Decided to post this here as well as in the review area. Sorry it's so long but I hope this helps someone. My US consulate is in Nassau, Bahamas.

 

Since I don't live in Nassau, I flew in the night before my interview. Luckily, my sister lives there so I didn't have to worry about booking a hotel, car etc. In fact, she literally lives right around the corner from the Embassy so I knew the horrible Nassau traffic wouldn't be a problem. Anyway, the week before, my fiancé had FED-Exed my sister (since there's no Fed-Ex locations on the island where I live) a packet filled with the sponsor form, a copy of our K-1 packet, our approval notices, our whats-app chat logs and copies of everything else we thought we might need to further prove our relationship.So when I got to my sister's apartment I was anxious to open the packet and organize it. Upon looking through it, I realized it was perfect EXCEPT she didn't include any new photos from our past year together since filing the K-1. I was so confused because she had PLENTY to choose from since she came to visit me twice in that time. The only pics in there were in the original K-1 petition!! I immediately began freaking OUT and planned to visit a local library the next morning to print out some pics just to ease my mind.Well, the next morning it just didn't happen, my sister was busy with dropping off my niece at school, running some errands etc and by the time we got around in the traffic it was just too late. I decided it was best to be on time for my interview than to have the pics but I was still really nervous about it.  My appointment was set for 10:30am on a Tuesday morning but Ms.Darling (my embassy contact who helped me greatly answering all my questions throughout this experience) advised me to arrive 30mins early for fingerprinting, payment of fees($265) and to turn in required documents (birth certificate, passport sized photos, sponsor guarantee form, and a couple other things I don't remember.) After going through two security checks (in which you have to check in your cellphone) I was told to take a seat and wait for Ms.Darling who came out after about ten mins. It was nice to finally meet her and to put a face to the name on the countless emails LOL. She was really pleasant, took all my docs and told me to have a seat. She also added that the wait would be "a while" today which surprised me because it didn't look terribly full inside but I said okay and found a seat. I was not as nervous as I thought I would be even though I was wishing that my fiancé could've been there but since she's a teacher AND she was having surgery that same week it was impossible. I saw a few people reading, some were talking with the people they brought with them and others were just mindlessly watching the tv in front of us. I decided to do the latter since I was too nervous to do anything else. In the embassy they turn all chairs away from the interview windows so that you can't watch whats going on while other people are being interviewed. In fact, one of the security guards actually came over to one lady and made her physically turn around because I guess she had been looking behind her at the interview windows and that was a no-no. BUT it's not a big room so you can still hear whats going on. As time waned on I heard so many interviews but I didn't hear a single K-1, they were all tourist visas, one student visa or work visas and I realized I was the only one for a fiancé visa which made me slightly uneasy. I heard mostly approvals but a few denials and I just prayed and prayed that everything would go well. The prayer helped settle me but I was starting to wonder why it was taking so long for them to call me because there were people who came in after me who were being called. I didn't know what to make of it and I wondered if it was a bad sign. Finally, TWO HOURS later at about 12:05pm, I heard my name. I went up to the window and saw a really young IO who was obviously new because when I first got there I saw him asking MsDarling a lot of questions. I inwardly groaned and hoped he knew what he was doing but then I thought it could also be an advantage like maybe he'd be easier on me lol. The other thing I noticed was that there was a document in front of him with my fiancé's passport photo attached to it that was stamped with a big red APPROVED. I didn't know if that meant we were approved for the interview or if it was just the approval from the original application. He made take an oath and began asking his questions . I wouldn't say he was friendly or unfriendly . Instead he was very professional and direct. he asked :What's your fiance's name? When/Where was she born? How old is she? When is her birthday? I fumbled on birthday and age like an idiot!! Those two simple questions that I know by heart. But when he asked "when's her birthday" I started to give my own before correcting myself and the same with her age. I inwardly kicked myself and hoped I didn't sabotage myself but he just raised one eyebrow and moved on. What does she do? When/How did you begin dating? Who proposed to whom and when? Where did you buy the ring-which I replied we didn't have rings yet. Then he asked about me; what I do and for how long have I worked there etc. Then he got to the scary part of the interview that I had been so nervous about. He asked me about my brief overstay which I explained to him then he asked when was the last time I was in the US and how long was my last stay. He also asked me to explain my denial of entry last year which I did in a short but honest way.I figure if he wanted more detail he would ask which he didn't. Then he asked again if I had overstayed any other times which I replied no and I worried whether he saw another overstay on my record which I had forgotten about and maybe it looked like I was lying but I was pretty sure there was no more overstays . I just had one from my student visa for a few weeks.He asked if I'd ever been arrested which again was no. Then he held up my sponsor guarantee form and asked, did you complete this form today? I said "no my fiancé did and FEd-exed it to me" to which he replied, "Well she didn't date it" and my heart literally STOPPED! In my head I was like "nooooooooo". He said, "Well I have to call my supervisor and ask if this is okay so give me a sec". So he used the phone attached to the wall and called Ms Darling right in front of me. My stomach was turning over and that 5second convo felt like an hour but in the end she told him it was okay and I breathed a huge sigh of relief. Then he casually told me I was approved and could pick up my visa on Thursday. Inside I jumped over the moon but in reality I just looked at him and said, thank you. He never even looked inside the packet I brought with me that I had been so nervous about. *Shrug* . I guess it's like everyone says, they pretty much know whether or not you will be approved beforehand and the interview is more or less a formality to ensure that you backup everything you said on your application, so he didn't need to see further evidence. I don't know.

Anyway, I then asked if there was anyway I could pick up the visa earlier since my fiancé was having surgery Thursday but he said no. I was slightly disappointed but so happy to be approved that I said, "okay" and practically skipped out of the Embassy to the McDonalds next door where my sister was waiting. She asked how everything went with a worried look on her face because earlier I had told her that it shouldn't take long and if it did it probably meant bad news LOL. So the whole time I was in there for two hours she had been worried about me but I told her I was approved and we celebrated together!!!

Well, They told me to pick up my visa on Thursday at 11am and knowing that my fiancé was having surgery that same morning, I bought my ticket for friday morning thinking even though I would miss the surgery at least I could be there first thing the next day.I arrived, went through security and sat and waited for ms darling. When she called me up to the window I noticed she didn't have my visa in her hand and I got nervous. That's when she told me that there was some system error or failure that had something to do with my fingerprints and the FBI's system and blah, blah blah. Honestly, I was so upset that I don't even really remember what she said. I just remember thinking that maybe they'd found something in my file and decided to revoke my approval or something or wanted to conduct further checks on me. it was nerve wracking. She made me retake my fingerprints but said it still wasn't working. Then I thought, maybe the new IO who conducted my interview did something wrong. Who knows?. In the end she sent me away empty handed which was so devastating. I cancelled my ticket and had to call my fiance's parents (she was out of it so I couldn't speak to her) to tell them I wasnt coming the next day and didn't know when I would be. I went back to the Embassy that friday and the system still wasn't working which meant that I was stuck for the entire weekend. I started frantically searching the internet to see if this had ever happened before and I found some articles saying that it had and that it took a couple weeks to get it fixed, I was in tears that I couldn't be there for my fiancé. Anyway on Monday I called Ms.Darling and she said that "they were working on the system" and that she would call me later on that day. I waited on pins and needles for her to call and she did about an hour later and said it was working and I could pick up my passport that afternoon. I was THRILLED but this time I didn't book my ticket until I had it in hand- I had learned my lesson. LOL. When I got there, Ms.Darling was so sweet and apologetic and she even asked how my fiancé was doing which I thought was nice. She gave me my passport with the visa inside, a large sealed envelope and a HUGE envelope containing my chest X-rays. She explained not to open the sealed envelope and to hand it over to the CBP at the border.When I got home that night I realized I hadn't asked her whether or not I was supposed to give my chest X-rays to the CBP as well. I decided not to and packed them inside my luggage.

Also at my interview, the IO also told me to make sure I gave myself extra time at the airport which I did. My flight was at 845am but I got to the airport at 6am and it was a good thing I did. I checked-in in less than 5mins (during which the agent asked me why I only had a one way ticket so I had to explain that I was in possession of an immigrant visa ,which she confirmed and said okay). When I got to the initial CBP officer, she was a really nice lady who looked at my visa, smiled and said, "oh you're getting married" and I smiled back and said yes. Then she  asked me to follow her to secondary where I sat for an hour and a half! Some other guy was in there with his huge chest x ray envelope and I thought, "Oh no, was I supposed to bring them after all?" but the officer immediately gave them back to him and said he didn't need them. Finally, the CBP officer took my packet from the tray and I saw him going through it. I found myself holding my breath yet again because since it's a sealed envelope I had no control over the contents and just hoped the folks at the embassy assembled it correctly. In fact, in the case of the guy before me with the chest x-rays, they hadn't included his passport photos in his packet and he was so scared but they let him go through anyway. When my name was called the actual thing only took about ten mins, he explained that I had to get married in 90 days and that I should not leave the US until I adjusted my status etc and he was really nice too. I wasn't asked to swear an oath like some other people on this forum said they did. He also told me that he had to keep everything in my envelope and he just passed me my passport back with my I-94 number and Alien registration number written on top of my visa. MAKE SURE THE CBP TAKES YOUR ENVELOPE.DON't ALLOW THEM TO GIVE IT BACK TO YOU, it's for them not you.

By the time I got to my gate they were calling my flight!!!!! So I seriously advise everyone to give themselves a LOT of extra time.

All in all, I have to say I had a good experience with the exception of the system error that was no-one's fault but it was surely inconvenient. I would'nt have cared if my fiancé wasn't in the hospital but hey, that's life and things happen. If not for that I would've given my experience a 5 star review, everyone was very pleasant and professional and the process for the most part was a smooth one!

Sorry this was long but I hope it helps someone who like me wanted to know EVERY detail of everyone's experience who'd gone before me so that I could prepare myself and help calm my nerves.

It's not possible to predict when he may have an interview, it depends on your local office. There is also a good chance he will receive an interview waiver, and just get the green card in the mail. 

 

He can still apply for AP. If he files now he should have it well before December. He should do it ASAP. 

 

 

As stated, you can file for AP now. You may or may not receive it by Xmas, as it's usually a ~90 day turnaround.

 

If you file for it now, complete an I-131, together with a copy of his I-485 NOA showing that his AoS application is still pending, and there will be no filing fee.

 

If you do not do this, or he does not receive his AP by the time of his intended travel, he should not travel. If he leaves without AP or his green card then his application will be deemed to have been automatically abandoned and he will be stranded outside the US.

My husband received his EAD in the mail today, and my question is if anyone knows if it's possible that he'll have his interview for AOS in the next two months? We filed back in August and didn't apply for advance parole because we stupidly thought it would all be done by December, when he has a flight home to visit his mother for the holidays. I'm worried that he may be stuck here until after that if his interview date is after his flight. If anyone knows who I should call specifically with any questions that would be appreciated as well, I'm on hold with the NVC right now but I can never tell if I'm calling the right department.

He came in on a K1, we married and filed at the beginning of August.

My fiancé and I travelled together from Europe to Atlanta one week ago. He came in with ESTA. He had no issues coming through customs. They simply asked what the nature of his trip was and for how long and he responded that he's visiting his fiancée's family for a month over the holidays. Unlike previous trips, they didn't even ask his profession or how much money he'd brought with him. Phew!

We brought lots of documentation just in case but it wasn't necessary for us this time.

I read that the DS-157 is a supplemental form for males between 16-54(?) years old. I think he has to fill it out with the DS-156k.
I got my packet via email and the DS-156k was attached...2-3 days later I got the packet via dom postal service and it didn't have the DS-156k, and the instructions said to fill out that form.
Does your fiancé's instructions also say to fill out DS-156k as well?


I had gotten it by email and the DS156k was attached. With a list of what he has to take. With what he got in the mail it was the ds157. We will take both just in case. Better more information than less.

My fiance received his package yesterday (surprised knowing DR postal system is less than reliable). In the packet they sent a DS 157 to be filled out. Everything I have read on what to do after the NOA2 says this:

This form is required in order to obtain your K1 Visa. It replaces the DS-230, DS-156, and DS-157 forms. Make sure you print a copy (with barcode) for your records.

We only need the DS 156k. Someone that has recently has a cita in DR can you help?

So we received a letter that NVC was forwarding our case to Islamabad with the file number and to fillout DS-160 in August.

 

We have submitted DS-160 online (sep 16th), and created an online account on the portal listed below:

I am a bit confused about the next step?

 

Do we wait for embassy to contact us first with packet 3.5 OR should we go ahead make the fee payment at the Allied  Bank and schedule an interview  appointment at the embassy, via the portal?

 

I have a letter from work and my bank but I am holding off sending it from here since I am not sure how long it will take t o schedule the interview and can get ones dated much closer to the interview?

Yes, you can marry on the VWP. Yes, your wife can submit the I130 petition while you are still visiting. You will however have to return to the UK before the end of the 90 day period to complete the process. You can continue to make visits during the process but you should always carry evidence of your ties to the UK showing that you intend to return at the end of your visit.

They barely looked at the documentation and after the interview they gave him a denial letter stating that because of section 221(g) (citing a paperwork/documentation issue) he is disqualied, and that by the time they send the application back to NVC and then to UCSIS the petition will have expired,....

 

If you can remedy the actual cause of the denial... refiling a new petition would be an ideal way to start!

when i download the packet from newdelhi embassy site they mentioned that Do not schedule your visa 

interview until you receive a letter from the Embassy instructing you to do so.

 

 

Get in touch with the embassy to get that letter sent to you!  Good luck to you.

Good morning, I am sending off my K-1 app today.  Can I send a money order or does it have to be a check? you can send a money order!

 

Also, I have all of my information in a 1/2 binder with each requested information in separate sleeves, is it ok to send fedex that way?  I would keep it a simple!

Binders are actually great  when you go to an interview but not for mailing documents especially to USCIS! When your package gets to the USCIS mail room all the sheets will be removed instantly and the binder discarded! Also, the clear sleeves for each page will just be removed anyway and all could slightly delay processing!  Great work arranging your documents by the way! Good luck to you :)

You will need to send a copy of your NOA2 approval when you file the I-485 .... "I-485 instructions, section "Initial Evidence" specifically 12B. "Based on Admission as the K1 fiance(e) of a U.S. citizen and subsequent marriage to that citizen... Attach a copy of the fiance(e) petition approval notice..."!

 

If you can not find it get in touch with USCIS to order a replacement which should be mailed to the petitioner's address! You can go ahead and proceed with your travel and wedding plans though! Good luck to you!

You don't need to worry about the ds-260 since you are a K1 filer! the DS-160 is fine!

 

A K1 visa is technically classified as a non immigrant visa with an intent to immigrate if the requirements are met! Good luck to you!

The I-129F says complete this question if your fiance is currently in the US.

 

Do they mean the entire question 15? If my fiance is not in the US, do I still need to put her passport number, etc in question 15.e 15.f 15.g and 15.h ?

 

You only complete Qn 15 a-h if you fiance(e) is currently in the United States!

Accepting a co-sponsor for a K-1 is entirely up to the discretion of the CO at the embassy. It could be because your mother is already on hook with an obligation to your uncle and cousin, that the CO thinks two is enough, I'm not accepting another one. They must accept co-sponsors when its a CR-1 or IR-1 visa. But you better look into the household size and income of your mother. She also must add in your uncle and cousin as well as anyone else in the household. You don't want to go get married and apply again depending on her co-sponsorship only to find you forgot to add in two other people that must be counted and she now no longer reaches the 125% required. Is she declaring you and your child on her taxes too? That also could be upping the household count.

 

 

 

But, she wasn't even the primary sponsor, she was just a secondary sponsor just to have on paper that they will not be public charge. They're not even here in ATL, they're in LA. There's only 4 of them that she put on the I-864, that's living in the house. My brother and I just live there, we're independents. My brother barely lives in the house. She doesn't declare me or my child on her taxes.

 

But how come, my stepdad? Since we submitted separate forms for him as a co-sponsor, how come they didn't take him?

Krinamej - are you sure that your mother meets the 125% poverty line for her household count?

 

How much does your mother make?  How many people are in her household count?

Look at the numbers you get and then look at the poverty line on the 2013 I-864p.  Look at the 125% poverty line.

 

 

 

Yes. We checked it. My uncle and cousin was listed on the I-134. She was just a joint sponsor (not even the primary), they live in LA and we're in ATL.

 

My mother makes, $45000+/year and my stepfather makes $41000+. On the I-864, she put herself, my stepdad, and my two siblings and of course, my boyfriend, 'cause that's pretty much all there is to it. My other brother lives with us, but is independent in terms of financially. Well, he barely lives with us.

WOW I am at a lost than. Do they meet the guidelines for current and last year? I know CO's can be picky with this. In Nigeria they deny all the time if co-sponsors didn't meet guidelines last year but are cool currently. Go figure.

 

Can you maybe go to embassy and see if you can talk to a CO and get some clarity? I am sorry..

 

Yes. My mom was even a joint sponsor for my uncle and cousin last year.

 

I'm in America, I'm the petitioner. Besides that, my problem now is the airfare to go back to the Philippines. We've got some covered, but $800 short, and I know for a fact I can't make that within next month. Since, we've decided to just get married. Maybe, if I go there, I will go to the Embassy and ask.

Let me ask your co-sponsors do they meet the 100% guideline or the 125% guideline? I hear that for many they want to see co-sponsors meet 125% and it helps to have not just I-134 but also a I-864 which is a contract and binding. Maybe that will help.

 

We were looking at the 125%, I didn't know there was a 100% guideline? We submitted my mom's and stepdad's, and they both meet the 125% guideline. We also submitted I864's for both of them. I just don't understand. We all put everything out already.

I just had my interview this last Oct 3, I was asked to submit additional documents of my husband, they kept my passport and everything i submitted, they did not give me 221(g) papers, but they only emailed me to submit the documents for them to continue with my visa processing...The interview went well, the consul was very nice, but she just asked for more documents... I dont want to worry about getting denied...thinking positive about it... But part of me is worrying ... any suggestions with my case... thank you in advance..........smile.png

 

Since they kept your passport, that's a good sign. They gave my fiance his passport back. I knew then and there that he's not gonna get it even if we appeal or submit more docs. The consul was apparently a dxck.

 

You'll be fine. Just keep your head up. You'll get it.

If the love is there then don't let the USG decide your fate.

 

Get ahold of the actual denial reason and if it's strictly financial then bolster up your situation and maybe reapply either for K1 or CR1.

 

I'm trying to, but they wouldn't tell me, apparently.

 

My stepfather's boss used to work for Dept of State, and said that if there is another reason why we keep getting refused, we'll never know. They'll just make us apply every time and spend our money for basically nothing.

  Accepting a co sponsor is up to the CO at the time of the interview.  They are supposed to look at the likely hood that the intending immigrant will apply for means tested benefits.  You apparently didn't provide enough proof that they wouldn't   They do not want to be in a position of going after sponsors for repayment.   So the real attitude about finances should be  convince me  I will never need to care how much the sponsor makes

 

Right, but if it is a known fact that they cannot accept co-sponsors, then why are other COs accepting them? If that's the rule, it should apply to everybody. I submitted everything, and extra things to let them know that he will not be a public charge. We have never intended for him to be one. We're not fraud people. We don't try to work the system. The co-sponsors live in the same house, so why wouldn't it concern a CO? But whatever. Thanks, anyway.

That's my one and only issue with this process, there is no hard and fast rule when it comes to the embassy stage.

 

That being said, what I've read on here is that USEM takes cosponsors for K1 when they look at a PETs future earning potential. For example, recent grad, new job, etc

PS: I think they have to look at co sponsor on a Spousal petition.

 

While USEL denied us last year, they could have easily placed my Fiancee on AP and asked me to come in and explain more stuff. They didn't but they do it for others. These things happen.

 

Funny thing is, he is a recent grad. And with electronics technology, that makes about $15/hr, just starting. I'm on the other hand, juggling two jobs, and a kid, have been waiting for him to come so that I can go to school.

 

I don't know if I really wanna go thru this again. It's so frustrating.

Yes, it is possible to be refused without AP.  Manila is well known for not accepting co-sponsors for K1.

 

Everybody tells me that. Since day 1, but how come they are approving people with co-sponsors? If it is a rule, that they cannot accept co-sponsors for K1s, then they should deny or refuse all, not pick people to give refusal/denial to. Makes no sense. It's stupid!

So, I got an email from my fiance's mother this morning saying that I need to call her husband ASAP.

 

I called and I couldn't understand why he was proposing to me that we (my son and I) need to go back home to the Philippines. So I called my fiance's mother and ask. Apparently, they got an email two days ago saying that the visa is refused again, and on the document, the one that is checked is, "You have not established an adequate financial blah blah blah", when I have sent a letter, and pay stubs from my second employer this time around. Included my mother and stepfather's I-864 and I-134, tax papers and pay stubs.

 

My question is, is it even possible for them to refuse the Visa without putting it on AP/AR? Because ever since we submitted more docs, I have been checking the status to see if it has been updated, and on the 15th, it was updated again to Refused, but I thought someone just touched it, not reviewed it.

 

What would be the possible reason why we keep getting refused, when there are others who are getting approved under SS, or no annual income and stuff like that?

 

Since we're refused, it is possible to apply for IR1/CR1 right? But I am really getting discouraged. I don't wanna apply if we're gonna go thru this one more time. The wait is long, the money doesn't just grow on trees. #######?!?!  cray5ol.gif cray5ol.gif  cray5ol.gif

I sent my I129F a couple of weeks before our 2 year mark is up. Haven't heard anything but the Alien Registration Number change. I certainly hope to get approved, not denied. But when I posted a topic, a lot people's response were that I'd be fine, since I filed before our 2 years was up. We still haven't seen each other though, it's very hard.
