The reason I'm freaking out is because well there is so much to do and my fiance needs to ask for a raise too which she was gonna do next week so we can be totally confortable with her sponsoring me God! I hope everything goes well... Lol we really tht this process was gonna last like 6 months or more... But yeah :)

I just woke up this morning and went to the USCIS website to check our status and it said we were touched 07/08/2010 and then I went to CHECK MY CASE STATUS and it changed from Initial review to POST decision activity and I just got on my fiances email and we got this email

Hey everyone

sooo Im freaking out now! Im just trying to gather all the documentation to take to my interview (I dont have a date yet but I heard it is already on the way to the embassy) and so I was checking my birth certificate and a little mistake that non of us notice for years just came up!.. My moms name is misspelled!.. well her last name!.... but just for one letter! and its not the one we share! Like here in latin American you get your dads last name and also your mom's... but the one that was misspelled is not the one we shared is just her "single" last name! and I dont have it!.. soooo I DONT KNOW how it would affect the whole process of getting the VISA... tomorrow I'll go and see what I would have to do to change it! but I wanted to ask you guys if you think I will have trouble for it!.. I know they dont ask for my moms ID or anything but on the BIographic form I put My moms last name but its different on my birth certificate for just ONE Letter! so yeah .. l

Can you call their number and ask? I didn't see any option for automated notification (by email/text) - but may have missed that option.

Yeah we just called the NVC... just follow the options and then just give your case number! and they will let you know if its been mailed :) btw if it gives you a busy tone! keep calling! someone else already posted the number :P

Hi jen,

it is teh DS160 online form that wants photos uplaoded. I believe this form is still in its beginning mode and not available at all consulates. Which would be why yours only requests DS156 & DS156K. If DS160 is not mentionned anywhere on your list of forms to fill in and send back for packet 3 then you are golden and dont even need to worry about the silly DS160 form with the uploaded photo. DS160 is basically the same as the 156 jsut it is online.

Now I'm a little confused, maybe this is all different since your embassy is in Canada but I guess there is nothing to lose for asking. I have read the instructions of the documents I have to bring for the interview and I was asked to fill out form DS-156, but they do not mention anything about uploading a picture onto the DS-156 form! so I'm wondering if you read that somewhere else and I havent noticed. My checklist says


DS-156 Two (2) signed and completed copies of the DS-156 form must be submitted for each applicant, including minor children. This form must be completed electronically (no handwritten copies will be accepted) from the website http://evisaforms.state.gov and printed out. The DS-156 is also available from the U.S. Department of State Travel website (http://travel.statei...forms_1342.html). The form must be filled out completely prior to the applicant’s personal interview. Each answer field must contain a response, even if the response is “Not Applicable.”

and the only part it mentions anything about photographs

Photographs: Four (4) recent photographs are required. The photographs must be, 2 by 2 inches (50x50mm) in size, with no head covering, and showing a full, front-face view against a white background. The applicant must sign their full name on the reverse side of each photograph.

I just wanna make sure I'm not overlooking any instruction! lol thank you guys!

Think I shall stick with what directly pertains to me and requires my signature. I believe the DS 156 has doing with my fiance and not me directly. So as to have I been arrested would not qualify. Secondly the FBI back ground check I have to have done periodically shows up everything I have ever done or been ticketed for. So if they ask for it I would disclose it. Not that I would be afraid to do so as I have plenty of documentation that covers me in any way.

Thanks for all y'alls input as you have been able to ally my panic moment and now have a better grip on what they were asking for. I shall be ok with this one.

But It does ask If you have ever been arrested..and if there is a record of it anywhere,and they find it,and you did not disclose it,you can be denied for misrepresentation...and banned for life..

Im sorry but please if you could show me were it ask if arrested.....I cant find that anywhere. If its there I want to know about it so I can prepare myself to deal with the issue should it become one.

Don't worry. You weren't convicted, therefore you were truthful, and it won't be a problem. HOWEVER, that said, it's a good idea to disclose it to your fiancé if you have not already, as it is something that could come up at the interview. UK is a pretty easy consulate, so they won't be looking for an excuse to deny, but if they think your previous arrest for domestic violence could be a red flag, they may bring it up.

Thanks! I was getting a bit worried there even though I had read and re read what it says. And my fellow knows all about it those events. And whats more, I still have a active restraining protection order against the ex. And I am a school bus driver as well. I have had the F.B.I Background check done on me several times over the last ten years so I didn't think anything of this until something I read clicked and then of course the panic set in....lolol Thanks again for all y'alls answers.

I just read your timeline and saw that you have already submitted your I-129F. I hope you answered truthfully on the form where it asks whether you've ever been arrested for DV (or any of the other crimes specified)...

You will receive an RFE for evidence pertaining to teh arrest. just provide what USCIS asks for and you'll be fine.

Okay about 15 years plus ago I was arrested for domestic violence. The poor cop was apologizing to me for having to arrest me because even he knew it was insane. The x had a scratch less then 1/2 of inch on his throat. I on the other hand....well the entire right side of my face was black and green. The elephant man held nothing on me and the swelling of my face. I miscarried the child I was pregnant with, had several broken ribs, and my nose was broken. So once this was taken to court quite literally it was laughed out of it. The judge even apologized to me for having to put me through the total waste of tax payers money. He also told the X several things as well. Long and short.....I was arrested but never in any way convicted of DV. Soooooo will this be a issue on our 129F petition? Jimminny Christmas I just thought of this as it was so long ago and I certainly never get into trouble....well I get a speeding ticket once in a blue moon but you get my drift.

First of all I'd like to give thanks to this site and to all members. All the information on Visa Journey has made the filing process much easier.

Hopefully some of the members here can help me with my question. I send my I-129 Fiancee visa out on 05-05-10 and the receipt of delivery was 05-07-10. As of today I have not received any other information or has my check been cashed. I've noticed similar petitions during my time frame and it has only taken two or three days to get notification. Is this normal or perhaps something has happened to my application?

Actually it took about 5 days to know for sure ....but that was only cause I called the bank to check on the check. Now you probably should hear something in about a week....It took that long for me to actually get the NOA1 in my hand. No panicking! lol

If your joking, then yeah there are alot of big No NO's to say.....And them folks....well I really don't think they have a sense of humor when on the job. There is one I have read that I know you diffidently shouldn't say..... your coming into the U.S.A. to marry your gal. The agent could take that as you intend to immigrate and deny your entry.

I havent started the K1 process yet either, not even proposed yet (planning this summer).
Im going to be visiting for 62 days on my school summer break...so hopefully no problem!

Make sure you have a copy of your itinerary with your return date. You might also wish to have with you proof of reasons you may need to return. Rental agreements, school schedules, Dr.'s appointment things of this nature. Believe me.....while he was in Atlanta I was holding my breath hoping nothing went wrong. But as most of what I have read...,.he just sailed right on in with no issue.

Where you guys already in the K1 process?

No we hadn't started the K1 process. We hadn't even decided to get married at that point. He entered in Chicago Dec 1 2009. The agent wasn't happy with how long my fellow was staying, about 85 days. For some reason he thought it a bit too long to visit. Either that or he was simply being a ####. Just make sure you have your proof of applying for the K1 with you....and make sure that you have proof of your income(or that of your S.O.) that will support you while visiting the U.S. The second time around I made sure I had sent a couple of paycheck stubs, a bank statement showing deposits (marking out account numbers and such) and a signed notarized letter in a sealed envelope that showed the postal stamps and dates. That way if they had said anything to my S.O. and took him to secondary, he could show that he is indeed being on the up and up and intend to follow the laws of immigration for the US. But like I said the second time he came through Atlanta and as the south is wont to do....the used good sense and welcomed my fellow and told him to have a great visit. Again good luck with yours.

My fiance and I went through this just a month ago. It was stressful to say the least. We however found that it depends upon the POE. He has been through Chicago now and Atlanta. Chicago gave him a hard time, while Atlanta asked him two questions and then told him to enjoy his vacation. Researching this myself, I found that most say that to be honest is the best policy. Also, for the most part you shouldn't have any trouble. It seems to be the odd case that gets hung up entering the country for a visit. So best advice .....honesty and hope you get a entry agent that doesn't have a corn cob up his backside. Good Luck and hope you enjoy your visit!

P.S. Less is more. Don't volunteer any extra information. Answer their questions simply and honestly.

I know most of you have probably read posts like this before, but I need to make sure.

Correct me if I'm wrong, but I've read that Canadians are allowed to visit the USA for as long as six months without a tourist visa. My fiance (he's the US citizen, I'm the beneficiary) and I want to do this, and he wants to hand in our K-1 papers while I'm visiting there. Is that allowed? I would of course leave once my time is up, I would need to finish off the process in Canada, after all. Would doing this cause any problems? Has anyone actually done this? Any advice and experiences would be very much appreciated!! Thank you.

Your only allowed 90 days in the US on the VWP.(VISA WAVIER PROGRAM) If you stay over the allotted 90 days you will get a ban from entering the US. for a period of time...(I think its ten years) My fiancee stays about 85 days in order to avoid that drama. We also filed our K1 petition while he was here. So that is allowed and lots seem to do so. And the answers vary for how long you have to stay out of the county before you can reenter for another 90 days....My fiancee generally stayed gone 6 weeks before returning. You have to make the POE agent believe that you have every intention of leaving the county before that 90 mark. Keep in mind though, it all depends on the agent at the POE. They can be having a bad day and decide that you are a easy target to pick on regardless of any proof you may have that you intend to leave the county. I have read about several people visiting every three months and staying gone three months for years, then all of the sudden refused entry for no real apparent reason. Then too I have read that others are refused straight off. Basically its on you, as to the burden of proof of your none intent to immigrate. Good luck with your K1!

You should be just fine...Myself married four times....Widowed twice....divorced once...and real throw down of a liberation from the fourth....This will be my last one...number five.

Not sure how the postal system runs in California.....they all run on their own schedule....some just faster then others. Its possible for them to be dragging their feet at the post office or maybe its just csc dragging. Never can tell especially with out being able to track it. But like I said....its still a little early to be panicking. (mind you I would be too regardless but that's just me.) Give it a few more days...take a deep breath and know that this ride has a lot more hills and mountains to climb and drop. If you start stressing out now then you will lose your mind long before you even get your visa. Good luck! Deep Breaths. And like I have recently been told....decaf.

Help my fiance sent our i-129f to csc on the 7 july 2010 and we still have not received our noa1. He sent it regular mail and also did not keep the receipt of the money order so we have no way to check to see if it has been cashed or not. Please can anyone offer some advice, we are beginning to get worried as we can see other people have received their noa1's from around the same time. Thank you



Thats a little more then two weeks now.....How did the SO send the packet? Snail mail, I could see it taking this long. And with out a receipt your pretty much out of luck tracking a money order. Did the SO get the packet with a signature required card? You could track it that way. Also too keep in mind that sometimes it does take a bit for the CSC to get their thumbs out. Good luck hope things work out for yall.

I seem to remember seeing on the USCIS page or travel.state.gov page that there are conditions for expedited processing. As I recall one of these was a humanitarian clause.. which one could argue this could fall under.
