and B. are required to show both that you were B. eligible to marry and A. legally and lawfully married with said marriage registered with the appropriate local jurisdictional authority. No other evidence of a legal and lawful marriage is asked for in this or any other section.

Please note that marriages that are "not bona fide" as in "entered into exclusively to derive an immigration benefit" will be able to submit a "Marriage Certificate" or all the evidence asked for that the marriage is a legal one, duly recorded and certified.

Now let's take a look at the context of the section that lists items E through J.

NOTE: In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may evidence that bona fides of your marriage:

To understand the context we must first understand the meaning of "bonafides of your marriage". Since you've already provided a marriage certificate, you can conclude they aren't talking about whether your marriage is legal.

Hello....I posted this in spanish and now in english so here goes....My boyfriend and I are filing for the k1 visa....he is 21 and I am 35.....he is Dominican and I am American born to Dominican parents....I am a bit worried and concerned that we may get denied the visa because of the age difference which can trigger thoughts of a fake relationship (fraud).....to my surprise this relationship is realer than real and I think that if we have all of our documents in order and answer all questions truthfully and correct that age difference is not a valid reason to deny a visa....Please give me your totally honest opinion...i appreciate it....thanks....

Age differences is an all time debate. Laying our cards to prove the relationship is genuine,God-grace, and worth dying for takes a LIFETIME.
In response to ur concern, Gather all pertinent documents, forms, affidavits of bonafides of relationship, receipts, and anything u can think of that qualifies u both for a K1 visa issuance. Take note of the relationship red flags, and be ready to contest it with tangible documented proofs. What others THINK of ur relationship is NONE of ur business. Stay happy, and be strong. Prove them wrong. Let not the society dictates what ur life should be. good.gif Goodluck!!

DS-156K doesn't have questions 29, 30, and 31. I presume you're talking about the DS-156?

If so, as long as the box for "No" is checked for each of those questions, then "None" doesn't need to appear.

You should get your NOA1 before you check is cashed.
I've noticed most people do, that way you know they have your package.

While NOA1 may be dated prior to the day the check cleared, the hard copy doesn't show up for several days—often a week or more—after the check is cashed.

From my experience and observations, the sequence of events after mailing the I-129F usually goes:
  1. Delivery confirmation received - 1 or more days after mailing, depending on whether you used express mail or a slower service
  2. NOA1 issued - usually the day or day after the confirmed delivery (but you have no way of knowing this yet)
  3. Check cashed - 1 or 2 days after NOA1 date. This is the point when many people learn their NOA1 date—they view the image of their cashed check on their bank's website and get the USCIS receipt number from the back of the check, then use the receipt number to track the petition on the USCIS website.
  4. NOA1 arrives in the mail - around a week after NOA1 is issued.
NB: this represents the average times as I've observed them, so your mileage may definitely vary.

HI all,

I'm quite new to all of this! Basically I’m from the UK and met my now fiancé when visiting friends in Minnesota. We have visited each other 4 times in the past 6 months, she has come here twice and I have visited there twice. She has recently got divorced and is 8 years older than me, but is financially secure and owns a very profitable business. I have read on some forums that the age gap and divorce could be a disadvantage to me getting my K1 visa.

The two questions I have are generally how long is the whole process of getting the K1 visa? Does it make a difference where I am from or where she is from?

Also what would be some general reasons for being denied the visa?

Any help would be great….

Thanks a lot, this seems be an amazing forum!
java script:add_smilie(":D","smid_7")

You'd be looking at about 6-8 months for a K1. Judging by what I've read on here over the past 6 months or so, 8 years difference isn't a "massive" age gap, so won't cause any problems. At worst, you'd only get a few extra questions at the interview stage. UK isn't a high fraud country, so wouldn't worry too much.

I guess there's lots of reasons you can be denied. Not enough proof of a relationship, history on drug abuse, criminal history, not passing the medical... that sort of stuff (plus of course fraud/lying on any forms) good.gif

Age gap and divorced status are not an Absolute grounds for Visa denial. Accordingly, if submitted documents are found to have somewhat doubtful information, then this pose a threat to getting ur case denied. Remember that all documents and papers are being checked and verified.

K1 Visa has 6 months processing duration. With some external intervention (such as political influence) and factors (such as health history), it could make ur timeline shorter or longer as the case maybe. Ur fiancee may be living half way round the world, distance nor race has never been an issue.

Hope this helps. Goodluck guys!! good.gif Take your BIG step sending your I-129F star_smile.gif

Hello every one, This would be Tom without Judy on this post. I have sad news,
Judy has decided not to go to the interview. This comes as a shock to me, but to some of you saw this coming.
Her reason is simple, One of her past boyfriends came back. And to keep it short. Money was involved.
She still wants to be friends. I still do talk to her.
But she is telling me now that I have to wait 2 years before I can file another Petition for someone else.
And for her it's 6 months for someone to file a petition on her behalf......IS THIS TRUE?

My orignal posts were under the name of Hoping2..

Tom

Obviously, after reading ur succeeding reply posts, I could tell that both of you(Tom and Judith) arent decided yet what u really want out of life,as of presstime(half-hearted hanging on to each other blink.gif ). The girl cannot possibly have the best of both worlds, not two guys same time...oops!Tom ,its sad to note but, infidelity came into place in your relationship right before you knew it. Moving on is your best option.Technically,I agree to Itzallgood.Put everything into writing and let the proper authorities(USCIS,NVC,USEmbassy) know bout your case.

In reply to the foregoing statements,I quote...

" The ATM worked for me for a time until my bank shut it down when they found out my fiancee was using it and she was not on the account, they were none too happy about that and if I had not been a longtime customer they probably would have launched me right out of there!!!!!!! "....

Bullseye! US authorities and banks will surely be suspicious . Why? Because ur fiancee is NOT a legitimate co-owner of your account. Thus proper banking procedures were taken into effect.

As with my fiance and I, we both have our own ATM card with our respective name on it. And for the record, were not encountering any problem in connection with any banks nor US authorities as of presstime. Hence, I would say it works best for us! Modesty aside, my fiance works in a Federal government , so dragging his name into doing crappy stuff is a NO NO.

His post is a useful helpline to those couples who are exploring their options sending money to their loved ones local and overseas. I do hope couples and families who have availed WALMART MONEYCARD enjoys the benefits of its service.

Hope I gave justice to my fiance's sincere intention to be of help to others! happy.gif

I use iKobo. Works like a champ.

I had heard they folded? Are they still in business? I looked into them at one time and it seemed interesting BUT

We send money ebery month to our son in Moscow and my MIL in Ukraine. But when I checked on these, and seems like Walmart is kind of the same, the fees were running $6-10 on both ends combined for each transfer. Right now we pay $10 per transfer with MoneyGram (MUCH cheaper than WU, WU can kiss my @ss!!) And it didn't seem like it would save alot, especially if Sergey decides to take his monthly allowance in $10 increments or something! So I have stayed with the MoneyGram so far. It takes more than a savings of $4 to lure ME into Walmart, besides we are Walmart Poor in Vermont (only ONE in the state) so I would spend more in gas.

The ATM worked for me for a time until my bank shut it down when they found out my fiancee was using it and she was not on the account, they were none too happy about that and if I had not been a longtime customer they probably would have launched me right out of there!!!!!!! So be careful if you are usingt an ATM for this. This technique is highly suspicious to US authorities and banks do NOT want to be involved with this. I am not saying you are a bad guy or something, but lots of bad guys do this to transfer money. Banks tend not to like it.

K-1 Fiance(e) Visa Process & ProceduresEasiest way to send money
QUOTE (Gigzapper @ Sep 30 2009, 10:49 AM) <{POST_SNAPBACK}>
After dealing with Western Union and MoneyGram I found they are way too expensive. Go to WalMart (or go online even) and get a WalMart Green Dot card. Get 2 cards - One in the US citizens name (so it's easy to put money on the card (only $3) and one in the foreign Fiancee name. The Finacee can use the ATM (extra $3 per use though) use it like a credit / debit card, pay for Visa fees, medical exam fees and do everything without any fuss. You can get a daily SMS or e-mail with the balance. Once the card arrives in e-mail send to fiance, put money on it by just stopping by WalMart. I found this is a lot cheaper (for the 6 or so months while we're working though the Visa process) and more convenient than using WU or MG.

Hope this helps!

(Just finished medical exam and interview on Oct 8th! Woohoo - almost here!)

Chuck and Rhean

100% worry -free using my WalmartMoney card. I dont have to carry with me large amount of cash paying my hotel accommodation. I have an easy access encashing the amount needed for my medical exam as well as on my application fee paid at Banco de Oro. Indeed,Saved me the trouble of running to the Western Union office going over long lines or afraid it might fall on a holiday ,worse if its stormy for few days . Besides I am able to check how much money I used, how much is left thru the email balance Walmart sends. My fiance is able to check how i handle money, so do i. To those couples out there, I highly recommend Walmart money Card. star_smile.gif star_smile.gif star_smile.gif star_smile.gif star_smile.gif

My fiance screwed up and admitted at the medical that she used marijuana one time. Now they want her to see a physchiatrist. But is it going to matter, or is that one time use 4 years ago going to get her banned anyway?

Sad to note ,it does matter Theyll be tracing back what caused the drug use, duration, and the patients perception. Theyll prove that potential drug use is out of her system or otherwise(the law of hypothesis)it would be best if u be the first to ascertain that she had overcome drug use. Bring her back at those days ,retrogress, open up the issue, synthesize then resolve it. Be her psychiatrist. Ill be honest with u, cottonball stories and issues of her life may arise but u have to understand . She has to prove that shed fully recovered.Be strong and supportive. Coupled with prayers and ur presence, she can make it! yes.gif

Did your dad claim you as a dependent on the tax return he filed last April? If so, then his household size should be 4 - himself, your mom, you, and your fiance. If he didn't, then his household size would be 3. Yours would still be 2 - you and your fiance. I'm presuming neither you nor your dad have any other dependents they support, nor paying child support for kids that don't live with you, nor have signed an I-864 Affidavit of Support for somebody else in the past, etc.

On the G-325A - it's FORMER husbands and wives, and not FORMAL! tongue.gif

The G-325A is a general purpose biographical document. It's not specifically just for fiancee or spousal visas. Since you're applying for a fiancee visa you should NOT be married, so "Husband or Wife" should be "NONE". Your ex-wife (or ex-wives) are listed under "Former Husbands and Wives". good.gif

This past april I filed as single, since I was working for Fox TV Station and divorced. I just recently started working with my dad after the middle of April when I moved back to Austin, TX. I wasn't living here, but now I am. Sorry for the vague descriptions. Anyway, I do have another dependent to support. Child support for my baby boy who doesn't live with me. doh i'm getting confused again!

Lol FORMER.. not formal.. I typed it wrong..

Thanks for the info...

After I read over the guide, it helped a little, but I needed more detailed info. Your info helped a lot. But one last question about that. I was kinda confused of the household size. It's just me, mom, and dad. Since dad is going to co-sponser, will he only put down that he is supporting 3 people? (Dad, Mom, and Fiance?) or (Dad Mom and Me?) Or does he put down household of 4 that he is supporting. I guess Unless I'm supporting myself, he only puts down as 3 which includes my fiance. So in that form that he fills out, I have nothing to do with the form he fills since I'm supporting myself? Which I am supporting myself. Sorry if I confused you, but I'm confused myself..haha

Otherwise, looks like I have plenty of proof and the right paperwork. I'm filling out everything as I am typing now.

Thanks for the help!!

Oh BTW! I'm stuck on the G-325A form. It ask for Husband/Wife, then under that Formal Husband/Wife??? I filled out the formal husband/wife because I am divorced. Otherwise, the top part of that which asks for Husband/wife, do I put my fiance's info on there or do I leave that as "none"??

I stumbled upon on the information. Looks like I will be getting a co-sponser and since my father owns a business. Most likely this will pass through. Yay! gonna start on my paper work now...

This site and others offer sooo many resources and there are many old timers here who are willing to help....save the coin for the attorney

Bringing my old post back on topic.

I've read and read. Looks like I'm stuck with the Income Taxes. I have my tax returns, but I'm not sure if I reached the $18k level. (that's if it hasn't changed) Anyway, I can't even find good info on co-sponsering. Since I'm living with my parents, I'm sure my father will most likely agree to do co-sponser. If someone can nicely explain to me or point me at the right link to it.. it would be great help as I am going to fill out the paperwork soon. Once I figure out if the co-sponser will help. I also found a thread that explains you can combine income, both you and your "fiance". but I'm still stuck with information.

Thanks!

Venus, I have both tax paper works and they are filed from 2008. Both my business and my work at Fox tv station. With both added up, it does not meet the requirements of $18k a year. The new job here with my parents, I just barely started 2 weeks ago. I'll post the rest when tonight when I get back online. gotta go to dinner..

sigh*,,, all the headaches are now relieved. I really appreciate everyone help even though I briefly studied different guides on here.

So No Lawyers it is!!

Well, No lawyer or not, we are changing plans. I don't know what will happen within 2 1/2 years. Long story short, she's still in school for RN nursing in Sydney. She'll be done by the end of 2011. Hopefully she will pass her exam to enter US Hospitals and apply for a job Visa. In the mean time while working at the hospital (if all goes well) she will find a sponser and hopefully get a PR. If it works that way.

Looks like I'll have a long journey!

Thanks for the help guys...

Oh one other thing, I had a business and solt in the middle of last year, so half the year I didn't make much because of income loss. The exact time, I aquired a job at our local Fox TV station and only made $8500. Is it 100% neccessary to show proof that I made atleast $18k that year? Now I am working with my parents, and they are paying me every 2 weeks cash because we both run the store. Pretty much I'm getting a small part of the income and it equals around $25K a year. Is there a way my dad can do something to show proff that I'm getting paid and able to support my future wife?

Thanks guys,, We are going to go by the rules in the book. Get married within the 90 days of the K1 visa (Lets hope it will go smooth). I'm also going to be hiring a lawyer who can help me throughout the process. Make sure I don't make any mistakes. I'd rather pay the money for someone who is experienced and save time, than trying to figure this out myself. We want her over here ASAP. I know it'll be a long and "infernal" process. but we are both commited to doing so.

K-1 Fiance(e) Visa Process & ProceduresJust Met My Fiance,,
Hello guys, new to the forum.. I met my fiance, wife by heart, on February 5th, and we started dating on the 8th. March 30th she flew to Austin Texas to see me and we had a wonderful time for 3 weeks. We decided it would be best that we marry so we can start our life together here in Austin. So my question is, We've only been together for 3 months and 2 days, is it possible that that our application will be denied because we've only been together for 3 months? I'm planning on flying over to Australia to meet her again in a few months for more evidence. We are going to do our best for her to come to the US with me and start our life together. I wish it was this easy, After reading a few posts, I'm starting to get iffy about this happening, but i'm thinking positive that it is going to.

any help would be appreciated,,
Thanks!

Is there any chance or way we can show evidence with digital video?

I have a few videos using my camera and my fiance's camera when she was here visiting. Would be nice if we submit video on a DVD or CD..
