When I called the Embassy about mine, they said it usually takes 6 weeks from the moment they receive your forms. It actually ended up taking 5 weeks for mine. Take a look at my timeline for dates.
You should definitely just be patient, they have a lot of forms to get through and yours will come up soon! Try to keep yourself busy while you're waiting, read up on the interview and make sure you have everything prepared smile.png

Hi

 

Can anyone tell me how long I should expect to wait before hearing when my London interview date will be, for K1 visa.

 

I received my packet 3 on May 3rd

 

I returned my forms  to London by special delivery on May 7th - including the DS2001 and cover letter to say that I have all required documents

 

I had my medical on May 10th and I know that the embassy have received the results as they were able to confirm this when I phoned to pay my fee on May 17th, however they were unable to confirm they had received my other paperwork.

 

I am just wondering how long it usually takes to then receive a letter with the interview date? I am a little anxious having already experienced a 6 week delay when USCIS apparently 'mislaid' our file before sending on to NVC!

 

Should I contact the embassy again or keep waiting?

 

Would love to hear from anyone currently going through this stage of the process

Hi, 

my fiance in the States is unable to use internet for the next 2,3 weeks, so it's on me to find out what to prepare for his petition. I've been looking up everything on the USCIS homepage, but still it's pretty confusing comparing those informations with the informations I found on a Do-it-yourself-K1-Visa-Package.

I just wanna know what are the exact first steps to get the forms, any letters or documents together and prepared so I can send that list to my fiance and he can fill out everything and let him send it to the local office in Atlanta.

I just started filling out my G-325A.. My problem now is, that I miss 2 more to fill my adresses in from the last 5 years.. Does anyone knows if I can put 2 street adresses in one field, if they are in the same state/country or what do I need to do????

My fiance is going to have to change jobs and her residence address for family reasons.  We are 3 months into the waiting after receiving our NOA1.  Is this going to cause any problems or delays?  How do I go about notifying the Vermont Service Center or do I need to do this after we get the NOA2?

 

Any help or advice would be greatly appreciated.

If he is denied due to misrepresentation then you can ask the CO if he will give you a waiver form. He may or may not give you a waiver option.

 

The waiver package is a huge undertaking and requires a lot of time, patience and a lawyer to guide you and is very expensive. $4000-$6000 for attorney fees

is common. Then you wait a long time to see if the waiver gets approved. 

 

Your circumstances are quiet serious.

I am hoping with the information that the head pastor provided,and being that he is well respected by the embassy they take that everything that my fiance told them 9-10years ago they now believe him since the head pastor was able to provide these same details to the consulate.

Did your fiance pay the church member for the "papers/forms" ?   Why was the pastor's signature on this letter if he was not involved ?

 

Count yourself lucky if he gets another chance for the interview. They may approve or they may deny at the 2. interview. It is at the discretion of the CO and section chief.

If I were you I would be present at the interview but you must have a very good understanding of what happened. If the CO is on the fence about approval then you being

there just may help.

In cases such as this it is often misrepresentation and denial but you still have that 2. chance.

 

The CO wants to know more about the situation and ask further questions. It is very important for your fiance to be truthful with every detail and not try to 

cover up any facts as they already have a good idea what happened and now want to test your fiance against what they already know.

 

They may want to know more about the guy committing visa fraud with "conference visa promises" and compare what the pastor said to what your fiance will say.
A sticky situation at best.

 

Let us know what happens.

 

No there was no payment involved.  As the head pastor explained to the consulate this particular individual was more like an assistant to him that stole paper work from him. This individual was banned from the church.  It happen when my fiance graduated from high school an entered the school to become a pastor (ps I don't know what they call this school in english, please excuse me) however I am just thankful that the original pastor is still leading the church and was even able to call the embassy to give his recollection of  what happen since it was so long ago. As far as wanting to know more about the guy that information was already provided to the consulate by the head pastor.

212.a.6.c.i has to do with fraud. A denial under this section of the INA means that the alien has been accused of fraud, and determined to be ineligible for any sort of visa to the United States.

 

You are very fortunate that the consulate has decided to grant a second interview. I don't quite understand the whole church conference thing, but I recommend that you obtain any documentation you can that will clear up this situation. They obviously believe your fiance lied about some aspect of the visa application for that conference. If you understand precisely what it is that they believe he lied about then you need to obtain documentation that proves he did not lie. If your fiance fails to convince the CO then the visa will be denied and your petition will be returned to USCIS with a recommendation that the approval be revoked. If that happens then the accusation of fraud will become a fact, as far as the US government is concerned, and your fiance will never be eligible for any visa to the US.

 

Your best chance is to get this cleared up now at the consulate.

 

My husband back then was just studying to become a pastor; in which, he is one now. However the head pastor of the church back then is still the head pastor now and is very well known at the consulate who has spoken out for my fiance which I believe why the consulate gave him the second interview, also the head pastor is also offering proof of documentation that is very helpful as well

My fiance was a vistor of the church in which a member ( that actually work at the church) invisted him to attend a church conference that was to be held in the United State at the time my fiance was only 19 years old. He said he would help him to get a visa to attend the conference with the church and will give him the necessary paperwork to apply for the vistor visa. He believe in what the  church member was telling him being that he was a member for so long and an elderly man in his fifties.  My fiance was never invited to go but he was lead to believe the  papers was ligit, but when the consular verified with the church his name was not there to attend as a guest.  The document  was from the church on the church letter head and had the Pastor signature. I just don't understand why the Consulate request for my fiance to come in and talk when they could have just simply deny the  visa , but according to the embassy the visa was not denied.  And the very same Pastor is willing to speak up for my fiance.

Had interview on 9/7/2012 put on AP. Given white paper given because birth certificate from National Archive D'Haiti not given.  Return registered version of birth certificate two weeks later.  One week later call from Consulate receive to bring passport and pay visa fee.  Check CEAC Website basically every day since interview date. On May 2,2013 status change to refuse. Call DOS and they advise REFUSE UNDER SECTION 212A6C1. In 2004 my fiance applied for a Visitor Visa for church conference. He was given a paper from a church member that was not accurate, but wasn't aware that it was not accurate.  We called the Embassy and asked them about what DOS told us, but we are so confuse because the Embassy is telling us they do not see what DOS is telling us.  They advise to pick up the passport from the Courier service which we did had no visa stamp in it, and that my fiance has a 2nd interview with the Consulate in next month, and told us not to forget to return back with the passport.  Can you please give us your opinion and advice.  P.S. we also found out that today the Church Pastor called the US Embassy who is well known at the embassy and spoke up for my fiance advising the embassy that he was blind sided by one of there old members and this was not the first time that this member has done this.  However the CO request a second interview before the Pastor call.

I would be willing to bet that if was pure accident to quote "Your" post. The person quoting "your" post did say that the wait is 5 months and that is a USCIS estimated timeline for the I-129F.I am pretty sure that the OP would appreciate everybodies experience as to how long they have been waiting to be approved. And to answer your question about Why people keep answering the same question over and over. This is visajourney. We decided to do the spouse visa rather than fiancée because when we started out Trevor was not a USC and LPRs cannot petition for a fiancée. If we had decided to go the fiancé route then we would not have been able to file until the naturalization process was complete so we saved a few months at least. There are other advantages to the spouse visa as well, most significantly (in my opinion) is that you get a Green Card on entry and so can work straight away. There is lots of information on here comparing the two routes - I-129 or I-130.

If he does visit he should bring as much evidence as possible of his intention to return - letter from his employer, rent or mortgage agreement, return ticket etc

It's difficult to know because it's up to the IO you see on the day. When I first decided to come to the US my plan was to come for two or three months at a time - just to be sure it was what I really wanted. I came for 10 weeks between October and Christmas and then returned a month later for a second extended stay. I was asked the usual questions about why I was visiting and I answered them honestly. I was then taken into secondary processing and told that I was obviously not coming as a tourist and so they would let me in that time, but if I wanted to come again I would have to get a visa. At that point of course we hadn't started the process but we got married a few weeks later then filed the I-130 and I went home as planned to wait it out in the UK.

It wouldn't do any harm to your visa application but he could be denied entry.

The first thing is that you would lose the filing fees you have already paid and have to pay again for the new petition.

The K1 visa is generally finished a bit quicker than the IR1/CR1 but it's not a significant difference at the moment. The main advantage of the IR1/CR1 in my opinion is that your spouse would enter as a permanent resident and receive a green card immediately so he would be able to work straight away and travel abroad if necessary. With the K1 you would need to marry within 90 days of his arrival and then file for AOS with another hefty fee.

Probably not but there's no harm in sending - but again, just a selection that covers a period of time - not the lot! I know that I did a different process, but all we sent with the original petition apart from the required civil documents was three affidavits. I had a lot more ready for the interview but didn't even get to take it out of my bag.

I didn't do K1 bit I still think you are probably sending way too much for a UK petition. You can bet your life they are not going to look at it all, so you might be better trying to rationalize it - send a range of different types of evidence that covers the period of your relationship rather than very single piece of evidence you have. Save some for the interview - even though London won't ask for it.

I had a similar experience. I visited my boyfriend for 9 weeks between October and December 2010. We got engaged during this trip. I returned to the UK for a month over Christmas and then returned to the US mid-January with a return flight booked for early April. I was taken into secondary processing and although they were polite with me it was not a pleasant experience. The place was full of people who were clearly not being admitted and many of them were distressed and struggling with the language. Nobody knew what was happening and they kept going up to the desk to ask questions and the officers shouted at them to sit down. When my turn came to be interviewed (after about an hour and a half, 2am UK time, and with Trevor waiting in arrivals with no idea where I was) I was in a state of complete panic that they would send me home. The officer asked me about my intentions and I was completely honest and told them I was visiting my fiancé and that we intended to get married eventually. He asked me why I hadn't got a return ticket but I showed him my confirmation and he then said that I would be admitted this time but that I would not be admitted again under the VWP and would need to get an appropriate visa.

Trevor and I then decided to get married while I was there, we then filed the I-130 and I returned home as planned. I did not dare try to visit again while the process was underway but I received my visa in under 8 months so that was pretty quick. At my interview the officer seemed to think I had been refused entry in January 2011 so she obviously had access to those records (she seemed confused as to how I could have got married in the US) but I explained what had happened and I don't believe it would have been an issue even if I had been refused.
