K-1 Fiance(e) Visa Process & ProceduresI had enough with the petitioner, i want to cancel the petition (merged)

I am just wondering why you refer to him as just "petitioner" instead of fiance or bf. Im sorry to say this but it sounds to me as if there is no feeling at all but I might be wrong that is why I said sorry.

On the other hand, I thinks some of VJers will agree with me that during the course of paper preparations there are always arguments and delays considering of time difference plus the work that your "petitioner" have. Doing one job is tough what more having two thats even tough. That means he has only few minutes for himself and all he wants to do once home is to eat and sleep ( my husband is like that and he only has 1 job) much more to do paper works. Plus since he works two job that means he needs to find time off to go to federal offices on work days to request the needed papers which is very hard to do. (you  will understand what I am saying once you are here). I understand your situation, yes it will be stressful sometimes but be patient. It really takes time.

My husband hired lawyers to do all the paper preparation but we were still the one will secure paper proof they needed and it is stressful but we did it successfully. Others dont have lawyers and they did well in the end. Patience and endurance is needed here. Remember Love choose no boundaries.

DOnt be too hard on him. You need more patience. In a relationship you need that. Instead of thinking  it as a stressful journey, think of it as just one hurdle that you both need to undergo because Im pretty sure there will be more :-) (thats my unsolicited advice)

K-1 Fiance(e) Visa Process & ProceduresEntering Atlanta POE on a K1

Hi Kev-N-Ann

ATL is my POE on a K-1 visa last Nov 7, 2013. Once you exited from the plane there are guide signs where to go. First to the immigration area to process your passport and other papers. If you are confuse ask, there are many airport staffs that will help you find your way. Enter to the tourist/non-citizen area and fall in line (again ask if you are not sure). Once in line hold your folder and passport so the staff can identify you as K1 visa holder and guide you to appropriate line. It depends on the Immigration officer this time if he will ask you questions and process your finger prints or not. One finace ahead of me was ask many questions but no finger print taken by the immigration officer in booth where we fall in line before she was ushered to the immigration officers who will process the K visa (check papers and enter it into the system). Me on the other hand was only asked if its my first time to be in US (it was my 7th trip already) so he asked me to put my right four fingers and took my picture before ushering me to the same immigration officers where the other lady was already waiting (there were 2 officers in the booth that time). While waiting she was called for finger printing and ask some questions and told to take sit and wait again. I was called and ask if we set date for wedding already (which I answered yes, and gave him date and the name of church were we will have the wedding; we set to get married in Catholic church we did the preparation already while still processing the K1 visa). He gave me a piece of paper that I need to read (basically this contains instructions what we need to do) and I'm done and told to go pick my luggage. I was done before the lady ahead of me. As I said earlier it will really depends on the officer processing your papers. After you get your luggage you will go to exit where a custom officer is waiting. depending on what stuff you have with you. My previous trips I was told to exit right away, this time I was told to pass through another xray machine because I was carry some food from my country. They just check if it fresh (which you are not allowed to bring; there are some processed ingredients that are not allowed too). They allowed all my stuffs to enter. Then off to exit already. Total it took me 30mins only.

I hope this will help. Don't worry they are nice. Have a safe trip

K-1 Fiance(e) Visa Process & ProceduresK1 Interview Paperwork (London Embassy)

Hello All,

Just a quick question. I am currently in my final stage of the visa process. My medical is booked for early January and I have sent off my Readiness Form. I have all of the documents that have been stated on the Packet 3 form, but it doesn't mention if I need to take my I-129F packet or evidence of an on going relationship. I have my I-134 form. I know the interview process has been altered recently. Does anyone know what to take and if I need it?

Thank you for any help.

K-1 Fiance(e) Visa Process & ProceduresIncome Tax Returns Question (London Embassy)

My partner thought they had the right tax info but now we are unsure. Does anyone know what Tax Income forms we need to take to the embassy. We have a Affidavit of Support form, 4 pay slips, a letter from her boss stating how much she earns and a bank statement showing savings. What else do we need to obtain?

Thank you

Sorry I seem to have asked a fair few questions over the past couple of days but I am just getting close to my final process and I want to check I have everything in order.

I took part in a J1 visa from September 2011 until August 2012. I didn't stay over my visa time limit. I am now applying for a K1 visa. Will my J1 affect me? I never even thought about it.

Thank you

K-1 Fiance(e) Visa Process & Proceduresi-134 and Tax Returns (London Embassy)

My interview is on Monday and my fiancee filled out the i-134 form and it all looks good. The supporting evidence that we have is a letter off her employer which states her wage and how long she has been employed with the company however it doesn't state if it's permanent or not. We have her current tax form however this has her Parents address on as she lived there for a month between rentals as well as her 3 wage slips. Do you think this will be ok? I am hoping they don't ask to see any supporting evidence but if they do will the letter be my best option?

Thank you

K-1 Fiance(e) Visa Process & ProceduresPassport - expires Nov 2015

Since I can't edit my previously, prematurely posted comment:

If it's easy for your to renew your passport while still at home, why not do it? You could save USD6! Fantastic. wink.png

I'll answer my own question. Why not? One reason could be that you intend to change your name after marriage and if you can wait until after marriage to renew, it can be done with the name change. If that's not the case, there doesn't seem to be a reason to wait.

I personally just renewed my US Passport (I live abroad) to ensure that I'll be allowed back into Europe after my holiday trip home this Dec/Jan. It expires in June 2014, and that left less than 6 months validity from my arrival date. Maybe it wouldn't have mattered, but I like to be (over)prepared!

Maybe consider when you'll be using the visa? And judge from there.

Assuming you hold an Australian passport, below are notes for renewal in the US:

*Adult renewal (including name change):     Lodge by mail or in person - If you are renewing an adult passport that was issued after 20/08/1986 with an original validity of two or more years, you may lodge either by post or in person. It does not matter if your passport is expired. The passport can be renewed before or after it expires.  Price: USD224.

Note: If your previous passport was issued to you as a child, you must lodge in person.

K-1 Fiance(e) Visa Process & Proceduresfinalizing I-129F

I also only sent black and white copies.

Additionally, I labeled pages with post it notes -- identifying the document and indicating which date and location each referred to. I also identified dates and locations/trips relating to passport stamps (some stamps were on top of others, so I tried to facilitate easy navigation). I didn't highlight since I figured the post-it is informative but allows the CO to view the unaltered document.

And I did not include the blank pages of my or my fiance's visa.

K-1 Fiance(e) Visa Process & ProceduresCan I apply for K1 while abroad? Please help!

I filed my petition while living abroad (I am a USC living in my fiance's country). The petition has been approved and we are waiting to hear from NVC/Consulate.

If you are already planning a trip to the UK in the near future then I think it makes sense to file it from abroad. You will need your fiance's original signatures on the G325 and Letter of Intent and this gives you the opportunity to get them.

If you do this, consider the documents you will need for I-134 (tax transcripts, letter from employer, letter from bank, and co-sponsor's (if you need one) I-134 and supporting documents). You could order and prepare all those documents before you travel so that your partner will have them for the interview. They can also be sent later but the I-134 will require original signatures from you and your co-sponsor (if you have one).

If you enter UK after your file and state that you are there to visit your best friend, you are not telling the whole truth (since you have filed a petition with the US Gov't for a fiance visa), Lying is not suggested and lying to gain entry could lead to a ban.

Perhaps read in the UK forum about entry before and after K1, or with regard to relationship status (boy/girl-friend, fiance(e), spouse).

K-1 Fiance(e) Visa Process & ProceduresLegal Name
If it's really an issue you have three(?) choices it seems.

1) Correct the name on your passport:
http://travel.state....correction.html

OR

2) Amend the name on your birth certificate.
The process, speed, ease and cost of this varies by state.

OR

3) Get an official name change to reflect name in passport.
(Could potentially create an issue if anyone reviewing it sees the discrepancy in dates.)
Also varies by state.

*4) Do nothing. Chance it.

Option 1 seems like the most legitimate correction. But what about the name on your SSCard or driver's license? Which name do they follow? Making all your identification documents match makes life easier in general. And by life I mean dealing with bureaucracy and red tape.

Before you cancel anything..Sit down with your fiance and try to figure out where his head is at.

If he is not willing to go the extra mile in completing the process or of thinking of developing himself,

Then you know should make a decision to stay with him or let him go and find someone who will make you their world..who would not want you to be stressed or frustrated...

You will end up being the breadwinner, Take care lady.

Hello fellow VJ members,

Expiration date is JUL 4 2014. I have to write my final semester exams in June. I plan on entering the US on June 20 2014. You need original signatures on the letter of intent and G-325A. He needs to mail those to you.

Thanks for responding. This is all I need from him now to include correct? Besides the picture for the G-325A. He is mailing what I need tomorrow. Just want to make sure I get everything I need from him in one package.

Thanks again!

K-1 Fiance(e) Visa Process & ProceduresStarting the process
Hello everyone....

Very thankful I found this site. It has been helpful, but so many questions still.

My fiance is in the Dominican Republic and I am starting the process to petition for him. I am gathering everything together but any suggestions on what to do, include etc to make the process easier?

Questions I can not find a clear answer on are:
Fiance intent letter? Original signatures? My fiance emailed a scanned copy of his is this accepted?
325a? Same question....original signature? He scanned that one as well.
34a supplemental question...what is too much or too little. Do they want a timeline or a conversational explanation?

I have pics, proof of visit (just got back Wednesday :( ), conversations, emails, phone cards, etc. I think we are good there.

Any and all advise is appreciated....anything specific to DR is a plus.

Thank you so much!

Passport stamps (both entry and exit) should be included.  If you have include pictures you took with his family.  You can send emails and any other conversation records you have.

There is a calling card called Boss Revolution, the have an app for smart phones you can use to call and refill your account.  You are able to print the record of when you refill as well as your call records.  That is what I use to call my fiancee in DR.

Best of luck!

It was already answered in this thread what to do. They are now automated and you get your I-94 online now. They no longer staple a paper one in your passport. This site is where you get your I-94 info after entering > https://i94.cbp.dhs....94/request.html

K-1 Fiance(e) Visa Process & ProceduresI-94 Question!!?

Hi everyone,

I'm sort of panicking a bit... I've just looked up some information that I need for drivers license and for AOS etc... and the I-94 is something that appears everywhere, but it doesn't look like I have one? When I came through POE, I handed over my sealed envelope, gave my fingerprints, handed in my customs form, have the photo taken with the webcam-looking thing, and then the officer stamped my passport and wrote in it. The whole process took around 5 minutes...

Should I have received an I-94? Does my stamped passport with the VISA inside count as the same thing? As far as I can tell, the I-94 is to state admittance with an expiry date, and that is evident on the stamp in my passport.

Any help would be appreciated!

Thanks,

David

I have my I-94 in my front right now, it is the small paper from the plane that u need to fill up before you go through the immigration.. they attached that to your passport nxt to your visa..

Just for shear sanity, i did give the hotline a call today and they sent the photo's back as they didn't them. It was just a generic letter they sent. the processor looked at my record and i passed the proof of evidence (he said it was checked off) if that really means anything.  so i now have additional pictures for my lovely fiance to show at the interview someday soon i hope :D

I just wanted to pass along to the other worry warts like myself :)  In case it happens to them.

I included all the flight information, passport showing entry and exit etc.... each picture was a 4x6 with Names, location, and time.   the pictures were in a baggy paperclipped to a blank sheet of paper and also included in the enclosure document.

I followed the instructions from the guide to every detail.   If all the other information is fine then great.  Just threw me off that my pictures were returned for whatever reason.  I would hate to have an RFE stating i needed more proof that we met within 2 years, when the only thing i have left to prove it, is the pictures, which they wouldn't accept.

I followed the guide, placed (5) 4x6 color photos, with dates, Names and locations on the back of photo and placed them in a baggie.  The return letter said they cannot accept photo format and cannot place this format in your file folder for review by an officer during the adjudication process.

I will call the number they gave me on Monday, but their website states its an acceptable format.  so I am boggled.

K-1 Fiance(e) Visa Process & ProceduresCan someone please explain this process to me, your own experiences?

Well, I am older than him by 10.5 years :/
I read someone elses post on here who had a similar age difference with her fiance, but others comments seemed to reflect that it wasn't a big issue being that AU is not a high fraud country and that such age differences in AU are not frowned upon..
We have been "online dating" for 15 months, met in person twice in that time, once as friends because of our age difference, the second time as a couple, where we spent the entire VWP length together..
The attorney said that these would raise suspicion and we should hire an attorney to handle such a "complicated case" :/

We do have financial support from family and friends until such a time that he, we, or I get employment. It's just that those who will be looking after us until we have sorted our visa/employment out, don't earn enough based on the guidelines (most of what they earn are "tips") although they live comfortably and supported me while I was there for my VWP stay. They also don't really want to sponsor me as they have issues with the current US government, LOL.. but anyways.. I have that covered as I said :)
