Besides, you must do all the work to get the information to your lawyer - only for them to type it on the form. Do yourself a favor and do it yourself. All this bull about lawyers being able to influence USCIS and embassy interviews is a crock!

I am French too and I know for sure France/US dual citizenship IS ALLOWED.
I have a french girlfriend here in Texas who became a US citizen and kept her french passport etc etc, and her husband too (he is Portuguese and took french citizenchip and now US citizenship)

I was thinking like you to do it too in one Year (I am now applying for removing my conditions) conditional green card will expire November 4th of this year ...............
and I talked recently to another French Lady here in Texas who is dealing with a lawyer since she lost her US husband from a heart attack (terrible I know) and the lawyer did tell her if she goes back to France she WILL HAVE TO FILE TO DO A TAX RETURN in USA for the rest of her life if she applies for US Citizenship ! It was a surprise to me and made me think ................

So from a Tax Point we have to think twice, and it all depends where your assets are here in the USA or at Home etc etc ...... every case is different.
If you have more info about it pls share them with me. Your topic is of high interest to me too !!!!!

I would love the freedom (because I am probably older than you and think of retiring ....) to live with my husband where we want France or USA and not report where I am etc etc ......... With green card I understand we can ask for a re-entry permit if we go to another country for over one year !

So good luck in making your decision ........ I do not think you have to apply just after 3 years ? My friends change citizenship after 15 years because they have decided not to go back home at all after all .................. but it was an easy process for them and got citisenship within 8 months both of them.

Thank you for the Info. I have actually included my two daughters since they mention Living with you or not and indicated they were not filing and lived in France........ Worse thing you can do is omit something !
We will mail next week with the new Fee ........... !!!!! of course we missed it by a week .... and then just wait. I think once the NOA arrives we are in good shape.

Something was asking about Info Pass. I had to do one in San Antonio (Texas) for an emergency parole whilst filing for AOS (the parole we had filed for never got to us ....) and everybody was very helpful and got me the right paper.... My mother was very sick and they respected that too .....
The waiting was awful it took like 4 hours to get it ! ..........................
My husband who came with me that day could not believe it since he never had to really deal with immigration at this point.

I had the same question and from what I've read in the forums, you have to list all of them (including your children in France). My mother is in the same situation; she wasn't sure who to list but we decided to list everyone and just write an explanation.

You are absolutely right .... the second attempt worked and my letter was received this morning at 5.25am (?) by Mesquite TSC .......... I even have the return receipt since I had asked for it last nite via email ......... so Express Mail works very fast but we have to remember that the first attempt just a notice is left ! Makes sense if it is a PO BOX ...........
Well now we wait for the check to be cash ! step by step ....................

Hi Everybody !
Well not a good start.
I was happy and relieved yesterday when I dropped my application file to TSC, via Express Mail. The post office said I could track it on line and it should get to them today.

Well I just checked the tracking and ............. it says Not delivered - notice was left ..........
at 10.53am (today). another attempted delivery will be made or we will keep the file for 5 days and return it to you !

Well I checked again and again the address .........
the USCIS site says

I did put attention of I-751 Petition (as recommended by VJ in the guide) after the address

Anybody ever had the same problem ????????

I cannot believe it. I just start dealing with USCIS and already a problem...
When I filed for AOS they had lost half of my file !

Well if anybody has any idea please share it with me, I am a little nervous about my letter being lost or returned to me without not knowing the reason........

If you are referring to a OMB date, you can continue using the form, it is a date that Office of Management and Budget specifies that suggested changes and auditing by the various departments needs to be completed by, in this case Department of State. OMB date is an internal audit date, not an expiration of the form.

Now I just realised when we prepared the form handwritten we downloaded the right form
OMB No 1615-0038 Expires 9/30/08 I-751 Petition
but
when my husband typed the information from the computer
he was on form
OMB No 1615-0038 Expires 9/30-05 I-751 Petition

I checked carefully just now both the forms are identical
but do you think they are going to refuse them and send the whole package back !

July 19, 2007 - used I-751 form, revised date 2006.
August 2, 2007 - package was sent back to me and was asked to use 2/2007.
August 2 , 2007 - checked USCIS site ,downloaded the form with the revised date 7/30-07.
August 3 ,2007 - requested forms by mail. ( just to be ready incase the one i downladed is not accpted.
August 13, 2007 - Forms rcvd with revised date of 7/ 31/ 2007.

I am so glad I checked again tonite otherwise I had again the previous version .................. I guess you are ready to send your package back tomorrow then ! Wish good luck on a fast process.
We loose time with them sending us back the package !

Hi, I think that the newer version must be ok, 7/30 was when they started the new fees so probably they updated the form but not all the information in the web site.

This is my understanding too, but I wanted your advice (s) ...............
because they show a form and say one line above something different, I personally think it is a mistake from their site but who knows ! Thanks anyway ....................

Check this new fee site, posted by Visa Journey. It took effect July 30th you will find the amount you have to pay for I-751. It is $545 (Biometrics included). We just missed the deadline by a few days, so we had to pay the new amount ..... You should have filed BEFORE july 30th to apply the old fee.

If not correct they will send you your package back and you have to resend everything.
Also make sure you always use they updated VERSION of the form that you find on THEIR site under immigration forms.

The I-751 does not require notarization, if submitting letters of support from friends/family, these would need to be notarized.

Since it looks like our package (I-751 ect) will come back to us (we did not use the last revised I751 form, silly yes I know.... I was not happy yesterday when I realised it, and it spoilt my saturday evening..)
I am preparing the New and Revised I-751 so it will be ready to go again ... when I get the file back from TSC..
Should we have the form I-751 NOTORIZED before sending.
I did not it either when I sent the package first time last week.

I just happened to read yesterday a few poles where they mentioned their Forms had been notorized before sending. Is it mandatory...? I am not too familiair with this notorized thing (being French)... and for K1 we used a lawyer - (but he was so expensive and so unkind - awful actually) so we decided to this ourselves.

I am not much of a poster but thought I might share my experiences so far with DHS. Our I751 petition was submitted to TSC in mid July as was lots of other folks. When the check didnt clear I got concerned (as lots of other folks) and when the package arrived from CSC I knew there was a snag. Sure nuff-- Our petition had been rejected on Aug 1 (hmmm doesnt that ring a bell???) becuase the I751 FORM was not the current 2/15 or 7/30 issue!

We rebumitted Aug 9 and they at CSC have now received our recubmit with the latest form (only change appears to be a preprinted bar code) and of course the obscenely expensive new and enhanced filing fees. No checkie cleary yet.

Soo --I can verify CSC is getting the I751's from TSC and that doesnt seem to delay things much. I note the current processing times at CSC are still out at January so they are taking 8 months themselves. They have probably been deluged by filers trying to beat the fee increase and are probably taking extra special actions to reject any they possibly can to get the higher fees -- that's my view on our submittal.

Stay patient and be rigorous and things will work out. (I hope).

I sent my package on August 7th to TSC with wrong I-751 form and I am looking out for the mail everyday to get the package back....... and restart the process with new from with barcodes (I had noticed the bar code at the bottom of the page). Only difference with you I could not beat the new fees since my greencard expired 4th November ... I had to file a few days later ........ I hope my package went to CSC nevertheless, it still looks like they process faster than TSC.

I felt so silly in picking up the wrong form I-751 but I see now I was not the only one. I saw many postings with people who did the same thing. The funny thing is we don't even know how we did it .... since we went to the Official site ? it should have given us one of the 2 latest version,
oh well ........ As long as I have a receipt /NOA before Xmas when I go home ......... I am OK I guess,although I would be nerveous if I do not get anything before expiration date of the conditional GC.

INFO PASS should help. I had once an Emergency and did not have a Parole to travel, they right away issued a Parole to travel back to the country. I had a letter from the Dr that my mother needed my visit urgently. I did have a passport still valide though. But I think they can issue either a NOA or a parole to come back. I even don't know where my husband found such an old version ............................. SO I KNOW they will reject my package and they havent not YET .................... so I will have lost may be a month or more in the process ..... I am really anxious to get the application back so I can start all over ! ............ with latest revised I751 ........

But I think they are so late in checking the application it could take 3 weeks before they return the whole thing to me and then I HAVE TO START all over again. My GC expires on November 4th. I am travelling on September 15th to France (so I will be Ok for this trip) but again on December 18th to meet my daughters for Xmas who still live in Paris ......... but I could always go down to San Antonio and get a stamp in my passport worse case ? .................................. 90 minutes drive ... and a long wait overthere I did an info pass once you have to be PATIENT !

Well it has been over 2 weeks we sent our package to TSC - and as I posted last week already, we realized once in the mail that we did not use any of the last 2 revised version ....of I-751
So Iwas expecting to get my package back .... and over 2 weeks have past and have not seen anything returned to me YET ................... no my check has been cashed. I guess they are really late in looking at the mail right now ?! I an anxious to get it back and send it again with the latest version of I-751. What a waste of time - Right now I have lost almost 3 weeks already ...................................
I guess I have to be patient and just wait ???

I read that a lot of the files sent to TSC are transferred to CSC (this happens when I filed for my AOS, )

I sent my Application package and I-751 Express mail to TSC August 7th they received on August 9th (second attempt delivery).I was expecting to get it back since I did not use the latest version of I-751 ......... and guess what ?
Today our check was cashed and .... on the back of the check looks like I can barely read CA ... which means they probably transferred my file to California.

I hope the fact that they cashed my check means that they are now processing ? and will not send us the package back to re-do I751 with newest version ?????

Well I was happy ! but let's wait and see for NOA to get here before I get too happy.
I will keep you posted.

Looks like THEY DO transfer all of TSC application to CA at least the ones from August....
and it takes roughly 2 weeks for them to cash the check.
Though this timeline might interest August TSC Filers !

We used a lawyer for the first part K1 and AOS he was pretty useless and not friendly ! This part is really easy to do by yourselves.

Did you try tracking your case with that number? I was not able to track my case with case no written on check.

Congrats !!!!! I have one question ....
I mailed mine yesterday via Express mail and it was not delivered today I saw on the tracking that a notice was left ? Do you have any ideas ...... why. Was your package sent with a return receipt or a signature requirement ???? I realised it is a PO Box so may be there is no-body to sign the return receipt ?

Yeahhhhh I am happy for you ! I know how frustrating not to see the package is delivered and in your case it took the 3rd attempt !
Now be patient I still have not heard anything from TSC ... and mine was delivered now 12 days ago ... no check cashed yet !

Sorry I did not realised it failed a second time ? I cannot imagine they will not try again on Monday again and keep the mail 5 days, and return it ? USCIS is used to this anyway. You were not the only one to be in that case yesterday. I do not know how they handle it...........but it must routine for them.

You have a tracking number you can always try to call the Post Office where the package is held if nothing happens Monday during the day.
I am sorry - I understand how you feel - I felt the same way until the package was delivered. Got so relieved when I got their email. (they deliver at funny hours trust me - first notice was like 1 pm and second 5 am ?).
My package was received 10 days ago now and my check is not cashed ... so be patient, even once delivered, I think they have a big big backlog right now.

No, do not worry. I had the same problem.
First time delivery failed (it almost does every time with Express mail), they leave a notice.
2nd attempt it will be delivered I am sure........
Mine was during the week and it was delivered on the 2nd attempt around 5 in the morning ????
You should register with UPS on line to get an email when delivery is made and also have a copy of the receipt signed. I did it and when I woke up the following day, the email mentioned
"delivered".
I am sure you will have your package delivered Monday ............... I think I remember they are not deliveries on Sunday anyway. Lools like the mailroom of the Centers are open pretty late and early in the morning .....................

Sorry I just read your package arrived at Mesquite on August 14th I missed that first time ...
so in fact just one week after mine...(I mailed to Mesquite as well) So wait another week at least before they cash your check it took them over 2 weeks for me .......
I have no NOA either and do not expect one too soon either ! If I put my expectation too high I will again be worried/dissapointed..

When did you mail package to TSC ? And when did they receive it ?
I posted yesterday
Mailed application on August 7th received by TSC on August 9th (2nd attempt)
checked cashed yesterday August 28th. File transferred to CA. (you can see it on the back of the check once it is cashed they put a stamp.

That's right. I don't know why they asked me to go to Houston this time... It didn't matter as it's roughly the same distance from where we live.

A buddy of Kathleen's son and a brother-in-law will provide letters of support to include in the stuff for the RFE

Did you read today more people got RFE so it is the new trend ? I hope you will be OK with the affidavits and whatever you could get .............. on top of whatever you already sent them.
