I went to school with my boyfriend and I moved to the states later. We met and started talking. I went to visit family and I visited him while there then we officially started dating.
We are making plans of getting married but i don't know which one will make the immigration process quicker.
if we do the K-1, we don't have any pics together (my mistake!!).
I need some advise on what to do.
I am still in school and he will be applying to school to do his masters but we both don't plan on living in the states permanently.

If I were in your situation, I would withdraw the application at this point explaining the situation, and when you want to return together to the US just do Direct Consular Filing, which is a fairly quick and easy process smile.gif

Yes, if you have been living in Argentina for as long as you have, you qualify for Direct Consular Filing. It's the fastest route so you're lucky (I believe the Embassy web site states around 3 months) good.gif

We are a little confused about what to expect with the processing times, because the USCIS web site says they are processing forms received in sept 2006, but that doesn't really match the timelines other users are posting on the web site :huh:

We sent in our 129F to the Texas serv center, as instructed in the form, but we found out it was forwarded to the California serv center. My fiance lives in Texas, so we were under the impression that the Texas serv center was the correct one, does anyone know why they could have forwarded the petition to California? :unsure:

And I agree with the rest that reading the guides will definetly help you too, even if you do hire an attorney, the better informed you are about the process, the better chance you have to make a decision that bests suits you and your fiancee. Government web sites are very informative...but not very user friendly in my opinion, I think you'll find that the guides on this web site are much easier to follow and understand.

There really is no reason for them to read your entire conversations. What is important is who is chatting, when, and how often.

What I do is take a screen shot of the chat archive for every day we chat. The archive shows the date, time, who is chatting, and the first part of the conversation. I paste this in a word document with our names, date of chat, and case number in the header. I format the document landscape for printing.

This gives 1 page for each chat rather than tons of pages for each chat. If I provided entire chats, I would seriously be killing an entire forest ;)

I use a free program called Gadwin Printscreen for capturing a screen shot, you can select any part of your screen to either copy to clipboard or save as an image...I use the copy to clipboard option as I am pasting into a word document.

I also use the same program to take screen shots of us a few of times a week while we are on Windows Live Messenger video conference. I include this with the chat archive for that day.

Once a month I gather all of our chat proof and burn it to CD in the even something happens to my PC, and also print our chats for the previous month and file it in a cabinet I have set up for all of the proof we have compiled for the last 2 years.

I'm sure you will have other members suggest different things, and you may find something else works better for you. I have found this to be the easiest to do, and maintain in the long term.

Thinking ahead for the proof of ongoing relationship, I was wondering what would be the best way to submit chat logs, since that is what we use the most. One way would be to take a screenshot of the chat (with an online version of a newspaper to show the date in the background), or to print the actual conversation.
I guess my question is...are they interested in what is said in the conversation? or just the fact that we talked that day?
My guess would be that the screenshot is the way to go, but...I still thought I'd ask :innocent:


I had the same problem since my fiance and I communicate by webcam, so we don't even have chat records. And we only text or call when it's something that can't wait until our next online meeting. Also, neither of us are camera-happy so we only have a couple pictures of us together. I wrote him some letters and sent Valentines and birthday cards so that he'd have something to take to the interview. I'm in the process of redecorating (to make my bedroom less girly) so I also sent him some paint chips and magazine pictures of general ideas for what I would like to do with the room.

I've no idea if that will be satisfactory, but I'll let you know. His interview is May 2nd.

Sorry to hear about your situation :(
People are right, the options are few on this point
*Finish highschool (not just for the visa process but for yourself! ), so that you can later look for a better position. I think this is the best option really.
*Get a second job (this would make it harder for you to finish highschool, so I think you should go with the first option)
*Keep trying for a co-sponsor
or...
*Consider a third party country where you can both live together, maybe untill you can save up some money and finish highschool

The K1 Guide says
" 1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).
2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy..."

Yes! When you mailed the first package you sent copies of the proof of having met within the last 2 years. The idea is that you mail her the originals of those documents you copied back then, add proof of ongoing relationship...and everything else that's explained in the guide Dawn mentioned.
Remember you'll have to write a new intent to marry, so that it is dated closer to the date of the interview

You mean in the K1 stats link? you're right, I haven't noticed that, that's weird

Maybe I wasn't very clear on the initial post. The question is:
What would be the most accurate way to calculate estimated adjudicated date? using the received date, the day NOA1 was received, or the date the first package was sent?
Many things can delay the date the NOA1 is received (I've even read about some people that never got the NOA1 at all!)
for example....someone that lives it Texas is bound to receive the NOA1 later than someone that lives next door to CSC.
or maybe they just didn't tip the postman on christmas! :P
Same thing with the date the package was sent...and keep in mind that NSC and TSC applications are being forwarded to California, so between the time we sent the the first package and California received it, 9 days went by. (we sent the first package march 27 with next day delivery to TSC and because of the transfer hassle, CSC received it april 5th)

So my question is...with all this factors in mind...why is the rule that we are using date of NOA1 to calculate estimated adjudicated date? is there something I'm missing? :innocent:

Welcome to the process. The first part is the hardest as it's the longest wait times for things to happen. Either way you look at it, if you go through CSC it's going to take about 3 months for your NOA2 and if you go through Vermont it's about one month. Since your at the CSC, you have till about the middle of July for yours to be escalated to NOA2 level. It's kind of weird in that the days go by slow by the weeks go by fast. We just submitted our Packet 3 and should be getting an interview date in July in Bangkok. It's well worth the wait. Just enjoy the process. Ken

Checking the timelines and stats, I see that it's a lot more common to calculate the estimated date for the NOA2 going by the day the NOA1 was received. But one would think that it would be more accurate to go by the date the I-129 was received by the service center, right?

I agree, I wouldn't risk having to cancel the reservations. Better you wait until the K1 is in your hand to book for the wedding.
for example, what we plan to do is, after we get the visa, go to city hall, get the legal part out of the way and the 90 days limit off our backs, and then plan with more time the actual big wedding ceremony. we think we can't plan that on just 90 days, plus this way we can have some time to save a little money.
I know how you feel, I hate USCIS everytime I see a white dress, I wish we could get married tomorrow, but oh well, we just decided to play it safe.
