Well, I am older than him by 10.5 years :/ 
I read someone elses post on here who had a similar age difference with her fiance, but others comments seemed to reflect that it wasn't a big issue being that AU is not a high fraud country and that such age differences in AU are not frowned upon..
We have been "online dating" for 15 months, met in person twice in that time, once as friends because of our age difference, the second time as a couple, where we spent the entire VWP length together..
The attorney said that these would raise suspicion and we should hire an attorney to handle such a "complicated case" :/

We do have financial support from family and friends until such a time that he, we, or I get employment. It's just that those who will be looking after us until we have sorted our visa/employment out, don't earn enough based on the guidelines (most of what they earn are "tips") although they live comfortably and supported me while I was there for my VWP stay. They also don't really want to sponsor me as they have issues with the current US government, LOL.. but anyways.. I have that covered as I said :)

So basically, as long as we can prove our relationship is genuine and ongoing, which we have no problems with doing, and as long as I have co-sponsors, which I have at least 3 US citizen friends who are ready and willing to be, there should be no problems for our application being approved?
Would I be required to live with one of the co-sponsors, or is it fine for me to live with my fiance? He IS looking for work, but he lives in a very small town. I have no intention of remaining unemployed once we're married.. I don't care what I have to do, even if its flipping burgers or cleaning toilets, its better than nothing.

Even though the attorney "advised" to enter and marry, then AOS, its not something I would be willing to risk. I want to do this the right way.

I have done a lot of reading through these forums, and over the internet in general, watched many youtube videos.. but I know the best thing to do is to ask those who have been, or are going through this currently.. can you explain the process please, if you had to have interviews before it was granted, problems that came up?
I've read that you can not have co-sponsors with the K1 visa, which means that my fiance and myself are basically screwed.. he does not work, he graduated last year and hasnt been doing much of anything... but we have many people who are willing and ready to co-sponsor me. 
The other drama is, I do not work. There are valid reasons as to why, but I've been told that this is an issue, too.
I spoke to an attorney who "advised" me to come to the US, get married after the 60 days, and file for AOS as there is a lot less drama, and a lot less reason for immigration to refuse the petition. Is this true? I know its the wrong thing to do, but I feel like all of our hopes and dreams will never happen based on the information I've been given.
If we go the K1 route, and we hire an attorney to help, will that work out better for us?

Yes he does need police cert from both country's because he was over the age if 16 when he moved to Italy. Yes he also need one from Albania. As for where to get it done i opulent tell you you may want to check the Albanian and Italian threads. The birth certificate is fine.

I'm on cloud nine, decided to call again and sure enough NVC has received the case as of today. He said turn around time is really quick. Now what?? Hurry up and wait, trying to have Klaus on the flight 9/14 which we already booked. 

 

 

Question:  I sent over Tax returns and Tax transcripts for the past 3 years, 401k recent statement, paystubs and a document that I am employed 32 hours a week as a registered nurse (not signed by management, just my profile from HR).  My last Tax return my income was about $87,000, do you think I need to send bank statements or should all of that be ok?

Yes, possibly.  It looks like you are desperate to get the the US: 5 visa denials, and then you find a US person to marry.  That presumption can be overcome with extra proof of a bona fide relationship.

harpa is right it does look suspicious 5 times is a lot. One or two maybe acceptable. Hopefully you have enough evidence of a bona fide relationship to convince them.

Do you have receipts or credit card statements of places you have been paid by card by both of you? Any restaurants hotels etc. Something that shows proof that you were in the country the dates your ticket stubs say.
Make sure pictures are dated digitally or you write the dates at the back of the picture and say who's in the picture and where you were at the time.

I am not "bashing" her.  I am wishing her and her fiance the best of luck.  I honestly hope that they will live happily ever after.  Don't you?  And sometimes pointing out the obvious, even if it is negative in nature can be helpful.  For example when a parent tells their toddler, "Don't put that fork in that electric socket."  Or if a parent warns of the danger of playing in the street.... I could go on and on but I want to focus on the OP here whom I hope lives in peaceful harmony forever with her future husband.  I am 100% serious about that.

In one way if my fiancé happened to be here in the states and didn't tell me about a marriage then I don't think it would be this big of a deal. But that's just me.
I assumed that his baby momma was the only relationship he had that was taken to a more serious level. I've noticed that most of the people I've met or know in VN don't talk about their past much. And I know that the only reason why my fiancé informed me about his baby momma is because of his daughter.

I would assumed if he was to hide anything towards me initially it would be his daughter more than a previous marriage. But that's just my thinking.

LND is the case number prefix for the London embassy. It is issued by NVC once an approved petition is received and logged there. Most people find theirs out by calling NVC a week or two after they receive their NOA2 (and then continuing to call until they get their case number).

Of course, if you are not going through London your prefix will be different.

I don't know the answer, but I'm suspecting you can't do this.

I would suggest you consider doing a civil wedding in the US and waiting until green card to do a ceremony on the cruise ship. We are doing a similar thing for our wedding in the Philippines. We are doing a Civil wedding here then after she gets green card we are going to have a ceremony in the Philippines.

I you do find out the correct answer please update us. I am curious about this.

Hi, I am from South Korea, and also working on K-1 visa.

My fiance is going to graduate school in Aug. Even though he is working as a teaching assistant, but his mother decided to be a co-sponsor.

 

When your fiance has an interview in Seoul, he has to have your I-134, and also your mother's I-134, too! When there is another sponsor, the person must fill out I-134. 

Also when your fiance has an interview and submit I-134 forms, your tax record, your balance in your bank account, and if possible, your mother's letter stating that she would be a co-sponsor should be added.

I think your fiance should explain the plan that he would be a provider after marriage, and show some evidence for that like his balance in his account, tax record like that. 

 

I heard some people were rejected for this matter, so the consulates in South Korea consider that part, too.

 

I think writing future son-in-law would be okay. 

 

I hope It could be helpful to you a little.

Even though he earn some money (more than $2,200 a month), but my fiance's mother would be a co-sponsor just in case. 

I asked a petitioner who already had gotten K-1 visa the same question a few months ago, and he said it is okay.

Yikes I hope it works for you, seems to have a few red flags that might cause problems. With a child that would make it tougher if you got denied. If I were you I'd contact a congress person and try to get a letter to help with an expedite. If you have proof you are about to get hired with homeland security I think that would only help. I would have done an expedite if I was in your shoes.


Apparently, I can't give them anything about my pending interview and everything with DHS, but can't they just look it up? What red flags do you see that may cause problems?

Manila does accept co-sponsors for K-1 visa, but it is on a case-by-case basis. Some get rejected, some get approved. I believe those being approved have had parents or close family member co-sponsor, but even then it is likely situation dependent. Make sure you have all your ducks in a row.

My uncle had asked my mom to co-sponsor them. My mom was the primary sponsor, and my aunt was the secondary sponsor. So if I use my mom, it wouldn't be a problem? I still don't even have my NOA1 yet, but I am really hoping and praying for the best. Thank you so much for your help! :D

I read something that if you're young, in school or just graduated, they will let you file with the co-sponsor. I'm planning to go to school in the fall, so if I do, they would take it right? I mean, I'm not really worried about that for the mean time, I'm worried about getting approved or not. Thanks for the info though, so I can prepare myself. :)

Sorry for jumping in, but this is actually wrong. It is not true that you must have known each other for at least two years. A lot of people on here file and get approved having known each other less than two years. The only requirement for the USCIS stage is that (no matter for how long you have known each other), you must have MET at least once within the last two years.

As for the OP, I think you will be fine since you have met within the two-year period. Good luck!


No, it's fine. I am actually trying to see how many people would reply with the same thing, cause that would determine what's correct. I have encountered one that have known each other for like a year and a half, and they had filed and got approved, so I get what you're saying. Well, thank you so much. Hello,
The requirement only stated that you guys have to know yourself for at least 2years before filling and since you both have a child together I you have know each other for a long time. The requirement also state you guys should have meet in person at least once before filling and you have done that too. You will be fine, nothing to worry yourself about. Your NOA1 should arrived in the mail one week from the date USCIS receive your application maybe two weeks the most. GOODLUCK!!!

No, but I have a pending job with Dept of Homeland Security. They said that while the sequester is still going on, I'll be put in to the I think they said, "Ready pool" o "Job pool"? Something like that. And my mom's friend said that as long as I have a co-sponsor I'll be fine? I'm so confused right now.

I just sent my fiance I-129F last week, and on April 3, 2013 we will hit our two year mark that we haven't seen each other. I can't visit him in the Philippines because of the fact that I am working a part time job, and if I leave, I will lose my job. I can't risk losing my job, because we have a kid together that I'm taking care of and providing to. I am the only one providing for our child because he doesn't have a job and is just graduating from college (& yes we're young, we're both only 19 y/o).

I know I should've asked this before I sent the petition in, but WILL THE PETITION GET DENIED because of the fact that we haven't seen each other? I didn't know what else to put on the I-129F Supplement, because I really can't leave my job and I'm barely making enough money for a month, I haven't even gotten passports yet, but I sent in my old ticket and receipt from when I flew back here, since I used to live in the Philippines. I also forgot to attach the form for Electronic Notification, but they have received my packet, so how long will it take til I get back the receipt or the NOA1?
