It should. There's a section in the I-864 instructions that explains how a beneficiary would need to prove that the income would be continuing and some other things.

In that case, the offer (or renewal) letter used for getting the TN-1 in the first place (I had two original-issue and three renewal-by-mail TN-1's1--the letters have to show the employee's salary, and the planned duration of the job2,3).

  • two of which were due to my chop**** attorney's misfiling my case as EB-3 rather than EB-2 (which caused a two year time of "hurry-up-and-wait" when I could not do final-stage filing)
  • up to 3 years (since Oct 2008, limit on TN-1 term), prior to that (such as my own 1994-1999) 1 year
  • there is a stack of rules the offer or renewal letter has to follow to be correct in USCIS' eyes

If he lives with someone and gets that person to complete an i-864A then he can combine his income with that persons.

If he gets a joint-sponsor to complete an i-864 (they don't live with him) then the co-sponsors income must alone meet the 125% requirement for their household size.

I'll rephrase the question--can her income (from the TN-1 job) be used in the combination?

Her fiance would still need to meet the income requirements when they filed AOS. Or do you mean TN-1 until he finishes in 6 years?

Does her fiance's income ALONE have to exceed it, or can combined income be used?

Another option would be to get a student visa or something, bearing in mind the costs there.

Which opens up the precise reverse option, of him getting a student visa to Canada (rates lots cheaper than US, even for total non-resident).

Basically co-sponsor if you want a greencard (unless he has assets that will fill the void). Doesn't need to be a family member. Yes the obligations are large but your fiance would also be a sponsor, the family member/friend would be a joint-sponsor.

Hey everyone!

I'm just going to keep this short and to the point unless otherwise asked. I am from Canada and I'm engaged to a man from Virginia. We have all the proof in the world that the relationship is true; we've been dating for 4 years and see each other at least 3 months a year if not more! Anyways, the only thing stopping us from filing a K1 Visa is that he doesn't make 125% above poverty line. His parents approve of the marriage, but are not willing to sign due to liability reasons. He is a full time student working 2 part time jobs at $8.00/hour. He really is trying hard, but is there another way around this? I don't know what to ask... just is there something we can do so that we can be with each other? Otherwise, we won't be able to get married for another 6 years (when he's done with school, finds a job, applies for application, waiting period, approval, etc.).

If I filed for a K3 Visa, would it be any different?

Please help, I really appreciate it.

What are your quals and your profession, Amy?

Another possibility may be for you to apply for a job in VA, get a TN-1 for it--and then move down to VA, get married (in US, not Canada) and file AOS full-packet (I-485/I-131/I-765).

Since you will want to attend a church in CA, check with the county where that church is located about the licence. Usually, counties will accept the signature of authorised ordained clergy as official--and it will combine both.

If you wish to involve your "home" church in Canada anyway, an avenue I will suggest is to have a fancy engagement/betrothal there.

Here is the scenario:

-Found out the ex-wife is seeing someone else Jan of 2009. Tried to work it out, but to no avail.
-Oct 2009 the ex-wife moves out.
-Apr 2010 I tell my ex-wife I am filing for divorce
-May 2010 I meet my Fiancee and have on going relationship
-Jul 2010 I file the divorce papers
-Oct 2010 I visit her and spent 3 weeks w/ her and we got engaged
-Mar 23,2011 the divorce is final
-April 1, 2011, I filed the I-129F, CSC, (in review status)

I have read a post by someone who got their Visa denied because the CO said you cannot be married and engaged at the same time.
I believe the beneficiary was from Colombia. Is this a standard operating procedure for CO's or does it depend on the beneficiary's country?

Any insight is appreciated. I just can't believe you would be denied for that reason even though you've been separated.:help:

You ain't married, as your divorce is final, and your marriage is indispuably over as of 2011/03/23 (and you filed after that date).

The I-134 needs to be filed by the USC well prior to the interview; the Consulate doesn't ask for it (though you could, if you wish to settle doubts, have your fiance mail you a copy of it). On the surface, I think you will need a joint-sponsor--as you will not be able to work for awhile (basically till you have EAD in hand) after entering US.

Also, the $340 check should be written to "US Department of Homeland Security" DO NOT abbreviate it to USDHS.

Minor correction, you can write to "USCIS" (but not USDHS, the chop****'s).

If you didn't know about the fee, I would suggest you go through the links and your package very carefully. Last thing you want is to send it in, wait 7 months and get an RFE. I checked my package 3 times and even waited a day to review it again before I sent it. Its very doable, but you should go through it carefully.

Eh, you won't get an RFE for not sending the cheque--the form will be returned along with a nasty note whose gist will be "[b}send cheque for $340 NOW[/b]".

On the information about assembling the I-129F package provided by VJ (thanks!) it says I need to include a check for the payment as required by USCIS. But I can't find anything on their website about a payment going with teh I-129F form. Any ideas of how much it should be or any information you all can give me? Thanks!

Did you miss the "fee" mentioned beside each form on the forms list page? You ain't receiving no services from USCIS until you pays the fee (for I-129F, $340).

Hello VJ family,I have finished my interview on the 17th, received my approved K1 visa 3 days after, and now ironing out last minute kinks before my departure.

May I ask if the the airports listed as POEs are the only acceptable ones?

No, there are alternatives (probably not practical in your case) such as going through Canadian airport with US-destinations PFI (where you clear immigration & customs) or going through Dublin or Shannon airports in Ireland (both equipped with US mmigration, but not customs, PFI's).

I am looking to book for July, and I favor Continental Airline for the airport most practical for me and my fiance-1 short lay-over in Narita, then non stop to US; with only 16 hrs of flying time, plus its the nearest airport for my fiance's installation. The airport is not included in the list I found here however, so I was wondering if that is fine for K1 visa holders?

Hey all,

I'm a US citizen and my fiance is Canadian. I was just wondering if the K1 visa is really necessary for Canadian citizens coming to the US. What I mean is, since he can legally come to the US for up to 6 months with no visa, what would be wrong with him just coming to visit and us getting married? If we start the application process for his greencard right after we get married would it matter that we hadn't bothered with a K1?

USCIS is more likely to red-flag this as "marrying to seek immigration" than if you did K-1.

However, you do raise other ideas--that Dante could possibly enter on work-visa (TN-1), and then you get married AFTER he enters.

I ask because this whole process is expensive and getting married (even without one of us needing to immigrate) is expensive enough as it is, we'd like to cut down on the cost wherever we can, so if we don't have to file for a K1 I'd like to skip it. That said, if it provides some benefit that I'm unaware of I don't want to make the process harder by skipping it.

I understand that people from countries that require a visa to visit the US at all would certainly benefit from a K1, but when you can come and go as you please with no visa anyway (well as long as the INS folks are feeling generous), I don't see the point. Thoughts?

Best solution for you may be to try for H1-b (work visa) and then come to US and then marry.

As others have stated, it will take you 2-5 years to get IV-number.

This is way more time than needed for ongoing LAX->IAH connexion.

An idea for her--she can bug the airline to get a standby on an earlier flight; best-case she gets to Houston earlier, worst case status-quo.

Several reasons to avoid pork:
  • improperly-cooked pork is the biggest source of trichinosis (while it can be gotten from bear-meat, the total population of ALL species of bears combined is much lower than the pig population for China or US ALONE)
  • Pigs are OMNIvores (while the diet of farm pigs is controlled, you cannot assume that the same will not be able to escape the pen and eat other stuff) unlike cattle/goats/sheep/deer/antelope (reindeer are used as livestock in Scandinavia, and antelope are sometimes "ranched" in parts of Africa where cattle-raising isn't possible) which are obligate-herbivores
  • The muscle-tissue of a pig is shaped like a fishhook (which means that it will not be digested as quickly)

Nowhere does it say the 3 decade freeze is the fault of the Bush Administration.

But the root cause of it was a belated reaction to the seizure of the American Embassy--with approval from the Khomeini government. One can also fault the current (and past up to 1979) Iranian leaderships of refusal to address this.

If the woman is not a USC, the baby may get citizenship based on the base-country of the airline.

A case like this actually occured 17 years ago, when a pregnant Indian Punjabi enroute to Canada on British Airways (on first leg of trip to London) gave birth inflight (while it was over RUSSIA). Child got British citizenship due to that.

My interpretation would be that you'd have to be USC and lived in the US before the birth of the baby (or maybe while pregnant?)

It's an interesting question... what happens to a baby if the mother is going through the process of becoming a USC- that would be worth a call at a US embassy or at the naturalization office :D (if there's such thing)...

  • if mum is in US at the time of birth, then baby is USC automatically (Mexican illegals have been known to cross the border to have "anchor babies")
  • I can only answer for selected countries (such as Canada) if mum is outside US at the time of birth (but this could necessitate a very migrainey I-130 petition for the child).

If the USC woman gives birth in another country, the child needs to be registered as USC through Consular Record of Birth Abroad.

The only issue is that she may need to get the ME/NA country visa--no functional affect on the USCIS petition.

For a PR woman wishing to file USCIS petition, the only one workable is the I-130--and FB-1 (spouse of PR) doesn't get all-that-quick an approval. She would have to be a USC to file K-1 (if unmarried) or K-3/CR-1 (married) petition. (note: this answer is general, not functionally related to cultural geography).

Here are some etymological and historical minutiae that probably only you will appreciate, Sriniv --

The eggplant was well-known in the Arab world long before it made its way to France in the 17th century. It remains a very popular vegetable -- many different eggplant dishes are standard in Arabic cuisine.

In fact, the French word "aubergine" is actually derived from the Arabic word "badinjan" (or "bathinjan," depending on your accent.)

Eggplant was introduced to Spain, Portugal and North Africa by Arab traders in the Middle Ages, where the word entered the Spanish language as "berenjena," and Portugeuse as "berinjela." It made its transformation into French from there.

The Arabic word "badinjan" is almost identical to its Persian root, "badnjan."

And as you already mentioned, the Hindi name "brinjal" is also very close to that.

The eggplant consumption rate in my house has skyrocketed since Mahmoud arrived. We planted some in the garden, and the plants kept producing all summer and fall -- they finally petered out just 6 weeks ago.

Middle East had trade with Sub-continent since Harappan times, so probably arrived there (the vegetable is native to Shivaliks) in near-prehistoric times.

I'm not exactly fond of aubergines or "English aubergines" (translation of near universal desi term, aka "Bangalore aubergine", for chayote squash--I have no clue how those name got juxtaposed on as the chayote is neither native to England nor Bangalore, nor even related to the aubergine), but I have had to consume some recently in the interest of marital harmony (as I had to handle considerable pouting the first few times Pras put them in the cart).

(she doesn't have that much of a taste for the chayote though so I'm safe on that score).
