Well if what you wanna know is if you will have any issues for going to the USA months later after you were appoved.. I think you wont have any issues.. I think your visa would expire in Feb 2011 or march.. so if you leave in January you would still have time! so I think you would be fine.. maybe they will ask you why it took so long for you to go over there.. but you can explain your reasons... I got my visa Approved in August 31 and I wish I could have left right away .. I miss my fiance so much.. but since I didnt know if my visa was gonna be approved or if I was gonna have any kind of delay, I couldnt book a ticket and I couldnt quit my job either! so now my trip will be for novermeber! I wish I could have left THIS MONTH! but I had stuff to do before leaving (like quitting and working a month notice, getting other stuff sorted out)... so Im sure they would understand!.. you can explain to them the real reasons.. maybe things you had to do before leaving...just my experience.. and like randy said most people leave RIGHT AWAY! but I think there are others that have things to do before leaving! so yeah!

just BE CAREFUL WITH THE DATE YOUR VISA EXPIRES

That is good news...and no I have never had any other type of visa filed. Just those B-2 stamped
on my old passport, and I forgot they were there. I hope I didn't have to have them stated on the I-129F forms?

I dont think B2 visas rejections will affect you in anyway.. I think it would have an effect on your application if you had applied for K1 visas before.. which I dont think you have.. I think you should put those dates.. and thats it I think its better to provide all the info you can .. than if they check their system and find things you are not telling them yknow?! ! :) good luck

btw I also had B2 visas rejected in the past for lack of ties to my country and Ihad no issues

you dont need to know the exact dates and its ok if it doesnt display the date by the camera, what we did was to put all the pictures together on a sheet of paper and write next to eat what month and year it was taken, what we were doing and who the people on the pic were (family, work friends, etc) thats pretty much all you need.. try to include pics of you two, family and friends.

well I think boarding passes show the date when you were there.. but the most important part to backup your boarding passes is Passport stamps!.. but yeah if you have any boarding passes that would be helpful and you can highlight date, destionation and your name.. also hotel receipts with your name on it and that it shows it was in her country.. my fiance even included flyers of the hotel. anything that shows that you were in her country and have both of your names or your name will be good to include!... we tried to include as much as we could!

about letters! umm well She included a few letters.. like 5 letters, one for every year we have dated!.. right now you have to prove you guys met within 2 years... you can frontload them later in the interview ... for the interview I incluced 35 letters hehehe..

include any chatlogs and phonelogs.. everything you include will be good.. they will probably not even look at it! but its better to include all you can than get a RFE

I am not sure about money receipts! if they come from you I guess its okay... and that would help.. maybe you could even include a letter stating why you were sending money.. you never want to give the wrong idea you know? so yeah hope this help!..

btw remember to keep copies of everything in your package!..

I have a question about this requirement: "Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photos."

I need to know does the date displayed need to be displayed by the camera on the front of the picture? Or can it be written on the back? My fiancee is saying she cannot get a date to be displayed on the pictures when she emails them to me or prints them from her camera. I've asked her to go to one of those picture printing places in tbe mall to see if they can make her camera show the date the pictures were taken. But if she tells me they cant, can we just write the dates on the pictures?

I have some of these things, but not all of them. And how exactly do they show that we have met each other in the past 2 years? Don't they only show that I have been there? I traveled there, so I do have my flight receipt from Cathay Pacific and passport stamps - but actual boarding pass? Long disappeared. We stayed with family mostly, so few hotel receipts. When we did stay at hotels, it's just my name on the receipts. What itineraries?

- I have known her for 10 years and have dozens of letters. How many should I send, and should I send ones from as far back as 10 years ago to show an ongoing friendship/relationship? They need copies of envelopes too?

- I have very few chat logs because the distance she has to travel to the nearest Internet cafe is quite inconvenient. We text every week, but I use something called Chikka to text her, so there are no phone bills. I do however have every receipt I've ever gotten for sending loads to her phone. Would those count?

- Also, she doesn't ask for much - actually, she never asked me for money until the economy turned, her father lost his job, and she became her family's "breadwinner" on her teaching "salary". I have a few Western Union receipts... Are those helpful for anything, like showing that I'm helping the woman I love to survive?

Yep. I have a few neighbors that adjudicate for the VSC, right on their dining room table. They go and pick up cases, process them and return them. They have access to what they need. I even applied for one of those jobs myself. Pays pretty good and you can work at your own pace (they do have an expected "quota", but you can work on them at 2am if you want...naked. maybe TMI)

Ok well I can try to do that since it is a handful but even then I just don't want them to come back and say well it's just a handfull please translate everything. If thats the case then I should just pick a few emails from every week and translate those and send them in. This is confusing!!!



I am in a 5 years and 3 months relationship, so I have 5 YEARS worth of emails!!.... and this is what I did... I printed off screenshots of my inbox showing emails from back in 2005 to 2010... two screenshots from each year... in those screenshots they can see my fiances email and dates.. so that will show them how often we comunicate (we would send like 2 to 5 emails to each other per day) and it was continuos.. then I picked two emails per year.. you can pick one if you want.. and translate them... thats how organized emails... that way you dont have to print off SOOO MANY because you can prove how often you guys talked with the screenshots of your inbox... and I did the same thing with chatlogs... screenshots of chatlogs from 2005 to 2010 and picked one conversation per year :)

That is the correct fee but the second question was where to mail. All fiancee petitions are mailed to a PO Box in Texas. Check the USCIS website for instructions. The lock box facility in Lewisville will do intake, then send the file to Vermont or California based on workload, not necessarily petitioner residence location.

I have a friend who is filing a K1 petition for her fiance in Venezuela and she is filling out form I-129F and in Question #10 it asks for her birthcertificate. she was born in Colombia and got her US citizenship through her parents, both of her parents are US citizen so the form is asking for a Birth certificate number... all she has is a certificate of birth abroad and form FS-240... now, Neither of those papers she has to prove her US citizen have a number .. which is require to write down on form I-129F on question number 10!... so what should she write n there? other than the papers I just mentioned she only has her passport!... please HELP! thanks

i got confused too and actually asked the same question here on vj afew days ago.

i called NVC 2 days later at 8:00Am (their opening time) and after going through afew options i got through to a Human operator, a very nice lady(professionally well customer versed) then she asked me the Following; INFO ON NOA2 Notice of Action-Approval..for confirmation !

Receipt number: from Uscis....for example EAC XXXXXXXXXX
Petitioners name and date of birth?
Benefeciary's name and date of birth.

She then read for me our CASE NUMBER and gave me a tracking number for my packet that is due to arrive at embassy SOON! :thumbs: :thumbs: .
she also explained that USCIS says that the "approved petition is sent to embassy" which indirectly means that it has to go through NVC then finally to your Embassy. that's the standard procedure.

i suggest you do the same and have your NOA2 at hand when you do. i was shocked at how fast we got our case number....some petitions take forever..oh well every one has their lucky day :dance: :dance:

I don't think having too much supporting evidence is a bad thing. Prevention is better than cure. It is best to have all of your evidence than to have to return for a second interview. Good luck!

I am about to file our I-129F and I noticed some where on this site that after the NOA2 has been received that you should FAX the NOA2 to Embassy (I think along with a letter stating the I-797 received, and a Request to open provisional file).

Can someone please clarify this? I just want to make sure that I know what is needed when we reach this point I know that it is a ways off since i have not submitted anything yet but if I can learn anything to make it go smoother I want to know about it

Colombia? Absolutely recommend being there.. If you read the Counsulate reviews, often times, denials occur if the Petitioner is not there.. There are no specified reasons why those denials actually happen, but many reviews state that they saw many beneficiarys denied that did not have thier significant others with them...

I know what you mean about the costs, but you simply need to plan for it and consider fact that she'll need to do the Lab, Medical and so on, a couple of days before the Interview itself, so expect to arrive about 3-4 days before the interview...

Yes Colombia is her home and Thanks it does make sense to be there, my main issue is just the traveling expense it is difficult for me these days and seems to be getting tougher to do much of anything hopefully lord willing things will be better and I can be there when it happens

I have a question about the I-134 it is my understanding that you need to have verification of employment.

My company uses an online type of verification, you have website to go to and put in your information etc and it returns a status, Is this type of verification information a valid proof of employment or is a letter from the company on company letter head better? I do not know if I can get my company to write such a letter it is a pretty good size company and they provide this type of service so I wanted to know before I go asking them for a letter.

Logic if you can call anything logical with USCIS is at 3/29 you hit 6 months. According to the operator they are working on cases from early September. So the "new" normal 6 months, the website simply has not caught up with this reality. So your case is NOT outside normal processing times. In fact they add thirty days to the 6 months so it would not be ONPT until 4/29 by thier "logic". It looks like they also tack on another 30 days for adjudicative review.

If there is hundreds or thousands of cases filed before you, then the operator is correct it would not be appropriate to issue an expedite request to pull you ahead of those who have been waiting longer.

To break it down to the most simple terms, unless they were processing cases dated say 10-29-2010 then you would be 30 days outside normal processing times.

So not to worry you are getting close to adjudication. Good luck


Their own documentation states that you can request expedited processing when outside of the normal processing times if you don't ask for it you cant get it, if you are following their own rules, then you are just using the system that is what is there for! Do I like it not really, but if I don't use it then it does me no good.
I'm just following their rules, then I'm not jumping ahead of anyone else who has reached the time which puts them ONPT they can do the same.

See if you can follow the logic, this may be a bit log so I apologize in advance

Called USCIS on March 1 after reaching 5 month mark a service request was entered and below is part of the response in the e-mail which took 15 days to receive

" The status of this service request is:

Processing times for specific petitions at the Vermont Service Center (VSC) are provided on the www.uscis.gov website and are updated weekly. Based on fluctuations and variables that impact the processing times and for the purpose of interim or final adjudicative processing, the VSC allows 30 days beyond the posted date before the case is considered "Outside of Normal Processing Time" (ONPT).

An additional 30 days must be allowed for adjudicative review and processing before we can request expeditious processing based on an ONPT request. If the petition is still pending after 30 days, and once we receive your formal request for expeditious processing, your case will be forwarded to the applicable adjudicative unit for expeditious handling."

So Notice that it states "VSC allows 30 days beyond the posted date before the case is considered "Outside of Normal Processing Time" (ONPT)"
Today I hit the 6 month mark which is 30 days past the 5 month approximate processing time

Also notice that it states the second paragraph "An additional 30 days must be allowed for adjudicative review" (Today is 30 days past 5 months )
It also says " before we can request expeditious processing based on an ONPT request" ( So it seems I should be able to ask for expedited processing because I would be ONPT starting today/tomorrow)


So I called and spoke to an agent today and I asked about putting a request to expedite my petition based on ONPT and the agent told me I was not out of the normal processing time and she could not put in the request, She stated that they are processing Sept 11 date to which I asked how I was not out side the Normal Processing time and she kept repeating they are processing Sept 11 date later she said that my petition date would have to have been before Sept 11 to be out side the normal processing time.

So following the logic here it really does not matter when you submit your petition as the USCIS is on time that time is what ever time they are processing it does not matter if the estimated processing time 5 months, you are not past that according to them. So I pushed it a bit and asked for tier 2 officer

I Asked to talk to a Tier 2 officer and went through the above response from them and that I was 30 days past Normal Processing and I wanted to ask for an expedite of my petition based on ONPT

She then tried to go down the path of the other reasons for asking for an expedite and I explained what the previous service request response stated and she said that she would put in the request but doubted it would be expedited and mentioned something about a adjudicator ( also note she did not refuse or deny me the request and actually based on the brief conversation she seemed to not really have any issues with my request once I presented my case and pointed out the beyond the posted date information)
Afterwards I asked if my petition had been assigned to an adjudicator and she said vaguely that she believed it was being worked on

So if you follow the logic no matter when you sent your petition in or received a NOA1 according to the first agent I spoke to you are not out side of normal processing time till they are past the date you received your NOA1 if you go by that logic depending how far behind the USCIS is in processing you could be waiting for any number of months for an approval

I think that I got the expedite request because of the previous response I received which stated about the posted date which I would take it as the NOA1 date which is what I think we all believe to be the start of our wait time

Anyway it was pleasant call both the Agent and Tier 2 officer were very nice, but I didn't leave the call with a great feeling that anything would happen anytime soon.

Nothing like beating a dead line not knowing if the Government will be shutting down later tonight. I was sitting here just after I got home waiting for my fries to be cooked and I get the beloved text at 6:29 pm EST, I was feeling a little down due to not getting approval yet and wondering how long it was going to be and if there is a shutdown what or how we all will be affected anyway we Probably will still be affected at the NVC if there is one but at least we got through the first half.

So I have checked my e-mail and the status and yep it was real status update. We are Approved!!!!! Now on to the NVC
