Hi everyone,

Here's my brief story: I am currently in the US visiting my fiance (we submitted the I-129f a week ago while I was here and we got our NOA1 this week).

I left the US in October after working on a TN visa for 3 years and moved back to Canada. I visited my boyfriend (now fiance) here in the US for 3 weeks in December. I entered the US to visit him in mid-January with the intention of staying for a week before returning to Canada - instead, I changed the date of my return ticket and will fly home in a couple weeks (so by the time I go home I will have been in the US for 140 days this visit. I know Canadians are allowed to stay in the US for 180 days per visit). I have never overstayed a visa or have been out of status in the US, not do I intend to do so.

I would like to visit him in July for a few weeks, maybe again in September. Of course, I know it is up to the Immigration Officer at the POE whether I am allowed entry into the US, and I know I need to prove strong ties to Canada (a little hard since I live with my mum and am currently not working).

1. If I am allowed entry for those visits, can these long visits to the US before and during the K1 process affect the K1 visa decision (at the interview stage)? I don't want to do anything that will jeopardize getting the K1 visa.

2. Also, if I change the date of my return flight after I have entered the US, does that look bad to US Immigration? Again, I don't want to do anything that will jeopardize getting the K1 visa.

I would love to get people's thoughts and advice - and experiences if someone has been in my shoes. Thank you in advance! I'm so glad to be a part of the VJ community!!! :)

Hi all, I have a question about the correct way to deal with the question I2 if your fiance is currently in the US, complete the following and then it asks for details of I-94 Arrival/departure record. I entered the UD on a visitor's visa from Canada and don't require the I-94. I will be leaving within a couple of days of signing the paperwork. Does anyone think it might be a good idea to also attach a declaration to that effect so there is no suspicion that I will be staying in the country awaiting the approval of our K-1? I know the USCIS website states this is illegal, but it also state it is OK to visit under the North American agreements. Any comments or advice appreciated. We don't want to run afoul of something here.



We were in a similar situation. My fiance filed the petition while I was in the US visiting him (I returned to Canada a couple weeks after we got our NOA1). We answered "yes" to the question whether I was in the US. We put "Canadian citizen, no I-94 issued" in the section where the form asks for the I-94 number. We answered "n/a" in the section where it asks for the I-94 expiry. Our case hasn't been adjudicated yet, but this was this advice given to us by a VJ 'veteran'. Hope this helps!

Hi my dear VJers...i know this has been discussed a lot, but still i am worried. we have filled our petition for the K1 Visa on may 13th; NOA1 is from may 19th. i booked tickets to see my fiance (the USC) in august for his b-day. I will stay 12 days. Will i be ok? i have the binding ties. I am from germany so not from a fraud country...Does the officer see that i have a pending petition/visa? I am especially looking for an answer to my last question because i can not find any answer to that!

I don't have much of an answer to your last question... but, for what it's worth, from what I've read in other posts the immigration officer does not see that you have a pending I-129f petition. I entered the US on Sunday to visit my fiance, and the IO didn't even bat an eye when I told him I was visiting my fiance. He didn't ask anything about my being engaged. I had proof of strong ties with me, but I didn't need to show anything. My whole interaction with him lasted maybe 30 seconds, then he stamped my passport and I was on my way. I hope this helps! :)

Yes, as far as I know the only address is the Royal Thai Police Headquarters in BKK. I guess that doesn't help him much if he lives in the provinces. :(

My fiance sent in forms and information to get his police certificate, but it's been a month and nothing was sent back. He is in Thailand, and we have not gotten NOA2 yet, but we wanted to do it ahead, and I saw some people on the forum talking about doing it ahead of time. What is going on?


Hey Ni-ing, I also sent away for the Thailand police certificate (I used to live in Thailand) ahead of time - 3 weeks ago. Granted with the Canada Post strike I knew I wouldn't hear back for a while. I also recommend Ice go in person and inquire. For me, if I don't get the police certificate in the next couple months, I'm going to go to Thailand myself and ask in person! :blush:

You should be able to get it in Ottawa. I got mine at the RCMP headquarters in Vancouver. It took about 20 minutes and it's valid for 6 months. In hindsight I should have waited to get it as we don't have our petition approved yet, but I guess I can go get another one if it expires before my interview. Hope this helps! :)

Last night I was panicking about things and working out our backup plan in case things didn't work out the way that we wanted them to. I think I was worrying my fiance with some of the stuff I was saying.

Our case isn't exactly straightforward, and I was over-worrying that we'd forgotten to include something. Or I would read things and think that the worst possible things were going to happen, I guess I am the glass is half empty kind of gal!

My fiance had also received a letter about the country I was from(Australia), called them, and apparently the information that they were requesting was already on the forms, they'd just missed it / hadn't entered it or something ... and I was worrying that the call wasn't enough ... I asked him to call them again to double check that he really didn't have to do anything else.

BUT after all that stressing ... we just got the NOA2 approval notice. It was a nice surprise to wake up to this morning :) :) :)

Yes, he will need one for the UK and one for Thailand. The police certificate for Thailand took me nearly 6 weeks to receive it from the time I mailed my request (granted there was a postal strike in Canada at the time).

On the website to see how long VSC is taking to approve I-129Fs I saw this "Field Office Processing Dates for Vermont Service Center as of: August 31, 2011" and also this "The charts are updated on or about the 15th day of each month." Well it seems to have been 2 months since the chart has last been updated. Is this correct or am I missing something? Is VSC particularly swamped with work right now? Are they struggling to get petitions approved on time right now?

The USCIS website was updated recently because the average processing time for VSC *was* 5 months and it is now March 15, 2011. The changed the site recently but neglected to update the "As of August 31, 2011" date at the top of the chart. All very confusing.

Called USCIS helpline on friday, 10/28. Was hoping to get a hold of human being instead of the (insert obscenity) automated system they've implemented for customer service. By weird luck, got a hold of a rep. Sequence is 1-1-2. The rep kindly informed me that VSC is swamped with I-129F applicants and are going through MARCH applicants presently. Which makes sense looking at majority of NOA2 updates in immigration timelines. She concluded by saying "please call back in 2-3 months." So, if you're lucky like me, the average wait time for NoA2 for VSC is 8 months plus. I call on the lucky average NoA2 expectant to kindly follow up with your frustrated comment...

That's what my fiance was told when he called USCIS to put in a service request one day after our 5 month mark, on Oct. 19. Yay, more waiting. :crying:

Hey!

Does anyone know if the NVC will contact is when they recieve our petition?
We received our NOA2 on the 5th of DEC. Just waiting to hear more now!

Our petition took about 3 weeks for it to be received at NVC (from VSC)... I called several times a week to check and see if it arrived. I was told it takes around 15 business days, which in our case was about right. I was finally able to get the case number yesterday and today our petition is on it's way to the consulate. We never received any correspondence from NVC. Just keep calling them. Congrats on your NOA2! And good luck!!! :)

Congrats!!! IMO, I would wait to fax anything until you have been instructed to do so by the Consulate. 3 days after our petition left NVC, I emailed the Consulate in Vancouver to see if it arrived, and if it had arrived, to ask if they would email Packet 3 to me. The Consulate in Vancouver is surprisingly quick in responding to emails (5 hours tops during business hours). So in the past few days they emailed Packets 3 and 4 to me and I booked my interview date. (Check out my signature below.). There are lots of interview dates open in the coming weeks (note that Woking is closed on Wed, Dec 28). Hope this helps... good luck! :)

You're the USC right? I don't see how your travel to the UK affects anything to do with obtaining a K-1 for your fiance other than supporting it by showing that you have an on-going relationship.

 

I'm sorry that you're being hassled at UK immigration but that has nothing to do either way with the US process you've started to get your Fiance into the U.S to join you. How you're being treated at UK immigration (even if you were refused entry) has no bearing on USCIS deciding whether your relationship is genuine and evaluating if the requirements needed to sponsor your Fiance into the US are met.

 

UK immigration Officers only want to ensure you really are only temporary visitor. What they're doing is annoying but it doesn't sound like they have any genuine grounds for refusing you entry to the UK.

I think the documents required varies between embassies, so its best to go by individual embassy guidelines, which are given in the packet 3 letter (even though it may only be a link to that particular embassy website telling you what they want). The other lists are generic and would contain the core documents always required as a starting point. But i don't think there can be that much variation, although some require more evidence of an ongoing relationship etc.

There's no issue, same thing happened with my Fiance & you don't have to do anything. We had received NOA1 but not NOA2. He just used his new employer on the i-134 affidavit of support that he prepared for me at interview time. He included a letter from his new employer confirming the date he commenced employment and his salary. He also enclosed last 3 yrs of tax transcripts and last 3 most recent payslips just prior to the interview.

 

Just make the i-134 the relevant most up-to-date document. They understand that things can change between filing the i-129 and the interview.

No, nothing about your wedding needs to be booked, although having a date in mind would be good if asked at the interview or at POE (I was not asked at the former but was asked at the latter)

Aside from meeting the residency requirements (being in-country for 8 days then waiting another week before being able to marry, (except if marrying in Scotland)) you only need to apply for UK fiancé visa IF YOU WANT TO STAY IN THE UK TO LIVE AFTER MARRYING. If you do not or can not, there there's nothing to stop you coming in as a TOURIST and getting married and GOING BACK TO THE US afterwards. You would need clear ties that you do indeed intend to return home if asked at the UK POE. This is just the same as there being nothing stopping a non-USC from getting married on the VWP and GOING HOME afterwards and then having their new USC spouse file and wait for the whole IR/CR-1 process to play out. The only different difference is where you get married.

FWIW I've been through both UK fiancée and US fiancée visa processes. The US process was definitely a bigger PITA.

If you're trying to do something big it needs to be pretty far out, but the truth is the process makes it difficult if you want to have the typical wedding of your dreams. i think most people compromise in some way because you cant confirm anything until you have visa in hand. After tossing out several other ideas we're going to Vegas.

I don't think you should assume it was because of the dates of your divorce and your engagement. My divorce was finalised last Nov and my fiance filed the petition in Dec - I did get asked for an explanation of this in my visa interview about why this was so close together and I explained that my ex & I separated two years prior to the divorce being finalised when he went to work in another country and we agreed to divorce 18 mths before it was finalised, during this time I embarked on a long distance relationship with my fiance who i knew from dating in 1994)

 

You do need to wait for further explanation as to reasons why but assembling proof that you were separated and free to start a new relationship even though you weren't yet divorced might be helpful. (In my case my explanation at the interview was sufficient.)

As stated in my example above there was no requirement to include wording about permanent immigration or future travel back and forth between countries. I merely had to show i had consent from the childrens father to take them with me when I relocated to the US.

Hello everyone,

 

I could use with your help on the letter that the non-main-custody parent needs to sign showing authorization of the immigration of children.

 

I am the main custody parent to my two children, but communication with my ex-husband is not the best. I plan on having them go with me to the US and have informed my ex-husband of this fact, but he hasn't said anything either way. He has moved to England, so my lawyer told me that there's not a lot he can do to prevent our move, but because there's a chance that he might put up a fight on this and that it will have to go to court, I want to start the process as early as possible.

 

So, I want to start by sending him a pre-written letter that he can sign and have notarized in England, so I wanted to ask your help on how to go about this. If you could give me examples of what you have done, sample letters and the like, that would be very much appreciated. Something like the sample letters of intent that are on the VJ Guides.

i did not have a specific letter but I did have a Consent Order (this was produced by my lawyer as part of my divorce) which is a document signed by my ex-husband which was filed in court and laid out in writing what we had agreed for child support and division of assets. It also contained a paragraph saying that I was the primary carer of our children and that he (my ex-husband) consented to our relocation to the US.

 

I would ask your lawyer to draft a letter containing the wording you need. The wording used in my Consent Order is thus:

 

AND UPON the respondent having agreed to concede, after deliberation and consideration for the happiness of the children, that the children (name of child and date of birth & name of second child and date of birth) shall relocate to Austin, TX with the Petitioner, as their primary carer, in or around August 2013 ('the Relocation Date')

 

I am referred to as the 'Petitioner' because it was me that Petitioned for the divorce and this is a document produced as part of the Divorce agreement - your lawyer should adjust wording as necessary.

 

I took a certified copy of the Consent Order with me to the interview and showed them the relevant section when they asked if I had consent from the childrens father to take them to the US.

Sorry for your troubles OP. It really does seem to depend on where you're coming from. It seems they give Canadian's quite a hard time. And citizen's that normally need a visa's to visit the U.S. I myself visited multiple times while our K1 was in process, entering via Newark, Houston or Dallas and never had a hint of any issue.  I never carried any evidence with me and answered truthfully who i was visiting ('my fiance and other friends'). I also came in for 6 weeks to wait for my interview date and flew back to London once notified of it.

 

I think you were particularly unlucky on this occasion.

My i129F has been approved and sent to the Algerian consulate. My fiance and i are gathering the documents for his interview.
I am a student here in the US and I just have a part-time job so I dont know if that qualifies as a form of "support".
Can my dad fill out the evidence of support on my behalf?


Yes they can if your income is not 125% percent above the federal poverty level for the total family members in your home and that includes your fiancé.

Hello. This is my first time posting and am very new to this process so please be patient with me :) My fiancee and I will be doing our paperwork for the K-1 visa in the next couple of months and I had a few questions. For the affidavit of support would child support I currently receive be included in that? Also, I am reading that my last 3 years of tax information will needed to be submitted. Currently I meet the requirements for income but, the years prior would be a little iffy because I was a student and only worked part time. Would we need to look into finding a co-sponsor based on that? I am sure I will have many more questions but that is it for now...ha! Thanks for any information. It is greatly appreciated!
