if you call the nvc they tell you your case is complete, they should have given you a new case number BGT......if you get that number you can see it on the list at the botoga embassy ...visa scheldule appointments, the list comes out every 15 of the month scrol down the list an look for your BGT... number time an date of your interview,...BUT YOU NEED YOUR CASE NUMBER,call again,603-334-0700 press 1 then 5 also call state department 202-663-1225 press 1 then 0 live person, have all your information ready, ask if case is complete to give you the new case number for the interview,

I have done both I get nothing from them!

K-1 Fiance(e) Visa Process & ProceduresI129F ? (Approved petition sent directly to Embassy/Consulate?) [edited title]

USCIS told me over the phone that non immigrant visa's like an I-129f go directly to the consulates and immigrant visa's like an I-130 go through the NVC. My best friends I-129f went directly to the Philippines once he got his approval letter.

That is interesting to hear as no one else on here from what I have heard or read has had that experience, but it seems as though mine is taking a similar route from what I can tell based on what is written on the NOA, I sent an e-mail to the NVC requesting information if it had been received and they responded back with a no, but it says that if it was not received with in 15 days to send them a copy of the NOA and they would track it down, all sounds good but I don't have a warm and fuzzy feeling about it

K-1 Fiance(e) Visa Process & ProceduresI129F ? (Approved petition sent directly to Embassy/Consulate?) [edited title]
Yes it is frustrating as I see many on here who's petition was received in a few days and some a little later and I do understand that it can take some time to get there and yes maybe I'm a little quick to jump but we have been waiting for so long that I just want to keep it moving since it actually started to move from that constipated state it was in plus knowing what all is needed from here is also another challenge, but this site is a great one from all who participate to the information

thanks to all who have responded

Thanks as I also thought that it would go through the NVC first but for what ever reason no one knows where the petition is at this point the USCIS cant tell me if it was sent and the NVC cant tell me if it was received there

K-1 Fiance(e) Visa Process & ProceduresI129F ? (Approved petition sent directly to Embassy/Consulate?) [edited title]
Nope I'm just going around in circles I call the NVC they have told me to call the USCIS and the Embassy to which I get nothing but normal spiel and I see people here saying that they call within 2 or 3 days and they get their case number

I have called the USCIS twice to only be told to call the NVC and called the NVC to only be given the spiel that it takes 2 weeks or longer or to call the USCIS

I did speak to a tier 2 officer at the USCIS but that was not really productive but she said that they should send me an e-mail about it now I an getting discouraged because it appears that my petition was sent to the Embassy but the embassy cant give me any information till next week between the hours of 2 and 4 on Wednesday Yeah a whole week to wait now to get anymore information

Now I'm worried NVC has no record of it they just say wait till we get it which means it probably went to embassy and has to go through customs and then they have to look at it and say that it has to go back to the NVC and then there for who knows how long a big circle for nothing ( speculation )

All when others on this site have gotten their case numbers in days I now will probably be waiting for months for them to find it or eventually be lost and have to start all over again because of someones screw up

This is turning out to be frustrating

Oh Well!!!!

K-1 Fiance(e) Visa Process & ProceduresI129F ? (Approved petition sent directly to Embassy/Consulate?) [edited title]

Hi, As far as I know everyone's letter says it's being forwarded to their embassy. But, It really goes to NVC. Call NVC again ask them if your case is there They should give you a new case number. It may have left NVC but you need to ask them that. You can call your embassy to see if it's there after you see if it's been sent there. Good Luck :)

Thanks that is what I thought happened but the guy at the NVC said something different

K-1 Fiance(e) Visa Process & ProceduresI129F ? (Approved petition sent directly to Embassy/Consulate?) [edited title]
We got our approval last week and our petition went straight to the Embassy

Is this normal? I thought that it went to the NVC first then on to the Embassy, when I called the NVC today he asked what the NOA2 stated to which I then realized that it states it was forwarded to the Embassy.

I have been trying to find out if the Embassy has received the petition and what our case number is but I have not been able to get a response

any ideas!! help etc where to call to get the case number?

K-1 Fiance(e) Visa Process & ProceduresI 134 - Supporting Documents? [edited title]

The instruction are old, like the form is. The best practice is to provide three tax returns, self employed or not. No need to provide a bank statement if your income is sufficient.

Thanks this is great information

K-1 Fiance(e) Visa Process & ProceduresI 134 - Supporting Documents? [edited title]

" I think" isn't good enough but if you "know", then leave the asset questions blank.

yes I know! it will be blank

K-1 Fiance(e) Visa Process & ProceduresI 134 - Supporting Documents? [edited title]

When income is clearly sufficient, simply leave all asset related questions blank. You only need to document bank accounts you list on the affidavit. A bank statement will do.

So documenting a asset such as a home is not necessary!
I'm pretty sure that I'm covered in the income dept, I'm not wealthy but I think I cover more than the 125% required

K-1 Fiance(e) Visa Process & ProceduresI 134 - Supporting Documents? [edited title]
I finally got the NOA2 now I need to move on to the next steps I134, NVC & Embassy etc.

So I have many questions

I have been gathering everything since filing my I129F

When is it really needed?
I noticed that the current form I have filled out is valid till 5/31 but I am not really expecting to get to the interview till after that time

How may years of taxes have most of you put in your I134?
What else do you feel is needed besides what is listed in the Forum here?
These are the normal ones, taxes, bank statements, any statements on assets, employer verification, etc

Is an electronic employment verification acceptable?
Is a letter from the bank regarding the opening of your bank account necessary?
Any help is appreciated

Thanks

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support
Now that we have electronic filing of taxes, do the copies for the I134 need to be signed? and would it matter on the dates that they are signed

say signing a 2009 copy and dating it in 2010 would that be an issue, I do all my taxes electronically as well as all the other things these days

I'm one of those people that big brother likes, everything I do is on line, taxes, pays stubs, W2 forms, banking and bank statements etc and then some

K-1 Fiance(e) Visa Process & ProceduresBinding the I-129F to send it in

No binding, just strong paper clips, and the table of contents for the main file.

We front-loaded our evidence of previous meeting. For that I had another table of contents and put page numbers for easy reference (boarding passes, chat logs, photos). I also used peel-off side tabs with labels. Liberal use of highlight pens...these guys see a ton of paper, I think it just makes it easier for them if you mark the key stuff.

Good luck.

I don't agree with the paper clip supporters, I used the ACCO fasteners two holes at the top there is a good post on here that gives the order to place all the documents

Paper clips only add to the bulk of the package and the ACCO fasteners allow for easy disassembly of the whole package in one step rather than many paper clips Im sure that the uscis will appreciate those who do not use paper clips just my 2 cents

K-1 Fiance(e) Visa Process & ProceduresBirth Certificate
Today we got a 221G for a birth certificate, I am posting this here in K1 because this is where you start to gather your documents but ours did not affect us till we got to the embassy.

moderator please move if this is not a proper form for this posting

In our case my fiancee's birth certificate was written wrong at birth ( hand written in those days ) and some years later it was corrected and noted in the new typed format. This is where ours bit us, as we submitted a notarized copy of the corrected certificate to the USCIS it was accepted etc and went all the way through till we got to the Embassy today!!!!

I knew about this but vaguely back when we started getting all the documents together for the USCIS

At the interview they noticed the note and this was the reason for the 221G to my understanding

To get this submitted you have to buy a 15 minute time to call the Embassy to get the appointment date and time.
So now we have to call Monday to get an appointment for submitting notarized copy of the first unchanged Birth certificate.

So to anyone who may not know ask your fiancee if his or her birth certificate has ever been corrected and then if so get the copy of both

K-1 Fiance(e) Visa Process & ProceduresCheck List: K-1 Fiance Visa Interview

DS-157 : Supplemental Nonimmigrant Visa Application

In addition to : Recent letter of intent to marry!!

We just recently went through our K1 interview and they practically gave back all our documentation from the 129f and the I134 from the I134 they only kept the 2010 tax doc, the letter from the employer and handed me back the rest of bank statements, copies of checks, W2 etc and from the I129F they gave me back all the copies of receipts and evidence but pictures, kept the main things the I12F form, the 325A, birth certificates etc even though they gave this all back to us I'm still glad we were prepared because we actually needed one document and had it with us and one we did not have was missed and but we were able to get that one filled out and submitted as well

K-1 Fiance(e) Visa Process & ProceduresWhat the US considers "having met"
If you're serious about going through the likely multi-year, not inexpensive process of applying for a K-1 visa, bringing her to the US, getting married, attending to all the things that married couples have to do as they merge their lives, applying for Adjustment of Status so she can get her Green Card, etc., it seems to me that a trip for you to the Philippines would not be your greatest hurdle. Why not just take a trip there and see her again? Yes, it costs a lot of money and takes some time. But compared with the thousands you are about to spend if you go through with all of this, and the time it takes to do all of this, one trip to see her is nothing.

Of course, if you prefer to marry her there in the Philippines and then go the CR-1 route, that's certainly another option. Nothing will be quick, though. It all takes a lot of patience, expense, and dedication.

K-1 Fiance(e) Visa Process & ProceduresTotal overall costs for this journey (K-1)?
Plus postage/FedEx and photocopying (with evidence attachments, mine was an inch thick) charges for the USCIS filings, translations of foreign-language documents, requests for certified copies, travel to see your fiancee while she's waiting for that K-1, cost of being away from work, maybe a trip to a lawyer to get some special question answered. We spent a few thousand dollars on top of the USCIS filing fees to get through this past two years.

K-1 Fiance(e) Visa Process & Proceduressuper tricky situation
At worst, you might receive a fine from OFAC. You could consider the cost of the fine as part of the cost of your "visa journey." With all the application fees and other costs that you will end up spending over the course of the next few years getting your fiance over here, a fine from OFAC for an unauthorized visit to Cuba would probably just be the tip of the iceberg. The best advice is probably to be honest and straightforward when asked for information, and be prepared for the consequences.

K-1 Fiance(e) Visa Process & ProceduresOy vey...what to do?
Not totally sure but, I do think you have to have income at that time as well as prove your income.

I will let someone else who is more knowledgeable and who has been throught the process answer this.

In my opinion, whatever income you have coming in needs to meet those guidelines, so no one person can really make the career path choice for you. Do what is best for you and your situation. Choose according to what is more important to you and your priorities in your life.

K-1 Fiance(e) Visa Process & ProceduresImportance of the Beneficiary's English skills in the interview.
Great advice. I really appreciate you telling me what is ahead as well. He is studying now, so I will hope for the best, if we get through this first hurdle. I will definitely be able to help him more with his English, once we are married and living together.

K-1 Fiance(e) Visa Process & ProceduresImportance of the Beneficiary's English skills in the interview.
Thanks. I appreciate the feedback. Actually I am the Fiancee in this case. The woman. LOL
My Fiance (man) is the Beneficiary in the case.

I have been learning his language for some years now, but it is slow going for me. We can communicate, and when we get stuck on a misunderstanding we use translator. He is slowly learning english when he has time.

But I speak more of his language than he does english.

This is for F1-Visa so this first interview will be just him at his embassy. Not both of us yet.

K-1 Fiance(e) Visa Process & ProceduresImportance of the Beneficiary's English skills in the interview.
How important is the Beneficiary's English skills in the F1 Visa Approval Process? Are the questions in the interview asked in the Beneficiary's native language or English. Or is there a choice? If there is a choice and the beneficiary chooses their own native language, does this sway the decision?

Hi. I think someone may have already asked this question but I do not remember where I saw it.

K-1 Fiance(e) Visa Process & ProceduresCalled the NVC and they received my I129F documentation from the USCIS today!
I received my NOA2 07/26/11 and have been calling and checking with the NVC on and off. I chose to speak directly to an operator today and although the recording said they did not have my info in their system, the operator said that they JUST received it. At that point I proceeded to ask the operator for the case number that they assigned to my info and when the packet of info will be forwarded to the consulate, and she said it should be sent to the consulate soon.

I was surprised. Basically it was not quite a week from the NO2 that the NVC received my info. 9 calendar days to be exact. We will see how quickly the consulate truly receives the info and when my fiance actually receives his packet of info.

K-1 Fiance(e) Visa Process & ProceduresMy case and Doco was sent from the NVC to the Consulate today!!!
I just called the NVC, to make note of my NVC Case number and I proceeded to ask if the case was sent out to the consulate today. It was just sent today! Whooo ho!.

I had just called earlier this morning to ask a different question and when I asked if it was sent yet they said "no".

Funny I call back later in the afternoon and they just sent it.

Works for me...LOL

NOA1 notice is telling you that they received your PETITION and you had enough of the initial documents included and signed for them to start the actual process of checking all your documents closer, and performing the background checks on you and your beneficiary. If you have the correct documentation and the background checks go ok, you will receive your NOA2 stating your petition is approved. If you have information missing, they will send you a request for more information

Hi VJ community.

In reference to K-1 Visa,

I am hearing talk of "Packet 3" and Packet 4". Not so much Packets 1 and 2.

Would someone who has had this experience, please explain what "Packet 3" is and what documents it contains"? Also "Packet 4".

Thanks.
