I have noticed that most of these ridiculously fast approvals are silent on the beneficiary's country of origin. Could it be that they are from Obamination's poster country (Haiti) and petitioners are hiding that fact for fear of bad publicity here at VJ?

I think what Obamination is doing is an absolute outrage. I wish Congress would impeach him and throw him in jail where he belongs for doing this to us.


You have no idea what you are talking about. First of all Haiti is considered a natural disaster country so whatever help the US can provide I am all for it. Second this is not the fault of Obama because your petition isn't approved in a month's time or whatever time you feel it deserves. I waited 5 months 28 days for my NOA2 to be approved, was I frusstrated, mad, felt it was unfair...of course but I did not blame one man for the delay. Your thought process is flawed, why not just blame Bush for 911 right? Does that make any sense to you?

just wanted to put out, my fiance wasnt arrested or deported in any way. after she surrendered herself, they interrogated her, and sent her on her way with all the paperwork handed to her. she continued to work in japan for a couple more weeks and bought herself a plane ticket to fly home to manila. i talked to some attorneys and they just told me to be upfront with everything, they never once mentioned about any automatic denials or anything bad. im still keeping my fingers crossed!


Is there a legitmate reason as to why she used a false name to enter Japan and work? Also how did she obtain a valid passport to travel abroad with another name? Just curious. :whistle:

I started the first and second quarter it was a hard fought first half against a stingy USCIS defense. I tell you we hit them with everything we had but they would not rollover. At Halftime we needed a new game plan. I looked down my bewildered bench for a spark. Saw my ole Senator Saxby Chambliss there holding up a sign " I maybe small but I can help," took him off the bench and provided us the spark we needed for the second half.

My lil buddy Chambliss went into the huddle called a play, we lined up nose to nose against that touted USCIS defense, Chambliss called an audible, the ball hiked and USCIS blitzed our offense. Chambliss faked right then left, saw his lil lady Kimmy breaking free down the seam he launches a tight Packet 3 spiral 50 yeards down field, Kim runs underneath reaches out grabs it, she's at the NVC 40, the DHL 30, the US Embassy/Manila 20, Visa fee 15, St. Lukes 10, US Embassy Interview tries a shoe lace tackle, kim stublles stays on her feet...she is at the 5, stretches out and APPROVED!!!!The crowd goes wild...Chambliss made the right read at the line of scrimmage. Coming to America!

same here they missed my middle name on my visa i called USEM and they asked me to go USEM at window 42 thats where they accept visa correction they asked me to live my contact info.after 4 working days they called me and said its ready for pick up.. DOnt worry it would not going to take too long specially if you will going to tell them that you had brought a ticket and your flight is near so they will rush doing your visa..

I have the same problem. The dad's name is spelled incorrectly as well. (Since I'm a sissy and hired and Attourney) I brought this to the Attourneys attention. She said: don't worry, it is a common occurance. I did supply my Attourney with a Official Letter from the Philipphine Goverment but she said that she would hold onto it but don't feel it is needed. As the above post read: As long as the 325 for the beneficiary is correct it will be fine. Your a earlier filer than me so you will know before me if its a problem. Good luck.. You don't have long to go.


Thanks sis fingers crossed all the way with a lot of prayers...on my 325 form I put Hevir which is not what shows on my BC...my BC has my dad name spelled Hibir and I hope it will not be a problem since I saw my BC after my fiancee already sent 325 form for K1 visa. I just hope now that when packet 3 is sent and I go to Embassy it will not be a problem.

If the spelling on the birth cert is correct it will be ok and can be changed on the 325 don't worry spelling mistakes happen all the time.

Hello All visajourney friends. My fiancee Kim received a copy of her Birth certificate today and she noticed that her father name is spelled different than the name she put on the G325a Biographic information. Her mom always spelled her father's name "Hebir", when she looked on the Birth certificate it shows "Hevir". Will this be a problem for her when packet 3 is sent to Manila? My fiancee already has a passport issued to her and now she is nervous that the mispelling of her father's name will cause issues there. Any advice would be greatly appreciated.

No, there are missing pieces to the conversation, they are telling her that they will not approval her children's visa until she ROC. There are some under-lying reasons that are not printed in the thread.

That is not what they are saying i will quote the letter,
Dear,
we regret to inform you that we are unable to process your application for an immigrant or fiance visa. section 221g of the immigration and nationlity act prohibits a cousular officer from issuing a visa to an alien if the cousular officer has reason to believe that the alian is ineligible.
based on a review of your case at the embassy, new evidence provided, not previously available to USCIS, requires uscis to review. therefore, we are returning your petition to the bureau of citizenship and immigration services cis of the department of homeland security dhs for review and possible revocation. That is what the letter said. On top of that the childrens name were incorrectly spelt and my sons last name is missing. The address my daughter as Mr and the letter is as flat as I restate it.

They are not saying wait until I ROC they are saying that when I took them to there interview I presented evidence to them that USCIS did not have.

These are the questions that was ask;

What does my husband do for a living. I told her.
How did I entered the US, To which I respond "work" because I came here for my then company.
Do I have 2010 W2 to which I thought I did but realize that i left it up here. I told her that I did and she said send it back with the kids passport.
She said do I have my drivers lincense and i told her that it expiers and that a new one was on its way to me. I ask her why is she asking for those things, and ahe said she is verifing relationship and address to which I respond to her, my husband and I have a child together and that I recently relocated to Fl for him to join us.

This is also my concern our daughter is not on the affidavit of support only his oldest child and she has a baby that he claim too, Does anyone know if that is the problem?
Right now i am just speculating so I will just wait to see if anyone has ever been through this can shed some light on the situation.

When did you adjust your status in the states, also I would be concern that they are not trying to revok your GC aswell.
The children in Jamaica are only yours correct, your husband is not the father of them.

What is registered on the children's BC, do you have their legal father listed?


They are not my husbands children, I adjust status a little over a year, as for their BC their dad name is on it. I heard that they will red flag my case until I am going to remove condition

Well we contacted a lawyer who thought the same thing, she is going to try and stop the case from returning by presenting our relationship evidence, plus we have a 9 month old daughter and he is the one who is paying all the bills here and a whole lot of other stuff.

The fact that only came here the end of last year and all my business that I do is in GA and all my bills that i owe are there. and we have a lot of bills together I have life insurance and health insurance, he is thr gaurantor on my student loan and it goes on and on.

I AOS here I am a conditional resident, however when he did the petition I think he did it as 6 month to join, I have been thinking if it was filed under the wrong catugory. I came here on a B1/B2 visa for an off shore company that I use to work for that is no longer in Jamaica.

Yesterday i check the DHL wesite and it said awaitnig pickup, a member of my family went and to pick the papers up only to find out that my kids where G221 white slip saying that they found new evidence that was not presented :o at the interview, so the case will be sent back to uscis for review and possible revoke :crying: :crying: :crying: . My question is has anyone ever encounted anthing like this and what are the possible things that they could find that would in this visa refusal.:help:

mainly because i did not include copies of my passport
even though i sent a copy of my temporary resident visa issued in brasil
they still required more evidence.

So along with a copy of my passport i sent a bank statement showing actual cash transactions in the city my fiance lives in
and two more pics just 2 say this is real ***holes

i sent all this back and they sent out my NOA2 4 days after they received it

The quickest way to get a case status is also to email the consulate directly. In the subject line include the interviewing consulars initials, as well as the US consulate of.......and the head consulars name ( if known). This will direct the email to the individuals mentioned, and most likely get a response from them quicker.

My best advice to anyone who has red flags, and is petitioning for their loved one at a consulate known for denials.. is to marry, then file an immediate relative petition. This is not a guarantee for a visa issuance, however if a petition is returned for revocation, the USCIS , by law is mandated to review it, issue a noid/noir, which a petitioner will be given 30 days to rebut.

The OP needs to be aware of that. Couples in Morocco without this particular beneficiary's history are having a very hard time right now, and a different K-1 app (with a different petitioner involved) less than a year ago isn't going to look too hot in Casa.

What happened in the beneficiary's interview for the first K-1? Was he approved or denied and, if denied, why? The answers to those questions are important to know here.



Yes Morocco is giving out 221g for validity............I was there , had so much proof . I waited outside as I was not allowed in the building . Consular knew I was there , said tell your fiance if she has any questions to go to front window......I did and they handed me a paper stating "we do not discuss visas here ". Did not find out for about 2 weeks it was due to validity. The consular never looked at anything but the petition and a few pics . She asked my fiance why he couldnt find a fiance in Morocco. Then she said how would you feel if you did not get your visa today ? OMG I am livid .........trying despartely to hang in there , as many others are in the same situation. I have decided to hire a good lawyer , but unfortunately that is going to take me another 2 weeks. Past the time of the 30 days after the interview . So it goes on and on. I ask why but the answer is at the consulate . Question is how long can they continue to give these out without being told this is not the way this works from the dos . Which I wrote a long 3 page letter to the sec of state . I dont know , but just be aware of anyone going through Morocco ,,,it may be a battle . Be prepared to have some extra cash to hire a lawyer .

It turned into an impromtu and fun "interview" with me trying to remember all the hot button issues I see on VJ

I told him that the number ONE and number TWO "complaints" I see are Why is the VSC taking so long and why can't we get through to you guys?

Why is VSC taking so long, what happened? I was approved in 58 days!: We had problem with labor last year and lost many workers, we hired more last November and it took some time to get them trained. Some of the petitions were sent to California and we also assign people to different tyopes of visas. They will concentrate on one tyoe, get behind on another and then shift many people back to the other type. Lately we have shifted many, almost all, adjudicators to I-129fs, so that should make people happy. They will do that until they get caught up. Summer is a busy time for I-129fs, usually about June we get slammed with them. The winter or early spring is the slowest time for I-129fs, but then it depends what they have everyone working on also.

OK, why can't we get through to you? The 1-800 line is useless. Those are contract employees and they are trained to select answers from a menu of 14 answers. They pick which one is best for your question. There are thousands of visas being processed at any time and everyone is special and everyone has special circumstances and if we had direct lines we weould do nothing but field requests by petitioners to give them priority, we just can't do it. How would you feel if your petition got bumped because some woman called and cried on the phone and then her petition got moved up ahead of yours. We simply have to operate in a way that avoids any chance of fraud, corruption or unfairness.

So what about some people get approved ahead of others? Sme petitions have problems or delays, we do not hold back others for this. If an adjudicator has problems, he puts that one aside or sends an RFE and goes on to the next. The next one may be clean and gets approved right away, in just a few minutes, they adjudicate 15-20 petitions a day per person, and the ones with problems may wait weeks for the petitioner to respond to the RFE, or maybe it is a name check they are waiting for. Petitions are assigned as they arrive, when we are working on those petitions, but they do not go out the door in the same order they came in.

G-325a, Signed or Unsigned? Unsigned.

WHAT? Ok I have seen the memo but lots of VJ members got RFEs for unsigned G-325s, what gives? They do not have to be signed,they can be signed at the consualte interview. Some adjusicators haven't read all the memos, we get hundreds of the things, and maybe they make a mistake. If you want to be sure there is no mistake, sign it. Or send a letter expalining why it is not signed and request it be signed at the interview. Do you have that memo?


It is on the VJ website somewhere You can print a copy of that and send it with the I-129f and G-325a.

Fiancee intent letter? Signed or unsigned? Signed.

What about a faxed or emailed signature? When I was adjudicating, if I could see a signature, I accepted it, but many adjusicators will not. Signed is better.

Lawyer or no lawyer? For what?

Enough said. Now a hot issue, a very controversial one. There seems to be a trend in some countries of foreign men marrying American women and the women are considerably older. There is always a question if this is a problem. It never seems to be a problem for older men/younger women (My wife is 13 years younger, his wife is also considerable younger than him) Is it a problem? For us, USCIS, no. "Free to marry".

What about the consulates or for AOS or I-751? Consulates do what they do, it is not USCIS, some of them are bastards. Kiev is easy, they approve everyone (laughs), they used to be bastards but they got easier since they first started doing those in 2005, before then you would have had to go to Warsaw, you know. For AOS if they can prove they are legitimate we do not care about age but anything that is "not normal" for the culture will draw suspicion. They probably will not get a no questions asked interview (I had told him our AOS was "no questions asked")

What about birth certificates, some people have trouble getting them? This is a problem for us also. Some people, especially our younger staff, think all the world is like the USA. I remember one, when I was in the Kansas City office, the beneficiary was from Viet Nam, she was born in 1954 there was no birth certificate. The CO asked me about this and I looked at the file. I said "Do you know what was going on in Viet Nam in 1954?" She looked at me, straight faced and said "What, their computers were down?" wacko.gif If a birth certificate cannot be obtained they can usually get something from a church, a village official, something, and send that with a letter of explanation. Or just their passport and a letter explaining the situation (this applies to AOS more than I-129f as beneficiary birth certificate is not required for the petition, but I wanted to ask anyway, it seems a common question here)

What about extra documents? Proof of relationship? We don't need it, only that they have met for the fiancee visa.

What about the consulates? Consulates do what they do, as I said, some are bastards. They get whatever we get when it is sent on. I can't tell you what NVC and consulates do, I know some are terrible and some are really easy, but I do not know all the details of each. Kiev is easy, western Europe is easy, Nigeria is horrible, but you would not believe the scams from Nigeria, I get jaded. I am surprised a lot of them get visas and then we have to deal with them.

What about changes? Are there any in the works? Is Obama ouching you guys to work faster? I am not sure Obama knows we exist. There have been no changes and no pressure other than the usual workload and shifting things around. I do not expect any immigration changes in the next year or two, at kleat not in rules or amnesty or anything like that. I do expect FEE INCREASES within the next year...across the board.

How much more? I cannot say, that is not my area, I just hear talk.

So how can I speed up my petition? laughing.gif You can't really. If it gets to be too long and if you can get a congressman or senator to call, that will get some action, but half the time those guys dont'' call or they do and the petition has only been there 3 months. Sometimes one falls through the cracks, gets overlooked, we are human. A congressman can get through and get them to dig it out if it has been too long, but I wouldn't call that "speeding it up". That's a fix for whn it is too slow.


we talked for some time more, about 5 hours altogether, briefly interrupted by Alla every now and again who had her own questions about the I-751 procedure which I posted in that forum, about VJ and other topics (his Navy days) He said he will check the site and gave me his home number. He said "call anytime but not 3 in the morning" I asked about an interview or answering prepared questions, he said possibly, he will check the site. He said many internet sites are advertisement for immigration attorneys or instructing people on how to pull scams, I assured him he would be very pleased with VJ and he thinks it is great that there is a good site for information and advice. (he never heard of VJ before this)

I can also say, that speaking to him, I heard so many of the same buzzwords or advice that I have seen right here, this is really a great site with some great folks giving some really great info.
