US Citizenship General DiscussionNeed some help!
Her best bet might be to file for citizenship (for my wife approval was given within 3 months of N-400 being sent--but due to having name-change packaged with N-400, swear-in was delayed another 4, for a total of 7 months) and then apply for US passport--and THEN fly to Thailand for delivery. In that case, you can go to the US Embassy in Bangkok and the process for registering the birth of a new US-citizen abroad will be "straightforward".

(btw, Thailand allows dual-citizenship--so she could still use unexpired Thai passport to enter Thailand).

US Citizenship General DiscussionOath Ceremony After Interview in Seattle?

Hello All,

My wife has her interview appointment scheduled for 9:00am in early October in Seattle. Does anyone know or have any experiences with the ceremony/interview in Seattle? Do they offer the oath ceremony in Seattle after citizenship interviews?

Thanks everyone in advance!

If your interview is done before 2:30 pm, USCIS centres oft do same-day oaths.

US Citizenship General DiscussionMy last questions

Hey all,

Almost done putting my application together and I have a few questions that I am not 100% confident with my answers.
Can you please advise?

1) Part 1 - B "Name exactly as it appears on the card"
So on the card it shows my name under the name section as FIRST NAME/LAST NAME/MIDDLE INITIAL and at the very bottom it lists my full name, which is too long and it doesn't even fit the card. Are they asking for what it shows next to the "Name" section of the card?

2) Part 4 - C "Telephone and Email"
Do I need to give USCIS email and phone number? Do you all do that?

3) Part 5 - D and E
I was born in Brazil and this question always makes me confused. Should I check YES or NO for the "Are you Hispanic or Latino" question?
Also, by marking YES, do I still need to answer the question below ("Race")? I am assuming I should say either yes or no for the Hispanic question and then mark "white" for "E". WTYT?

4) Part 10 - B "Affiliations - Have you ever been a member of...."?
So how ####### are they with is? I haven't been a member of any organization, association, society, etc... but I have a CVS card, my insurance is AAA, I have an annual pass at the ZOO, I have a gym membership, etc. Do I ignore this stuff or is this the type of thing they are looking for?

Thanks a lot. I am just waiting on this so I can finish my package. Cheers!

  • write it as on the card (l-f-mi)
  • phone number is ok (email optional)
  • (pass)
  • if you have never been a member of the organisations of concern (such as communist/nazi/fascist organisations/parties, al-qaeda/hamas/hizballah, ...) then you can check off no.

US Citizenship General DiscussionQuestions about interview at fairfax,VA & passport application timeline
Merrifield Post Office is the nearest place AFAIK for US-passport application.

The Certificate Of Naturalisation will be handed to you when you are sworn-in--and will be necessary as proof-of-citizenship for your fist US passport.

If your former country of citizenship allows multiple nationality, there is another (albeit technically illegal) approach providing you are taking a vacation exceeding 4 weeks there--use your non-US passport to go there, and then apply (obviously, you will need to carry the Cert of Natz with you there) at the US Consulate/Embassy (and sit through the class which they will give you for doing that instead of getting it ahead of time Stateside).

US Citizenship General DiscussionPassport Application

Do not try this! It's not just illegal (and punishable by a fine), it's not possible unless the airline agents screw up in a major way. When you leave the country you need to show a foreign passport and (1) an I-94 form stapled into your passport or (2) your green card, or (3) a US passport. You meet none of these conditions if you are a citizen without passport, and if the airline agents do their jobs, they will catch you and at the very least deny you boarding. -- International law stipulates that entering or leaving a country you must use the passport of that country if you are a citizen of that country irrespective of how many other passports you may hold.

Therein lies one of the flaws--USCIS assumes that the airline-desk people know enough about US immigration to implement an exit control.

Also, #1 is a relict, since there are large numbers of Canadians who visit US without ever getting an I-94--so it would be impossible to collect a nonexistant document. And this is made even worse by mail-in non-immigrant visas, which have as part of the approval-sheet a tear-off I-94 (which does NOT resemble the one issued at a POE, and which is also rather easy to copy--in full-colour two-side).

And when is an airline going to prevent a foreign traveller from leaving the US voluntarily?

Oh, also many other nations (such as Canada) don't make much issue about duals entering with the other passport--my sister (a dual since 1996) has entered Calgary many times with the US passport (though technically she should use the Canuck one).

On a different note, there is no problem in getting a passport within a day for impending travel. I've done it and I know others who have done it.

US Citizenship General DiscussionPassport Application

Dear VJ'rs,

I have received a request to appear for my oath ceremony on a Thursday in October. My predicament is that I am currently on an overseas assignment and will need to leave the U.S. and return to work as soon as possible. What are my options to expedite the passport application?

I have read about companies that offer 24hr passport services, but to be honest, the websites I have found don't instill much confidence in me...
Also, if I attend an oath ceremony on a Thursday, is it actually possible to have the passport in hand the next day?

On the bright side; I am really happy with the quick turnaround time, as it gives me an opportunity to exercise one of my my rights as a citizen - vote in an election!

Thanks!

How long do you need to be overseas? Also, does your erstwhile country allow dual-citizenship?

There is also another, albeit technically illegal, way--go overseas with your non-US passport but carry your Naturalisation Certificate with you--and use that to apply for a US passport at the Consulate/Embassy (note: the Consulate/Embassy will give you a class on that issue if you do it...).

US Citizenship General DiscussionN400 With Unemployment benefits while Lot of International travel

Hi,

Im new here, hello everydoby.

I am eligible to apply to Citizenship this DEC 2010 based on a 5 years rule;

I'm assuming you mean "5-years-minus-90-days" there.

back in 2009 I was let go from my job; I then become a freelance writer making, after many weeks of study, a very small monthly income.
During 2009 and 2010 I was collecting unemployment benefits and I traveled internationally to find resources and original pictures for my articles. I do meet all the residence requirements in terms of months I resided in US.

Will this create a problem during my N400 application?
If the IO see the amount of benefits I collected combined with all my trips, can I get in trouble?

thanks

Nope. I've been in a "similar boat", having been laid-off in Oct 2001 and alternating between UI and "tideover" jobs from then until Jan 2004. And I also made some international trips (four of them lasting over 24 hours, lots more within one-calendar day--all to Canada) during that time.

US Citizenship General DiscussionN-400 Part 7. Time outside USA

Yeah the N-400 was kind of designed for the 5 year thing, and surprised they haven't changed it. I was here about 7 years before I got married. So when I got to the N-400 a few years later, I listed all 5 years. The IO looked at the dates and started crossing out the ones that were before 3 years saying because it's marriage based those trips are not considered.

So even if you've lived here on another status for 5 years, you still would only need to put down the past 3 years for marriage based ones...

Not really surprising when one sees the instructions for various forms (example, those for the plain-jane I-129--not the I-129F--still contain about "TC")

If he is not sworn-in immediately after the interview, he may be able to travel depending on oath-schedule (if same-day, excellent for OP's case).

The GC will be taken by USCIS at the oath ceremony and exchanged for Naturalisation Certificate--with which he could get a US passport as little as 24 hours from swear-in (show the Cert at the passport application centre--probably Post Office--along with a completed form, another ID and moneys).

US Citizenship General DiscussionOld citizenship??

Wow. I would have thought that being stripped of one's citizenship would be accompanied by a lot more due process, especially in Western Europe. I stand corrected.

I'm glad I'm Canadian.

Western Europe has several countries, each of which has different laws on this subject. Germany (subject of hhN400) doesn't allow duality, where UK does (exactly like Canada, but different fees/forms).

Wow, I guess it´s good to be from a small country then...

Today Iceland does officially not care if you have another citizenship, or 10, but back when it was illegal to have another one it was one of those 'naughty, naughty´ slap on the wrist kind of offenses.

Just out of curiosity, this BBG process, is it relatively hard to get approved or relatively easy?

depends on your definition of "small"--UK is small in area, but substantial (about 1/5 US, and about twice Canada) population, and allows dual-citizenship.

Was her Green Card issued before 2007/05/29? In that case (only) you can send in the N-400 prior to 2010/02/28. Otherwise, the earliest that you can send it in (or more accurately, earliest that USCIS should receive it) is 90 days prior to the 3-years-anniversary of her getting the GC.

US Citizenship General DiscussionCitizenship/passport questions

Cathy arrived in the U.S. January of 2008 on a fiance Visa. Her AOS was approved September 2010. She will have been a permanent resident for three years in September 2011. We plan for her to apply for citizenship 90 days in advance which will be June of this year.

The question I have regards her current Philippine passport which will expire in March of 2012. We have no plans for her to leave the country until at least mid 2012. Since we see no reason that her citizenship might be denied is there any reason for us to renew her Philippine passport? We will have to travel to Chicago to the Philippine embassy to have it renewed and we would much rather put that money towards her N-400 application if we can. Is our logic sound? Is there any reason for us to spend the time and money to renew her passport when it will be replaced by a US passport soon?

Andy

Did you mean ROC (Removal Of Conditions) rather than AOS? If her AOS was approved in September 2010, her Permanent Residency started then.

Does PI allow dual-citienship?

This depends on several factors, including the time of interview and whether she availed of legal name-change--prior to noon interview with no name-change oft gets same-day oath.

Yes, it is legal to travel outside US between interview and oath on foreign passport--but it may lead to questions.

One approach--she can ask not to avail of same-day oath option, let them set an oath-date (which will allow at least some delay during which she can travel).

She should absolutely not attempt to travel to India post-oath on Indian passport (even within the 3-month "grace-period" which India government officiously allows).

 This is exactly what I availed of for Pras' interview.

That is a lot more parking than they had in San Francisco near their office.

And marginally better than at Hopkins Plaza in Balto (where a few church members who wished to attend my own ceremony in 2005 had to avail--I had the "luxury" of parking at Rogers Av Metro Station, Metro'ing downtown to work and simply walking from the office to Hopkins Plaza).

Looks like a big parking lot across the street:

that's parking for Dunn Loring Metro station--you will get clobbered there for between $4.00 and $5.00 (flat-rate) if there is any space available (usually it's near-packed before 10:00).

If you can take Fairfax County Connector to either Vienna (routes 621,622,623) or West Falls Church (latter I know of, having to go from Reston to Downtown, lots of routes) you can use Metro to Dunn Loring station which is practically across-street from that office.

US Citizenship General DiscussionTravel question

My foreign passport has a former married name which matches my GC. I remarried and have provided that info to the USCIS so my Naturalization paperwork will bear my current name.

My worry is that before I began the Naturalization process, I purchased Airline tickets and of course booked in the name that is on my Passport and GC.

I'm a bit concerned that I may have my interview and Oath before my flight and my GC will be taken. This will create a few problems with travel as I am not sure that I could get a USA passport in time AND even if I did, it would be in a name other than what is on the ticket.

If the country of which you are presently a citizen allows dual citizenship, there is a 2-part solution to it.
  • get a 24-hours expedited US passport after the oath (assuming that oath is more than 24 hours pre-flight); expensive option, but works
  • then use your other-country passport to travel outside US, and present your US passport at re-entry
FYI, I was naturalised in 2005 about 3 weeks prior to having a trip to India, so I got an expedited (1-week) US passport. Since I didn't have time to get a new India visa (my citizenship prior to US naturalisation was Canadian), I used my expired Canadian passport (on which I had a 10-year India visa) and my then-current one to enter India--and presented the (totally-blank) US passport at JFK when I re-entered.

(presenting a blank US passport when returning from abroad will get you further screening by CBP)

Is there any chance that if I Naturalize prior to travel that they will stamp my foreign Passport? Or can I just present the Naturalization document upon return to the USA?

No and no

I suppose also, I could just delay the Oath - looking at the time lines of others, I think I will have the interview prior to the travel date of Sept 23rd.

That option may work.

US Citizenship General DiscussionBecoming a US citizen

My fiancee was approved for our K1 visa on July 21st. I was wondering though once she comes here and we get married how long does it take for her to become a US citizen?

Earliest she can apply is 3 years after AOS approval (AOS should be filed after marriage in the US, which needs to be done less than 90 days from her arrival) minus 90 days.

She will not be considered one right away correct? Once we marry will she still be considered an Indonesian citizen until a certain time.

She will be considered an Indonesian citizen until she actually takes oath of naturalisation--unless she happens to naturalise to a third country (neither Indonesia nor US) between the time of arrival in US and taking citizenship oath (not exactly a common occurrence).

Just curious how long the process is to become officially a US citizen? I would like to let her know since she was inquiring about it. Any help would be greatly appreciated. thanks

I went into the VA DMV this morning and was told that it is not important to them what my citizenship status is so I did not need to do anything. She said they would not just change anything unless my card was up for renewal. I reiterated that I had been told I needed to come in to update it and she said she has no idea what they would have been referring to. She said the only difference is the length of time they put on the expiry date is shorter for non-citizens when they issue a license or id.

Thoughts on whether I should go back another day and retry? I only have a state id (don't drive)so I am perfectly happy to leave it as is. Next time I renew I'll have my US passport with me as id.

Did you have a name-change (in which case they DO need to be informed) along with the naturalisation?

US Citizenship General DiscussionWhen do they take your Green Card?

How about only have that new ten year green card for only a couple of weeks and having it taken away from at your oath ceremony. After all the expense and stress to get it, and no prorating on the fees.

If they had to prorate the fees for this, then those such as myself (who used the "conventional" GC, and applied after five years should get back 50% of the visa-fees we were charged at Consulate or I-485).

Depending on if your are flying or driving, if the latter and certain bordering states can get a special drivers' license to get you into Canada. LOL, if living in Minnesota or North Dakota, a snowmobile will get you in and out.

Then why Christmas for get togethers? Had to work long hours with my job and just wanted to spend Christmas with my kids without a bunch of in-laws around, and travel during that time is insane. A couple of weeks after Christmas, everything is dead.
