I need some help.

My I-130 got approved and I received NOA-2 on 23 May 2011. I also received letter from NVC a week back to stating "my petition has become eligible for
further processing with NVC". In the letter NCV has asked me send a signed letter registering an agent on behalf of me to whom NVC with communicate (it could be my self or any one, but I would register my wife). My wife has to pay the Affidavit of Support (AOS) processing fees. None of this is done yet as we just got is before few days.

Meanwhile my employer company (I work with HP)is thinking to hire me in US when I come there. However recently do to project needs they are willing to call soon and asked me if I can apply for L (intra-company transferees) visa and then do rest of my processing in US (that means filing of Adjustment of Status once in US). My question is, I am not sure if I can apply for an L visa (which is nonimmigrant visa) after my I-130 is approved and case has reached to NVC, but my further communication/processing with NCV has not yet started. I guess if the processing had started with NVC (i.e the required
fees paid) then it would not have been possible. But what about the in between time. Can I (of course through my company) file for L visa, come to US and then file for Adjustment of Status?

Any help, suggestion or pointer to more information is greatly appreciated.

Yes, you can take an L-1 even while the (shambolic) K-3 is processing--then marry in US and file for AOS.

In that case I would do IAH--2.5 hours at ORD is cutting it a bit fine (as Chicago ranks #3 among all airports in passenger-volume--#1 is Atlanta, and #2 is Beijing).

There's a question on the DS-230 Part II, "Have you ever been refused admission to the United States port-of-entry?". If your answer is YES, would that affect the approval of the visa? What are the chances that a visa could be denied because of this? Just curious. Thanks

In 1988/1989, I was denied entry twice (through Canada PFI's), and delayed (read, "denied for particular flight, was able to come in one day later on different flight) entry due to improper TN-1 offer-letter format.

Basically, include a separate sheet detailing the reason for refusal.

(note: there are some cases where the reason will bin the app: membership in terrorist or totalitarian org such as Nazi, Communist, al-Qaeda/affil; multiple felonies)

FYI, the question is also asked on N-400 forms (I was naturalised in April 2005, which is known to many of the other VJ Canucks).

Due to the title, I'm going to post as well (as I had gotten an EB-3 GC, and not a CR-1, at Montreal in Dec. 1999).

Rescheduled my return flight (from Montreal) to Atlanta in order to let me clear the PFI, then went there. Was directed into a separate room where I handed over the brown envelope, and after 15 minutes got prints taken and a stamp in my passport--after which I proceeded through air-security.

It is not a big deal, Devraj. Visit a family physician in India and analyze his blood and make a report of available vaccinations in his blood. U.S panel physician will accept it and they will provide only any missing ones. This way you can save some $$ also.

BTW, check with your VFS office. They have some pre-defined days before the actual interview for the applicant to show up.

decided not to change my wife last name to that of mine at this stage to avoid any confusions and thought of doing at a later time. we also took the marriage certificate in my wife's original last name instead of using my last name. In the future at some point we both want to have same last names, is it good idea to change it now since i read that it is complex to do at a later time? or should i just withdraw the petition and get the marriage certificate using my last name and then ask her to get a new passport in her new last name, then file taxes using her new last name which would be same as mine and then file a fresh I130?

or can we just change it at the time of Naturalization whenever she decides to take US citizenship? (my only concern with this route is that some people mentioned that the home country will not have a track that she changed her last name officially in US and if at all we decide to go back to our home country I don't know if at all they will accept the US evidence as proof of legally changing the last name?

Name change at naturalisation is perfectly fine. If the home country is one where you forfeit citizenship when you naturalise to another country, in theory they won't need a record (in practice, more complex, especially in the case of India since 2008/11/27) of name-change.

If your GC is issued before the two-years of marriage milestone, then it will be conditional; otherwise the 10-year unconditional.

Maintaining a home in US is excellent evidence of continued residence.

Yes, it is possible, but your timing is a bit short--you need to add in the time for the naturalisation process (after which you can petition for your mum as immediate relative).

Obviously, consulates-general do not have to necessarily issue immigrant visas (in Canada, issued only at Montreal).

  • I-134, along with copy of USC's tax return (including W-2's), proof of current employment
  • evidence of continued relationship (letters, phone bills, etc)
  • copy of USC's US passport, ALL pages
  • if USC not US-born, copy of naturalisation certificate
Beneficiary must also furnish:
  • original, valid passport
  • police certificates, as required
  • medical report, sealed
Wedding dress and ring receipts are actually redundant.

I got an RFE because I asked Pras to provide me with several Telugu signature samples, some of which I posted in the signature space on "her" G-325A (which I had otherwise filled online in US); they wanted it to actually be signed by her. Found out the hard, expensive ($55 for DHL courier) and slow (two extra weeks for me to send unsigned G-325A's to Pras in India and get ORIGINAL signature) way that I should have prefilled it BEFORE going to India and gotten her to sign it there.

No tax return's were required for my fiance's K1 petition. They asked for 3 years tax returns with the I134 though - at the time of the interview. No need to send info that's not asked for nor needed at this point. Good Luck

Doesn't hurt however--and for me, it actually proved to pay off in a way.

I only had to send one year's tax return (that for 2004), along with a current employment letter and paystub for the interview.

0.8 mm is less than 1/32 of a inch. If they want to get the micrometers out they can go ahead. But they're not going to reject a photograph for a dimension that is less than 1/32 of an inch.

Those who could detect that small a discrepancy would be likely working as jewellers, rather than for USCIS or as CO's. :lol:

Lucky you're going by air. If anyone is crossing the CDN/USA border through Buffalo beware of "supervisor" Gary. He will lose your return ticket home and deny that he took it from you.

Unless your destination is close to Buffalo AND your starting point between Chatham and Ottawa (highly improbably for a VWP visitor), that's really an out-of-the-way approach.

Your NoA 2 should be enough evidence and a VERY good reason that he wants to leave the USA again to attend his interview and proof that he DOES NOT want to stay in the US illegally.

Other approaches for this trip:
  • Through Dublin or Shannon (immigration cleared there), change at US landing-point (there are no direct Dublin/Shannon to Atlanta flights, and you need to factor in the delay for CUSTOMS clearance with this approach)
  • Through Montreal or Toronto; both have PFI's where you clear US C&I--unfortunately, you also need to clear Canadian C&I both ways, even though only in transit
Both approaches only real advantage is that of avoiding "Officious Butler".
