CanadaBeginning of the End

Well tonight is the beginning of the end of my visa journey. It has been a long 10 months since the beginning. First applied early Sept 2010, seemed like it would never end. Now tonight after work I head to the airport and fly to Montreal. Tomorrow I pick up my results from the medical (hope they are approved)!!! Bright and early Weds morning I will be at the embassy for the interview. I just hope I have everything I need. Have gone through the checklist time and time again and have what they asked for. Now how much extra does one bring??? If everything goes well, hubby comes on the 14th and we leave to cross the border on the 22nd of July. Can it really be happening???? Am starting to get a little nervous but excited at the same time. Thank God for VisaJourney. I have learned lots from everyone on here, its so nice to know you are not alone in this process.

As ex-Canadian (and not by birth), I'll chime in. I was able to adjust easily to Atlanta from Calgary (where I lived ages 8 to 30), so it should be even easier for one born in Canada given that "cultures" are already rather similar.

CanadaPOE at Prescott

My fiance' will be making his POE at Prescott later today..... other than the sealed envelope, his passport with visa, and his letter for his vehicle and proof of ownership.... is there anything else he needs??? He will have all of the copies of everything from his K1 application with him, but it will be packed along with his stuff. Should he have the NO2A available??

We're so excited we just want to make sure we haven't forgotten something!! Posted Image

Any personal items he needs rightaway in US, and can't wait till he gets EAD/AP to go back and collect. :) :thumbs:

Wow, this is the first I have heard USCIS getting so hard-nosed with a Canadian having to provide proof of entry. Generally,most Canadians who enter the US as a visitor do not have any documentary 'proof' of entry - it is not provided by the US border guards. If he has a plane ticket, then he would have had to go through US immigration at the airport before they even let him on the plane to the US. His boarding pass, if he has it still, would provide proof of legal entrance because he would not have been allowed to fly to the US without going through immigration before boarding.

No, Canadian visitors do not get an I-94 nor a physical visa (except under certain circumstances) nor are they members of a visa waiver program. Canadians who present at the border as visitors are given a de-facto B2 visitor visa status - but do not get an actual document stating so. It is a unique situation available only to Canadians. Sometimes US authorities will stamp a passport but more often they don't. It sounds like the interviewing officer may have been very inexperienced not to have known this or else is using this request for proof of legal entry as an easy out to deny an application he wanted to deny on other grounds but could not justify..

The best thing I can suggest is that your friend contact the border where he made his entry, provide them with the date and time of his entry, the type of vehicle he was in if he didn't fly, his flight number and carrier if he did, etc., his passport number and personal identification (name, address, etc.) and ask if they can provide him with some sort of proof of his legal entry to the US, even if it is just a statement that he was inspected on XXX date at XXX location and admitted to the US. He may be able to do this at a CPB office at a local airport if they can check their own records from other POEs.

Could be due to the fact that he married a USC--which is a "red-flag" to many USCIS officers.

And unfortunately, many Stateside USCIS officers aren't entirely aware of the laws regarding Canada and NAFTA; I can remember being asked "where's the visa" when I reentered at Atlanta (directly, not diverted through a Canuck PFI as was oft suggested on Grasmick Forum) from Gatwick in March 1999--and I can't claim that, even today, another TN-1 will not have a similar experience.

Not VWP. Canadians (only) are allowed (at officer's discretion) to enter US "undocumented" (B-2 status, but no papers) for up to six months.

It is very rare that Canadians get tourist visas to enter US (unlike VWP, a refusal does NOT bar future entry as earlier).

Yes, there are vending machines there; also, there is a cafe (SB/Caribou type--but it's NOT a Second Cup) on the building's ground floor.

(DO NOT try bringing in a ziploc of crackers--the security will probably take and consume them; you would be better off asking the clerk if you can go to the cafe and come back).

Yes--if December is within the timeframe of the 1-year extension (you will need to take the letter with you when you travel).

I have 2 bedroom stuff plus 1 car to haul and I need the stamped visa in order to give it to the movers to prove that I am eligible to live in USA.

Is there a problem doing this?
what is expected to happen?

You can even POE in the morning and return in the afternoon/evening--this isn't exactly a new practice, it's been done lotsa times by those doing TN-1 activations at land POE's.

I have my interview at the vancouver consuate this friday. And if al goes well, I'l be moving to the USA in with my hunny!

The job im currently working at gives T4's a little late every year, we get ours like March 6 every year or something like that.
Since ill be gone at the end of February in the USA can I get my job to mail my T4 to a family member here and then have them mail it to me in the USA?

If I am allowed to get get a US citizen to do it, that will be easy enough.

I looked for Canadian Consulates. The closest for us is probably Houston. That will work great, my mother in law lives there. We can plan a visit for when I need to renew.

I still have a few years left on my Passport, but I was curious about what we have to do.

You can download the form from the site suggested and courier it to Ottawa or Gatineau (you have to send it to one of these places anyway--since at least 1997).

If you want to fly straight in from Ottawa (YOW) to US, it does have a PFI. But it has rather limited straight-in connexions.

You may want to reconsider going through YYZ (Pearson :P -- it DOES have more US connexions than YOW) as you may be able to get cheaper (or more time-convenient) flights that way.

True. I've known cases that were botched by imm attorneys--including my own GC application (caused me an 18-month "hurry-up-and-wait with approved I-140" delay)

Also I think it's clear that just because someone offers advice - (and I've even seen you do it...) that they are NOT an immigration atty and are just speaking from personal opinion.

Generally, there are three cases where someone a (family) petition can be filed for over-21 member:
  • immediate relative (parent, and "derivative" spouse)
  • sibling (F-4)--a category which IMO should be expunged (2 reasons: a. takes way too long--about 12 years at best case, no hope of speedup; b. in general, it sounds like a "last gasp of hope" category applicable only to those who would otherwise be ineligible to immigrate)
  • unmarried child OVER 21, of USC
None of these applicable here.
