K-1 Fiance(e) Visa Process & ProceduresChild Support Included?
Hello. This is my first time posting and am very new to this process so please be patient with me :) My fiancee and I will be doing our paperwork for the K-1 visa in the next couple of months and I had a few questions. For the affidavit of support would child support I currently receive be included in that? Also, I am reading that my last 3 years of tax information will needed to be submitted. Currently I meet the requirements for income but, the years prior would be a little iffy because I was a student and only worked part time. Would we need to look into finding a co-sponsor based on that? I am sure I will have many more questions but that is it for now...ha! Thanks for any information. It is greatly appreciated!

Thank you to all that replied. I googled ACCO binder and they look like they would be difficult to take apart when they disassemble our paperwork. Maybe the ACCO binder clips would be a better option. Thanks again :) It is a very exciting time! I want to make sure we are doing everything correctly.

My fiance and I will be sending in our petition VERY soon and I wanted some clarity on the Visa fees. For the K1 petition, I keep seeing an amount of 340 dollars but on this website http://travel.state...._1263.html#perm I see the fee for the K1 visa is 240 dollars. Which is correct? Hello all,

My fiance and I just received our NOA2 and I am in the process of getting the paperwork together in preparation for the interview. I had a question about the letter from my employer. I have two part time jobs. My main job is 30 hours per week and my salary is way over what I should make according to the poverty guidelines. I have been looking online at sample letters and they all state employment should be full time. Can anyone tell me if a full time job is a requirement to be approved? Any advice would be greatly appreciated! Thanks!!

Yes. I wanted to make sure that letter was sufficient and it was leaving out any crucial information.
I work as a nanny for a family on a permanent basis making well over the 125% guidelines. How would I get them to write a letter on company letterhead? That is not feasible for me in my situation. Thanks for the info!

I understand all that. My real question is what should I sent now ( in the mail)? He has a full copy of our petition. It is my understanding that I mail the I-134 and the letter of intent because they both need my original signature. I will also send the photos and the NOA2 (approval letter). Thanks for your help! Those of you that have been through the K1 interview process, can you tell me what original documents my fiancée HAS to have from me? What if the paperwork never makes it there? Would they take copies? Interview is end of next month so I will be sending financials and I-134 to him by the weekend. I just don't want to miss anything. I am a bit OCD and want to make sure we are doing everything correctly ;)

I read somewhere on here (I think) that for two jobs, I should put the higher paying job (that job is over 125% poverty level) first and attach an attachment stating the same information but for my second job with how much it is annually and with the address and all that. I need to send it to him ASAP. Do you think this would be ok to do? I would also date and sign it. Thanks :)

I encountered the same problem. My employment letters were written (typed) by my employers and then I had the copies notarized (I have two jobs). My fiance had the interview last week and our consulate officer did not even look at them. I am glad we had them just in case. I am not sure what your embassy requires as each embassy is different.

 

I was a full time student in 2012 and did not meet the requirement that year. To be honest, our consulate officer did not look at that either. They just looked at the I-134. I would look into the reviews for your country, have everything they ask for and go from there. Good Luck!!

I think if your sister wants to buy the rings as a gift, why not have her give you a greeting card for the occasion of your engagement with a note in it saying 'as your engagement gift, I will pay for your rings!  You and Fiancé have fun picking them out!'  Then you can share a photocopy of the card with USCIS as evidence of family support and knowledge of your relationship?

Sponsorship for a petitioner who isn't active duty military is 125%, across the board.  IIRC, the I-134 is the form you'll need to file for affidavit of support for adjustment of status once you're in the US.  They won't give you a K-1 unless your sponsor can support you for AOS.

(I have trouble remembering form numbers, but I know that those poverty guidelines are always, always, always what is used for family sponsorship.)

The poverty guidelines are here.  You look for the household size including yourself and your fiancé.  So if your fiancé has two children, you will be looking at a household size for four people (you, him, two kids).  If your fiancé lives alone with no dependents, you will be looking at a household size for two people (you, him).

 

A cosponsor is necessary if the petitioner (your fiancé) makes less than 125% of the poverty guidelines.

Worst case, you'll get an RFE, which will delay you a bit, but won't result in a denial.  They'll just ask for statements from both of you and you send them in.  Have them typed up and ready to be signed and dated as soon as you get the RFE and then away you go.

Hi there! I just had my interview last Oct 4 here in Singapore and CO asked for the court certified with a stamp divorce paperwork. I was given form 221(g) because of that. I have submitted the next working day. Fedex will take 2 days maximum. I agree, it depends on the CO I guess.. but it is better to be ready just incase. Goodluck! :)

At the interview you only require the original or a certified copy of the certificate for the beneficiary.  You do not require the certificate of the petitioner.

 

The birth certificate needs to be the long form version that shows both the father and the mother's names.

Hi There,

 

I assume that you have exchanged a number of emails / text messages / etc during the course of your relationship?  Also, if you have sent / received any Birthday / Christmas cards etc.  Essentially a paper trail between the two of you.

 

All of this can be submitted as supporting evidence of your relationship.  

 

Even though I actually was in physical contact with my fiancée for a over a year and a half, we had very few photos (I hate having my photo taken).  

 

The email submissions were accepted with the initial petition and we got through to interview etc without a hitch.
