More than enough evidence of meeting in person for your "petition" not "visa application". Visa applications are submitted to Consular officers AFTER the petition is approved.

For my visit over to the U.K. I have my boarding pass going over, but not coming back. I have clear passport stamps dated for entry and exit for myself. I have credit card statements of where I used two different credit cards while visiting over there. I have my bank statement that shows purchases made while visiting over there.

For his visit over here. I have boarding passes coming and going the first time. I will have boarding passes for his second visit too. (he is coming over just before I file the I-129F) I have both of his trip itineraries. I have his passport clearly stamped with the date of entry for both his trips over here. I have his bank statement showing bank withdrawals and purchases he made while over here. I have a photo receipt from JCPenny's w/ their local address showing both he and I in the pictures together receipt. I have our first joint bank account statement. I have a copy of his ESTA approval receipt that shows my address, saying that that is the address he is staying at while in the U.S.. I have tickets from the museum and a few movies. I have lots of pictures of he and I together. I have a copy of his Sam's Club membership w/his photo. Do I have enough? Do I need more? And what else can I get just in case?


Proving a ongoing relationship is easier then proving you have met in person.

Post-it notes is a bad idea. They can (and do) fall off.

It's usually not a problem to write notes on copies of documents and evidence. It's probably best if you don't write over the image of the document or evidence itself, though. Keep your notes in the margins, or on a separate piece of paper. For example, you could make a sheet which contains copies of a few boarding passes, and then write your notes beneath the image of each boarding pass, but it's better if you don't write over the image of the boarding passes themselves. First, it puts the adjudicator in the position of figuring out if the markings were added to the copy or were written on the original document (if he happens to think that's relevant). Adjudicators aren't always good at this, as evidenced by the fact that people have gotten RFE's because the adjudicator thought a document containing their signature was a copy and not the original. Second, it's a good idea to give the adjudicator an unobstructed view of your evidence, which means don't obscure portions of the image with your own markings.

Hi-liting is usually not necessary, unless you think an adjudicator is going to have a hard time finding an important piece of information. Even if that is the case, it's better if you can write in the margins to point out where the information is, rather than marking over the image of the document itself. That said, people have gotten RFE's because the adjudicator couldn't find what he needed (he couldn't tell a document was a certified divorce decree, for example), and they've responded by resubmitting copies of the same evidence with the relevant information hi-lited, apparently without problems. For me personally, I wouldn't mark over the image of a document unless I thought there was no way the adjudicator was going to find what he was looking for without my help.

I made a cover sheet for each separate attachment listed on my cover letter. I labeled the cover sheet with my name, the attachment number, and specifically what was included in the attachment. For example"

JimVaPhuong, Attachment 8
Form G-325A Supplement: Copy of birth certificate (Petitioner)

Other than the cover sheet, I didn't put markings of any kind on copies of full-page documents, like birth certificates and divorce decrees. For other evidence, like boarding passes, receipts, etc., I labeled each page as described above, and also added a page number (Page X of Y pages). I didn't add a description of each item on the page unless it wasn't completely obvious what it was. I put photos in full-page plastic photo pocket sheets, and wrote the date and description on the back, and then labeled the top of the page as described.

Reading the cover sheet and page labels, it was pretty obvious what everything was.

Ok maybe I am being paranoid, but after coming to this site and reading all that I have and seeing how little the USCIS actually tells you about what you need and needn't, I wanna make danged sure that any notes I put onto the sheets that contain the copies of this or that to clarify what it is .... isn't gonna be rejected because I neatly put the date and a short explanation as to what the copy was of. Or do I need to actually use post-it notes for each note needed and leave the copies totally blank as to what they are...or is what I was doing until the thought crossed my mind that they are very very picky about what they want ...OK? Better safe then sorry so am checking. Silly or not. And what about highlighting stuff as well?

Yes he would as a US citizen apply and send the application to one of the processing centers. And you can visit the US before and during the application process ....Just depends on customs and if they believe your going to leave the country or over stay your allowed time.

It may look like a lot of work, but it's basically just filling out a few forms with information that you already have and mailing it in. As I've explained it to curious friends, unless one has special circumstances, applying for a K-1 visa is no more complicated than preparing and filing one's own tax returns (assuming you've dealt with some moderately brain-teasing issues like deducting mortgage interest and things like that). If you're the kind of person who goes to H&R Block to have his taxes prepared, then you might similarly want to have someone else fill in your K-1 application forms. There's no shame in that. But if you're capable enough with government forms and procedures to do your own tax returns, you can probably handle the K-1 forms.

Consider that no matter how dumb you may feel, someone dumber than you has done it before you. You're not the first to feel that the task is too difficult for you to handle.

If my wife were to be offered a $100,000/yr job in Brussels today, we would abandon the AOS process and move there in a heartbeat, and then in a few years maybe think about returning to the U.S.--starting over with the immigration process (DCF in that case, I would imagine), etc. We both prefer Brussels to Atlanta ten times over!

SO WHAT if your efforts to immigrate via the K-1 route were all for nought and you simply abandon that route after you get married and have to start over from scratch in a few years. You get to live in Europe's Best Kept Secret and have enough income to really take advantage of living there.

We are envious.

Interestingly (well, to me), when I walked into the room in the courthouse in downtown Atlanta where they keep inactive/archived court records, the person in line in front of me was requesting a certified copy of a divorce decree, and while I waited for mine, several other people came in for the same thing. In fact, there seemed to be a steady stream of people for the 30 minutes I was there who were seeking certified copies of their divorce decrees. To see so many in the same place--apparently a steady stream all day long--really put into perspective for me just how common divorce is in the US.

Their stated policy is to scan and convert checks to electronic transactions and submit them twice if needed. Of course, they don't always follow this policy. If they don't reject your petition, they'll employ means of collecting on the check.

I recently had major neck surgery, and I have been on FMLA/STD (Short Term Disability) since November. I tried to go back to work before I was ready, and worked two days. My job considered it a relapse and suspended my pay until my benefits were approved again. Long story short, I didn't get paid, nor did I get any notice of not getting paid. I was devastated because this has caused me a huge financial burden now.

VSC just submitted the check on the 29th, of course it will be returned. I have a case # and the system states that they have mailed my NOA1. My question is this, will they try to draw the funds again, or will they just return the petition and give me another case number? I will be getting paid because my FMLA/STD benefits were approved. I know that I have seen something like this posted before, but I don't remember what transpired. Any info you can provide will be helpful. Thanks.

We have sent you a check deficiency notice in the mail which explains the steps you must take to resume processing of your case. If you do not receive this notice within 30 days from February 12, 2009, please call customer service at 1-800-375-5283 for further assistance.


I got the actual invoice today in the mail. However, I resolved it on 2/12/09 as soon as the email alert hit my Blackberry. I'll post something when the status changes again. good.gif

This would normally be embarrassing...but it was totally out of my control and not because of my mismanagement of funds....such is life I guess.

Hi everyone!

I posted a few weeks ago about my K-1 fee being returned by my bank as NSF (long story about my job not paying me for Short term disability). Well, I was waiting for the case to be returned. Instead, I got an email update that stated that my petition had been placed in a suspended status, and a letter with detailed information was mailed on Feb 12th. I called USCIS, and spoke to a Customer Service rep that told me how to resolve the issue before the letter arrived.

I called the Burlington Finance Center (BFC) at 866-233-1915, and the rep took a credit card payment for a total of $485 (I-129f $455 fee and NSF fee $30). This center does not have case status info, and cannot correct an error of sending the wrong amount for the fee. Nor will they process a refund request. They only resolve things such as NSFs or payments that will not clear for whatever reason.

All this to say, that the days of old when they rejected the entire petition for NSF are no longer. You also have 14 days from the date of the invoice to remit the payment. If you cannot resolve it in that timeframe, they will send the entire petition back and void any case status info.

I wouldnt give a work address since you both wont be living at work. They are asking for a home address where you will be living, are living if in the US, and where you will be recieving any correspondense from USCIS via snail mail.

They are asking for the address where the Beneficiary is going to live in the US, and that would be the same address as yours, the Petitioner. You guys do intend on living together I assume.

About not telling my parents: Sigh!! Yes, unfortunately, I realize that. The times I've tried to begin expressing our plans, I've been told I'm "living in a fantasy world". Our plans are to be able to show them our independence, to prove that we know what we're getting ourselves into and that we are serious about this and we're going to see this through. You can also rent a box from UPS and have a real address that does not say PO Box


Here's why I ask! I(USC) live at home now with my parents. I haven't told my parents about our plans quite yet. Instead, we'd like to announce our engagement when he's here (They rejected him for a tourist visa, so we're thinking about telling them during the 90 days we have before we get married on the K-1)

Okay! So basically for the I-129F packet, we just need to prove that it's a legitimate relationship? For that we should use primary evidence such as boarding passes, passports, hotel receipts and secondary evidence such as pictures and chat logs, etc?

So we could mail off the paquet before my visit in April- but of course take lots of pictures and save every receipt to show as proof of an ongoing relationship?

My girlfriend is coming to Venezuela this coming April so we were planning on including her plane ticket in the package, but then I ran into this post (can't remember which one) that said that plane tickets themselves can't prove she has really entered into the country, that we should attach a copy of her passport with the stamp of her arrival in Venezuela and if it was possible highlight it!... Anyway do you think it would be better if we wait after April to file for K1 so we have better proof that we have met, maybe we will have more recently pictures of us since last time she was with me was in June 2007!!!

it really is...and I'm really sorry to hear you forgot to include the check in the package, but I learned something out of this today...I'll post the list of everything we put in the package and ask if everything is fine and nothing is missing BEFORE we take the package to the post office wink.gif

phone bills , skpye calls, and selected im's are not necessary at the USCIS process.

you should have included a photocopy of the VISA stamps on your passport..

The boarding passes and pictures will probably be sufficient for evidence of meeting in the past two years but what is missing from the list is the check for the filing fee.

What makes you want to bring your fiance to the U.S.... instead of relocating to his/her native country?

(I posted this in the Your New Life in America Forum because I thought it fit there pretty well.. but if you're like me, the K-1 forum is pretty much the only one you check, and seeing as how K-1=you're bringing your fiance to the U.S., it does directly apply to you!)

I have a checking account, but I haven't ordered any checks. Could I go to the bank and get the free ones where the hand you a couple with a blank space to write in your information? I think they're called "starter checks". Would USCIS accept a 'starter check' as long as I have the funds in my account?

So in order for a co-sponsor to be legitimate, your income doesn't count. So I guess conceivably, you might be $1 shy of the 125% of poverty guideline (which for household of 2 is around $18,250), and still your co-sponsor would need to completely meet the 125% of poverty guideline for a household of THREE (you, your fiance, and the co-sponsor, plus maybe everyone else in the household).
