Make sure he's not going through Atlanta!!!!!!! Have almost been sent back by Officer Butler there last month.
Your NoA 2 should be enough evidence and a VERY good reason that he wants to leave the USA again to attend his interview and proof that he DOES NOT want to stay in the US illegally.
Be careful with other evidence,they've tried to use that against me last month!!!!!!

Other approaches for this trip:
  • Through Dublin or Shannon (immigration cleared there), change at US landing-point (there are no direct Dublin/Shannon to Atlanta flights, and you need to factor in the delay for CUSTOMS clearance with this approach)
  • Through Montreal or Toronto; both have PFI's where you clear US C&I--unfortunately, you also need to clear Canadian C&I both ways, even though only in transit
Both approaches only real advantage is that of avoiding "Officious Butler".

One good idea might be to send Patrick a copy of the NOA-2, with an explanation that the case will be forwarded to the Embassy/Consulate--and that he will HAVE to leave US for the interview.

Maybe surprising, but the necessity to leave US to do the consular interview (including for employment-based GC's) is enough in USCIS eyes to negate immigrant intent. :wacko:

(not a guarantee that USCIS officious will allow in though--unfortunately, it IS up to the officious' discretion)

Approved within 2 months of that.

Some counties/states (Howard County, MD for example) require only ONE of the parties to be present to get a marriage licence (I'd checked into this some time ago, before it was overruled by Bro. Joe--who wanted both licence and wedding to be done in MI) which would eliminate the need for the foreign fiancé(e) to have an SSN.

Fortunately for me Oakland County, MI (which requires BOTH parties to be present for licence) also doesn't require SSN.

I wrote this morning and some girl gave me a number to call for my pending visa. After waiting a half hour a man came on and i begged him to put my case number on computer and see if any change in the processing. He said seems like its still under processing. I said oh. Then he says oh wait a minute.... Looks like something new here. I said what???? He said looks like visa was issued today!!!!! I said nooooo wayyyyy he says wayyyyyy. I said so he got his visa??/ He said yes he did. So now i dont know what to do i forgot to ask if they will call him or send it or what? Today is friday so he cant do anything today. I sure hope they call monday. I am sooooo happy. I called my boyfriend and he said " that is good now i talk to u on pc this call costs money :P . Guys are so emotionless lol. Im jumping for joy over here. Ill let u know when visa is in hand. wish us luck.

It's virtually impossible for any single woman from russia to get a visa to the USA (unless it's a K1 or k3 fiancee or family based visa). Section 214 sub section b of the INA of 1952 assumes all visa applications are trying to immigrate to america. To get a visa to the USA she'd have to prove why she'd return to Russia. Trust me when I say consulars make this very difficult.

I can spot a scam even before they ask for money. Been talking to this girl for a couple months. Has never come close to asking for money. I am happy that a work visa is even possible. Also, if she is present in US on a valid work visa, you would not need to apply for a K-1 for her--as you could easily proceed to AOS (AP/EAD optional depending on work visa type).

Correct: the medical report is to be delivered seal intact to the consulate/embassy. Afterwards, the consulate will issue the visa papers in a "mysterious" brown envelope with one corner clipped. This is to be left sealed until the USCIS inspects it at POE/PFI.

With F-1, there's no rule that you have to go back home AT ALL; a considerable number of H1-b's (mostly Indian and Chinese citizens) are from conversion of F-1.

Zyggy is correct in saying that a current F-1 holder can marry and do AOS directly in US and not waste money (filing fee, plus travel costs) to do K-1.

We don't have to fill out an I-130
On the US Department of State website, it lists a fee of $335 for the DS-230 and I have to fill that form out.

You will have to do that when you AOS!!!
the only fee you will have now for your K1 at the Consulate will be the visa fee...not sure how much it is i think about $100us............. :thumbs:

No, a passport is not required to enter Canada from the U.S., at least not yet. There will come a time (I believe it's 2007) where everyone will require a passport.

All you need right now is your birth certificate and your driver's licence or state ID card.

What about duals (Canuck-Yank)?

Currently, I know I can carry my US passport (smallest, least awkward document to use) for re-entering US and show my Canadian Citizenship Card when entering Canada.

Will duals like me require a passport both ways?

The issue is when the wife is older--CO's HAVE been known to ask RFE's (or even push to AR) on this.

When husband is older, it will sail through scrutiny (yes, it is a double-standard--but not much you can do when such a standard is applied by someone with "authority")

We have very good relations after one year, why does she not tell me of this?
When we have last phone conversation on Dec. 24th she was very emotional during

hear from her, apparently she knew something i did not know. She had no internet service
at the relatives home she was moving to in St. Pete., but said she would contact me as soon

Also, she has a 20 year old son. She told me he was moving with her to St. Pete. Did he really come to
US with her? Would that only make it more difficult for her to leave Russia so quickly? More paperwork!

One possibility is that she had already had a multientry visa valid for X amount of time (say 2 years) from issuance, OR a US work visa. Her son COULD come to US if he has a similar visitor visa, OR a dependent (only if mum has work visa--and then only till he turns 21).

But if she did, she should have been forthcoming.

For the petition, I used (copies of) my Citizenship Certificate (as the passport WOULD have generated issues--having only the US re-entry stamp, no visas) and all pages of Pras' passport--no BC from either side.

Ok, so let me get this straight:
You are a US-citizen and your fiance is from Canada. He is currently visiting you but he does not have a visa. He went through passport control when entering though which means he must have some sort of stamp or some sort of paperwork that allowed him to enter and stay for a certain amount of time. He plans on staying for another 5 months on whatever program allowed him to enter in the first place.

I know there's some special visa for Canadians, so the question is if your husband entered on that visa? The other question would be for how long is he allowed to stay under that visa? And finally if he can stay and adjust status on that visa should you get married?

I would be careful about him staying until August without any visa because he could be illegal during that time which would probably be worse than trying to adjust status after marrying now. You might want to consult with a lawyer on how to proceed, just to be on the safe side.


Canadians do not require any kind of visa to enter the U.S. and may stay up to 6 months (I'm pretty sure... someone correct me if I'm wrong). All that is required for Canadians to enter the U.S. is either a passport or birth certificate and driver's licence for identification.

In theory, the 6 months is correct (don't try actually booking an airticket with 6 month validity though, as most USCIS officious will take that as "red flag"). You forgot another acceptable (admittedly, not all born in Canada have these, but naturalised always do) ID: Citizenship Card (I have used that on trips prior to 1999).

The UK citizen may not of wanted to say anything personal, may of just been looking for some advise, after all we are an advice forum are we not. Maybe he wanted a quick answer and did not want to go into the whole story but may of done later. :( Give people a chance to prove there in it for the wrong reasons before putting in comments like the above.

Ok..... yes you can fiile for a K1 whilst in the USA and then just go home for the medical and interview at the end of the process OR as you did not come into the USA with the intent to marry you could stay and apply for AOS. (im not saying do this or dont, theres mixed views. In the RIGHT circimstances it is legal to go this route)

JackJack actually answered the question--he came to study originally, and met a girl whom he liked.

However, many on VJ seem to be "boxed in" by the marriage-related visas--and never consider the work visa (as JackJack is on OPT, this is a viable option as I stated above).

Although I didn't actually try to expedite Pras' K-1, I found that there was an issue about her mum's wish to attend the wedding (a very big issue amongst desis). I contacted the offices of (retiring) Sen. Sarbanes and Congressman (running for Sarbanes' seat) Cardin over the last month.

Cardin's office phoned me this morning stating that they had emailed the Delhi embassy last friday, and were still waiting for a response.
