K-1 Fiance(e) Visa Process & ProceduresThe Abu Sayaff want to marry my fiance and put her in a Harem, any ideas on expediting this?
I seem to remember seeing on the USCIS page or travel.state.gov page that there are conditions for expedited processing. As I recall one of these was a humanitarian clause.. which one could argue this could fall under.

good luck

Of course you can come visit. As always, you do run the risk of being denied entry. Under the K1, I would make sure that you bring copies of your paperwork along with papers showing your ties to your country, round trip ticket and be prepared to be questioned and reminded NOT to marry while you are here and not get a job and that standard stuff.

Anytime a Visa or VWP person comes to the States, they run the risk of being denied entry.

K-1 Fiance(e) Visa Process & ProceduresTravel to US after packet 4 sent to US consulate
I am by no means an expert on this... but here are my thoughts...

1) Gather ALL the stuff you need in advance of getting packet 3 from the embassy. Call the Embassy when they get it to see if they will expedite the interview.

2) It is my understanding that a tourist visa will be canceled AFTER your interview and approval, so I see no reason why you should not be able to come to the US. Save two very important points... a) that you can get here and back for the interview and cool.gif you obviously run the risk of being denied entry at the POE

I noticed that the g-325a that is referenced on the site is marked at the top as expiring the end of this month. Is there any word on a new form coming out at all, or will this still work? I won't be able to file until around the middle of next month but I have this 'old' version of the g-325a filled out by my fiance and hope we don't have to do that again!

Use that form, even if a new one comes out the previous edition will be acceptable

Sweet, I hope so!

Speaking of, do all 4 copies need to appear in each packet?

When you file the initial petition you have to include all four copies for yourself, and then all four copies for your fiance.

Just for clarification... copies=ORIGINAL SIGNATURES

So we got the visa in the mail today!!!!!!!!! The instructions ask him to present the passport, the sealed envelope and the "x-rays" when he gets to the US and goes through immigration.

Does anyone know what x-rays they are talking about? Do we need to worry about this? Is this the x-ray from the lab work we had done for the interview?

Yes, however, unlikely will the border patrol look at them... they are NOT doctors... but you will need them in the future. And remember, don't open the envelope smile.gif

K-1 Fiance(e) Visa Process & ProceduresQuestion about timelines
QUOTE (Chaz and Riggs @ May 21 2009, 04:44 PM) <{POST_SNAPBACK}>
This is another question about the timelines. I first filled out my information in my timeline, and it would tell me "Based on your NOA1 date, your approximate adjudication will be between Sep 16th and Oct 23rd" ... or something like that...I was just guessing at that point when I would have my NOA1. Now I have it, and it doesn't give me dates! Anyone know of this issue?

If I understand your question, you are trying to find your adjudication date on the noa1? if that is right, you won't find it there as this is a VJ estimate. I neglected to look if you were a CSC filer which right now apparently the time line function is either not working or suspended? Not sure why.

My fiancee and I are getting ever so closer to our first meeting. I was reading on one of the visa sites where you pay for a guaranteed successful visa acceptance that all the evidence that I was thinking one would use to "prove" a meeting was wrong (of course, they will tell you what you should do for a fee). I was thinking of course, photos with newspapers held in hand to time stamp them, receipts from flights, hotels and restaurants as well as a copy of my passport (I live in the U.S. and she lives in Dubai). According to them, all this can be faked (cant anything be?) and there are sure fire things one can do to overcome this. What do you suggest we do? Is there things I am overlooking that can be done to "prove" that we have met? Thank you and forgive me for not reading all the guidlines yet, life is busy.

Also, is there a way here in visajourney to add another email address so my finacee can get notifications too? Thank you.

Photos together... boarding passes... passport stamp... and in your case a visa stamp since Dubai will issue you one of those also...
read the guides.. they are most helpful.

Good luck

Great! I called my local UPS store and it seems like that may work out. Just.. a couple more questions!! Because there are several different places that the address is needed for different forms.
I-129F: Part A, #2 Address (Number and street)
I-129F: Part B, #14 Address in the United States where your fiance plans to live
G-325A: Applicants residence for last 5 years

Should I list my UPS Mailbox address on Part A, #2 of the I-129F in order to have all coorespondence from USCIS be sent to my UPS mailbox?
Should I list my current residence (though my boyfriend and I will move into an apartment after getting married) for Part B, #14 of the I-129F form?

Thanks for all your help!! We really do appreciate it!:D

B #14 can be "to be determined, City"

G-325a, I would use it as your current address. It's just biographical, not an interrogation.

Okay, so then Part A #2 would be my UPS Mailbox? And then all corespondence from USCIS would be sent there?

USCIS sends mail to the address you give USCIS. Contact your local UPS store to set up a private mailbox. These used to be called "Mailboxes Etc." There are other similar private mailbox services available as well.

Does USCIS send mail to my residential address written on the I-129F?
Would it be possible for me to have only mail with my name sent to "Mailboxes Etc." or would that mean all mail sent to my current address(even if it were addressed to my parents) be sent to that private mailbox?

They have no respect for our relationship and claim I'm living in a "fantasy wolrd" and accuse me of "rushing into things" though we've been exclusive for over 3 and a half years. Which is why I would like to go ahead with the process and have him come over here and make the announcement to them (both my fiance and I) in person and lay out our very real, very "non-fantasy" plans for the future.

Believe me, I want so bad to tell them. But I don't feel like hearing how I'm just living in a fantasy world and nothing is ever going to come of something I've built my future on.sleep.gif

Like Gary I've heard that some embassies/consulates require 125% for the I-134.

The Dept. of State website states 100% for the I-134. See this link: http://travel.state....types_2994.html

I don't think the I-134 allows for a co-sponsor. The I-864 does allow for co-sponsor.

With the short time period between required marriage and AOS with the K1 if the petitioner doesn't meet the 100% might as well have the same sponsor for both as the 134 "obligation" stops with the AOS (which does require the I-864 with income requirement of 125%).

EXACTLY!

And since it's the Department of State that uses the form, that's why their guidance is the guidance that matters.

*USCIS and DOS are NOT one and the same*

Brownie points for understanding that there is no such thing as a co-sponsor with the I134.

No co-sponsor allowed for the I-134? Does that mean the co-sponsor would be the person sponsoring and not me? Ahh.. help

Suarez (family name) Marcos (first name) Alejandro (middle name), but then there is question that says All Other Names Used (Including names by previous marriages)... Should I put my other last name that would be Ortega? or is it just names by previous marriages? .. sorry if this question is dumb, but I just want no mistakes in the forms!

Okay, now I'm even more confused. Are you saying we should send everything we plan to have for the interview along with the I-129F to USCIS?!

I thought the mailing of the I-129F was just the first step where you have to prove you meet the requirement (i.e. 125% over poverty level, having met within the past 2 years, etc) and THEN the interview was to determine if the relationship is legit.

I don't think all of that was needed, but including more information then necessary can never hurt. 4.Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it.
^^from the guide

"Describe the circumstances under which you met. If you have not personally met each other, explain how the relationship was established."

^^from the I-129F

"We first met in person in Merida, Venezuela on June 23rd, 2007 when I was studying abroad. I studied there for one month, then lived with him and his mother as my host family for two months. My last trip to visit him was from April 8th to April 15th, 2009."

^^This is what I wrote for #18. I didnt mention that we first "met" online. Should I put that we first met online? I thought since they didn't count that as "meeting" that they wouldn't care to know about that. Then again, when it comes up in the interview, I don't want them to think we were omitting anything. Also, if it fits in the box, do we still need to use a separate piece of paper and sign and date it?

Before I could though, he interrogated me about what my "intentions" were. ! He's just a lot of subjective:"He is far away, I don't see how it can work out."and not very much "Oh, I'm so excited for you finding the love of your life!". That talk felt more like a math problem instead of the very special thing I thought it would/should have been!

And I don't think we have to worry about teaming up on him! If anyone's going to be teamed up against, it'll be me! But I'll be confident and defend myself!

Here is another option:

I see you have spent almost 2 years apart already.

Get her here asap. Use Co-Sponsor.

Either you or her get enrolled in a Community College and get you Associates Degree in Nursing.

Community Colleges are very cheap and it will take about 2 years to get your Associate Degree.

School loans are easy to get if your low on cash.

You or her can then register to sit for NCLEX to become a Registered Nurse

Pay will be about 3 times what you are making now.

When your young you really don't earn that much money, you need to be schooling yourself so you can have a easier life when you get older.

Actually, we spent April 8-April 15th of this year together.. so it's only been about 13 days(though it feels more like 13 years!) since we've seen each other.

The restaurant industry is not the best place to get rapid salary growth starting off. Are you working as a server? Supervisor? As a server you can get as many shifts as possible and declare all your tips. And you can get more than one job to boost earnings.

You will need to show current and continuing income that will exceed the minimum. There is a time lag from filing the 129F to the interview where the 134 is submitted. So you can begin the process once you are settled in to the new higher paying job. That being said, you don't have a strong income history so far. Not sure how that will be viewed by the CO. As mentioned before you should get a feel from others in the Latin America forum as to what thery expect at Caracas with regard to sponsorship.

Keep working at it.

Thanks. I currently work as a receptionist and a waitress. The place that might be hiring is a reallt nice hair salon that needs a receptionist and it's only right around the corner from my house. I'm gonna see if maybe my current employer might work with me before I pursue that though.

I don't think being a RN is for me, thanks for the suggestion though! I looked into what it would take to teach Spanish. See, I have my Associate's in Spanish- but I didn't take any education classes because I didn't think I was interested in teaching. And well, now, I am! But with all the questions I've been asking and all the people I've spoken with, I'm more confused than when I started.

So! I've told one parent! It went better than I thought- kind of. She said I should wait to tell my dad after I'm already comfortably above the poverty line. Well this is how it went:

Me: I don't really know how I should tell dad.
Mom: Well, what kind of timeline are you looking at?
Me: Well, I guess I'll go talk to the people at La Cabana to see if they could give me some extra hours.
(I had told her that I needed to make a certain amount of money and that's when she said I should wait.)

Off-Topic2.gif Well, my six month evaluation is coming up and I plan on telling them our situation and hoping and praying they'll have mercy on us! (I think I've done a pretty good job, but I don't know if they'll think I've done $2 per hour worth of a good job, but I'm praying!)

I also heard about this other job that said they are hiring and will be paying $8-$10. So, I could go in there and let them know I do a good job, but that I woud need $10 an hour or else there'd be no reason for me to leave my current job. (I really do enjoy my current job).

My question is will I need to have worked an entire year at $10 in order to be considered meeting the minimum? I ask because I just started my two jobs late last year. In fact, I only made $8,000 in 2009- not even enough to file federal taxes!

We've been reading a lot lately and we're really eager to file, but I want to know if I should wait to file until I for sure meet the minimum long enough to show up on my tax returns because my 2008 returns will disappoint them!

Thanks for all the help!! luv.gif

I am not sure why you have waited until now. The I-134 portion is several months out if you file today...go for it! I cannot tell you what you will be making in 3-4 months. You can only guess and do your best. You are no tso far from qualifying now. My feeling is you can do it, go for it!

You could land a $60,000 per year job tomorrow and get laid off the week before you file the I-134. My job's pay structure has changed so much since I filed the I-129f I can't even keep track! Same job, just different pay, bonus plan, etc. It was not the same for the AOS as it was for the I-134 and now I am doing another I-134 for a K-2 interview in June and it is different than the AOS was in January, and I doubt if the I-864 to follow in July will be the same as this months I-134. Who cares? It is what it is, what it is. The stated annual income on each is different and none is false, it is what is true that day that I sign it. I wouldn't wait any longer for the "perfect situation" that could well change before the I-134 is completed.

Thanks for the encouragement! smile.gif We're gonna go ahead and get started and just pray, pray, pray that everything else falls in to place.
