this is true. my wife just had her interview last Wednesday, Nov 2nd. they asked less than 8 questions building up to my trips there and when and where we got married. she simply showed the consul our pictures - about 12 in all, the consul looked through them and when she saw pictures of our wedding she said "congratulations, have a happy trip" and approved my wife's visa. so i think, if you applying for a CR1 or IR1 visa, and you have good collection of evidence in pictures then the interview is very easy. my two cents.

Ours said that until yesterday (since 04/01) but now it says Request for Evidence Response Review.

awww...so we are almost in the same boat i think...but i a worried because we havent even received a confirmation leter from them saying they received our documents !!! i thought they process us citizen spouse petitions faster...keeping my fingers crossed...they said they wud be able to say something only after 30 days wen we phoned them two ays back...so gonna wait for two more weeks..hopefully something will happen..for BOTH of us !!


He got an email yesterday to say that they have received the RFE response and they have also updated his status on the website. They say we should now hear something within 60 days!! Hopefully it won't be anywhere near that long. I hope you hear something soon too.

Trevor got his naturalisation on 8 July and phoned them the same day to upgrade the petition. They didn't ask him to send anything in at that time but when he phoned a few days later to see if the upgrade had been applied they told him they had put in a service request but it would take 30 days. He received a letter a few days later confirming that the service request had been made then on 25th July he received an RFE requesting a copy of his naturalisation certificate. He sent that straight back so we are hoping we will see some activity soon. I hope it won't be long for you now either.

When we filed the I-130 the only evidence we sent was three affidavits from people who knew us. We got our NOA2 with no RFEs (apart from the naturalisation certificate). We will have much more for the visa interview but at that time we were (and still are) living on separate continents so we hadn't been able to co-mingle our finances. We have been working on that since we filed.

USCIS will figure it out which class you are belonging to...
IR1 stands for Immediate Relative type.
If you married to the same person for more than 2 years when you get interviewed, it will be considered as IR-1 and they will give permanent resident card (I-551) with 10 year validity.
If you married with less than 2 years for same person when you get interviewed, they will issue Conditional permanent resident card with 2 year validity marked as CR-1.

Are you sure NVC "completed" the case? I expect USCIS approved the petition and sent it to NVC where it now awaits payment of the AOS fee, IV fee, affidavit of support, visa application and civil documents. If all that has been done already, then September or October is possible. If not, probably looking at November if the NVC process is managed efficiently by the petitioner.

IR1 is a permanent resident category and a visa category, not citizenship.


Yes, I am sure that the NVC completed the case. The petitioner has paid all of the fees, submitted affidavit of support, send marriage certificate, etc. I noted IR-1 because the petitioner and beneficiary have been married for five years. Please see below.

Thanks for replying Singhisking. The case was completed at NVC on December 16, 2010. Since she was a LPR at the time, the case couldn't be forwarded to the Embassy in Jamaica. In other words, her husband had to wait for a visa to become available. Since she is now a US citizen, hopefully, her husband should not have to wait much longer.

My friend's IR-1 petition was completed on December 16, 2010. She just became a citizen yesterday. Other than sending a letter to upgrade F2A to IR-1 along with a copy of naturalization, what else does she need? Does any one have any experience with Kingston, Jamaica? My wife passed her interview.. It was like 10 minutes.. They didn't want to see any documents. They ask only few questions..

1. Where ex husband lives?
2. Why 19 year old son not go America now?
3. Where you meet husband?
4. What you love about husband??
5. Your husband understand your english?

LOL wife tried showing all her picture album, interviewer just nod and grin.
They finally tell her you have your visa and my wife was still trying to show more pictures etc..

They took passport and it will take 8-10 for her to receive visa and documents from DHL..

I'm glad that you have positive outlook, but maybe you don't realize that this could take up to 2 years? It is urgent that your fiancee get her congressman involved. Send him/her all the evidence including the plans for your formal engaement. You may still be able to stop them from sending back your case file. Also have her call the Embassy herself and ask to speak to the director of consular affairs and make her case. The more noise she makes, the more likely that you can handle this now. If they kept your passport, than it may be in Administrative Review and you have a better chance at a second interview. Good luck.

They did not require us to call to schedule through the automated system or to pay the customary fees, the vice-consul emailed me and said that she personally placed us on the list!!! THIS IS UNBELIEVABLE!!!

I just got home from visiting my husband in Colombia last night (6/17/07) and of course, today I'm sitting at work completely bummed out because although we had a wonderful time together, everytime someone asks me how my trip was I want to say "TERRIBLE!! I'm here and he's there and we don't know when he's coming!!!" It takes all my strenght not to cry everytime.

Well....my cell phone rings..ID UNAVAILABLE...I'm so busy that I hesitate to answer b/c its probably a bill collector (ha ha ha), but I think, sometimes when the hubby calls it says the same thing...so I answered......

"This is the vice-consul from the US Embassy in Bogota..." I almost fell out of my chair! "We have your husband's application under administrative review and want to offer you another opportunity to interview in Bogota" The lady is as nice and polite as she can be, she tells me that the police certificate and medical are all valid and that she only needs me to send her an updated I-864 with this year's tax return and how SOON DO YOU WANT THE INTERVEIW? (YESTERDAY) She says that the embassy understands that long distance relationships are difficult and that they have to be very carefull about situtations with marriage fraud (she was almost apologizing to me)...then she says to me...."do you remember that I was the one that interviewed you and your husband in Februrary?" I SURE DID! So with that I started to explain away some of the concerns she raised at the interveiw and she said "lets not revisit the interview, I'm going to give you the opporutnity to have another interview with another officer and to provide more evidence" I told her that I just got home from Colombia last night and she said "that's great! that will be very beneficial to proving the validity of your marriage"

I don't know if this was prompted by my constant pestering of my congressman, incestant prayers to the Almighty or what, but I thank God first for this unbelievable turn of events and secondly to the support from the VJ community!

I have a meeting with my boss today to formally request the time off (I'm out of vacation days and just got home yesterday!) and as soon as I get the OK at work I'm emailing her with my availability for the appointment!!!!!!! It looks like we can have an interview in less than a month!!!

Hi there. Sorry I've been out of touch so long. As of today, I've recieved a resonse for each of our FOIA requests (4 in total, I sent 2 each for my husband and myself, just in case they want to say that the information is his or mine). The letter states they have recieved my FOIA petition and will contact me once they have located the documents. Very standard. In the mean time, I'm planning to visit my husband for 10 days in JUNE!!! I can't wait!!! and we are documenting everything. We've gathered letters from our parents, siblings, aunts, uncles, cousins and close friends. After my trip in June, I plan to send my first batch of 'additional' evidence to the NVC Fraud Unit and the CA service center. I'm expecting that between June and August, I should recieve the NOIR letter and I WILL BE READY!!!! My spritits are high, I'm focusing on the positive, using my time effectively and being as proactive as I can. I haven't heard a thing from NVC or DHS concerning our petition, but I'm going to ask the Congressial assistant to ask for the Consular Pouch today!! I wanted to share the latest response from the Vice-Consul in Bogota, Colombia concerning my husband's K3 visa. As some may remember from a previous post, the visa was denied on the basis of a Labor Certification and below is the consul's response:

This petition is being returned per INA 212(A)(5)(a) 9 FAM 41.81 N6.5. The
consular officer finds that the spousal relationship is not bona fide, but
rather entered into solely for immigration purposes. This category of refusal
is used for immigrant visa applicants who are not determined to be eligible for
the immigrant visa category for which they have applied.

As a result, the petition is being returned to U.S. Citizenship and Immigration
Services (USCIS) at the Department of Homeland Security (DHS). A memo will
accompany the returned petition outlining the consular officer's reasons for
returning the petition.

DHS will provide the petitioner with a copy of this memo. The petitioner is welcome to
file a FOIA request, but DHS will already provide her with a copy of this memo
as soon as it receives the case.

As I stated previously, the decision of the consular officer is not final,
however. A decision to revoke a petition, or to return it to the U.S. Embassy
for continued processing, rests with DHS.

If the petitioner wishes to pursue his application for a fiancée visa, she or he
should contact his or her local USCIS office for further consideration.

I hope your constituent finds this information useful. If I can be of further
assistance, please do not hesitate to contact me.

Kiya, I was with him at his last inteview and the consular officer gave me a form with a bunch of statutes and circled the same one she referenced to the congressioanl aid. I looked it up yesterday and its pertaining to a Labor Certificate. I think this merits a call to a lawyer. I'll definityly get in touch with EI by tomorrow and get his take on it. By the way, I forgot to thank you for his contact info. I'll keep you posted.
