I agree, I wouldn't risk having to cancel the reservations. Better you wait until the K1 is in your hand to book for the wedding.
for example, what we plan to do is, after we get the visa, go to city hall, get the legal part out of the way and the 90 days limit off our backs, and then plan with more time the actual big wedding ceremony. we think we can't plan that on just 90 days, plus this way we can have some time to save a little money.
I know how you feel, I hate USCIS everytime I see a white dress, I wish we could get married tomorrow, but oh well, we just decided to play it safe.

I'm afraid I can't help you with questions 1 and 2. Regarding question #3, we sent our application on 03/27/2007 and we received our NOA1 on 04/14/2007. Since Nebraska SC is no longer processing fiance visas, your application will be forwarded to California SC, and that's known to cause some delay.

If I were you...I'd meet with an Immigration Lawyer.

but also look around the waiver forum, to complement the information and help you get from the attorney, because I assume you'll have to ask for a waiver on the overstay.

Prepare yourself for a long, difficult journey...I think it's not impossible, but it won't be easy. Be careful, a lot of couples fall apart from the stress of separation and a bumpy visa road. Factor that into your decision and protect your relationship.

And I agree with the rest, we are all helping each other out here, and it's a valid question what you had (I don't think USCIS would have posted an specific answer to it, if it wasn't a commonly asked question, right?).
I think that, you've already gone this far with the K1 visa...getting married abroad would be an option, but then, like TimDaisy explained, you'd be stuck at the beginning of the process again, because you'd have abandon the K1 and start the K3 visa (doesn't sound good, does it?)...Still a valid option though, if you really can't change your wedding plans. And like Karen said, with the K1 you have to get married in the US.
According to the timelines, it's taking about the same amount of time to process for the K3 than it does for the K1.

One advice I can give you, if you decide to continue on the K1 path, is start getting ready for the embassy interview, that would save you some unncesarry delay. For example, I am making an appointment with my doctor this week to start getting my vaccinations certificates in order for the medical examination (I'm the beneficiary)...The guides and the embassy reviews are an excellent source of information for everything that you'll need for the next steps.

I don't think CSC would move the case forward, unfortunatelly USCIS specifically says on their web site
"we process fiancé(e) cases in the order we receive them.
We cannot pull a case out of order to accommodate wedding plans.
In addition, once we complete processing, the U.S. Consulate must
process your fiancé(e) for a visa; so factor this into your plans. "

mmm good question!
At the end of the fiance visa application the USC has to sign a declaration stating "I am legally able to and intend to marry my fiance(e)...."
so as long as she can legally marry him, and they can comply with the affidavit of support requierements -and all the other ussual requierements like having met within the last 2 years and so-...I think they should be fine. I don't know about the legal age to get married where she lives, she should look into that. It also says that if any of the two is of an age that requieres special consent or permission for them to marry, then they have to submit proof of that consent.
(Do her parents agree with the engagement?)

Justin sent me the affidavit of support, and for question 11 "indicate the exact nature and duration of the contributions"...He answered:
"this is my fiancee and soon to be wife. I will support her for life"

but after several hours of saying aaww...I started thinking that this may not be an "exact nature and duration"

remember the purpose of this forum is to help each other. So what if new members ask the same questions a thousand times? I remember how confused I was the first night I stayed up reading USCIS, travelstate, and visajourney. Sure you had an obvious questions at the beginning, or at least can understand why people starting on the process would have such questions. Remember that feeling before you judge others wink.gif

And as for positivity...look around the forum. Look up the threads of VJ families being reunited, posting pictures of ther weddings, talking about trying to conceive, posting pictures of their new borns. I know it all looks dark now, the time between NOA1 and NOA2 is the hardest, most frustating part of the process. but it will be over in due time and you'll be thinking "I'll be leaving for the airport in a week! I'll be hugging my fiance(e) in 8 days! "

K1 is the fiance(e) visa, K3 is the Spousal visa
NOA means notice of action. The reason everyone awaits for the NOA2 with much anticipation, is because it means that the USCIS service center has completed their part of the process. Then the case is forwarded to the NVC (national service center)...and all the rest that is listed more eloquently in the guides.

When you apply for a tourist visa, you have to provide proof of significant ties to your home country, so that they would justify your return. That is tricky on itself, and more difficult if you have a fiance(e) in the US. Not "impossible"...but very difficult.

Hi Kem,
You need to
*Enter the US before March 6 (if you fly in February, then you'll be fine).
*Get married within 90 days after your arrival
*File for AOS as soon as possible after marriage
*No need to have your SSN or driver's license before filing for AOS. In fact, chances are you might not be able to obtain a driver's license until after you receive your EAD card or green card, depending on your state's regulations.

(all sorts of good info on this travel.state page. One of my favorites, I highly recommend reading it to anyone about to start the process)

From personal experience:
Do the math thinking that you will have to support your fiancee for at least 6 months while she gets her work permit and finds a job. And hey, and if it's less than 6 months, then it's a nice suprise.
Consider the cost of adding her to your health insurance ($140 for us), and car insurance.
Consider means of transportation.
Wedding expenses.

and as you mentioned, travel expenses and anything else that applies to your specific case.

A short courtship followed by a quick engagement the first time you met in person is certainly a red flag, that will come up at the consular interview, but not a reason for automatic denial. Make sure you have a lot of proof of ongoing relationship by the time of the interview.

awu25, read up on the guides and, based on your personal situation, make a decision wether you want to file with or without the help of a lawyer. A lawyer may NOT expedite your case, just advice you and guide you through it. If after reading the guides you still believe you'd feel more confident with the help of a lawyer, I'd look for one that is a member of the AILA (American immigration lawyers association) AILA

The original packet should include both the petitioner and beneficiary's letter of intent (see example here). If you did not include this in your original application, you will have to wait for a (possible but likely) RFE.
An RFE may delay your application, but they generally don't have a significant impact on your processing time.
