Pras and I waited till she had her EAD in hand. As a first-time we were told it could take "up to 4 weeks". I also applied for a US-citizen SS card (also replacement for my earlier "INS authorisation" card which I misplaced) and was told "up to 2 weeks".

I got mine within 1 week, but Pras' still hasn't arrived.

Or you could go the H1B route, work right away, get married and adjust status in the US and not have to worry about going back to your home country. Also, you'd avoid the whole Advance Parole issue too! Of course, you may want to spend a few bucks and consult with a good immigration attorney to determine which is the best way to go since I'm no expert! Good luck!!

Remember too, Kinsey, that some people never show a touch or the NOA2 online (or via email) - then suddenly get the NOA2 in snail mail. Heishe springs to mind as the most recent case of this. I believe she saw the approval online a few WEEKS after she got NOA2 in the mail. Obviously its not a perfect system.

Especially as many don't even sign up for email alerts or check online.

True; however, living in another country (as temp-worker or student) qualifies it for "residence" for consular purposes.

I am about to apply for a K1 visa with my fiance.

He (alien) and I (citizen) have gotten conflicting information on obtaining a work visa for him.

Can he work immediatley with a K1 visa?

Yes, if he obtains the "instant" EAD upon entry (meaning, he MUST use JFK as his POE)

Does he need another visa as well as the K1 to work in the US?

This would actually be impossible, since one cannot hold multiple DIFFERENT-TYPE visas simultaneously.

When can he apply for a work visa: before we return to the States, as soon as we arrive in the US, or once we are married?

Even if he enters at JFK, the EAD thus issued is only valid 90 days--with no extensions. When he files for AOS (as your spouse, after marriage), he can get a 1-year-valid "regular" EAD by sending in I-765 along with the I-485 (main AOS form).

Going a bit tangential here, but...

I can remember when my imm attorney had (royally) messed up my case by filing in the wrong category--which meant a considerable wait (turned out to be nearly 2 years) for cutoff-date progression. During that time, I found that for employment-based GC's, Consular Processing at Montreal would be likely faster than AOS through TSC.

Getting to the point now: the cutoff-dates DID progress; and by filing an I-824, I swapped to CP at Montreal--and got the GC in Dec. 1999 (and US naturalisation in Apr. 2005).

So, be patient and have faith Tracy.

  • the fact that you asked the question gives some indication of it working. It would be likely that USCIS official deciding on it will be similarly (if not more) ignorant of outside cultures--and would bin the app there
  • For USCIS satisfaction, that neither of you was medically able to travel for the 2 years prior
  • Financial has been TRIED (but generally fails--as USCIS doesn't accept "where was I supposed to get the money to fly to ....")

Yes, there are possibilities for a non-US-citizen fiancé(e) to work prior to marriage--but rather limited (for all of them, I'm assuming NO application for K-1):
  • if fiancé(e) is Canadian citizen, it may be possible to get a TN-1 (but restricted list of occupations even with "tweaking"), then marry in US and file AOS
  • an F-1 student may be able to work restrictively off-campus with USCIS permission
  • an F-1 at f@g-end of the visa can use CPT or OPT to work
  • other temp work visas (all restrictive in occupations, some also in numbers) are also available

Actually, they'll do both in most countries and particularly in London but within reason. The USC can drag their feet returning the P3 and then request an interview in a specific month or perhaps week out into the future. I'd say 3 to 5 months delay can be managed with no problem.

You'd be amazed how long it can take to gather the documents on the checklist, if you don't know what to get until the P3 arrives. This is true for vast numbers of applicants and Consulates are aware of this.
Oh, I know how difficult/long it can be to gather some documents in India (having heard it from Pras).

There is a load-factor (including tempworkers) at each of the service centres, affected by multiple factors (state's population, employment possibilities, number of tempworkers/immigrants generally...)--so CSC and TSC tend to be slower than VSC.

There is one effective way to change districts, but it usually involves moving to a state in the other SC's jurisdiction.

Also, you are dealing with government (as maztec states), so patience is a necessity.
