Just to let you know, we did the spouse visa and went from filing to visa in hand in just over 7 months so it can be a pretty quick process. I would certainly recommend it for the very reason you are considering it - having the ability to work (or at least seek work) as soon as you arrive.

Also, the only evidence we submitted (apart from our marriage certificate of course) was three affidavits from people who knew us as a couple.

You have way way too much. I don't know which country the beneficiary is from and if they are from a high fraud country you may need to front load somewhat, but generally at this stage you just need to establish that there is a petitionable relationship - i.e. that you are actually married. So you should be aiming to send a fraction of what you have - a much smaller number of photos taken over a period of time with different people, ideally other family members, and a sample of chat logs covering a period of time. You can take the rest to the interview if you like.

And however you organize it, the first thing the USCIS mailroom will do is take it apart and reorganize it in the way they want it so I wouldn't fret too much about it.

Others who are more knowledgeable will hopefully chip in but it is my understanding that the K3 is effectively obsolete. It was used when the I-130 was taking significantly longer to process than the I-129 but that is no longer the case. Nowadays there is not a lot of difference between the two.

As I said, there is no rule that you cannot visit while the I-130 is being processed and many people on here have done so without an issue. There are just no guarantees that you will be admitted and you may have to convince a CO that she does not intend to stay. The very fact that you are in the process may in fact help because it shows that you are going about things the legal way so it will be worth having your NOA1/2 with you. The return ticket will also help of course.
You will probably have five or six months to wait for your NOA2, after that things will move faster but that is when she will need to be at home for the medical. Once she has her interview you will be almost there as all being well the visa will be issued straight after that.

Congratulations on your forthcoming marriage.

Your wife can travel to the US to visit on the VWP but it is at the discretion of the CBP as to whether she is admitted or not. She will have to prove strong ties to home which may be difficult as her husband is going to be in the US, unless she still has a mortgage/rental agreement and a job. If she is not eligible for the VWP it may be very difficult to get a tourist visa with a pending I-130 application.

She cannot come over and stay with you permanently as she will have to have her medical and interview in Germany. You are looking at a waiting period of normally 8-12 months after you have filed. We managed to get through it in 7 1/2.

All we sent apart from our marriage certificate was three affidavits from people who knew us. We were only just married and had not lived together other than on visits so when we filed we had no other evidence of an 'ongoing' relationship. We were approved with no problems.

The K3 is pretty much obsolete nowadays though strictly speaking it is still available. As I understand it, it was introduced when the IR/CR1 visa was taking much longer to process than the fiancé visa and was a means of reuniting families quicker. Nowadays there is not much difference between the two and what happens is that both petitions (the I-129 and the I-130) are approved at more or less the same time so the I-129 is abandoned and the process follows the I-130 route.

You can normally expect the IR/CR1 visa to take 8-12 months all told, although we were lucky and I had my visa in hand at about 7 1/2 months. You should look at timelines for South Africa to see what the current wait times are at the Embassy.

You can visit during the process and I know from what I have read on here that many people do so successfully, but there are no guarantees. It is up to the CBP officer on the day to decide whether or not to admit you, depending on how likely they believe you are to stay. You are advised to bring strong ties to home and evidence that you will return - your return ticket of course, a mortgage/rental agreement, a letter from your employer saying when you are expected back etc. Your NOA1/2 (depending on where you are in the process) may also be good evidence as they will show you are planning your immigration the right way.

Yes, you can file the I-130 while you are visiting the US. Lots of people do and then return to their home country to wait out the process and have the medical and interview. It's what we did.

Yes, print the receipts from the payment page.

I can't remember if we sent a birth certificate with the original petition but that was obviously ok as they approved you but I think she will need one at some point. I think you only need to be able to prove your citizenship so your naturalization certificate is probably sufficient. I would check the NVC forms to see what is required.

This is copied from my interview appointment letter although most of the documents went to the NVC:

MY NAME must bring the following to the visa interview:
* Any original documents that were requested by the NVC but were not submitted to the NVC
* The medical examination results if not submitted to the Embassy/Consulate by the physician (the clinic will send these)

You can submit the AOS package as soon as the I-864 invoice shows paid and then the other package - the forms and documents - as soon as the IV bill is paid. You need the barcoded cover sheet and receipt for each invoice to go with each of the packets.

I'm sorry, I don't know for sure about the birth certificate but my instinct would be that she would need it. Have you submitted it at all so far? i thought a copy had to go with the original petition and then I am pretty sure the original has to go to NVC and that is as much for proof of your biographical information (since they always seem to require a long form with both parents' names), as much as for proof of citizenship. I paid the AOS fee of 88 dollars last week. now I got the bill for IV which is 404 dollars.

So to understand correctly there are no more fees after that ?
how long does it usually take for the counslate to get the file from NVC and how long does it usually take for the counslate to schdule somoene for an interview?

when do they ask for Affidavite of support forms etc?


Saylin is the go-to girl for NVC procedures but you can take a look at my timeline and signature for an idea of UK specific timings.

I agree totally with the other responses but I would also add - be patient. There is just about nothing you can do to speed up the USCIS stage of the process and at times it will seem interminable - but it will end.

I would recommend the CR1 as nowadays it is not much slower than the fiancé visa (we went from filing to visa in hand in under eight months) and when you arrive in the US you will immediately be a permanent resident and able to work.

The evidence provided should be in relation to the "fraud alert" sirens that you think are going to go off in the reviewing officers head. Offices in UK, Canada Australia etc are not going to question much cause the standard of living is pretty much the same. However people from India, Pakistan, SE Asia etc are going to face much more scrutiny especially since there is not much courtship and much "pre Marriage" proof that an applicant can submit. Visa and Immigration officers still cant wrap their head around a person meeting his/her spouse right before wedding but it still happens more than 60% of cases. The burden of proof is upon applicant.

Better to front load the application as much as you can without overdoing it rather than getting a RFE.

I didn't send much proof with my petition either, but now I am chewing my nails that husband will get the 3rd degree at interview. :unsure: he will not be happy with me when he gets the packet of stuff he needs to bring to the embassy..shhh

He probably won't be asked to show any evidence. We just sent in three affidavits with the I-130 as we had none of the other things listed. I took a lot more to the interview but didn't even get to take it out of my bag. This seems pretty normal for London.

Trojam227 and I are echoing each other! The only thing I would add is that you don't need to wait for Case Complete at NVC before you book your medical. If you want to you can book it as soon as you have your LND number (and your Police Certificate). The results are valid for 12 months. I was glad that I had mine when I did because the chest x-ray showed something that they wanted me to have investigated. In the end a scan showed there was absolutely nothing (all that worry for nothing!) but it set the medical results back and they were only with the Embassy the day before my interview.

The medical is fine. They will have a quick look in your knickers (!) to confirm your gender and a general check of your boobs for lumps but that is as 'probing' as it gets. I take it you haven't had any babies yet! :innocent:

My signature and timeline will give you an idea of processing times for a CR1 through London. As Saylin said times do vary up and down at different periods (when we got our NOA2 it was taking over a month to get an NVC case number) but it should be a good indication.

Once your case is with NVC and they give you your new case number (LND number), you can call the Knightsbridge clinic and book your medical. In the meantime I would recommend checking the vaccinations required and if you need any then get your GP to do them. They will probably do them for free but if they do charge it will probably be less than the clinic.

But, that is why I asked here, so we did not do anything fraudulent.

I was not questioning the point of visas, I just did not fully understand the use of the I-485, thats all.

I get that people have already done the process, know more about the process, but some of us are still learning!

I agree with the other respondents. Amongst other uses, the I-485 is for those who are already in the US, on an employment visa for example, and get married whilst there and remain in the US. It can be (and often is) used by those on a tourist visa but it is intended for those people who get married where there was no intent to do so when they arrived.

There is nothing wrong with getting married under the VWP. You will find plenty of peole on here who have done that, me included. There is only an issue if you enter under the VWP with the intent to marry and then stay. If your wife returns home after you are married then there is no problem.

The separation from your spouse is painful but we were used to the whole long distance thing. The worst thing was that after that warning from Immigration I couldn't even visit, although Trevor did manage a trip to the UK. But it's a bit like toothache (or childbirth!) - once the pain is over you can't even remember what it was like.

It is perfectly legal to enter under the VWP and get married. People come to the US for destinations weddings (think Vegas) all the time. What is not legal is to come to the US and get married with the intent to then stay and adjust status. Again, people do that and as you have said, it doesn't seem to be an issue for most people but you run the risk of coming unstuck.

We decided to get married while I was visiting because Immigration said they would not let me in again under the VWP. We were married in the local courthouse in Georgia and we then filed the CR1 and I returned home for the rest of the process. All perfectly legal.

I definitely would not do the K1 if we were starting over again for the reason you state - not being able to work for several months. And it works out more expensive overall.

As others have said, we didn't include anything in the cover letter apart from the list of documents we were enclosing. And we didn't enclose anything about the relationship apart from three affidavits - we had no financial commingling evidence at that stage so they were our evidence of a bona-fide relationship.

I completely understand that. Especially as it seems to depend who picks your file up as to whether they recognize the document as the norm or not. You can get a new 'original' from the court that issued it in the first place. I did that just in case and they charged me ?5. It was just a (poor quality) photocopy with a stamp on it. Luckily I didn't need it.

I think it is very unusual that they ask for a marriage certificate from previous marriages but of course you relinquish it when you are divorced, so I did order a new one 'just in case'. They didn't ask me for it at my interview.

Trojam227 is right in that this does seem to come up from time to time, I don't know why it is sometimes an issue and sometimes not. We filed just after Donnison so when I saw the post that Trojam has linked you to I panicked and got new certified copies so I would be ready to send another with the relevant parts highlighted etc but there was no query with my decree.

I guess you mean that he may have already responded to the RFE with the exact same document. That's tricky. Do you still have a copy of the RFE letter? If so, maybe send again marked as suggested in Donnison's thread. I haven't re-read it so this may be mentioned, but I would also send a cover letter pointing out that this is the standard UK divorce decree and doesn't have a signature or seal. I am sure the thread does suggest highlighting the key words and phrases and sending a color copy so that the stamp shows in red (if yours is red).

If you don't have a copy of the RFE you could try a follow-up letter but there is a possibility it will not get matched up with your file.
